Theft Offenses Committed During State of Emergency (PC 463)
In order to promote consistent and equitable filing practices the follow[ing] analysis is to be applied when giving consideration to filing of PC 463 (Looting):
Was this theft offense substantially motivated by the state of emergency, or simply a theft offense which occurred contemporaneous to the declared state of emergency?
Factors to consider in making this determination:
Was the target business open or closed to the public during the state of emergency? ii. What was the manner and means by which the suspect gained entry to the business? iii. What was the nature/quantity/value of the goods targeted? iv. Was the theft committed for financial gain or personal need? v. Is there an articulable reason why another statute wouldn’t adequately address the particular incident?
Becton is the same district attorney who charged a couple who painted over a message promoting Black Lives Matter on the street in front of the Wakefield Taylor Courthouse with a “hate crime,” as Djhjmedia pointed out.

BLOG POST #6 CALIFORNIA PROPOSITION ASSESSMENT
1. Proposition number and title
Prop 20: Restricts Parole for Non-Violent Offenders. Authorizes Felony Sentences for Certain Offenses Currently Treated Only as Misdemeanors
2. Summarize the proposition in your own words.
It would amend several criminal sentencing and supervision laws that were passed between 2011 and 2016. It would have made specific types of theft and fraud crimes, including firearm theft, vehicle theft, and unlawful use of a credit card, chargeable as misdemeanors or felonies, rather than misdemeanors. 
3. What was the fiscal impact: how much would it cost to enforce?
Increased state and local correctional costs likely in the tens of millions of dollars annually, primarily related to increases in county jail populations and levels of community supervision. Increased state and local court-related costs of that could be more than several million dollars annually.
4. What were the election results? Do they surprise you?
It was defeated and not passed. Does not surprise me. 
5. Identify the proposition sponsors, interest group endorsements, and financial backers.  Are you surprised by any of the endorsements? Explain how this information can help voters understand the true intentions of the proposition.
Donors include California Correctional Peace Officers Association Truth in American Government Fund, California Grocers Association Issues Committee, and Association For Los Angeles Deputy Sheriffs PIC. A lot of police and law inforcement supported this bill, meaning something to a lot of voters. 
6. What were the arguments for and against the proposition?
For, Asm. Jim Cooper (D-9): "Right now California crimes that are considered nonserious and nonviolent—and that allow you to get out of jail or prison earlier—are drugging and raping somebody, raping a developmentally disabled person, spousal abuse, a drive-by shooting, human trafficking of a child. So a myriad of different crimes, some 17 to be exact. The public never had any idea. These were not considered serious or violent crimes in the state of California. When they hear it they're shocked." 
Opposition, Contra Costa County District Attorney Diana Becton: "Accountability is a key piece of justice, but it is not the only piece. You cannot double down on punishment at the expense of getting results. By increasing the number of offenses eligible for parole by over 100 percent, the only thing Prop 20 guarantees is that a person who’s locked up for those offenses will have no incentive to participate in the rehabilitation program. That means far more people will exit our prisons without receiving the rehabilitation services that research shows recidivism." 
7. How would you have voted on the proposition and explain why.
I would have voted no on the measure. As I believe prison rehabilitation is something that we as a county and state show focus on and this prop would hinder that. 
8. Identify one additional fact you found interesting about this proposition from your review of Ballotpedia. 
It was not passed by 9,694,233 votes to 5,967,655.

Contra Costa County is where I was appointed to my first County Commission. It’s where I raised my first 2 kids. What happens there matters. Safeway E Gift Cards District attorneys in Alameda and Contra Costa counties announced a $140,000 settlement with Safeway in a price gouging lawsuit involving hand sanitizer sold during the early days of the COVID-19 pandemic.Prosecutors said Tuesday that the lawsuit was prompted by a customer at a Safeway store in Concord who called the Contra Costa DA’s Consumer Fraud Hotline and complained about the prices of two brands of hand sanitizer back in May.A joint investigation by both district attorneys offices revealed the grocery chain marked up both items more than 50% over the wholesale cost after Gov. Gavin Newsom signed an executive order in April that prohibited price gouging on “critical items” during the pandemic state of emergency. Safeway stopped the pricing as soon as it was brought to the company’s attention and has fully cooperated with the investigation according to statements released by O’Malley and Contra Costa County District Attorney Diana Becton.“The violations at issue here are serious by their very nature,” Becton said in her statement. “Public health officials were advising constant handwashing to prevent the spread of the virus. If soap and water was not available hand sanitizer was recommended as the next best thing. These are the items that Safeway sold or offered for sale at ‘unconscionably excessive’ prices.” The settlement calls for Safeway to pay more than $140,000 in penalties and restitution to resolve the case without admitting liability. Prosecutors said the company Sell Safeway Gift Cards which had long corporate ties in Pleasanton quickly corrected the pricing problem when called to its attention."The violations at issue here are serious by their very nature. Little can be more serious than a violation of a governor's emergency order during a state of emergency.
