Arguments For And Against E-Bike Registration And Licensing

Last month, with great fanfare, Gov. Kathy Hochul signed State Legislation intended “to raise awareness about the safe use of e-bikes and products that contain lithium-ion batteries and protect New Yorkers,” she announced in a press release.

The eight-bill package, set to go into effect in January, 2025, makes important strides in the area of battery safety. It also requires mopeds to be registered at the point of sale, and alters Department of Motor Vehicle accident reports to include a new category for e-vehicle collisions with pedestrians, so they can be tracked.

What is not included in the package, to the consternation of some public-safety advocates, is “Priscilla’s Law.”

Named for Priscilla Loke, a teacher who was killed in Chinatown in 2023, by the driver of an electric Citi Bike who fled the scene, Priscilla’s Law would have required all e-bikes to be registered and display license plates. It was introduced by Queens City Councilmember Robert Holden last fall, and accrued 34 co-sponsors — the amount required to trigger an automatic hearing in the City Council.

But the hearing never happened. According to Holden, two councilmembers, Rita Joseph and Sandy Nurse, rescinded their support after Transportation Alternatives, a nonprofit organization whose stated mission is “to reclaim New York City from cars,” Wrote a Letter to every councilmember, urging them to reject Holden’s bill, leaving it at a legislative standstill.

West Side Rag reached out to Holden, Transportation Alternatives, and the NYC E-Vehicle Safety Alliance (NYC-EVSA), a grassroots organization of pedestrians, many of whom have been hit by e-vehicles, for insight into the opposing sides of the e-bike-registration controversy.

The Arguments

“By licensing e-bikes, bikers can be held accountable for accidents,” Holden contended in a call with West Side Rag. Without a clearly identifiable license plate, reporting bike accidents is difficult, he added, as it is not uncommon for riders to leave the scene.

“Priscilla’s Law is clearly part of a much more concentrated war on bikes generally,” said Alexa Sledge, director of communications for Transportation Alternatives, also in a phone interview with the Rag. “E-bike licensing would be both ineffective and a bureaucratic nightmare … ” she added.

Those were the reasons local Councilmember Gale Brewer cited for not signing onto Holden’s bill. “I do not believe a blanket e-bike registration rule will make streets safer,” she said, “nor is NYC DOT [Department of Transportation] equipped to establish, manage, or enforce it.” Brewer did support the lithium-ion safety bills.

Carol Hilfer, who was hit by an e-bike on June 24 of this year, believes that e-bikes should be treated differently than regular bicycles. “An e-bike, to me, is just a motorcycle. It’s not a bicycle.”

Hilfer was crossing Central Park West at 90th Street this past June when an e-biker ran a red light and knocked her to the ground. The resulting hematoma on her leg took weeks to heal. “The idiot on the e-bike — it was a Citi Bike — he’s got earbuds in his ears, oblivious to everything,” she said. Once she managed to stand up, the biker sped away.

Marian Lewis, 85, another e-bike hit-and-run victim, agreed that e-bikes pose a new danger to pedestrians. “I’ve timed [e-bikes] on Central Park West [to see] how long it takes one in the bike lane to go one block. It’s just a couple of seconds. They’re so fast.” In March 2021, an e-biker collided with Lewis on 93rd Street and Central Park West, breaking her hip. The biker fled and Lewis was rushed into emergency surgery, remaining in the hospital for eight days before being transferred to rehab.

“This bill is really trying to bring order and get the chaos out of our city,” Holden told the Rag. “If you’re reckless, if you hit people, you should be held accountable.”

Sledge set forth the following argument: “The more people on the road riding bikes at any point in time, the safer that area is going to be for people on bikes, because cars are used to seeing them. Licensing e-bikes would dissuade ridership and, therefore, make the streets more dangerous.”

“Well, why would it dissuade ridership?” demanded Janet Schroeder, co-founder of NYC-EVSA. “Because someone doesn’t want to be held accountable for their egregious riding? Then those are exactly the people that should be dissuaded,” she said.

E-bike licensing could lead to discriminatory police stops, Sledge said. She pointed out that a large percentage of e-bike users are delivery workers, who are predominantly immigrants and men of color: “If we institute this bike licensing law, that’s giving a brand-new power to the NYPD to allow them to pull over anyone they want who’s riding a bike. Time and time again, when it comes to traffic stops…we’ve seen it’s been done in a racist way.”

“Transportation Alternatives is playing the race card,” Councilmember Holden responded. “[The NYPD] is going to stop bike riders breaking the law, period. They’re not going to distinguish between the color of their skin,” he said.

As for other safety measures the city could adopt, Sledge suggested better protections for delivery workers. “If you’re a worker for DoorDash, and DoorDash is requiring that you do what is safely a 20-minute bike ride in 12 minutes — that’s not acceptable,” she said.

She also called for the city to build more protected bike lanes, which would deter riders from biking on the sidewalk, she said. “The root of the problem of e-bike safety is that there is not enough space for bikers,” she said. “With these massive levels of density and not enough space for anyone in our streets except for people who are driving cars, this problem becomes even more serious.”

According to Sledge, cars pose a much greater threat to pedestrians than bikes, and if more people rode bikes, less people would drive cars.

Holden, on the other hand, expressed skepticism about waning car use. “There’s record registration for cars in New York City,” the councilmember said. He argued that more bike lanes do not prevent bikers from breaking the law, but licensing and registration will.

“An e-bike doesn’t have any restrictions. You’re really a phantom — you’re invisible,” he said. “That’s why so many of them don’t adhere to any traffic regulations at all. You need penalties,” he added.

Holden told the Rag that “a lot of councilmembers get, you know, campaign donations from Transportation Alternatives,” and that’s why they hesitate to support his bill. “I’m not represented or paid for,” he said. “I’m doing this for the cause.”

Jacob deCastro, interim associate director of communications for Transportation Alternatives, denied these allegations in a phone interview with the Rag. He pointed out that Transportation Alternatives is a 501C Organization and is, therefore, prohibited from contributing to political organizations.

It was cute when they were in school, the whole rivalry thing. Draco’s “I got an E in potions” versus Harry’s “my mum sends the best parcels”, Draco’s “Padfoot let me ride his bike” to Harry’s “I’m still faster on a broom”. It was fine. Fun, even, rolling around the Gryffindor common room, teasing and screaming and laughing, endless nights of sneaking around and annoying the shit out of everyone.

(Draco told him once, hiding underneath a desk in an abandoned classroom, waiting for Filch to leave the library. How his Father always said he’s meant to be in Slytherin. Father, with that look in his eyes, detesting and sneering and a little hungry. But then he got Moony and Padfoot, and can you imagine the look on Pads’s face if he got sorted there? Mental. Besides, who would want to anyway. It was better to be here with Harry, making sure his stupidity didn’t get him killed.)

It was still a little cute after graduation, when Harry came to stay with them for three months. Draco’s “I know the best restaurants” to Harry’s “I made your favourite pasta”, Harry’s “early registration” to Draco’s “already have a job”. Moony and Padfoot let them do whatever, almost, treated them like adults, in a way Harry’s parents never really would. Although Sirius got so angry one morning, when Draco came back from a night shift he wasn’t meant to do. He hasn’t told anyone about it, and Pads was worried about him, wanker. Draco had tears in his eyes when he shouted back, about back off and shut up and this isn’t even, a lot of “you don’t understand”s that Remus actually laughed at.

(Harry never had shouting matches like that with his parents. His mum would usually storm off to cool down, and his dad never raised his voice. But Draco and Padfoot made up before breakfast was finished, frowning around their toast and glaring at Moony, who was still laughing, and it was okay. Then at the end of summer when Draco handed them the envelope with all the money he’s saved—“I just wanted—to give you something back—” Harry was glad he’d be leaving soon, because it was terrifying, watching Remus and Sirius cry so fucking much).

It was less fun during Uni, because Draco never went, and Harry had no one to compete with. Draco got a better job than his crappy summer one, and Moony got him his own bike, which was really unfair. Harry’s shitty old car used to be his gran’s and it didn’t go thirteen miles without falling apart. Whatever. They met every break, sometimes during the semester too. Often as they could travel. But it wasn’t the same, because their lives were so different now. “Submitted my essay on the very last minute” didn’t really compare with “getting an actual office here!”. And Draco looked so grown up in his black jacket and that annoying new eyeliner-habit, so good and—far away, and it hurt, a bit. To not be a part of it all. Of his life.

(He went to see Father, he said, a rare three AM phone call the night before Harry’s organic chem exam. In prison. He went to visit him, mostly because—well, he didn’t really know why. And it was awful. Which Harry was a little happy about, because he always hated the man, and it was easier, he imagined, not to be so torn up. But Draco sounded so sad. Heart-breakingly so. There were lots  of pauses on the phone, like Draco was smoking fifteen cigarettes one after the other. “Anyway,” he said in the end, sighed again. “Don’t tell Pads or Moony. They’ll break that man’s face, and I can’t have my real dads in prison, right?”)

It got infinitely better when Harry moved to the city in work placement. Draco got his own flat—a horrible, dingy little place he was endlessly proud of, and Sirius and Remus came by every weekend. Harry loved it and hated it and decided he was moving in too, to which Draco laughed and said, I already have a room for you. Supposing he won that round.

(it was messy, and gross, and wonderful. They found the best-worst pubs in the neighbourhood and became friends with the old queer couple the floor above. A lot of things became—clearer, and more confusing, and his mum almost got a stroke when she came to visit the first time, and dad and Sirius warded the entire place like it was a national security issue. It was amazing, and Harry was a little bit in love. Oops.)

It got worse again, because being in love (oops) meant Harry lost every single argument, seeing as he couldn’t think straight anymore. He forgot to tell Draco about his big findings because the bastard wore the tightest trousers. Draco’s ‘hilarious’ stories about his ‘hilarious’ ‘’handsome’’ (!) colleague made Harry green with nausea, which meant he couldn’t form any good rebuttals with his co-researchers. It was a disaster, and Harry hated losing, and losing to Draco all the more—then Draco got that promotion offer in Italy, and—it was getting worse and worse by the minute, because he was actually thinking of going—

(“I have to be my own man,” he said, with that face he makes when he’s hurt, like Harry’s betrayed him. “I need to find—it’s not that easy, not like it is for you, it has nothing to do with—” and Harry didn’t know how to ask him not to leave, how to make him understand he’ll be taking Harry’s heart with him too, how to keep Draco from doing what might be the best thing for him. So he only nodded and said, “You should go.” And Draco turned around, still shaking, and left.)

Then it was the worst, because Draco was in fucking Italy, and the flat was so empty it made him sick. His mum and dad came over, and when it wasn’t enough they brought Moony and Padfoot too, so his whole family was there, and they had nothing to tell him. Harry hated his job, hated his life, hated everything and everyone—and no, even if it wasn’t true, it felt like it, because Draco wasn’t there. Sirius patted his arm, and mum hugged him so tight, and Moony sighed, but dad was the brightest, because he said, “Why don’t you go too?”

(It took three Floo calls, a month of preparation, and five job interviews. Dad bought him a new suit, mum rewrote his resume, and with some of Pads and Moony’s contacts, they got him this magical-researcher position in Verona. Booked the portkey and everything, and didn’t tell Draco he was coming. And then, suddenly, they were all coming: always wanted to see Italy, apparently, and hey, they missed Draco too, he was basically all of theirs son, and—butt off, mum—didn’t help. They all got tickets on the same key, and ambushed Draco outside his new, fucking-gorgeous building.

He came down the street around half five, laughing with this handsome Italian bloke, and Harry wanted to die. But then he saw them all and stopped still in his tracks. Blinked and blinked for an impossibly long time. Tilted his head, blinked again, then said, out loud, “What the actual fuck?”

The others waited, thank god. Harry ran forward, so nervous he was choking, and said, without a single thought in his head, “I missed you so much. You’re so fucking beautiful, I missed you, who’s this guy, I missed you I missed you I—”

Draco smiled, that lopsided thing with the eyeroll and said, “I missed you too, but why did you have to bring my parents?”

And then he kissed him, and Harry felt like he’s floating, like fireworks went off—no, it was just the others, cheering like bloody idiots. Harry’s grin was so wide it hurt.

“I know the best ice cream place in town,” Draco whispered, conspiratorial, still smiling. “Fabio’s wife owns it, right around the corner. Want to go, catch up a bit? Just the two of us? Before we… with everyone else? I just. I really missed you.”

And maybe it wasn’t a competition, not exactly, but Harry still felt like he won.)

We're going to go ahead and make these now but we're going to buy them and we'll see which one wins because then they'll start making more of when kind and he says I don't think this is what you're getting out of the conversation you can take all these dumb hub motors you have in stock and all these mid motors and everything else that are sitting around and engines from smaller HVAC fans then I'm being used and anything like that electric motor and change and take a cruiser and change it into an evike that can be modified to be an e motor or a moped would be better as that would be legal in their requirements might come out in regular cities so we're going to see that's a way to make money right there I can turn this one into a emoped pretty easy and he wants one

This is a great thing but he's saying and we need a bigger one but yeah that's funny I said look like a motorcycle and we don't happen to you it still look like a boss sauce I'll still ride on the sidewalk it'll look like Las Vegas after muto and that's funny down the sidewalk but anyways so he's saying bring it bro to me and I'm telling him to shut up they're like little kids sometimes it says I'm going to drive my cruise around circles after you like a little kid on the lawn doing burnouts in the dirt yeah that's great that sounds like fun but really we have something to say it's a great idea as a moped you can go a certain speed it's up to like 60 or something and we need that and if you use this ebike you just you take the plate off if you need to boot out of there you put the plate on and you can carry the plate in a pouch or something in a backpack and it's not a bad idea but he wants to do is leave it at home and if you really has to do it you'll see it fell off you can show them the registration or just say it's my e-bike and I'm pedaling fast but really you can see it fell off but I do understand what you're saying it's for like if something happens he can leave and it's a good idea it's kind of a scam and it might work very well actually they'll all look like this

On my way to LA fitness every morning, 🏊‍♂️ I take a meandering route through Belleair, Florida and wind my way past stately homes and manicured lawns. Crossing the biking/jogging trail with caution, I always see a stop light up about a half a mile ahead. It is timed so that even if it's red when you see it and turns green you'll never make it to the intersection before it turns red again! Not today I thought as I fished out the traffic light signal.🚦 It not only stayed green the whole way up to it, it stayed green for even longer after I went through it. 🟢 As if fishing caused it to miss a cycle to turn red 😮  How delightful that we have this magical power to make our lives healthier, more abundant and easier! 🤩  If we can get our minds uncluttered, the depth of the oceans is what is possible!!! On my way to LA fitness every morning, 🏊‍♂️ I take a meandering route through Belleair, Florida and wind my way past stately homes and manicured lawns. Crossing the biking/jogging trail with caution, I always see a stop light up about a half a mile ahead. It is timed so that even if it's red when you see it and turns green you'll never make it to the intersection before it turns red again! Not today I thought as I fished out the traffic light signal.🚦 It not only stayed green the whole way up to it, it stayed green for even longer after I went through it. 🟢 As if fishing caused it to miss a cycle to turn red 😮  How delightful that we have this magical power to make our lives healthier, more abundant and easier! 🤩  If we can get our minds uncluttered, the depth of the oceans is what is possible!!! What are some of the UK Laws for electric bikes?

In the UK, electric bikes (e-bikes) are legal if they meet certain rules. The motor must not exceed 250 watts, and the bike should not go faster than 15.5 mph (25 km/h) when the motor is running. You must be at least 14 years old to ride an e-bike. E-bikes that meet these rules are considered regular bicycles, so you don't need a license, insurance, or registration to ride them. You must follow the same traffic rules as for regular bikes, like using bike lanes and wearing a helmet for safety.
