“A Tale of Domestic Torment: The Ordeal of a Woman Abused and Driven Out by Her In-Laws”
The HC dismissed this petition of the Husband, father-in-law & 3 sisters-in-law praying before the Court to quash the FIR, Charge Sheet & the order of taking Cognizance against them for the offenses U/s 498-A, 406, 504, and 34 IPC. The Complainant-Wife filed the FIR.
Hardik Prakash Shah & 4 others v. The State of Maharashtra & Another
Crl. WP 13446/2023
Before the High Court of Bombay
Heard by Hon'ble Mr. Justice A S Gadkari J & Hon'ble Madam Justice Dr. Neela Gokhale J
Facts
The Complainant asserts that her father bore the entire marriage expenses. Despite living separately, her three sisters-in-law interfered in her household, removed the house help, and forced her to do all the chores. They demanded proof of her cleaning via WhatsApp video calls and persistently instructed her on meal preparations through text messages. They created a WhatsApp group including their brother, father, and themselves to berate her and complain to her husband. Her husband abused her, instigated quarrels over trivial matters, suspected her character, and refused conjugal relations, citing diabetes.
On October 10, 2022, at 10:30 pm, her sister-in-law Kajal called and verbally abused her about cleaning the house. Her husband joined in, snatched her mobile, deleted the call record, and pushed her. The next day, all three sisters-in-law came to her house, abused her in filthy language, and demanded she leave. Father-in-law joined in the abuse, and they all demanded gifts from her parents. Ultimately, they quarreled with her, drove her out, retained all her jewelry, Streedhan, and refused to return it.
Legal Issue: Whether the FIR and chargesheet under Sections 498-A (cruelty), 406 (criminal breach of trust), 504 (intentional insult), and 34 (acts done by several persons in furtherance of common intention) of the IPC should be quashed, as the petitioners contend that the allegations are false and amount to a misuse of the legal process.
Points of Arguments:
Submission of the Counsel of the petitioner
The complaint is a matrimonial dispute given a criminal angle to harass the petitioners.
The complainant allegedly influenced the police and used the FIR as leverage to extort money.
The allegations lack specific evidence, and the case is an abuse of the process under Section 498-A, IPC.
Submission of the Counsel of the Respondent-Wife
The FIR and witness statements substantiate the complainant's claims of harassment and cruelty.
The petitioners retained the complainant's Streedhan, causing her distress.
The treatment meted out to the complainant constituted cruelty under Section 498-A, IPC.
Courts Observation
The allegations in the FIR prima facie disclose the commission of the alleged offences.
Specific and categoric roles are attributed to each Petitioner independently and collectively.
A newlywed daughter-in-law was pitted against the might of the five Petitioners, who were abusing and ill treating her on petty issues.
The sole aim appears to be to extort money from her and her parents. This is clear from the fact that, even after driving her out of the matrimonial home, they have refused to hand over her Streedhan’ comprising valuable jewellery and her articles.
The allegations against the sisters-in-law about compelling the Complainant to show them the house cleaned by her on what’s app video call appears to be a peculiar and sadist manner of ill-treatment.
This is enough to cause apprehension in the mind of the Complainant that, there was danger to her life and limb at the hands of the petitioners.

things that seto kaiba is almost certainly bad at:
singing
playing literally any kind of instrument
learning languages (i will concede that he can read and write well in "business" languages like Chinese or English but a uvular r would kill him and also you can speak well enough to get through a meeting but that doesn't mean you're conversationally adept!!!)
dancing (a man with negative rhythm)
casual conversation
picking his own outfits
speaking in an inside voice

#but he still had access to dumbledore and mcgonagall at the very least#and clearly he never tried to visit sirius to get answers //
AND ALSO! If I were Remus Lupin and one of my best friends got one of my other best friends and his wife killed after which he went and killed my other other best friend (and a bunch of muggles)... I personally feel like I'd want to be at the trial you know? Look him in the eyes as he gets told that he is going to spend the rest of his life miserable in torture prison. Or at least I would want to read about the trial or the sentencing or who voted for him to go to prison etc etc. I'd want to know SOMETHING. And quite famously... there was no trial.
(I'm not even sure if anything other than 'SOME TODDLER KILLED YOU-KNOW-WHO??? (also his parents are dead now)' made the news? Do we know if those pictures of a laughing Sirius were ever even published before or if they were just mugshots that the Aurors had and now that he escaped they released them?)
I honestly cannot believe that Remus wouldn't ask someone, whether it's by writing the Ministry or Dumbledore or literally anyone else from the Order, about the trial and the sentencing. Did he not at least want to make sure Sirius got a life sentence if he did fully believe that Sirius killed them all? Like??
that headline help 😭😭😭 i need that asap. it has to be brought into reality, it’s entirely too hilarious not to be.
and anon yes! truly, sirius’ entire arc is SUCH a glaring plot hole like. with the amount of emphasis given to his betrayal in PoA, the foundation of it is so shockingly weak? a while ago a few others had chimed in and there was a fascinating discussion going on here but it extends out to dumbledore also like if ur the self proclaimed leader of the opposing faction and one of ur (maybe?) inner circle men is outed as a spy, would u not try and get more info out??? not find out how much they gave away??? sirius knew people, did none of them want answers or vengeance or revenge or closure or anything????

I have taught an entire discord server the German word for pussy. This has awoken the desire to learn German in at least one person, who has been speaking in full sentences and with passable pronunciation after only half an hour.
Santa is skipping my house this year, but damn if I'm not impressed.

like okay i realize that "subject" is probably the appropriate noun to use as a result of the verb "subjugate" but like. The word subject has become so weakened in connotation as like "the subjects of the kingdom" or just like "the subject of the sentence"... you know? like the verb is intense but the noun itself is tepid and I need a noun and my brain was like... "subjugants"! and I'm like. That's not a word but.
fuck it i'm writing incredibly self-indulgent fanfiction, i'm making up words and nobody can stop me

would akechi speak multiple languages? cause at this point its basically canon that he soaks up information like a sponge. would he go all out and get dictionaries and textbooks and pronunciation guides or would he be able to learn just from watching shows in the target language?
im asking bc i wanna know if he would memorize every single verb tense in french. 99% of them are unnecessary, useless, needlessly specific, and so similar to like five others. but would akechi be able to use them properly.

nobody:
me, disabled, and with special interests in both worldbuilding and disability accommodations, history, and advocacy: i wonder what kind of disabilities existed on gallifrey. would regeneration reset an autoimmune disorder, or would it follow through to their next form? can they regenerate into a body with an autoimmune disorder? is it there to stay once it hits?
what about limb differences? if gallifreyans can regenerate limbs (at the very least within the first 15 hours of regeneration, as seen in the christmas invasion), would that mean the majority of limb differences on gallifrey would be congenital? would a gallifreyan be encouraged to regenerate regardless of threat to their life after an amputation, or has gallifrey moved past that sort of ableism? (probably not, since fifteen's tardis being wheelchair accessible (or, the entrance, since the ramps within seem pretty steep) is considered remarkable by wheelchair user and unit agent shirley anne bingham. plus, from a doylist perspective, dw is very much a product of its various times, being a universe that started development in the early 60s.) would regeneration ""fix"" (heavy airquotes on that) such limb differences? is it possible to regenerate into a body with a limb difference? what sort of adaptive devices are/were there on gallifrey for those who either can't regenerate because they're very close to or at their regeneration limit, or simply choose not to do so?
a lot of these questions also apply to neurological disorders and injuries, too, if you change the wording a bit. tremors, chronic pain, weakness, paralysis, mobility issues, those sorts of things.
and are their blind gallifreyans? (if so, the doctor clearly didn't spend enough time around them.) deaf/hoh gallifreyans? similar questions there, too! (written gallifreyan language already makes my head spin, personally, but i'm intrigued by the idea of how they might go about designing an equivalent of braille! and i'd bet money that gallifreyan sign would include words and phrases that humans wouldn't think to consider, just like any other language. but then, why doesn't the tardis's translation matrix recognize and automatically translate british sign language, as we see with cass's signing confusing clara in before the flood?)
further, what about potential disabilities with no human analogue that relate to the regeneration process itself-?
my parents: hang on. slow down. what the fuck are you talking about
