Government planning CGT ‘tax grab’ on buy-to-let property investors, experts warn
The UK Treasury has launched a “review” of the capital gains tax system to "ensure the system is fit for purpose", the BBC reports.
Some experts are warning of "a tax grab" in the autumn to pay towards the multi-billion-pound cost of Coronavirus measures, such as the furlough scheme.
The Chancellor, Rishi, Sunak asked the Office of Tax Simplification to investigate how capital gains are taxed for both individuals and smaller businesses.
"This review should identify opportunities relating to administrative and technical issues as well as areas where the present rules can distort behaviour or do not meet their policy intent," the chancellor said.
"I would be interested in any proposals from the OTS on the regime of allowances, exemptions, reliefs and the treatment of losses within CGT, and the interactions of how gains are taxed compared to other types of income." Source: BBC.
CGT is a tax on profits, which hits business owners, as well as millions of share and property investors.
Rishi Sunak specifically mentions reliefs and losses, which can currently be offset against profits and carried forward to future years. This could change and lead to higher tax bills for investors who risk their money and work hard to earn profits.
Capital gains are taxed at a lower level than income, so there's a risk that the chancellor will use the current crisis and deficit to justify a hike in CGT to income tax levels.
CGT rates are set at 10% for basic-rate taxpayers and 20% for higher and additional-rate taxpayers, or at 18% and 28% where gains relate to residential property.
CGT is basically a tax on the gain a property investor makes when they risk their money. This is in addition to the income tax they pay and any other taxes like stamp duty and land registry fees.
Previous Chancellors have a habit of grabbing money from the estimated two million buy-to-let property investors, many of whom have a small number of properties which they plan to use to supplement their pensions.
Buy-to-let investors have already lost a number of reliefs, for instance on mortgage interest and wear and tear allowance, and are paying higher taxes thanks to multi-millionaire ‘six jobs’ George Osborne’s raid on soft targets.
Business owners spend years building up their businesses, working long hours often for little or no pay, only to be taxed on the profits when they sell up or retire.
Is it still worth investing in buy-to-let property, as judge bans “No DSS” tenant policy?
A District Judge has ruled that blanket bans on renting properties to people on housing benefit are unlawful and discriminatory.
The court ruling found a single mother-of-two had experienced indirect discrimination when a letting agent refused to rent to her.
She ended up homeless with her two children, when her case was taken on by housing charity Shelter.
The judge ruled "No DSS" rental bans are against equality laws.
District Judge Victoria Mark heard this latest case in York County Court on 1 July, and ruled: "Rejecting tenancy applications because the applicant is in receipt of housing benefit was unlawfully discriminating on the grounds of sex and disability" and contrary to the Equality Act 2010, she said.
People deserve a home but that doesn’t mean everyone has a “right” to rent home in the private sector. Landlords must also be able to choose who they want to take on as a tenant. I have current experience with both private and benefit tenants with mixed results.
The LHA rates in some areas are simply not competitive or equivalent to the open market rate and dealing with benefit claims is a steep learning curve for landlords. Deposits and upfront rent can also be an issue.
The rates paid to landlords are also confusing and differ according to age. Is that not age discrimination?
The private sector should not have to pick up the pieces for the failures of successive governments to build enough social housing. There has been no major council house building programme since the 1970’s.
The last major town to be built with proper infrastructure and rail transport links was Milton Keynes which, along with other new towns, was planned in the 1960’s.
Councils can build more social housing and borrow at low rates, but many choose not to.
I'm not sure if a ruling by a District Judge in a County Court is binding in law. If it is binding, it will be a further example of ‘red tape’, costs and legislation for private landlords, many of whom feel like they are swimming against the tide in the buy-to-let market.
Investment in buy-to-let properties can still be profitable when done professionally. However, there are still many other opportunities to make money in property without the need for buy-to-let mortgages, large deposits or high rates of tax.

Weekly Recap:
On Wednesday, the Edmonton Oilers officially announced that GM/President Peter Chiarelli had been fired. Earlier this season the Oilers also fired their coach and brought in Ken Hitchcock.
There was slight concern that Erik Karlsson might miss the All-Star Game due to injury, but luckily he was able to participate.
Hockey legend Pavel Datsyuk is coming up on the end of his KHL contract and his agent says he’s not ruling out an NHL return.
In a somewhat unexpected turn of events, Tyler Seguin (Dallas Stars) has made a surprising change is his pregame routine with Mark Scheifele (Winnipeg Jets) by exiting the ice without putting up a fight. Both Scheifele and Seguin prefer to be the last player off the ice after warm-ups which has, in the past, led them to rock-paper-scissors and, most recently, trickery. More on this next week.
Connor McDavid won Fastest Skater for the third year in a row at the All-Star Skills Competition. All Skills Comp results can be found at nhl.com.
Brianna Decker of the US National Women’s Team was among those who demonstrated for the All-Star Skills Comp and her time was faster than that of Leon Draisaitl, who won the competition. This prompted fans to tweet #PayDecker, as the winners of Skills Comps get paid for winning them and fans felt that Decker, who had the fastest overall time, had been cheated. CCM announced they would #PayDecker the full amount.
The NHL announced that they would pay $25,000, the amount of the prize money for competition, to all four demonstrators from the US National Women’s Team; Kendall Coyne Schofield, Brianna Decker, Renata Fast, and Rebecca Johnston. The money will go to the charity of their choice.
The All-Star MVP Award was given to Sidney Crosby for his performance in the All-Star Game.

Forward Taylor Hall of the New Jersey Devils currently has 11 goals and 37 points in 33 games played this season. He has a career total of 202 goals and 511 points in 562 games played. Hall was drafted first overall by the Edmonton Oilers in 2010; he played six seasons in Edmonton before being traded to New Jersey in exchange for Adam Larsson.
Forward Ryan Nugent-Hopkins of the Edmonton Oilers currently has 16 goals and 46 points in 50 games played this season. He has a career total of 135 goals and 359 points in 507 games played. Nugent-Hopkins was drafted first overall by the Edmonton Oilers in 2011.
Forward Jordan Eberle of the New York Islanders currently has 11 goals and 23 points in 45 games played this season. He has a career total of 201 goals and 464 points in 633 games played. He has 4 goals and 8 points in 13 games played with the Bakersfield Condors of the American Hockey League this season. Before being drafted, Yamamoto played with the Spokane Chiefs of the Western Hockey League where he tallied 105 goals and 291 points in 230 games played.
Forward Ryan McLeod, drafted 40th overall by the Edmonton Oilers in 2018, currently plays for the Saginaw Spirit of the Ontario Hockey League; he previously played for the Mississauga Steelheads, also of the Ontario Hockey League. McLeod has 14 goals and 46 points in 41 games played this season between the two teams. He has a career total of 56 goals and 178 points in 239 games played.
Team of the Week**:
The Edmonton Oilers, who are currently 7th in the Pacific Division of the Western Conference, were founded in 1971 but didn’t play their first game until 1972 as one of the founding teams in the World Hockey Association and were originally supposed to be one of two Alberta teams along with the Calgary Broncos, who relocated to Cleveland, Ohio before the WHAs first season. Because the Broncos relocated, the Edmonton Oilers were renamed the Alberta Oilers, though they did return to their original name the following season. The Oilers joined the NHL in 1979 when the two leagues merged. The Oilers have won five Stanley Cups, most recently in 1989-90. The Oilers very famously played from Rexall Place (Northlands Coliseum) from 1974-2016. They now play from Rogers Place. Notable alumni include Wayne Gretzky, Mark Messier, Grant Fuhr, Adam Oates and Jacques Plante.
Outside the NHL:
The National Women’s Hockey League All-Star Weekend will take place at the Bridgestone Arena in Nashville February 9-10.

Weekly Thoughts:
The Edmonton Oilers have been struggling this season, which has been a theme for the franchise for this decade. The Oilers have had four first overall picks in the last 9 years; in addition to this they have had Top Ten picks four separate years in the same span. Many blame former GM/President Peter Chiarelli for the poor state of the franchise, despite the fact that his career with the franchise started in 2015, which is long after their struggles began.
Prior to be hired by the Oilers, Chiarelli worked for, and was fired by, the Boston Bruins. In his time with Boston, he drafted Tyler Seguin second overall in 2010, but traded him to the Dallas Stars in July of 2013. Seguin became one of the top producers in Dallas as well as a fan favorite; there are those who view this as a bad trade, and those who do not.
While working for the Oilers, Chiarelli drafted Connor McDavid first overall in 2015. He also worked out a trade with the Islanders which resulted in them gaining the draft pick that gave them Mat Barzal, who won the Calder this summer. Chiarelli also dealt Jordan Eberle to the Islanders in exchange for Ryan Strome.
Chiarelli also traded defenceman Justin Schultz to the Pittsburgh Penguins, who went on to win the Stanley Cup two seasons in a row.
The summer after drafting Connor McDavid, Chiarelli dealt Taylor Hall, the first overall pick from 2010, to the New Jersey Devils in exchange for Adam Larsson. This is still a hotly debated trade.
Chiarelli has also signed several frankly outrageous contract extensions. Milan Lucic at 28 was given a seven year, $42 million extension. Goaltender Mikko Koskinen, 30, was recently signed to a three year, $13.5 million extension after only appearing in 31 NHL games.
While Peter Chiarelli made mistakes and ultimately harmed the franchise, he is not the source of all their struggles. The franchise has been on a decline for a very long time and it might be time to just toss the whole front office and start fresh. This would, of course, steal even more time from Connor McDavid who honestly deserves a team that is doing well, seeing as he already carries the weight of the franchise on his back.

Celly: Short for celebration. A player may celly after scoring a goal.
Weekly Trivia:
The first NHL All-Star Game was held at Maple Leaf Gardens in Toronto on October 13, 1947. The Maple Leafs played against a team of All-Star players from other teams in the league. The All-Star team won 4-3. The idea of the game originated from the Player’s Committee and was approved on May 23, 1947. The proceeds from the game were divided between Toronto charities and the Player’s Emergency (Benevolent and Disability) Fund. At a meeting in September, players agreed to set up a pension fund, to which players gave $900 each and 25 cents per every playoff ticket sold and two-thirds of the All-Star Game proceeds.

Behind the scenes, interviewing Chris was a little surreal for me. Before the show, the only interaction I had with Chris Hogan was after I waited in line for an hour to get an autograph and picture with him after attending one of his shows here in Phoenix a few years back.

May 6th In Arsenal's History
On this day in 1868 Henry Boyd was born in Pollockshaws, Scotland. After playing for Sunderland Albion, Burnley & West Bromwich Albion, centre forward Boyd signed with Woolwich Arsenal in May 1894. He scored eight goals in his first four matches. Sadly for Boyd he then broke his leg and was kept out of the game for over a year. All in all Boyd scored 32 goals in 41 appearances before he was sold to Newton Heath in January 1897 for £45. Today in 1914 future Arsenal captain Billy Blyth joined the club. He made 12 appearances before the outbreak of World War I. After the war he went on to make a total of 343 starts for the club scoring 51 goals and played in Arsenal's first ever FA Cup final in 1927. He finally left for Birmingham City in 1929. Arsenal played a benefit match today in 1916. It was to raise funds for the widow of the tragic Bob Benson who died while an Arsenal player. They invited a team made up of a Rest of London XI. The match ended in a 2-2 draw. Never officially an Arsenal player, Freddie Steele was born in Hanley, England today in 1916 aswell. He played numerous times for Arsenal as a guest player during World War II. Today in 1922 the aforementioned Billy Blyth scored the goal that gave Arsenal a 1-0 win over Bradford City at Highbury in the last match of the season. After a dismal season which included 5 consecutive defeats Arsenal rounded off with 4 wins and a draw in the last 5 to finish 7th in the league. Henry White was the club's top scorer with 19 goals. Herbert Chapman ended his final (complete) season with a 3-1 defeat at Bramall Lane against Sheffield United despite a Frank Hill goal. Arsenal had already won the league for the second time in three years. Cliff Bastin's 33 goals made him top scorer for the season. Champions Arsenal went to Carrow Road for a post season friendly on this date in 1935. Ray Parkin got the only goal of the match in Arsenal's 0-1 win. Arsenal players George Male, Eddie Hapgood, Cliff Bastin, Jack Crayston, Ray Bowden and Wilf Copping were all in the England eleven that played Austria today in 1936 at the Prater Stadion, Vienna. Hapgood captained the side that was managed by Tom Whittaker but lost the match 1-2. In 1939 today it was the last match in an Arsenal shirt for Eddie Hapgood. The Gunners beat Brentford 2-0 in the match at Highbury courtesy of Ted Drake and Alf Kirchen's goals. Arsenal had finished 5th and Drake's goal added to his top scorer's tally for the season of 16 goals. The action was filmed and used in the movie 'The Arsenal Stadium Mystery'. Captain and left back Hapgood retired after playing 440 times for the club. He had been with Arsenal since 1927 when he signed from Kettering Town for £950. Four other players took their final bow after this match. Midfielder Jack Crayston also retired after 187 performances in Arsenal colours, another retiree was right winger Alf Kirchen who had signed off with his 45th goal in his 101st match. It was the last of two matches for goalkeeper George Marks who was sold to Blackburn Rovers in 1946 after the war and centre forward Andrew Farr also played his second and final first team match before moving on to Aidrieonians in 1940. In the Football League South today in 1944 Brentford were at White Hart Lane to play Arsenal. Ted Drake scored and Reg Lewis bagged two in a 3-1 win for Arsenal. In 1948 on this date the Gunners continued to enjoy the sunshine in Portgual where they were beaten 3-2 by Oporto in a friendly. On the final day of the season today in 1950 Arsenal enjoyed themselves with a 2-5 win over Stoke City at the Victoria Ground. Reg Lewis and Ian McPherson both scored and Doug Lishman got a hat trick. The Gunners finished in 6th place with Lewis getting top honours for goals scored with 24. Today in 1954 Arsenal played their second friendly in Switzerland. The day before they had beaten by Grasshoppers today they faced Young Boys. Cliff Holton opened Arsenal's account but no one could add to it and the Swiss side won the match 3-1. Today in 1955 Highbury was in use again for a Representative match between England and Young England. The senior side won the match 5-0. The same two sides met at Highbury again today in 1960 when England beat Young England 2-1. Arsenal were at Old Trafford on this date in 1963. Goals from Joe Baker, Alan Skirton and Geoff Strong managed a hard fought 2-3 win over Manchester United. George Eastham was at Wembley Stadium today in 1964 as he played for England in an international friendly with Uruguay. 55,000 watched a 2-0 England win over the South American side. Stoke City were at Highbury today in 1967 but left empty handed after Arsenal beat the Potters 3-1. Frank McLintock and John Radford scored for the Gunners and Stoke put through their own net. Ray Kennedy joined Arsenal on this day in 1968 as an apprentice. Before leaving in 1974 he had notched up 212 appearances and scored 71 goals for the Gunners. In 1972 this was the date that Arsenal as FA Cup holders lost 0-1 in the Centenary Final to Leeds United at Wembley Stadium. Arsenal travelled for a post season friendly today in 1974 with Kettering Town. John Radford, Brian Hornsby and Charlie George all scored in a 0-3 win. It was the first time that Arsenal would play apprentice John Matthews who would make his official debut in the opening match of the new season. In 1978 today Arsenal were back at Wembley. Unfortunately they lost another FA Cup final, this time to Ipswich Town in a 0-1 defeat. At Highbury today in 1985 it was Arsenal versus Southampton and Graham Rix scored the only goal of the match for the 1-0 win. The Gunners nicked another 0-1 win today in 1989 at Ayresome Park. Martin Hayes got the goal for the victory over Middlesbrough. In 1990 today it was not a good day for Tony Adams as after crashing his car he was found to have four times the legal limit of alcohol in his bloodstream. It was a 1-3 win over Manchester United at Highbury today in 1991 thanks to a Smudger Smith hat trick. Before the match Arsenal had the pleasure of the northerners forming a guard of honour to welcome the Gunners onto the pitch as champions. Smith finished top scorer for the club and top scorer in the league for the season with 27 goals. It was the second time they had won the title under George Graham, with just one defeat all season. Into the Premiership era and it was defeat at Hillsborough on this date in 1993. The Gunners failed to score and lost 1-0 to Sheffield Wednesday. Arsene Wenger gave two players their debuts in the match. 20 year old right back Scott Marshall (picture middle right) played for the senior side for the first of his 26 times and Gavin McGowan made the first of his 7 appearances ater graduating from the academy. It was this date in 1998 that Arsenal suffered what should have been a crushing 4-0 defeat to Liverpool at Anfield but they were still celebrating after securing Arsene Wenger's first Premiership title the match before at Goodison Park. Theirry Henry got both the goals today when Arsenal played Chelsea at Highbury today in 2000. It ended in a 2-1 Gunners win over the Pensioners. Before the match Thierry Henry was presented with the Player of the Month Award for April. Finally, it was Chelsea again when Arsenal next played on this date when Arsenal got a 1-1 draw at the Emirates in 2007 thanks to a 43rd minute Gilberto Silva penalty.
