What’s the worst that could happen?
Steph’s voice rang in Rory’s ears, sweet and sharp. A lot could happen– the worst of it already had. But Ulfric, the blonde wolf who stood nearly a solid foot above her, had convinced her to venture out to White Crest, Maine. It had taken her a month to follow his trail, tail tucked beneath her legs, but she had ended up on his lawn, the farmhouse far more daunting than it should have been– than it would have been, if she weren’t afraid of every little thing.
But she could do this. Had to do this. Rory had no other choice at this point.
So they swung their legs over the side of the bed that Ulf had provided. Rory wasn’t alone– she could hear steady breathing, the sound of clatter from the kitchen, and the telltale signs of footsteps. Like their shifts, Rory hadn’t yet gotten used to their enhanced senses.
Rory managed to drag themselves up from their bed, crossing the distance to the door. With a shaking hand, Rory finally managed to twist the knob of the door, pushing it open. Ari’s scent lingered, too, even though she wasn’t home.
“Ulf?” Rory called out, venturing into the kitchen, hands clammy rom the sudden bout of nerves.

Mere moments after Rory called out, the first pat of butter hit the pan with a sizzle. Old cast iron, well seasoned took it like a champ. Bringing out a medley of smells and tastes into the air. The old wolf was all smiles. Still in his morning digs, which pretty much consisted of a pair of boxers, hair up in a bun, and one sock. The other one always managed to get lost in the night. Something about heat-balance, as Ulfric had attempted to explain to Ari once. Though this morning he also donned a frilly little apron, as to catch the grease that sputtered off the stove top as he started to cook.
“Ahh! Morning pup!” His voice boomed over the soft tunes playing out from the little record player in the other room. “I hope you are liking pancakes. They are big hit around here.” The norseman’s grammar wasn’t always the best. He made an honest effort when typing, if only so clients wouldn’t think less of his tattoo shop. They could think the man himself was a dunce all they wanted, but nothing would tarnish the rep of Ink Inc.
“No need for nerves this day, you come sit and we get your belly big and full.”

The smell curled around Rory’s nose, and though it should’ve done something to ease the nerves she’d begun to feel from the moment she realized she wasn’t alone, it just brought back those feelings in Redding– of Steph knelt over a pot with a wooden spoon. But this was not Redding, and that was not Steph.
This was a part of their new life. What was before had been obliterated, as dramatic as it was. Rory forced a half-smile as they approached Ulf. It was soft and simple, the term of endearment, but it still felt foreign to their ears. A year and a half and they had nothing to show for it. “Pancakes are good.” Rory stood far enough away from where Ulf was working so that they weren’t in the way, hands wringing together behind their back.
The question of how he knew she was nervous was cut easily by the steady beat of Ulf’s heart. He could probably hear the rapid beat of her own. It wasn’t easy to miss, she didn’t figure. “Oh. Right. Yeah, sorry.” Another forced smile. Rory took a seat as instructed, hands gnarled in her lap like intersecting branches. “It does smell good. I don’t mean to be…” Rory’s brows knit together as they tried to figure out how to express it themselves, “quiet about it. I’m obviously really thankful.”

“What sort of toppers you like?” A probably too large plate of breakfast confections towered in front of Ulf for a moment as he turned from the stove and placed the whole stack in front of Rory. The man took a moment to study her features, confirming the story his senses were already reading. Heart beating out much too loud. Sweat leaving a salty taste to mingle with the morning sweets.
Telltale signs of a nervous nelly.
Ulfric was not oblivious to the fight going on inside the new guest at the farm. He had been born this way, but it didn’t make him blind. If anything it made him more warm. Ready to step up to bat twice as hard as for those who were still learning. Ulf had seen his share of new pups, knew how the changes often felt more of an affliction than the blessing that it could be. He also knew those negative feelings could fade in time, with the right care and right nudges.
“You’ve nothing to ‘pologize for. This is all new, yes?” There were soft crinkles at the corners of his grayish blue eyes, alight with the same love and care his parents showed him and his siblings. Berserkers were very good at feeling everything so fully, so freely. It was their nature after all. No filters. “Your thanks are appreciated though, pup.”

It hadn’t occurred to Rory that one day, far from those moments in Redding, she would be someplace new, and in that place, she might have to enjoy herself. This could be that place, if they allowed themselves the pleasure. But they still felt guilty. After everything they had done, they were sitting here staring at a stack of pancakes while being asked what kind of toppings they wanted. Back in Washington, her family’s life had been torn apart. She swallowed down the burn in her throat and looked up to meet Ulf’s soft gaze.
“Yes.” It was short, definite. Maybe it would tell Ulf all he needed to know. Though, she imagined their first meeting had done that job for her. In Vegas, Rory had insisted that she didn’t need his help, and now here she was, tail tucked between her legs. Really, she wanted to be stronger. Not because she wanted to prove she could survive in this new world– the one without Steph, the one where a beast hung low beneath her skin, but because she wasn’t sure she deserved his kindness.
“Do you have strawberries?” She figured she’d be able to still make out the shape of them, even if they were a deep green that also felt familiar.

The older wolf stared with softened eyes. A charm he didn’t extend to everyone. Sure Ulfric was warm to most, but to his pack he could be the sun. Life giving, bright, strong, but gentle. He sat across from them for a moment, placed his massive hands over theirs and just held that pose as if to transfer any amount of his calm, his strength, or his joy over to the struggling young wolf. “You will be alright pup. I will make sure you are. You are not alone here. And if you choose it, you never have to be alone again.” Things at the farm had never been exactly, well… stable. “There will always be at least one of us around, and being a part of a pack means you have someone to be watching your sticks at all times. In time, it feels… like family. If you let it.”
Ulfric knew he was gone too often, always out there searching for something he was never really sure he’d find. Hell, half the time he wasn’t completely sure if it was a thing he was after. Maybe more of a concept. He wanted to bring people in. People like Rory who needed a home. People like Ari who would always be Ulf’s home. The pack was little, chaotic, and the faces changed out a bit too often for the old wolf’s liking. But it was still his. And he wanted to protect that with everything he could. And that meant searching.
The truth he learned out on the road was one that kept him away longer than he’d ever intended. Consequences. They’d always follow him. And they’d always lead back to the ones he cared for. For his pack to be strong, Ulf had to be the strongest. He had to control himself in his human skin so no one would get hurt because of his wolf. It was all instinct and rage and sure he’d never directly harm one of his own, but killing the wrong human at the wrong time could just as easily sign a death warrant. Rory here was living breathing proof of that.
“Oh, of course, valpen min! It is strawberry season! We have some freshly picked. Big as your head almost! Would you like them diced, sliced, as is, in a jam?”

Despite his stature, Ulf was kind— Though, maybe that had been presumptuous on her part that he wouldn’t be. Rory was beyond grateful for the kindness he continued to extend towards her, as well as the understanding. It couldn’t be comfortable, hearing somebody have frequent panic attacks from across the house. The smile that they wore now was far more confident than what had pulled at the corners of their lips prior. Though she hadn’t yet trained her ears to pick up on the lies by the beat of a heart— genuinity seemed to be the only thing laced with his words. “I’m… starting to learn that.” It would be hard, and Rory knew that— to believe all of this as truth and to not fall prey to the inner workings of their mind, but to trust Ulf, and even Ariana implicitly, that was what would get them through this. “I can’t… uh, say when I’ll come around, but you know— I’m grateful for the patience regardless.”
The smell of breakfast began to make Rory’s stomach groan with anticipation. Though there were little things that reminded her of Redding, and even of Washington, this was its own experience. It split from the frame that Rory figured the path their life would take, but it was similar enough that maybe Rory could pretend. Pretend that this was what was meant for her, even if fate was something she hardly believed in at all.
“Oh, uh—“ Rory stared across the island to Ulf before shook her head, “whole is fine, I use the uh, bottom part of my fork to just mash it overtop.” It wasn’t as barbaric as it sounded, but if they were ripe enough, they squashed easily, and even though the stains they’d leave on her fingers would be different from what she remembered— if she could remember such a thing, they were a favorite of Rory’s.
“Is there anything that you need help with? I feel guilty just sitting here.” Realistically, they could have stood and began working around Ulf, but they still felt pressured to ask the question before presenting action.

“No one is expecting things to happen right away, pup. It is too big a feeling, too big of change for anyone to come ‘round to in a few days, weeks, or even years sometimes.” It warmed the old wolf’s heart to see Rory soften around the edges. Ulfric wanted his home to be an open hearth. Wanted his arms to be a refuge to run back to. He’d protect his pack from anything, even if it was just the dark thoughts in their own minds. He’d spend as much time as they needed, being whatever they needed.
But right at that moment, it was all about breakfast. It was about serving up some strawberries and making the farmhouse fill with another round of delicious smells. Ulf was beaming as he brought out the basket, and plucked a few of the ripe red fruits for himself as he returned to the stove to whip up a few more stacks.
“Cleanup is always required, house rule. Everyone works together to make it easy.” The ‘wolf called over his shoulder as another pancake flipped in the air and was caught by deft hands holding onto the cast iron pan. “If you wanna work on the dishes after you finish up your food, I’d be pleased as getting punched.”

Marcellus Shale Coalition Lays Out All the Legal Flaws in DRBC Fracking Ban

The Marcellus Shale Coalition filed 71 pages of commentary on the legal problems with the proposed DRBC fracking ban. Read it and weep if you’re the DRBC.
The Marcellus Shale Coalition has jumped into the battle over the proposed DRBC fracking ban in a big way. It filed 71 pages of comments with the DRBC on March 29, which may be found here. There are three elements to the submission; (a) a tough letter from David Spigelmyer, MSC President, (b) a lengthy legal analysis, and (c) supporting technical comments. All are excellent and the message for Steve Tambini, the DRBC Executive Director, is simple; your failure to lead is going to make you the fall guy for having destroyed the reputation of this agency, even though it was your predecessor who took the first fatal steps.
Carol Collier, the former Executive Director of the DRBC, was the individual who decided the DRBC would go a different direction on gas drilling and created the mess we now have. Her vision of the DRBC, contrary to those who went before her, was as a regional super-agency responsible for regulating land use and protecting the environment. She colluded with the Delaware Riverkeeper and its funder, the William Penn Foundation, to engineer a moratorium on gas drilling that would be in place forever but for the currently pending lawsuit from the Wayne Land and Mineral Group.
Steve Tambini had an opportunity to straighten it out and apparently made some moves to do so. But, in the end, he has turned out to be a weaker leader than Carol Collier and left the agency like a canoer without a paddle trying to navigate Skinner’s Falls; batted against first one rock and then another as the politicians have treated the agency like a rubber ducky. He has become the perfect follower and now simply does what he’s told by his Commissioners without any attempt to educate them on the issues, the implications or the likely outcomes. There’s not so much as a thread of independence left in the agency. It is now captive to the Machiavellian pols and the special interests they seek to appease.
Only the courts can now put manners on the DRBC and, as we await a decision on one case currently before the Third Circuit of Appeals, another lawsuit over the proposed DRBC fracking ban begins to take shape. Dave Spigelmyer’s letter couldn’t be more direct. Here are a few excerpts (emphasis added):
To prohibit the development of this critical energy resource, as the Commission seeks to do, defies common sense, sound science, responsible policymaking, and perhaps most importantly the authority of the Commission and the United States Constitution. It improperly infringes on the property rights of thousands of property owners within the basin and relegates them to second-class citizens while depriving their families and communities of the economic opportunities that rightfully belong to them. The Commission’s action is motivated by political considerations and calculations that mock the rule of law while undermining the credibility and integrity of the commissioners elected to serve the public…
The DRBC has no authority to prohibit so-called High Volume Hydraulic Fracturing (HVHF) permanently in the basin. Not only does the plain meaning of the Compact preclude finding that DRBC has such authority, but the long-standing history and negotiations of the Compact offer clear evidence that neither Congress nor the DRBC Compact States intended for the DRBC to have the authority to ban any industrial, commercial or residential use of land in the basin.
Furthermore, despite DRBC’s erroneous assertion otherwise, Article 5 of the Compact does not provide the DRBC with the authority to ban so-called HVHF permanently simply because of the perceived risks of spills. Indeed, the authority found under Article 5 is limited, and whether read individually or collectively, the various sections cannot be manipulated into authorizing the DRBC to impose a permanent ban. To do so, in fact, would not only interfere with each individual state’s sovereignty, but it ultimately would render various other provisions of the Compact meaningless…
Such a ban would effectuate a categorical regulatory taking of the property interests of gas-only property owners, and would also effectuate a regulatory taking of property from individuals who own both the gas and the surface estate… The proposed permanent ban, in addition, would violate both the due process and equal protection principles of the Fifth Amendment…
It is clear that a majority of commissioners have already made up their political minds on this matter. Indeed, while DRBC staff stressed publicly several times that no final decision or action had yet been taken by hosting multiple public meetings and extending the public comment period, it is noteworthy that on September 13, 2017 a majority of the commissioners issued a press release congratulating themselves on banning natural gas development within the watershed and depriving their own citizens of their fundamental private property rights.
Pennsylvania Governor Tom Wolf demonstrated the blatant political motivation of this rulemaking by stating that he “supported this resolution since was a candidate for Governor of Pennsylvania.” Such a statement renders consideration of any actual science and data moot, while relegating the public comment period to a charade. Ironically, Governor Wolf recently extended an agreement with the state governments of Ohio and West Virginia to enhance regional cooperation and further the development of natural gas within the Appalachian Basin.
In the MSC’s view, the DRBC is legally obligated to review and consider fairly the comments submitted to it, without harboring prejudice. Public statements by commissioners of the DRBC that a ban of hydraulic fracturing is a foregone conclusion demonstrate that this rulemaking is not undergoing a deliberative process, open to modification or withdrawal, as required under the rulemaking procedures of the Commission…
The Commission has failed in its most fundamental responsibility: to allow reasoned science and the interests of the citizens it represents to guide its actions and decisions. The Commission unlawfully and permanently seeks to take the property owned by landowners in Pennsylvania and neighboring states without due process or just compensation. It substitutes the political interests of elected politicians for the inherent rights of the citizens they represent by asserting falsely and without justification that natural gas cannot be developed safely within the watershed.
That about says it all but the legal arguments and technical comments also deserve attention, as they debunk every argument made to date for the DRBC fracking ban and make it unmistakably clear where this thing is headed and how it is likely to be decided. Here’s what I take from the legal discussion:
The proposed DRBC fracking ban would prohibit high volume hydraulic fracturing within the Delaware River Basin. Because Pennsylvania is the only Basin state with significant gas reserves that does not already prohibit HVHF activities, the ban would impact it only.
The foundation for the ban relies, as a practical matter, upon speculated risks of inadvertent spills and releases that do not qualify as legal justification. Water acquisition, consumptive use, siting and landscapes are already addressed by other Compact provisions, leaving only Section 5.2 and reliance upon potential spills and releases as ban excuses.
Yet, DRBC staff, relying upon Pennsylvania DEP, previously told a Federal Court, in another matter, how Pennsylvania’s comprehensive regulatory program eliminates, reduces, and minimizes the very same perceived risks that it now asserts to justify a ban.
The DRBC also cites its own regulations as authority for the ban, but, as a creature of the Compact, the agency has only those powers conferred upon it through that agreement and accompanying legislation. The DRBC cannot expand its own authority, as it does in this case.
Moreover, in the absence of a clear statement to the contrary in the Compact, “each State left to regulate the activities of her own citizens.” Any surrender of state sovereignty must “be treated with great care, and the Supreme Court has stated that courts should not find a surrender unless it has been ‘expressed in terms too plain to be mistaken.’”
As an illustration, the Supreme Court rejected the U.S. Army Corps of Engineers’ assertion of jurisdiction over certain wetlands, noting the “government’s expansive interpretation would result in a significant impingement of the State’s traditional primary power over land and water use.”
This case law is why, since its creation in 1961, the DRBC has not attempted to ban refineries, nuclear power plants, chemical plants, pharmaceutical manufacturers, commercial farms, or, until recently, well pads and natural gas wells; it doesn’t possess the authority. More importantly, it cannot expand its authority through the back door.
The Compact does allow DRBC to classify waters of the basin and then “establish standards of treatment of sewage, industrial or other waste, according to such classes,” and can “require such treatment of sewage, industrial or other waste within a time reasonable for the construction of the necessary works.”
Jurisdiction to classify waters and establish standards for, and require, treatment of wastes that are discharged into those waters, does not entitle the DRBC to ban an activity or preclude an otherwise lawful use of private property. If the DRBC had such broad authority, it could simply use it to ban any human activity that might cause pollution.
The DRBC is not, and was never intended to be, a regional super-regulator or zoning authority, with veto power over the use of private property. If DRBC attempts to so expand its authority go unchallenged, the DRBC would, in effect, have a form of police power exceeding States. Under the guise of controlling “future pollution,” the DRBC would be able to dictate when, where, and under what conditions any human activity can occur in the Basin.
The DRBC’s core mission was, and properly remains, coordinating development of water projects to meet water needs of Basin residents and New York City. The DRBC has historically understood its authority was limited to classifying waters of the Basin and establishing standards for, and requiring, treatment of wastes discharged into those waters.
In 1973, in response to the 1972 Federal Water Pollution Control Act amendments, the DRBC relinquished its program on pollution abatement schedules in favor of the federal NPDES and state programs. It said it was now spending more time coordinating and reformulating water quality standards, reworking assimilative capacity allocations, developing better monitoring programs” and occasionally arbitrating some interstate issues.
Summarizing, the DRBC’s interpretation and application of its Compact over many decades provides compelling evidence it has always understood Article 5 authority to be limited to classifying waters and establishing standards for, and requiring, treatment of wastes discharged into those waters. It has never interpreted Article 5 to authorize a wholesale ban on anything.
There are other legal problems as well. The ban would result in categorical and other regulatory “takings” of property, for example. Because vertical wells would not be feasible as a means to recover gas in the Basin, the ban would fully and permanently prevent owners of but gas rights from making any economical viable use of their property – a categorical regulatory taking. There is also a good argument for regulatory takings in the case of owners with surface and gas rights on the basis that there is no environmental justification for the huge declines in property values.
Even assuming, for argument’s sake, the ban would not effectuate regulatory “takings” of property in the Basin, it would, nevertheless, violate substantive due process principles. There is a wealth of evidence to show, contrary to DRBC claims, shale gas production activities are safe for water and other environmental resources. There is, therefore, no rational basis for a ban.
The proposed permanent ban would likewise run afoul of equal protection principles. When a governmental action creates a discriminatory classification system, the validity of the action, from an equal protection perspective, is determined by certain tests, including whether the discrimination bears “a rational relation” to a legitimate governmental purpose. The proposed permanent ban would not pass the test as it would effectively prevent members of the oil and gas industry from producing gas in the Basin but, at the same time, would not prevent those in other industries from undertaking their business operations in the Basin.
This discriminatory classification system, in other words, would not “bear a rational relation” to a legitimate government purpose. It would be arbitrary and irrational because it would be premised on a perceived risk of spills and releases from one activity (HVHF) in one industry (oil and gas), even though there is an equal or greater risk of spills and releases from various activities that occur in various other industries, including the refining, energy-generation, chemical, landfill, paper, technology, farming, sewage, wastewater treatment, and housing.
Finally, as a general matter, an agency action will be set aside if it is arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with the law. The DRBC identifies what it claims are certain undue impacts that HVHF activities have on “Water acquisition,” “Consumptive use,” and “Siting and Landscapes.” but as the MSC’s technical comments and information demonstrate, shale gas production activities do not unduly impact those things any more than, and in many respects less than, other business operations that are conducted in the Basin. Because the undue impacts are merely imagined by the DRBC, a ban would not be justifiable as means of addressing them. DRBC action must be supported by “substantial evidence” that simply doesn’t exist in this case.
These are the hurdles DRBC fracking ban has to overcome to be successfully implemented and they are many and high. The Marcellus Shale Coalition has done the citizens of the the upper Delaware River Basin right by these comments. The association deserves our many thanks for a job superbly done.

Chilean rock fans are wildly enthusiastic about Santiago Rock City, a festival which will take place on 29th and 30th September in Santiago with old pickled-in-vinegar names such as Guns n’ Roses, Aerosmith, The Who, Def Leppard, Marky Ramone and, L.A. Guns headlining the nostalgic party.

It is clearer than ever that developing countries such as Chile1 have become the favourite place for aged bands due to that diminutive enthusiasm shown by people in their own homelands. Iron Maiden, for instance, with their tour 2016 took in money $11,532,491 dollars in gross sales only in South America. In contrast they only collected $6,701,818 in North America (Canada and the US)2
The point here is that the more ignorant you are the easier to impress you become, especially by justifying entertainment for entertainment’s sake –art as a utilitarian function.
The average Chilean is timid, sceptical, short of self-esteem, herd-follower and not very creative due to the low standard educational system and the standardized production parameters. Lack of education and poor character has just ended in a gray ordinary man (very appropriate to power and large economic interests).
In a 500-point scale Chile got 220 points in literacy and 206 in numeracy, being located significantly below the average among 33 countries/economies3. Other South American nations do not differ mostly, thus it is not difficult to conclude how low people’s capacity to take part in a complex society is. Chilean economy has relied on copper exports for decades, and studies show4 that countries may become rich but no complex as a result of income based on extractive activities (which do not imply know-how). In other words, countries which are able to make products of high complexity (machines and appliances) are countries which own tacit knowledge5 and have the means to generate networks (which allow specialization) and share knowledge. Therefore, once the society has been educated and its access to an ample range of visual, auditory and dramatic expressions has been guaranteed the members of this community are able to participate in a more complex environment having the power to promote and execute higher forms of thinking.
Hard rock has never being a privilege of minorities, neither has it been a massive phenomenon such as Michael Jackson6. In many cases some hard rock/heavy metal albums have made real works of outstanding artistry. But artists, when tempted by earthly desires, vulgarize their art and enter into the dynamic of industry to become nothing but a piece of merchandise –the commodity form. Artists give up their principles by becoming part of the machine, and this series of actions –like a chewing gum masticated endlessly- wears away their oeuvre until dissolving into the status quo.
Companies do not attach importance to truth values, they just concern about how much profit they can get from record sales. Thus, artists’ anger is diluted to the category of a commercial.
Marcuse stated that “man can do more than the culture heroes and half-gods; he has solved many insoluble problems. But he also betrayed the hope and destroyed the truth which was preserved in the sublimations of higher culture” (Marcuse, 56). Yes, all comfort brought in by medical and technical development has allowed man goes through unconcerned unlike that man who, some years ago, went uncertainly thinking of if some possible firm conviction were possible in the near future7.
The best rock music was made between the 60s and the 80s, in an atmosphere absorbed by the Cold War when fear thawed in an atmosphere of hope and uncertainty. Bands existing as result of those glorious days have not disappeared as symbols of an era but their once subversive force and destructive content has been neutralized and managed (to make a profit).
Today I heard the last Venom Inc’s record –a crashing bore full of commonplaces that would stupefy Satan himself. It is not difficult to find out what these aging folk (and the machine) wish. On one hand there is a bunch of youngsters revelling in their early records waiting for a new “Welcome to Hell” while, on the other, record companies reform old names as a means to obtain financial advantages by making this bunch of aging men play rock (again) and make them believe they still can do it. Twenty years ago Steve Jobs reflected upon that: “when you’re young, you look at television and think, There’s a conspiracy. The networks have conspired to dumb us down. But when you get a little older, you realize that’s not true. The networks are in business to give people exactly what they want. That’s a far more depressing thought. Conspiracy is optimistic! You can shoot the bastards! We can have a revolution! But the networks are really in business to give people what they want. It’s the truth.”8
Thus, one does not know if laughing or run away when you see Axl Rose trying to look younger with his hair dyed, James Hetfield in a “I am still can do it” attitude or Kerry King developing substantial muscles to show a more normal level of firmness. It is true also that being old today is different than it used to be twenty or thirty years ago, but the problem is, on one hand, the regeneration of the social tissue: young bands are unable to succeed the old generation, and on the other, profit and consumption –deeply rooted acts inherent to the machine- collapsing any efforts that implies reflection. Who would have imagined some years ago Chilean banks offering tickets for the Santiago Rock City Festival using their credit cards or the most conservative Chilean newspaper advertising the event? O tempora! O mores!
When Joe Corre set fire to Sex Pistols’s punk clothes and paraphernalia two years ago he stated that “punk was never meant to be nostalgic. Punk has become another marketing tool to sell you something you don’t need.”9
