Yeah, those treaties that we have consistently and persistently ignored to the detriment of Native Americans may offer an important oooomph element to make progress on environmental issues when the politicians don’t want to do anything. Federal and state officials signed nearly 400 treaties with tribal nations in the 18th and 19th centuries. Threatened by genocidal violence, the tribes signed away much of their land. But they secured promises that they could continue to hunt, fish and gather wild food on the territory they were giving up. Many treaties also include cash payments, mineral rights and promises of health care and education.
For the most part, the U.S. has ignored its obligations. Game wardens have targeted and arrested tribal members seeking to exercise their hunting and fishing rights. Governments and private interests have logged and developed on hunting grounds, blocked and polluted waterways with dams and destroyed vast beds of wild rice.
If Native treaty rights had been honored, the natural landscape of the U.S. might look very different today.
In recent years, some courts, political leaders and regulators have decided it’s time to start honoring those treaty obligations. Some legal experts think that asserting these rights could prevent—or even reverse—environmental degradation.
The foundation for contemporary treaty claims is a landmark 1974 case known as the Boldt decision, a ruling issued in a federal district court and upheld by an appeals court. The case affirmed that tribes in Washington state have a right to fish for salmon in off-reservation waters. It forced the state to abandon its attempts to block Native fishing, making the tribes co-managers of Washington’s fisheries along with state wildlife officials.
“It started bringing to light the fact that these treaties aren’t ancient history,” said John Echohawk, founder and executive director of the Native American Rights Fund, a tribal advocacy group that successfully litigated the case. “They're the supreme law of the land. If the courts are going to be enforcing those rights, [political leaders] have got to pay attention.”
Treaty rights earned another milestone victory in 2018, with another case involving Washington tribes that reached the U.S. Supreme Court. That year, the court ordered the state to rip out and replace about 1,000 culverts that blocked the passage of migrating salmon, at a cost of billions of dollars. The ruling held that Washington couldn’t uphold its treaty obligations to the tribes simply by allowing access to waters where it had already destroyed the fishery.
Legal experts say that decision has changed the landscape—motivating political leaders in many states to consider whether their decisions could affect treaty-protected hunting, fishing or gathering rights.

By Srestha Banerjee The Prime Minister of India held a meeting on April 30, 2020 to consider reforms in the mines and coal sector to jump-start the Indian economy in the backdrop of COVID-19. The mining sector, which is a primary supplier of raw materials to the manufacturing and infrastructure sectors, is being considered to play a crucial role for the resurgence of the economy post the lockdown and in the coming years. While several reforms are being mulled over to boost mining businesses, the Centre and the state Governments also need to consider boosting local livelihoods. In the context of mining districts, the District Mineral Foundation (DMF) funds can be used for prioritising livelihood generation and creating local jobs. The Prime Minister in the latest meeting has also discussed the scope of improving “community development activities” through the fund.[1] DMF was instituted in March 2015, under the Mines and Minerals (Development and Regulation) Amendment Act 2015. It has been conceptualised as a benefit-sharing mechanism with mining-affected communities, recognising them as partners in natural resource-led development. Set up as a non-profit trust in all mining districts of India, DMF comes with the precise objective to ‘work for the interest and benefit of people and areas affected by mining’, through a participatory process. In September 2015, the Centre further aligned DMF with the Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY) scheme, to implement various developmental projects and welfare programmes in mining-affected areas using DMF funds.[2] Livelihood and income generation is a key issue that DMFs need to focus on for mining-affected communities across the country. This has been emphasised through the MMDR Amendment Act 2015 and the respective State DMF Rules developed under it, as well as the PMKKKY scheme. The emphasis comes in three ways. Firstly, considering the fact that mining-related activities lead to significant displacement and loss of livelihoods in these areas, the law specifically notes that people who have lost their land rights (including user and traditional rights) due to mining or whose livelihood has been affected by such activities, constitute DMF beneficiaries. Secondly, one of the defined objectives of PMKKY is to ensure long-term sustainable livelihood for the people affected by mining. Finally, following the PMKKKY guidelines, livelihood and skill development have been recognised as ‘high-priority’ issues under all state DMF Rules on which districts must invest adequately. Besides regulatory prerogative, the economic situation in the mining districts also clearly point out why income generation and creation of diverse livelihood opportunities should be a focus of DMFs. For example, in most of the mining districts, particularly in the rural areas where most mines are located, the income level among the local population is extremely low. As per socio-economic caste census of the Government of India, in a majority of these districts, 80 to 90% of the rural households have the highest earning member getting below Rs. 5,000 per month (Table 1: Distribution of household earnings in rural areas of some top mining districts). What adds to the low-income levels is the income uncertainty, as more than 50% of the workforce comprise of manual and casual labourers in these districts. Poverty and uncertainty of income also undermines the access to adequate food, proper healthcare, education and all such basic needs. Source: Socio economic caste census, 2011, Government of India Neglected so far, livelihood investments must now be a priority for DMFs Despite the mandate to improve livelihood and income among communities in the mining-affected areas, DMFs in almost all mining states have failed to make the required investments on this extremely important sector so far. For instance, in most of the top mining states, the funds earmarked for livelihood and skill development are negligible compared to the total cumulative accrual of DMF funds (Table 2: Allocation of DMF funds for skill development and livelihood in top mining states). The allocation towards this account for only 0-4% of total allocations for various developmental works in these states. As policymakers at the Centre and state levels discuss relief measures for the poorest and reviving their income, they have an opportunity to strengthen implementation of key programs like PMKKKY and DMF to improve the ground situation. For this, the Centre and respective state governments need to provide clear directions to all districts. With more than Rs. 36,858 crores in DMFs across the country, the potential of this fund is enormous for improving socio-economic conditions of local communities in the mining districts. As we start a new financial year, it is also the time for DMFs to start planning and budgeting for the 2020-2021. The law requires DMFs to undertake such annual planning considering the situation on the ground and capturing the need and aspirations of local communities. For DMFs in all districts, much attention must be paid to skill development and providing other resource support for sustainable income generation. This, as noted earlier, is also enshrined in the third objective of PMKKKY and a priority component of all State DMF Rules.[5] Considering the potential of local skills and resources, employment opportunities can be improved through multiple means. For example, incentivising livelihood opportunities around local resources such as forest products can be helpful as many of the mining areas are rich in forests. In fact, the Government of India last week announced raising of minimum support price (MSP) for 49 varieties of minor forest produces, including wild honey, tamarind, mahua flowers and seeds, lac, sal leaves etc., in view of circumstances arising out of Covid-19.[6] DMF funds can further be used to support market linkages for these produces and their products to ensure better economic value for the goods. Besides, agro and horticulture-based industries should be developed which will be relevant to the knowledge and skills of the local people. Providing support to women self-help groups (SHGs) on micro enterprises such as poultry farming, dairy, sericulture, handicrafts, handlooms, etc. will also be important to improve women participation in the workforce. At the same time creating a workforce for various occupations including health care givers through proper training will be crucial for supporting income as well as bridging resource gaps in primary healthcare. Research: ‘Free’ Electricity for Students Makes College Campuses Major Crypto Miners
According to research from tech conglomerate Cisco, college campuses are the second-largest crypto miners across industry verticals. The researchers investigated crypto mining activities across a variety of industries, finding that university campuses are ranked the second-biggest miners of digital currency at 22 percent, with the energy and utilities sector in first at around 34 percent. According to the research, the increasing mining difficulty for many cryptocurrency means that a higher amount electricity is needed, making it profitable for students to mine since the university pays their electricity costs.
‘Coffee for Bakkt’? Starbucks Equity Deal Will See Crypto-Based Payments, Source Claims
An unconfirmed report about Starbucks’ partnership with United States digital asset platform Bakkt this week has revealed that the coffee giant will allegedly accept Bitcoin-based payments after an equity deal. Starbucks had become a founding partners in Bakkt when it was revealed in August 2018, but had shut down rumors that it would be accepting BTC for coffees. Now, an unnamed source has said that the chain will accept Bitcoin through Bakkt’s software, but it will instantly convert the crypto into fiat, so that Starbucks will never actually hold any cryptocurrency.
Crypto Lending Company BlockFi Launches Crypto Accounts With Bitcoin and Ethereum Support
BlockFi, a crypto wealth management and lending firm, has launched new cryptocurrency accounts supporting both Ethereum (ETH) and Bitcoin (BTC), with 6 percent annual interest paid monthly in crypto. According to this week’s announcement, the interest earned in the BlockFi accounts compounds monthly, with results in an annual percentage yield of 6.2 percent. As well, the accounts are not entirely newly created, as they have been in private beta since the beginning of 2019 and reportedly already hold more than $10 billion in assets. The accounts are custodied at the Gemini Trust Company (Gemini – the custodian of the crypto exchange lead by the Winklevoss Twins), which is regulated by the New York State Department of Financial Services.
Twitter CEO Jack Dorsey Alludes to Spending $10,000 a Week on Bitcoin
Jack Dorsey, the CEO of both Twitter and Square, hinted in a podcast interview this week that he has been spending $10,000 per week on Bitcoin. When talking about the idea of “Stacking Sat Saturday” — a trend where users buy $25 in BTC every week to both promote and show crypto adoption — Dorsey noted that “[he] saw that [Stacking Sat Saturday] on Twitter […]”. “I would have participated but I have already exceeded my limit on CashApp. I can’t purchase anymore,” – he said. Since the maximum weekly buy limit on Square’s CashApp is $10,000, Dorsey’s statement implies that he spent $10,000 on cryptocurrency, probably Bitcoin, in one week. Dorsey further noted that he will be able to join the Stacking Sat Saturday next week.
Coinbase CEO: Ex-Hacking Team Neutrino Members Will Transition out of Company Roles
This week, co-founder and CEO of major United States crypto exchange and wallet CoinbaseBrian Armstrong said that all staff at Neutrino with prior connections to controversial software firm Hacking Team will transition out of their new roles at Coinbase. The major crypto exchange had experienced backlash after announcing the acquisition after it came to light that several Neutrino members had worked with Hacking Team, which has been accused of selling tracking software to authoritarian regimes. Armstrong acknowledged in his statement that Coinbase did not properly evaluate the team from the perspective of their mission.

Bloomberg: Crypto Companies Still Run Into Trouble Opening Bank Accounts
A Bloomberg report this week found the companies in the cryptocurrency industry are still having trouble opening bank accounts. According to various companies cited, banks are reluctant to grant accounts to those working in the crypto industry because “it’s a massive compliance headache that they don’t want to put the resources in to solve.’’ Giving some examples, Bloomberg referred to crypto payment processor BitPay specifically having trouble opening accounts. Bloomberg also quoted Silvergate Bank’s November 2019 IPO filing that noted that crypto businesses have as much as $40 billion to deposit.
NEM Foundation Releases Restructuring Plan Amid Financial Difficulties
The NEM Foundation released a financial and organizational plan for restructuring this week, in the wake of previous news that the foundation was running low on its native XEM tokens. According to the announcement, the foundation intends to set up a transformation task force in order to work on short term goals, like the development of weekly and monthly reporting structures, as well as scorecards for grading employee performance. The foundation also noted that they have hired SDK developers in order to fund the expansion of its current SDKs to include Python, PHP and Unity in addition to the current Javascript and Java.
US District Attorney Charges OneCoin Founders With ‘Billions’ in Alleged Fraud
The founders of an international cryptocurrency pyramid scheme have been charged with fraud by the U.S. Attorney Office of the Southern District of New York. The two leaders of OneCoin, Konstantin Ignatov and his sister Ruja Ignatova, were arrested this week in Los Angeles under the charges of wire and securities fraud, as well as money laundering, as part of their business that reportedly lured investors into spending billions of dollars on a fraudulent cryptocurrency. The U.S. investigation reportedly found that OneCoin generated almost $4 billion in sale revenue in the fourth quarter of 2014 and the third quarter of 2016, with profits of around $2.5 billion.
