Medical Negligence
Tumblr media
Najrul Seikh v. Dr. Sumit Banerjee & Another
SLP Civil 17437/2018
Subject: Medical Negligence resulting in complete loss of eye sight
Before Supreme Court of India
Heard by the bench of Hon’ble Mr. Justice Vikram Nath J & Hon’ble Mr. Justice Satish Chandra Sharma J
Order Civil Appeal was allowed order of the National Consumer Dispute Redressal Commission (NCDRC) & State Consumer Dispute Redressal Commission (SCDRC) was set aside and the order of District Consumer Dispute Redressal Commission (DCDRC) was upheld by the SC on 22.02.2024.
Fact
Master Irshad on 14.11.2006 got an injury in his right eye. He was taken to Disha Eye Hospital by his father who was a BPL Card Holder and the examination report revealed that Irshad was suffering from traumatic cataract and required minor surgery. The next day, he was taken to Disha Eye Hospital. As the father was unable to finance his son’s treatment the Doctor at Disha Eye Hospital approached the Doctor& partner at Megha Eye Hospital on 18.11.2006. Thereafter, the Respondent confirmed the medical opinion and operated the boy. After the operation the boy was experiencing irritation, pain, and blood clotting, the father visited the operating doctor multiple times but no improvement came in the eye problem.
The Doctor at Disha later referred the boy to the Regional Institute of Ophthalmology where it was revealed by Dr. Anindya Gupta, RMO-cum-Clinical tutor from the Burdwan Medical College that it was a case of Retinal detachment leading to permanent loss of vision in the right eye and it was mainly due to pre-operative and post-operative care and rehabilitation.
Complaint before DCDRC
The complaint was filed u/s 12 of the Consumer Protection Act by the father of the boy and the present appellant. The Complaint was allowed by the DCDRC with clear observation that the boy lost his vision due to the negligent attitude of Respondent manifesting through lapses in pre-operative and post-operative care and rehabilitation.
Order of DCDRC
The DCDRC found a deficiency in the medical services provided by the Respondents and as such directed the Respondents on 16.05.2013, for payment of Rs. 9,00,000 as compensation, in favor of the Appellant within one month, failing which, the amount would be subject to an interest @ 10% until the date of realization.
Appeal by Respondents before SCDRC
The SCDRC dismissed the order of DCDRC & observed that the Appellant father had failed to establish deficiency of service/negligence on the part of the Respondents.
Revision by the father before NCDRC
Aggrieved by the dismissal of his Appeal, the complainant preferred revision before the National Consumer Disputes Redressal Commission & NCDRC also dismissed the Revision on 09.06.2016 & affirmed the decision of SCDRC & held that there was no negligence on the part of the Respondents, and concluded that the Appellant’s delay of one month in approaching the Regional Institute of Ophthalmology was fatal for his son.
Observation of the Supreme Court
The DCDRC has made specific findings regarding lapses in duty of care by Respondent both pre-operative and post-operative standards for conducting a traumatic cataract surgery relying on the evidence of Dr. Anindya Gupta, RMO-cum-Clinical tutor from the Burdwan Medical College.
A connection is established between the lapses in post-operative care and the development of loss of vision after the operation.
The expert evidence of Dr. Anindya Gupta went entirely uncontroverted due to the absence of cross-examination and the failure of the Respondents to bring on record any other contradictory expert evidence.
Despite the presence of evidence pointing towards negligence of the Respondents, both the SCDRC and the NCDRC failed to consider it and relied only on the report of the Medical Council.
On a perusal of the Medical Council report, it appears that the Medical Council did not delve into the nuances of pre-operative and post-operative care.
The finding of SCDRC & NCDRC of contributory negligence on the part of the Appellant is entirely unsubstantiated by any expert opinion.
Both the forums have mechanically and exclusively relied upon the Medical Council report and reiterated its findings without any reference to the evidence of Dr. Gupta.
The Respondents are directed to comply with the order of the DCDRC within one month from the date of this order.

Dental Implant Cost in Delhi | Single Tooth Implant Cost in Delhi
Dental Implants
Tumblr media
A dental implant is a metal (titanium) screw which is designed to position into the jawbone beneath gums. It allows placing a replacement for a missing tooth or teeth. Implant fuses into jawbone to make firm support for artificial teeth – dentures and bridges mounted on implants remain firm and feel more natural and convenient.
Here Are some important FAQS on dental implant
When would I require a dental implant?
Dental implant is treatment modality in which missing teeth are replaced with titanium screws through which a crown is attached in the oral cavity.
Is a Dental Implant suitable for me?
Visit our clinic Crown and Roots for a thorough check-up of your oral health to know whether you go for dental implant directly or require a bone grafting surgery for implant.
Why replacing a missing teeth with dental implant so important?
Do you have a missing tooth?
If yes, then you might face a bigger risk of not just losing your teeth but the jawbone around that teeth. Missing teeth will eventually lead to deteriorating bone quality around those areas. After a certain point placing implants would also be difficult in that particular area. Jawbone needs stimulation to retain its mass and it gets the stimulation from teeth. Missing a tooth would mean no stimulation for the jawbone.
What happens in dental implant procedure?
It is surgically placed directly on the jawbone but sometimes a bone graft surgery is required. In any case, an implant is fixed and the patient is allowed to walk-out with tips and tricks to maintain the implant in good health.
The procedure takes up to 45 to 60 minutes and same day you can go home happy and healthy after the surgery. Soon, you will get the replacement crown on the implant. It would complete your set of teeth and bring back the lost smile and glow.
What are the advantages of dental implant over bridge work?
If you are still living with a missing tooth, you are denying yourself the advantages of implants. A dental implant looks, feels and works like natural teeth. And it requires no special care. Here are some advantages-
No damage to adjacent teeth
Expensive initial cost but economical in the long run.
Same chewing efficiency in comparison to natural teeth
Longer lifespan
Who will perform implant procedure at Crown and Roots?
At Crown and Roots, implant related procedures are done by Dr Mansi Datta. She is a qualified implantologist and has completed her masters in implant related field. With the desire and zeal to lean about all the recent trends in implant she has mastered the craft like a thorough professional. Her patients are always relaxed and calm about the treatment outcomes.  The surgery team comprises of two highly skilled and experienced oral and maxillofacial surgeon Dr Kriti Nagpal and Dr Tarun Sharma. Before starting every case, a detailed discussion takes place between all specialists and a patient centric treatment approach is planned. The same is conveyed to the patient and all doubts and concerns are addressed. After the go ahead from the patient, surgery is done in strict sterilization protocols.
How much does a Dental Implant cost?
Cost of dental implants in Delhi starts from Rs. 25,000 and goes on depending on the type of implant and service charge of the dental clinic. You won’t require hospital stay because it is a short-surgical process that lasts up to an hour.
Dental implant cost in Delhi is affordable in comparison to other metropolitan cities in India. It starts at Rs. 25,000 and goes up to Rs. 45,000 depending on the treatment and type of implant placed. Since an implant can last a lifetime, if it gets proper care, you won’t require making further investment on the implant. Once it is fit, you are ready to go.
What are Oral care tips for Dental Implants?
An implant can last a lifetime, if it gets due care
Brushing twice a day using an interdental brush that slides between the teeth is a good habit. And if you can floss once regularly, it would be good for your implant.
Your implant is fused into jaw bone but it isn’t firm enough to support chewing frozen food and other hard items that put pressure on jawbone. It will be better, if you could avoid eating hard food with an implant.
Smoking is injurious to health and fatal for implants. The tobacco can weaken jawbone to the point where implant can fail to work. If you do smoke then please quit smoking.
Visit your dentist every six months for regular examination of your implant. The dentist would certify the implant is in good condition and working.
