Business Partnerships May Not Survive A Divorce—But There Are Exceptions
I don’t mind losing a spouse, but I hate the idea of splitting up a successful business partnership.
Most business partnerships between spouses will not survive a divorce, but there are plenty of exceptions to just about every rule about human behavior.
In cases where a joint business venture preceded and fostered a marriage, there may be valid reasons to keep a successful business going even when the partners no longer want to live together.
Such a situation requires extremely sensitive lawyering. A good lawyer can help you gauge whether a proposed divorce settlement maintains your ability to continue running a profitable business while divorcing your partner. Tax issues, property issues, credit issues, insurance matters and even immigration status may have a bearing on whether and how your joint business can prosper even with the dissolution of your marriage.
The primary mission of Hirsch Legal, LLC is to protect our clients’ rights in divorce and custody actions. We share your goal of achieving an optimal post-divorce arrangement, where your personal and financial viability are assured as much as humanly possible.
While we certainly do not encourage our clients to maintain or form business partnerships with their ex-spouses, we recognize that economic needs and the vagaries of personal chemistry may mean that such an arrangement is viable and perhaps even indispensable post-divorce.  Every matter we handle is unique, therefore its important that each client be honest about their desired outcomes so that strategic matters, settlements, or proposed trial orders, comport with their preferences.
Attorney Carmina Hirsch (formerly Tessitore), is widely recognized for her ability to help her clients negotiate advantageous settlements under very fraught circumstances, and prevail at trial when settlement is not possible due to unreasonable demands or conduct from the other side. If you want to figure out how you can keep your thriving company intact when your marriage is falling apart, and if our legal analysis determines that this does not harm your best interests, we can help you achieve such an outcome.
Hirsch Legal, LLC is one of Connecticut’s foremost divorce and family law practices. We serve clients throughout Fairfield County: our Shelton office is within easy driving distance of Bridgeport, Westport, Danbury and Stamford. Call today to arrange a consultation!

Divorce Court Is A Puzzle
Going through a divorce is a difficult process to navigate. It can feel like every word or action from the other side is calculated to harm your dignity, your fortune, and your sense of belonging in your community of friends and family. In making their case to the judge, many advocates seize on to put into record your darkest secrets, all the while painting a portrait of you as an unfit parent, an unscrupulous businessperson, a liar, cheater, disengaged lover, lazy sponge or whatever other insulting characterization they determine might sway the judge into granting their inequitable and exaggerated demands.
Had Dante gone into hell without Virgil, he might not have made it out in one piece. Similarly, while divorce court can feel like hell, it can be managed well when you have adequate representation despite the onslaught of obstacles your angry spouse and his/her counsel may try to place in your path. You need a lawyer who is thorough in her research and strategy, and whose exhaustive knowledge of the law and procedure enables you to avoid and/or conquer all obstacles designed to harm you.
At its core the legal process is organized to give both sides a fair outcome – getting there however takes strategy and perseverance. A proactive legal strategy focuses on the weaknesses and misdeeds of the opposing party, forthrightly providing evidence to correct inaccurate claims made against you, while highlighting your positive attributes and contributions to the marital estate.
Divorce court is not a forum where a party should “wing it” as the saying “he who represents himself has a fool for a client” is ever present here. We often hold consults with parties who represented themselves during their divorce and now post-judgment express regret over terms they settled on, many of which may not be modifiable and/or may require intensive and costly post-judgment litigation to correct.  Had those parties been represented by counsel during their divorce, their initial outcomes could have been better suited toward their ultimate goals.
Hirsch Legal, LLC is one of Connecticut’s foremost divorce and family law practices. If you retain our services, you will enter the divorce process with considerable advantages. Many of our litigious opponents back off from their unreasonable positions and unnecessarily aggressive tactics once they see the formidable case strategies developed for our clients.  Our methods are designed to place our client’s on the best possible footing in furtherance of attaining global resolution and/or preparing a matter for trial.
Hirsch Legal, LLC do our utmost to ensure that our clients maintain a solid financial position post-divorce when dividing the marital estate; that custody and visitation arrangements are fair and reasonable and in the best interests of the minor children; and that reputational harm is prevented or minimized to the maximum extent of the law. Our mission is to save you time and money while attaining your reasonable goals.

Why Lawyers Do Not Make Idle Threats
I don’t really want to divorce my wife; I just want to scare her. Can a lawyer help me do that?
When it comes to how you want to live your life, you are in charge. The essential job of an attorney is to provide legal advice that will help you defend your rights when you are under a legal threat or help you prevail in court if you are initiating an action against another party.
Generally speaking, lawyers want no part of a frivolous lawsuit.
If you want your wife to stop drinking, or to abandon a secret love affair, or to stop nagging you about mowing the lawn, you could consider hiring a life coach or a psychologist to help you deal with life’s common problems. Save making an appointment with a lawyer for when you need legal assistance.
Lawyers do not make idle threats. Any legal documents you want to send to your spouse (or anyone else) must be grounded in solid facts, illuminated by a precise knowledge of laws applicable to a particular situation.
Whether you need legal advice on how to prepare for divorce or on how to stay within the law when trying to stave off a divorce, Hirsch Legal, LLC stands ready to advise you on steps you can take (within the bounds of law) to achieve your desired ends.
Not every consultation leads to a case that a prospective client will take all the way to Court. We often advise clients on how to be proactive in insulating themselves from legal exposure, whether by providing advice on what a divorce settlement might look like if a marital situation continues to worsen, or by suggesting strategies to forestall issues that may be in opposition to your best interests.
There is no one better qualified than Attorney Carmina Hirsch, a perennial “Super-Lawyer” as judged by her peers in the legal community, to advise you on divorce and child custody matters arising under the jurisdiction of Connecticut courts. If you live in Fairfield County or New Haven county, contact her today, she’s serves clients in Bridgeport, Westport, Danbury, Stamford and other urban centers in Fairfield and New Haven County.

Save The Children!
Fairfield and New Haven Counties are excellent family-friendly places to live in the United States. We are renowned for our nationally-ranked schools, for our spacious and beautiful public parks and sports facilities, and for our convenient and well-stocked shopping centers. Our communities take seriously the health, education, well-being, and security of our children.
Divorce can pose greater stress to children than to their parents. Children often feel a sense of insecurity of what the future holds for them.  Splitting the marital estate can mean a child leaving the home they grew up in, losing a place in a good school, changing healthcare coverage, and losing emotional stability at a critical age. In cases where spousal or child abuse is the precipitating factor in a marital breakup, the physical safety of children may be an additional urgent factor requiring the attention of the Court. In cases where there are grounds to suspect that a child is being victimized by his parents or siblings, the Court may appoint a Guardian Ad Litem (GAL) to investigate such matters.
Hirsch Legal, LLC is intimately familiar with these aspects of Connecticut family law. We work toensure a child’s best interests are upheld in all matters on track for a hearing or trial, or that ultimately settle. At the same time, we recognize that abuse allegations levied by opposing parties are sometimes used as a smokescreen to gain advantages during negotiations, and we won’t stand for that either!  We ensure all evidence is presented to uncover the truth behind inaccurate facts or misleading information presented by the opposing party.
Most cases proceed under the assumption that both parents ultimately want the best for their children, and will do their best to meet their responsibilities until the child reaches the age of majority. We assist our clients in preparing and/or agreeing to settlements in which matters such as child custody, education, support and healthcare are adequately and fairly covered.  In cases where one parent poses a danger to a child, more aggressive tactics must be utilized to ensure that child’s safety is maintained.
Your spouse may have betrayed or abandoned you, but this should not affect your relationship with and your responsibility toward your children. Your marriage may be ending, but your role as co-parent will go on for years to come.  You are now in the ‘business’ of raising your children with their other parent.
Hirsch Legal, LLC has been recognized as one of Connecticut’s top divorce and family law firms. We can’t make all your problems magically disappear, but we can help you resolve your issues with your spouse in a manner that preserves the integrity of your family, and especially your relationship with your children.
Our principal, Attorney Carmina K. Hirsch (formerly Tessitore), has been annually recognized by her colleaguesin the Connecticut State bar as one of the state’s “Super Lawyers Rising Stars,” and she’s received accolades for client satisfaction. She can advise you on how to end your marriage with dignity and in the best interests of your children. Divorce Court Is Full Of Surprises
After a decade or more of marriage it is easy to imagine that you know a person well. During a divorce trial however, when the gloves come off, you may find that the person you thought you knew is gone.
Not all of the surprises you may face in a divorce proceeding stem from your spouse’s emotional or unreasonable positions.  You may also come across serious issues in discovery, like hidden assets or missing funds. You may come across documents that reveal that you are not his second wife, but his third or fourth. Perhaps a health crisis or chronic disease that was covered up for years suddenly comes to your attention. Maybe you find out that the business your spouse inherited from his/her parent is now worth less than nothing, perhaps because of an unusual step he/she took just after you filed for divorce.
The earlier you know about such potential surprises, the better prepared you will be to deal with them properly when negotiating a settlement of the financial portion of the marital estate, or custody/visitation arrangement, and/or readying your matter for trial.
The process of “discovery” entails learning about (ie. inventorying) what exists in the marital estate, obtaining documentation to support claimed assets and debts, and vetting information disclosed.  Discovery includes a gathering, exchange, and review of all pertinent legal and financial documents, and may involve depositions of you, your spouse, and any business partners or family members who may have a stake in the case.
Not all people surrender such records or reveal such personal financial information willingly. Discovery may involve court-ordered evaluations, real estate or asset appraisals, and forensic accounting methods to be employed. Sometimes there may be jurisdictional or tax issues that require some research and knowledge of laws in other states or even other countries.
As well, skeletons in your own closet may have to be disclosed in a way that does not injure your prospects of reaching a reasonable settlement or attaining a positive outcome at trial. Handling such discovery matters with tact and dispatch is the hallmark of a competent lawyer.
Hirsch Legal, LLC will handle your matter with focused attention, utilizing intensive discovery methods and experts when a case demands that complicated financial structures be unpacked and brought before the court in the most clear manner possible. Attorney Carmina K. Hirsch (formerly Tessitore) has been recognized by her peers and clients as among the top divorce and family law practitioners in New Haven and Fairfield County.  She has represented clients in high net worth matters involving complex litigation, as well as matters wherein the marital estate is of lesser value yet comprised of convoluted asset and debt structures.
If you are involved in a divorce or attorney for child custody matter in New Haven or Fairfield County, and you want your case handled as smoothly and efficiently as possible, you would do well to contact Hirsch Legal, LLC to schedule a consultation. Our Shelton office is conveniently located within easy driving distance of Stamford, Westport, Bridgeport, Milford, New Haven, Danbury, Waterbury and other nearby towns and cities.
