Conservative calls to deport Representative Ilhan Omar over comments she purportedly made about Somalia have no legal merit, experts tell Newsweek.

The progressive Democrat, a Somali American and Muslim, has been under fire for remarks she allegedly made to Somali American constituents that have been viewed over 7 million times on X. Omar, a Somali American and Muslim, seemed to address a deal struck by Somalia's breakaway region of Somaliland with landlocked Ethiopia to give it access to the sea.

Republicans, including Florida Governor Ron DeSantis and Georgia Representative Marjorie Taylor Greene, have openly called for Omar to be deported, with the latter saying: "She flaunts using her position as congresswoman to protect Somalia's border while our border is invaded by MILLIONS of illegals who are a danger to America."

Immigration lawyer Rosanna Berardi told Newsweek that since Omar is a naturalized U.S. citizen, calls for deportation lack legal ground unless the individual in question gained citizenship through nefarious means such as fraud, misrepresentation or membership in certain organizations—or being dishonorably discharged from the U.S. military if citizenship was based on military service.

The Minnesota representative's statements, whether accurate or taken out of context, are also protected under the First Amendment, which extends not just to U.S. citizens but also to public officials who routinely express opinions on foreign and domestic matters and do so without fear of legal repercussions—especially deportation.

"The Immigration and Nationality Act allows for deportation/removal of individuals due to criminal activities, violations of status or violation of immigration law," Berardi said. "Deportation for expressing political views, particularly those covered by the First Amendment, is not legally supported. Political speech does not constitute a valid basis for deportation.

"In essence, we have a series of sound bites here that are legally baseless. Typical political banter."

Stephen Schnably, a law professor at the University of Miami, told Newsweek that calls for the deportation of a sitting member of Congress for expressing personal views—whether accurate or spun by political adversaries—is "far beyond the realm of any reasonable response to her remarks."

"It's just not in the cards, deportation as punishment for a U.S. citizen," he said. "That is something that just cannot be done."

He said that even if Omar's statements, as attributed by some conservatives, are taken at face value, favoring foreign country interests over U.S. interests "is not a First Amendment violation to do that." Members of Congress can say what they want, and ultimately, voters have their say in elections.

The situation would potentially be different if Omar did not hypothetically register as an agent of a foreign government, comparing Omar's casual remarks to criminal charges against Democratic Senator Bob Menendez. The New Jersey legislator and his wife are accused of accepting bribes, including gold, cash, a luxury vehicle and payments toward a home mortgage, allegedly in exchange for advancing their interests, as well as those of the Egyptian government, in his role as the chair of the Senate Foreign Relations Committee.

But in Omar's case, there is no indication that anything of that sort—of "committing a well-defined crime where conduct or actions are not in accordance with a statute that is not constitutional."

Politicians make similar remarks all the time, Schnably added, saying there is nothing unusual about foreign policy positions that favor one country over another in a dispute.

Omar's alleged statements, backlash

According to one translation of Omar's remarks first shared on X by Ambassador Rhoda J. Elmi, Somaliland's Deputy Minister of Foreign Affairs, Omar purportedly said that she was "Somalian first, Muslim second" and "here to protect the interests of Somalia from inside the U.S. system."

Omar is also alleged to have said that "as Somalis, one day we will go after our missing territories."

But Omar has refuted the retelling of her statements, calling the viral clip "not only slanted but completely off," adding that she "wouldn't expect more from these propagandists."

Another translation posted online by Abdirashid Hashi, a researcher and Somalia analyst, states that Omar said that Somalis "are sisters and brothers, supporting each other, people who know they are Somalis and Muslims, coming to each other's aid."

Per that translation, she also said: "While I am in Congress, no one will take Somalia's sea. The United States will not back others to rob us. So, do not lose sleep over that, O Minnesotans. The lady you sent to Congress is on this, and she is as cognizant of this interest as you are."

Greene bashed Omar and her comments in an X post, saying: " Patriots, you must show up big in 2024. We have a country to save and people to deport."

"Expel from Congress, denaturalize and deport!" DeSantis wrote on X.

In the past, DeSantis has singled out Omar as allegedly propagating antisemitic movements within Congress. In January 2022, after a group of people wearing Nazi symbols made national headlines for yelling antisemitic slurs on streets and highway overpasses in the Orlando area, DeSantis said he would not let others shame him for his support of Jews.

"I'm not going to have people try to smear me that belong to a political party that has elevated antisemites to the halls of Congress, like (US Rep.) Ilhan Omar, that have played footsie with the (boycott Israel) movement," DeSantis said at the time.

The Liberation campaign which finally drove the Italians out of Ethiopia conditioned the nature of the country’s international relations in the 1940s. The prominent role that the British played in the process, for their own global strategic reasons, gave them a position of ascendancy in Ethiopia. The tripartite competition among Britain, France and Italy for control of Ethiopia in the pre-1935 period was replaced by unilateral British domination. This fact was given legal embodiment in the agreements that Ethiopia was forced to sign with Britain in 1942 and 1944. On the basis of these agreements, and under the convenient excuse that the continuation of World War Two required making adequate provisions for Allied defence, the British came to assume extensive control over Ethiopia’s finance, administration and territorial integrity. In the first Anglo-Ethiopian Agreement of 1942, although the British nominally recognized the ‘free and independent’ status of Ethiopia, almost every article underlined its dependency and the preponderant role of Britain... In short, the status they reserved for the country was aptly expressed by the term they chose for it, despite protests: Occupied Enemy Territory Administration.

All this was clearly not to the liking of the emperor. While grateful to the British for helping him to return from exile to the throne that he had lost five years earlier, he was not prepared to stomach for long the curtailment of his prerogatives. What he aspired to was the reconstitution of his autocratic powers on an even more solid base, in partnership with the British, but not through subservience to them. What the British sought was apparently to drag the country back to its pre-1935 level, depriving it of even the few benefits of Italian colonial rule. The second Anglo-Ethiopian Agreement, signed in 1944, went some way to restore Ethiopia’s sovereign rights. The precedence enjoyed by the British minister over all other foreign representatives was lifted. The Ethiopian government regained its freedom to appoint foreigners of any nationality as advisers or officers.

While the Agreement of 1944 thus gave the Ethiopian state a relatively greater margin of independence, the British none the less still retained substantial control over the country’s destiny. This was particularly evident with regard to Ethiopia’s territorial integrity. Taking advantage of their strong military presence in the country, the British took control of both Eritrea and the Ogaden. Soon, they started to devise plans for the future: in both cases, these plans envisaged the severance of the territories from Ethiopia. The Ogaden was to be added to British Somaliland and the former Italian Somaliland, to form what was rather ominously christened Greater Somalia – the seed for Somali irredentism in subsequent decades. For Eritrea, the British had a slightly more complex arrangement. The Eritrean lowlands were to be united to Sudan, with which they shared geographical, ethnic and religious affinities. The predominantly Christian highlands, integrated with their Tegrean kin in Ethiopia, were to form a separate state. In effect, the plan envisaged a further amputation of Ethiopia in the north. It is worthy of note that the British plans for both Eritrea and the Ogaden, with the exception of the special fate reserved for the Eritrean lowlands, amounted to a perpetuation of the administrative divisions set up during the Italian Occupation.

DP World and Somaliland open new terminal at Berbera Port

Expanded port, economic zone and Berbera corridor will transform Berbera into an integrated maritime, industrial and logistics hub in the Horn of Africa.

Berbera Port’s new container terminal inaugurated, has capacity for 500,000 TEUs a year; Second phase expansion of terminal will increase capacity up to two million TEUs a year; Berbera Economic Zone under development aims to attract investment and new businesses, and to create jobs; Expanded port, economic zone and Berbera corridor will transform Berbera into an integrated maritime, industrial and logistics hub in the Horn of Africa.

DP World, a leading provider of integrated logistics solutions, and the Government of Somaliland, yesterday inaugurated the new container terminal at Berbera Port, following completion of the first phase of the port’s expansion as part of its development into a major regional trade hub to serve the Horn of Africa.

The new terminal was officially opened by His Excellency Muse Bihi Abdi, President of Somaliland, and Sultan Ahmed bin Sulayem, Group Chairman and CEO of DP World, at a special event attended by over 200 guests, including a Government delegation from Ethiopia, led by their Excellencies Ahmed Shide, Minister of Finance and Dagmawit Moges, Minister of Transport.

The event also included a symbolic ground-breaking for the new Berbera Economic Zone, the first phase of which is under construction.

The new container terminal with a deep draft of 17m, a quay of 400m and three ship to shore (STS) gantry cranes, can handle the largest container vessels in operation today, and increases the port’s container capacity from current 150,000 Twenty Foot Equivalent Units (TEUs) to 500,000 TEUs annually.

The terminal also includes a modern container yard with eight rubber tyred gantry cranes (RTGs). A new port One Stop Service Centre is also currently being built and will be ready in quarter three this year.

DP World has committed to investing up to US$442 million to develop and expand Berbera Port, and with the first phase now complete, Mr bin Sulayem also announced that work is already underway to further expand the port in a second phase.

This includes extending the new quay from 400 to 1,000 metres, and installing a further seven STS gantry cranes, increasing the total from three to 10, enabling the port to handle up to two million TEUs a year, and multiple large container vessels at the same time.

Part of the overall Berbera plan and modelled on DP World’s Jebel Ali Free Zone in Dubai, the economic zone is linked to the port and strategically located along the Berbera to Wajaale road (Berbera Corridor).

The economic zone will serve as a centre of trade with the aim to attract investment and create jobs, and will target a range of industries, including warehousing, logistics, traders, manufacturers, and other related sectors.

It will allow producers, suppliers, and customers to operate in a conducive and competitive environment for investment and trade.

DP World and Somaliland open new terminal at Berbera Port, Announce Second Phase Expansion and Break Ground for Economic Zone

The Berbera Corridor road upgrade project, funded by the Abu Dhabi Fund for Development (ADFD) and the UK’s Department for International Development (DFID), and the Hargeisa Bypass Road funded by UK Aid, is set for completion in quarter four, 2021 and quarter three 2022, respectively.

The road will link to the existing modern highway on the Ethiopian side and position Berbera as a direct, fast, and efficient trade route for Ethiopian transit cargo.

His Excellency Muse Bihi Abdi, President of Somaliland, said: “This is a proud and historic moment for Somaliland and its people, as the completion of the first phase has made our vision of establishing Berbera with its strategic location into a major trade hub in the region a reality.

With the new terminal, along with the second phase of expansion and economic zone along the Berbera corridor, we are now firmly positioned to further develop and grow our economy through increased trade, attracting foreign direct investment and creating jobs”.

Sultan Ahmed Bin Sulayem, DP World Group Chairman and CEO, said: “Our further expansion of the port in a second phase, and its integration with the special economic zone we are developing along the Berbera Corridor, reflects our confidence in Berbera and intent to develop it into a significant, world-class centre of trade.

It will be a viable, efficient and competitive option for trade in the region, especially for Ethiopian transit cargo”.

DP World Berbera, which began operations at the port in March 2017, has since increased volumes by 35 percent and vessel productivity by 300 percent, and reduced container vessel waiting time from four to five days, to only a few hours.

DP World and the Ethiopian Ministry of Transport signed a Memorandum of Understanding (MoU) in May this year, with the aim of developing the Ethiopian side of the road linking Addis Ababa to Berbera, into one of the major trade and logistics corridors of the country’s international trade routes.
