Late Night Calls
Summary: As much as you love talking to the guys, late night calls with them isn’t always the best thing, especially when timezones are in the way.

Ah, tests. No matter how good you were at school, there would never come a time when you’d look back on them with a smile. Of course, with this being the last year you’d have to take them (at least, until you decide to go to college), you just can’t afford to flunk a single one. Despite several protests from both your own squad and the boys, you promptly locked yourself in your room with nothing but several cans of Red Bull and one too many snacks that definitely didn’t count as dinner. Of course, you couldn’t really ignore the repeated knocking on your door (courtesy of Elodie, the twins, and Alex) nor could you ignore the buzzing of your phone, no doubt caused by the guys trying to convince you to take a break and actually eat something that didn’t come from a vending machine, so with a sigh, you get off your bed and unlock the door.
Unbeknownst to you, Alex stopped banging on the door roughly half an hour ago, and she’d been put on update duty; sending pictures and telling Zabdiel–who would then tell the others–how things were going on their end. Zabdiel did the same, although he still sent you messages every half hour or so. By the end of your five-hour study session, you swear there would be little grooves on your door from where one of the girls’ bracelets or rings hit. Checking your phone for the notifications, you’re mildly impressed to see the number of messages and missed calls you got, most of them from Erick and Chris. Probably something about your unhealthy habits, but really, you’re not about to listen to them; those two were sometimes worse than you after all.
And that’s how, ninety minutes later, you went back to your room after a somewhat excruciating–but delicious–dinner. As she came from a family that put a premium on academic achievement, Alex was the most sympathetic to your wanting to spend the rest of the night studying, though she was quick to tell you to not “study until you pass out” again. Slipping on a stolen hoodie (probably Christopher’s judging by how it wasn’t too baggy on you), you put on your studying playlist and get lost in your textbooks, a feat more difficult than it would seem.
The hours pass in a blur of flash cards, ink smudges, notes scrawled messily in the margins of a page, and several breaks for you to pop the knuckles of your hand when it feels like it’s about to cramp up from writing so much. By the time you finish, it’s already nearing eleven in the evening, and judging by the lack of noise from beyond your door, the others were already asleep or out. (E/c) eyes glance over the mess on your desk, papers and books and pens strewn around your laptop. You then glance over to the vanity-turned-extra-desk-space in front of your bed, brows furrowing at the mess. Not really the most ideal set-up, especially when everything you needed had to be within arm’s reach, but you could fix it later on. Or once your tests are over, something that seems more likely than the former.
Stretching your limbs, you let out a yawn before your eyes fall upon your phone, a notification light blinking to alert you of, well, unseen notifications. Placing your thumb over the home button for it to acknowledge your fingerprint, you rub your eyes with the other hand as your phone unlocks to show everything you’ve missed.

And finally, a group selfie from Richard, with all of them looking like kicked puppies. You have no idea who came up with the caption, but you were sure the dorks were trying to guilt you into studying and looking after your health. As much as you wanted to deny it, the fact that they all cared enough to spam your phone with messages telling you to take care of yourself warmed your heart. Needless to say, that picture gets saved to your gallery, where you’ll keep it to look at every time you needed a reminder to look after yourself it’ll stagnate and probably end up buried under the copious amount of memes and videos you save from your chats with the guys.
Noticing that your phone’s about to die–you both love and hate them for spamming it, because that meant your battery got drained quicker than it normally did–, you snag one of the many phone chargers on your bedside table, plugging it into the socket behind your table lamp and leaving it there. Next, you stretch some more before you pad over to your bathroom, fully intent on taking a shower before falling asleep. Hey, you might even get the chance to try out that new body wash you and Joel got from Lush the last time you hung out with him.
You step out of the bathroom twenty minutes later, shea butter-scented steam wafting into your room. Mental note to self, (Y/N): thank Joelito next time you see him, because shea butter smells so good. Plus it felt great on your skin, a bonus that usually came with the skincare products you bought. Yes, where most people bought skincare stuff for the sake of making their skin better, you buy the stuff because it smells good. After you wring out the excess water with a towel, you plonk down on the stool in front of the bathroom counter, a hairbrush in one hand and the hair dryer in another. Five minutes is all it takes for your hair to be just a little damp, and you set the dryer down to brush your hair until it’s no longer wet. Once that’s done, you brush your teeth and rush through the five step skin regime that Iana and Joel set up for you. Yeesh.
By the time your head hits the pillow, you don’t bother with anything aside from getting the blanket over your head as sleep claims you. Too bad you’re not getting the uninterrupted eight hours of sleep you wanted.

but you figured that Chris wouldn’t call you at fuck knows what time in the morning if there wasn’t a reason
so you pick up, pulling the micro-USB connector from your phone’s charging port before pressing it into your ear, half your face smooshed into your pillow

now normally the hyper ball known as Christopher Velez wouldn’t annoy you by simply saying one word, but
 you were tired
so you grunt before speaking. 
“Hola, Chris.”
bear in mind you were rudely awakened by his ringtone playing, so you’re not in the best mood rn
but he deadass doesn’t pick up on it
so he’s babbling on and on, switching between Spanish and English way too quickly for your still-sleepy mind to comprehend
just as you’re about to yawn, he stops mid-sentence
“(Y/N)? Cuál es tu color favorito?”
you actually yawn while he’s asking, and it takes a second or so for you to realize he asked for your favorite color
“Uhh (f/c),” you say, yawning right after.
he doesn’t say much to you after, and you’re about to let the background noise from his end lull you to sleep

just as you close your eyes, he makes this triumphant little noise that wakes you up again
and really, you don’t want to rain on his parade (even if he’s keeping you from your precious sleep), so you pull the phone away to let a tiny groan out

once you press the phone back to your ear, you barely just get the tail end of what he was saying
and really, you missed the guys (and Chris’ crazy laugh, but shh), but you needed sleep
so you yawn again before interrupting him

by this point you’re cranky and mildly insulted, so you plug your phone back in to charge before you go back to sleep

basically your mood was like Joel’s every time he was on Twitter
the bad mood followed you all the way through your test, and it was pretty obvious from how tightly you were holding onto your pen
after school, though, you call him again and hope he doesn’t hang up on you

oof this was not something you were prepared for
“The hell are you talking about? You’re a better dad than most are, man.”
as it turns out, he misses Aaliyah and worries that he’s not doing the best he can as a father
and you’re like “???” because the fact that he and Yocelyn are co-parenting means that he’s doing his best
especially given that he’s away on tours and doing promo stuff a lot
and he’s slowly spiraling into this really dark space and you! refuse! to! let! it! happen!
“Dude, listen to me. Yes you’re not around as much as you want to, and yes you may miss some parts of her life, but look at it this way: you’re making an effort to be part of her life, and that’s way more than I can say for most of the guys who accidentally knock up their girlfriend. So chill, okay?”

he laughed at that, but then apologized, so you’re not annoyed at him anymore

you yawn as you accept the call, laying on your side so you don’t have to hold the phone to your ear

you didn’t expect to hear loud ass bass and what was probably a party on the other end
but you did
and now you’re trying to keep yourself from cussing at him. you two weren’t that close yet, and no way were you going to risk offending someone because they called you at lord knows what time in the morning.
so you take a page out of his book and take several breaths to calm yourself before repeating the question
“Cometí un error,” he groans, and you’re so tempted to just yeet your phone away because fucking hell, he’s drunk! or somewhat intoxicated.
either way, you are not in the right state of mind to speak to a drunk person
“¿QuĂ© hiciste?“ It’s a struggle to not let the annoyance in your voice show, but you barely even manage to hide it. Thankfully, he’s too drunk to notice.
“I screwed up, (Y/N).” The way he says it is almost too pathetic and you sigh.
“Si, you said that. What happened?” There’s mumbling on his end and all you could make out is a name: Gwen. it takes a while before you piece it together, and you facepalm once the puzzle pieces slot together.

his ex that, according to rumors, he cheated on
and then, for some reason, he figured you were the best person to talk to? okay, not the best person, but one of the first people he should call. 
you were not equipped for this. nuh-uh.
“Zabdi, that was a whole year ago. Hell, maybe even more.” Really, you wanted to ask why the fuck he was thinking about this now

“I really liked her,” he continues slurring into the phone, and you muffle a groan with your hand. did befriending an entire boyband mean that you had to listen to them talk about their exes even if it’s been a year? even if they were probably the cause behind the breakup in the first place?
can you resign from being their friend now? (you say this despite knowing you wouldn’t go through with it. you love the dorks too much)
“Zab, you can’t do anything about it now.” You’re trying to be a nice and comforting voice of reason, you really are, but damn it the bass is too loud and you still have a test later in the day
you don’t know what’s happening on his end, but you think you hear something that sounds suspiciously like a sob
cue another eye roll
“EscĂșchame, Zabdiel. It’s in the past, si? Nothing you can do about it other than learn from your mistake and no lo hagas de nuevo. Lo tengo?”
there’s a bit of scuffling on the other end, and your brows furrow. the hell was happening?
you get an answer when Clara’s voice comes through, and you blink. huh, guess they were bringing him back to the hotel. or his room, who knows.
“Lo siento (Y/N), the rest of the guys thought he went off with a girl,” she explains, and you muffle a yawn.
“It’s okay, Clara. Just–”yawn, “Make sure he doesn’t puke or something. G’night.”
you hang up before she does, plugging your phone back in before you finally conk out again
during dinner that evening, you ask the girls how to deal with a friend who’s an emotional drunk, just so you’re prepared for the next time he calls you when intoxicated.
after that, you send him a few feel-good texts. mostly stuff that siblings would send each other, so you’re really living up to the familial nature your friendship has begun to take on
Joel Pimentel:
just so we’re clear, the only reason you call Joel more than any of the other guys is because he rarely checks his messages, groupchats or otherwise
that said, you’re surprised when, instead of the first of your alarms, The A Team plays from your phone
it’s weird that he’s the one calling you and not the other way around, but you shrug it off
at least he’s calling around the time of your first alarm
“What,” you deadpan into the phone
“When the fuck were you going to tell me you were at the Infinity War premiere.”
whatever it is you were expecting to hear, this ain’t it folks

and cue a cranky Joelito ranting about you getting to be there and not telling him so he could’ve tried to get tickets 
to which you needed to cut him off
“Bitch, my parents got tickets. Besides, my godfather invited us.”
“Who’s your godfather?”
and cue the silence
“I’m not allowed to say.”

it goes from this to you deflecting the topic until you decide to bring up your test.
he knows you’re trying to change the topic, but he’s going along with it. he’s been there before.
you start spewing out random facts, both to keep his mind from going back to anything Marvel-related and so you can see how much you remembered from last night’s study session
for the most part, it works.
Joel’s listening to you talk about facts, and every now and then he’d interject with a question, to which you quickly launch into an explanation that spawns even more questions from him
and so you two talk through the next two alarms you set, with you explaining concepts that would probably (hopefully please please please) show up on the test later
“You think I’m going to pass?”
“Hey, if I understood that because you managed to explain it to me, I’m pretty sure you have nothing to worry about.”
“Yeah, unless it doesn’t show up on the test.”
“

you two hang up around the same time, and you’re in a considerably good mood considering he called you to ask how you managed to be at the Infinity War premiere
also it’s shocking how you two didn’t sass each other much during it
come to think of it, what time was it there when he called?
meh, you’ll figure out later. right now, you have to get ready for school, and that uniform tie isn’t going to tie itself.

ANYWAY, you get to school and shit, breeze through most of your classes until last period

test time
you’re shaking with nerves bc the teacher for this one is notorious for giving college-level tests to his AP classes
and even if he’s been your teacher for the past three years, you’re still terrified of failing any of his tests
but one look at the questions had you breathing a sigh of relief.
those were the things you explained to Joelito! you were going to pass!
ngl, you nyoom through the multiple choice questions and double check your math for the ones that need calculations
once school lets out for the day, you find a nice, secluded area near the botanical garden (again, private school feels) so you could call Joel and tell him you’ve got a good chance of passing the test
but when he picks up he sounds groggy af
oh, how the tables have turned
but you’re sympathetic bc he needs to look pretty; his face is one of his main selling points after all
“Hi, sorry I woke you, but I think I’m definitely gonna pass. Thanks for a while ago, bye, love you dude! Get some more sleep!”
how you managed to say that in one breath, no one has any idea.
meanwhile Joel’s just staring at his phone in confusion before realizing you thanked him for helping you recall what you studied
you two didn’t acknowledge the “love you” that got dropped in that quick, minute-long call and you never will
later that night, he calls you again because he saw another picture of you at a Marvel premiere
and this time, you two sass each other until you fall asleep

it’s back to your regular, sassy program with (Y/N) and Joel. except for when tests come along, especially midterms and finals.

after a bit of shifting around in your bed so you can comfortably nestle in your blankets, you finally drift off to sleep, dreaming of getting an Academy Award in the future
as you were about to accept said award, the dream gets shattered when the fucking Guachineo begins to play
along with the shattering of that dream (because damn it, it’s been a near constant goal since you were a kid) comes a rude awakening not even thirty minutes after you fell asleep
as much as you loved Erick (PLATONICALLY), you were going to throttle him, pretty eyes or not
at least, that was the plan until you hear his voice
who knew someone could sound so shaken up over the phone?
okay that was rude and insensitive af but you weren’t expecting this
he literally sounded like he was about to cry, and damn it, this was the baby! this was little bebito Erick on the phone sounding like he’s about to cry and you’re not going to hang up on him.
to be fair, you wouldn’t hang up on any of your friends, but least of all Erick.
so in the sleepy voice you swore never to let anyone but the rest of your squad hear, you yawn out a “Que pasa?”
he’s practically sniffling, and even if he doesn’t quite want you to hear him cry, you’re one of the first people he thought to call, especially since the guys were out at the club 
“Extraño a mi familia,” he admits, voice shaking and you just want to wrap the guy in a blanket and cuddle him.
sure you don’t really get homesick much since you don’t live far from your parents, but it’s a wholly different thing for Erick
for one thing, he has a tight bond with his family. for another, he was what, 14 or 15 when CNCO was formed. it was probably the first time he was away from them for a long period of time, and sometimes, it didn’t get easier to bear with the passage of time
“No llora, bebito.” You’re trying to comfort him and all but you’re not exactly the best person to go to when you need emotional support. Hell, you can barely support yourself emotionally.
which brings you to the question: why me
and why when you had a quiz the next day
but this was Erick. not only was he your fellow group baby, but he was little bebito as well
you’re not about to let him be upset like this, not when you could do something about it
one problem though: you have no idea what to do about it. nice.
thankfully, he keeps talking.
as it turns out, it’s not just homesickness he’s dealing with
it’s also the pressure he puts on himself to be as good as the rest of the guys are

you kind of stick to a soft voice the whole time you two talk
and when you feel a yawn coming on, you muffle it with your hand bc you don’t want him to feel bad
it takes a while before you ask how he’s feeling
but when he says that he’s feeling better, you immediately feel relieved
not just bc this meant you’ll be able to sleep soon, but bc it meant he wasn’t as upset anymore
a crying and upset friend always made your heart sad, but a crying and upset Erick? you were half-tempted to book a flight to wherever they were and give him a hug, exam be damned

so you go back to sleep, then wake up when your alarms go off
the school day passes by in a blur, but you’re hurrying to go home bc you wanted to check in on him via FaceTime
so you do, but he doesn’t pick up
instead you just leave him a message in his voicemail
hopefully he listens to it bc as his fellow group baby, he needed to know that you were gonna be there for him when he can’t share stuff with the other guys
literally though, he’s the only one to always bring out your soft side.
but at least you love the dork.

Pierce Bainbridge, Hecht Partners & Virage Capital: What is Going On?
The news coming from Pierce Bainbridge Beck Price & Hecht is like a real-life version of an over the top John Grisham novel. Adding to the never-ending drama are issues surrounding former name-partner David Hecht allegedly “leaving” Pierce Bainbridge to start Hecht Partners. As it turns out, Hecht Partners is comprised almost exclusively of former Pierce Bainbridge lawyers and personnel and appears to be funded by Virage Capital, the same Virage Capital in the hole for $65 million with Pierce Bainbridge.  Recent revelations raise serious questions about Hecht’s new enterprise and its ongoing relationship with his “former” firm. 
We know that (i) the Pierce Bainbridge debt is reportedly around $70 million ($65 million of which is owed to Virage Capital), (ii) Pierce Bainbridge and firm founder John Pierce took out a $2.5 million loan in February which appears to call for daily remittances, yet more than three months later not a single dollar has been paid; Pierce recently entered a Confession of Judgment for almost $4 million, (iii) Hecht appears on signature blocks for both Pierce Bainbridge and Hecht Partners in federal court filings, and (iv) a UCC filing suggests that Virage Capital may now be providing funding to Hecht Partners.  
Hecht’s activities since he claimed to have “resigned” from Pierce Bainbridge have been, at best, odd.  He removed the firm from his LinkedIn profile, the Hecht Partners website makes no mention of Pierce Bainbridge, yet Hecht appeared on a recent federal court filing on behalf of Pierce Bainbridge.  The case is a high profile one involving a putative class action against Southwest Airlines & Boeing.  
The Southwest & Boeing signature block is below, juxtaposed with a signature block a week earlier in a case where Hecht Partners represents Corellium, LLC in a dispute with Apple (the United States Attorney’s Office and Department of Justice have also appeared in that matter).  Hecht Partners’ co-counsel for Corellium is Cole, Scott & Kissane, P.A. Hecht’s name is in the title at both firms.  
Muddying the waters further, Hecht Partners lists eight lawyers on their website, seven of them ex-Pierce Bainbridge, including five former partners: David Hecht, Janine Cohen, Maxim Price, Conor McDonough, and Kathryn Lee Boyd. David’s wife Kinza Hecht, who also worked at Pierce Bainbridge, serves in an of counsel position for her husband’s firm.  
Hecht has been harshly criticized through the years and such criticism has come from several sources: a federal judge, his own ex-PB partners and a seasoned Los Angeles attorney.  It seems surprising that attorneys from his former embattled firm would join Hecht as the leader of a new one.  For example:
Ex-Pierce Bainbridge partner Christopher N. LaVigne, whose LinkedIn indicates he now practices at Withers Bergman, wrote:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than him.”
Federal judge Alvin K. Hellerstein found Hecht to have violated Rule of Professional Conduct 8.4 on attorney deceit; Hecht apparently was involved in secretly audio recording an adversary at a social event.
Hecht then publicly boasted about the Hellerstein opinion because Pierce Bainbridge was not disqualified; and stated the firm was like “grand masters in chess” while disparaging the Jones Day law firm.  A senior Los Angeles senior attorney commented that Hecht’s post was “childish and unprofessional” and continued “schoolyard stuff like this is why no one wants to be a lawyer. Grow up.” 
Another ex-Pierce Bainbridge partner provided written commentary on Hecht’s obedience to Pierce Bainbridge founder John Pierce stating:  “[A]t a certain point you have to put self-respect above all else if you are a real person. You’re either compromising yourself or you’re just plain dumb.” The comment was also directed at ex-Pierce Bainbridge General Counsel Carolynn K. Beck, who now practices at Goldstein & McClintock.
Hecht spearheaded a number of “dance move” cases in early 2019, in a May 1, 2019 article on Techdirt.com, Tim Cushing concluded:  “Despite its 100% failure rate in Fortnite lawsuits, Pierce Bainbridge is still finding plaintiffs willing to ensure its partners keep collecting paychecks. And isn’t that the greatest victory of all?”
If all that was not enough, an ex-Pierce Bainbridge associate recently accused Hecht of lying to a federal court, while also accusing a new outside attorney for Pierce Bainbridge, Ed Altabet of Cohen Seglias, of engaging in “intimidation” tactics to keep the associate from coming forward.  The issues are covered in more detail in “Gangland Lawyering? As for Virage Capital, after reportedly sinking around $30 million into Pierce Bainbridge in April 2019, it ponied up again in November 2019 this time squandering more than $30 million.  In April 2020, Law360 reported, based on conversations with Pierce Bainbridge insiders, and reviewing communications involving ex-PB partner Douglas Curran, now at BraunHagey & Borden,  that Pierce Bainbridge is in the hole to Virage for an estimated whopping $65 million.
If indeed Virage is the Hecht Partners benefactor, it seems a matter of: “Fool me once, shame on you.  Fool me twice shame on me.  Fool me a third time
” 
Filings and hearings are scheduled for the Southwest & Boeing matter, and there is still the issue of the $70 million Pierce Bainbridge debt and 7 lawsuits against the firm.  It is remarkably interesting times for Hecht Partners, Pierce Bainbridge, and Virage Capital.  We shall see what the future holds.

Coucou tout le monde, on se retrouve aujourd’hui pour mon BILAN ANNUEL !
  Je vous propose donc ce Bilan afin de revenir sur tout ce qui s’est passĂ© en 2019.
En dĂ©but d’annĂ©e 2019, j’étais au plus mal dans le cadre de ma formation en soins infirmiers. J’ai baissĂ© les bras Ă  plusieurs reprises Ă  cause d’un stage qui s’était mal passĂ© quelques semaines plus tĂŽt. J’ai commencer Ă  aller mieux fin fĂ©vrier lorsque mon second stage est arrivĂ©. Mais plus le temps passait, moins je me sentais Ă  ma place dans cette formation. C’est un trĂšs beau mĂ©tier, je ne dis pas le contraire, mais c’est Ă©galement un mĂ©tier trĂšs dur et je ne peux pas voir des personnes malades, mourantes ou dans une dĂ©tresse absolue. C’est la partie la plus dure du mĂ©tier et celle que je ne peux assumer.
Du coup j’ai interrompue ma formation fin mai et j’ai dĂ©cidĂ© de concrĂ©tiser mon rĂȘve n°1 : partir vivre en Ecosse. Je suis donc partie une semaine Ă  Glasgow et Edinburgh, du 27 mai au 3 juin. Le voyage Ă©tait vraiment un rĂȘve, cette semaine lĂ  bas est passĂ©e tellement vite mais malheureusement elle n’a rien donnĂ© et j’ai du Ă©laborer un plan B.
Au mois d’aoĂ»t j’ai dĂ©couvert la Sicile, en Italie que vous pouvez retrouvĂ© dans des articles spĂ©cial voyage rĂ©capitulĂ© en bas de cet article. Ce voyage Ă©tait une merveilleuse expĂ©rience et m’a permis de dĂ©couvrir l’Italie du sud qui, bien que trĂšs pauvre, est trĂšs belle et intĂ©ressante. 
En septembre j’ai lancĂ© ma boutique Mathilde Made. Je pensais la lancer comme activitĂ© secondaire mais je me suis rapidement dĂ©couvert une vĂ©ritable passion pour la couture et depuis je n’arrĂȘte pas. Les booksleeves ont rapidement Ă©voluĂ©es et les collections se sont rapidement Ă©largies.
J’ai Ă©galement reçu la super nouvelle fin octobre que j’étais blogeuse partenaire de Page Turners qui regroupe les editions Milan et Bayard pour l’annĂ©e 2020! J’ai lu tellement de roman des editions Milan et j’ai toujours adorïżœïżœ ce que j’ai lu. J’ai tellement hĂąte de dĂ©couvrir les romans Ă  paraĂźtre! 
Cette annĂ©e mon objectif Ă©tait de lire 100 livres et j’y suis arrivĂ©e mais Ă©tant un peu en retard sur mes lectures en fin d’annĂ©e je me suis mis un petit coup de pression et j’ai du coup moins apprĂ©ciĂ© mes lectures. J’ai donc dĂ©cidĂ© de rĂ©duire mon objectif Ă  5 livres par mois quitte Ă  en lire plus car ayant l’objectif de reprendre mes Ă©tudes j’aurais beaucoup moins de temps que cette annĂ©e. 
Mes Bonnes résolutions pour 2020 :
Lire 60 livres dans l’annĂ©e. Mon objectif est plus lĂ©ger que celui de cette annĂ©e mais ça va me permettre d’ĂȘtre plus attentives Ă  mes lectures. 
Vider ma PAL qui s’est encore allongĂ©e avec NoĂ«l. Je vais Ă©crire tous les noms des romans et les mettre dans un bocal et en panne d’inspiration je piocherai au hasard un titre de roman pour ne pas les laisser traĂźner dans ma PAL. 
Lire au moins 1 roman en vo anglais par mois pour reprendre le coup.

Gangland Lawyering? Featuring Pierce Bainbridge & Hecht Partners
Rudy Giuliani tied himself to Pierce Bainbridge Beck Price & Hecht LLP with a tweet announcing the firm would represent him for the Ukraine fiasco. The man formerly known as “America’s Mayor” made his chops taking on “The Five Families,” a New York City Organized Crime syndicate. The revelations coming out of Pierce Bainbridge have many opining that Pierce Bainbridge operations are more akin to a criminal enterprise than a reputable law firm. A bombshell accusation from an ex-firm associate has increased the already searing spotlight on the firm, as well as its current and former partners.  The accusations – which sound like something that could be found in Rudy’s bag of tricks – include alleged fraud on a federal court and related intimidation tactics.
 “Intimidation” & “Fraud on the Court” Accusations
A new outside lawyer for Pierce Bainbridge, Ed Altabet of Cohen Seglias, has been accused of attempting to “intimidate” the ex-associate from coming forward with accusations that ex-Pierce Bainbridge named-partner David L. Hecht (Hecht Partners) intentionally defrauded a federal court.  The issue arose in connection with a putative class action against Boeing and Southwest Airlines.  The story is covered by LawFuel.com here.
Hecht has been so loyal to Pierce, his ex-partner Christopher N. LaVigne (Withers Bergman) said “David would toss dogs off of cliffs,” if Pierce said it was a good strategy.  To be fair, LaVigne clearly has a low opinion of Hecht, LaVigne has also opined in writing:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than David.”  Similarly, Mike Masnick of Techdirt.com, referred to a complaint Hecht filed on behalf of Tulsi Gabbard as “laughable” and said Hecht should be “embarrassed.”
Notwithstanding these views, Hecht recently started his “own firm,” Hecht Partners LLP.  Oddly, seven (7) of the eight (8) lawyers are from Pierce Bainbridge, certain administrative personnel from Pierce Bainbridge have reportedly joined, and Hecht puzzlingly said in open court that while he is no longer a partner at Pierce Bainbridge, he still works with the firm.
This, as well as related events such as the Boeing Southwest fiasco, the reported $65,000,000 Pierce Bainbridge debt to litigation funder Virage Capital Management, and the at least six lawsuits currently facing Hecht’s former firm, has led to suggestions that the two firms, and perhaps a third-party, are involved in Gangland-like shell-game shenanigans.
The Bombshell Filing does nothing to help the image of the newly established Hecht Partners.  It has Gangland tactics written all over it.  The former associate took direct aim at Altabet and Hecht.
Altabet replaced long-time Giuliani ally, and a lawyer intricately connected to Donald Trump, Mark Mukasey. Even for Mukasey, the Pierce Bainbridge environment appears to have been unacceptable; he withdrew citing ethics concerns.  In came Altabet, and the unethical conduct did not skip a beat.
In a filing in the United States District Court for the Eastern District of Texas in front of the Honorable Judge Amos L. Mazzant, the ex-associate said:
“After reviewing the transcript from the May 13th hearing in this matter, I have confirmed what I believe are numerous statements of material fact by David Hecht which are inaccurate, and may have been made to intentionally mislead counsel and the Court.”
“[I]n light of an email I received from Pierce Bainbridge’s outside counsel, Ed Altabet, today, in which he made several baseless accusations against me in what appeared to be an effort to intimidate me and hamper my efforts to correct the record, I request an In-Camera ex parte hearing before the Court.”
The John Pierce, Keyboard-Fueled Gangland Tactics
Pierce’s bombast proclamations of global domination, and overwhelming lack of candor, have rendered the Harvard Law School graduate a laughingstock in many legal circles.
Pierce is still, however, commonly seen as the straw stirring Hecht’s actions, as well as the driving force behind the intimidation tactics.  Pierce, who claims to have been a tank platoon leader in the United States Army, takes his faux machismo passionately; for example, a report by Meghan Tribe in Law.Com, quotes Pierce:
“We are building an army of killers on a highly collaborative platform. In addition, we have a culture obsessed with winning and bringing maximum value to clients.” – John Pierce, January 3, 2019
Pierce subsequently attacked Tribe on LinkedIn in a falsehood-ridden post with his disciples lending support.  Former Pierce Bainbridge partners Michael Pomerantz, Thomas Warren (Warren Terzian), Johanthan Kortmansky (BraunHagey & Borden) and, you guessed it, David Hecht endorsed Pierce’s nonsense.
Indeed, the Pierce modus operandi seems to be to threaten by e-mail.
For example, Pierce threatened a former client by email, the client reported Pierce to the California State Bar and included an opinion that Pierce is a “menace to the legal society.”
Pierce threatened a lending company named Newtek by email in September 2018; in early October 2018, Newtek denied Pierce’s request for a $ 1 million SBA loan secured by a client’s $ 6 million home;  the denial was related to Pierce’s obligations to the Internal Revenue Service (IRS) as well as California state tax authorities.  (Public records show Pierce has around $1.5 million in tax liens, e-mails show he owes $21,000 month alimony, and Pierce claims to be the sole guarantor of a $65,000,000 Pierce Bainbridge debt to Virage Capital Management.)
To complete the trifecta, Pierce also threatened former partner and whistle blowing Don Lewis by email.  Lewis’s ex-partners, all who have been sued by him, were on the email. Lewis says, “despite their fiduciary duties of care, they all did nothing.”  (Denver G. Edwards pictured, joined after Lewis, but has been accused, along with Christopher N. LaVigne (Withers Bergman) of “lying under oath” to smear Lewis.)
The group are experienced attorneys who now practice at Armstrong Teasedale, Braunhagey & Borden, Withers Bergman, Hecht Partners, among other firms.  Their prior experience is at reputable law firms such as BakerHostetler, Baker & McKenzie, Browne George & Ross, Brown Rudnick, Covington & Burling, Davis Polk, Fish & Richardson, Gibson Dunn, Glaser Weil, Grais & Ellsworth, Grant & Eisenhofer, Kasowitz Benson, Kirkland & Ellis, Kaye Scholer, Kobre Kim, Margolis & Tinsman, McKool Smith, Murphy & King, Murchison & Cumming, Reid Collins & Tsai, Steptoe & Johnson, Sullivan & Worcester, Quinn Emanuel; White & Case, Wachtell Missry, Wilson Sonsini, and White & Case.
Next Stop Jail?

The Mysterious Richard Silverstein of Loan Annex
An individual who may have some answers, but to date has largely stayed out of the fray, is Richard Silverstein the Founder of Loan Annex.
Silverstein is pictured above with promotional material from his LinkedIn page.  The Loan Annex founder filed a sworn affidavit in federal bankruptcy court at the end of last year stating:  “Throughout 2019, I was engaged by Pierce Bainbridge as their consultant for the purpose of arranging financing for the firm.” 2019 is when both tranches of the $65 million Virage deal were struck.
Interestingly, Silverstein’s affidavit was filed to support the claims of a lender named Counsel Financial; Pierce Bainbridge was allegedly in discussions with Counsel Financial about financing in March 2019.  In line with the Gangland theme, the underlying debtor claimed in an affidavit:  “A colleague of mine derided these tactics as ‘Mafia-style’ intimidation, but even the Mafia had a code about attacking family members.”  The tactics had to do with alleged e-mail threats from a lawyer for Counsel Financial.
More Questions:  What’s Going on with Talon LF, LLC
Recently leaked solicitation materials for potential investors in a litigation fund intricately intertwined with Pierce Bainbridge may also shed light; the name of the fund is Talon LF, LLC.
Two ex-Pierce Bainbridge partners, Doug Curran (BraunHagey & Borden) and Thomas D. Warren (Warren Terzian), as well as Pierce are listed as closely affiliated.
The Talon investor solicitation materials appear to have several issues, but there are two glaringly puzzling representations.
“Vertically integrated with PB w/ a success rate on contingency cases of 97%”. (From cover e-mail accompanying the materials)
A chart which represents a positive investment rate of return (“IRR”) for litigation funder Pravati Capital, which apparently failing to indicate that Pravati declared a $9,157,072.95 default.
Are these representations true?  Are they materially misleading? Are they fraudulent?
Issues surrounding the clearing of the Pravati default raise more Gangland type flags.  A former firm client, Gustavo Escamilla, President of Greenway Nutrients, says he “has strong reason to believe that Mr. Piece and his firm Pierce Bainbridge accepted bribes ”from individuals with “criminal backgrounds” and  “used this bribe money to pay down some, or all, of an over $9.1 million [Pravati] default.”
Escamilla has also developed a compelling timeline, which suggest his claims may be valid.
The General Counsel & Blind Eye:  Carolynn K. Beck
On the issue of Pravati, ex-firm General Counsel, Carolynn K. Beck, now a partner at Goldstein & McClintock, was intricately connected to Pravati.  She is alleged to have misrepresented, with Pierce, a case value to Pravati by well over $900,000,000.00, and documents appear to support the same.  In addition, a Philly lawyer has sued Beck individually, the other named partners and Pierce Bainbridge claiming the case value presented to Pravati was wildly overinflated. The Philly lawyer worked the same case for 16 months before Pierce Bainbridge took over.
Beck joined her new firm with Craig Bolton; the duo reportedly worked very closely together at Pierce Bainbridge. Bolton was apparently involved in litigation funding efforts, including the alleged discussions with Counsel Financial in March.
A cavalcade of severe misconduct happened under Beck’s watch:  lies under oath, violations of ethical rules, deletion of evidence, misogyny from the top, potential double-pledging of firm collateral, Pierce siphoning funds from firm accounts, the list goes on.
Beck as General Counsel for the firm, appears, at best, to have done nothing to stop it.  A type of Gangland consigliere who seems to have made an internal oath to never get in the way.
As an example, written communications indicate Beck was aware of Pierce using firm accounts as a personal piggy bank back in October 2018.  A text that Lewis received from the firm’s bookkeeper, just days before being banished, strongly suggests the Goldstein & McClintock partner was in the know.
Subsequent to this October 2018 message, the Firm, under Beck’s watch, would go on to rack up a $65 million debt from April 2019 – April 2020, find itself a defendant in three cash advance lawsuits (where upfront cash was provided in exchange for alleged firm receivables) and see a mass exodus of attorneys starting in October 2019.  Beck’s apparent willful turn of a blind eye is not consistent with the role of a General Counsel.
Camille Varlack, Kevin Cash & The Future
Beck left the firm around a month ago; a Law360 article said Chief Operating Officer and Deputy General Counsel Camille Varlack and Chief Financial Officer Kevin Cash were running Pierce Bainbridge while Pierce was on a forced leave of absence. Both Varlack and Cash are not part of the original Pierce Bainbridge inner circle; but their role in leadership positions, with apparent visibility into the firm’s finances is noteworthy.
With a firm boasting so many red flags, the possibility of a wide-ranging Pierce Bainbridge bloodbath seems more likely by the day. Cash and Varlack may be subjected to some hard questions about what they knew, when they knew it and what they did about it.
Giuliani, some would say, has learned from the mobsters he used to prosecute and has pulled off Gangland tactics for years, while remaining relatively unscathed.  It remains to be seen if this brat pack of attorneys Rudy hired have what it takes to keep ahead of the tsunami of severe issues that are closing in on them.

Gangland Lawyering? Featuring Pierce Bainbridge & Hecht Partners
Rudy Giuliani tied himself to Pierce Bainbridge Beck Price & Hecht LLP with a tweet announcing the firm would represent him for the Ukraine fiasco. The man formerly known as “America’s Mayor” made his chops taking on “The Five Families,” a New York City Organized Crime syndicate. The revelations coming out of Pierce Bainbridge have many opining that Pierce Bainbridge operations are more akin to a criminal enterprise than a reputable law firm. A bombshell accusation from an ex-firm associate has increased the already searing spotlight on the firm, as well as its current and former partners.  The accusations – which sound like something that could be found in Rudy’s bag of tricks – include alleged fraud on a federal court and related intimidation tactics.
 “Intimidation” & “Fraud on the Court” Accusations
A new outside lawyer for Pierce Bainbridge, Ed Altabet of Cohen Seglias, has been accused of attempting to “intimidate” the ex-associate from coming forward with accusations that ex-Pierce Bainbridge named-partner David L. Hecht (Hecht Partners) intentionally defrauded a federal court.  The issue arose in connection with a putative class action against Boeing and Southwest Airlines.  The story is covered by LawFuel.com here.
Hecht has been so loyal to Pierce, his ex-partner Christopher N. LaVigne (Withers Bergman) said “David would toss dogs off of cliffs,” if Pierce said it was a good strategy.  To be fair, LaVigne clearly has a low opinion of Hecht, LaVigne has also opined in writing:  “David is an embarrassment to lawyers everywhere.  Some of the worst lawyers I know are better than David.”  Similarly, Mike Masnick of Techdirt.com, referred to a complaint Hecht filed on behalf of Tulsi Gabbard as “laughable” and said Hecht should be “embarrassed.”
Notwithstanding these views, Hecht recently started his “own firm,” Hecht Partners LLP.  Oddly, seven (7) of the eight (8) lawyers are from Pierce Bainbridge, certain administrative personnel from Pierce Bainbridge have reportedly joined, and Hecht puzzlingly said in open court that while he is no longer a partner at Pierce Bainbridge, he still works with the firm.
This, as well as related events such as the Boeing Southwest fiasco, the reported $65,000,000 Pierce Bainbridge debt to litigation funder Virage Capital Management, and the at least six lawsuits currently facing Hecht’s former firm, has led to suggestions that the two firms, and perhaps a third-party, are involved in Gangland-like shell-game shenanigans.
The Bombshell Filing does nothing to help the image of the newly established Hecht Partners.  It has Gangland tactics written all over it.  The former associate took direct aim at Altabet and Hecht.
Altabet replaced long-time Giuliani ally, and a lawyer intricately connected to Donald Trump, Mark Mukasey. Even for Mukasey, the Pierce Bainbridge environment appears to have been unacceptable; he withdrew citing ethics concerns.  In came Altabet, and the unethical conduct did not skip a beat.
In a filing in the United States District Court for the Eastern District of Texas in front of the Honorable Judge Amos L. Mazzant, the ex-associate said:
“After reviewing the transcript from the May 13th hearing in this matter, I have confirmed what I believe are numerous statements of material fact by David Hecht which are inaccurate, and may have been made to intentionally mislead counsel and the Court.”
“[I]n light of an email I received from Pierce Bainbridge’s outside counsel, Ed Altabet, today, in which he made several baseless accusations against me in what appeared to be an effort to intimidate me and hamper my efforts to correct the record, I request an In-Camera ex parte hearing before the Court.”
The John Pierce, Keyboard-Fueled Gangland Tactics
Pierce’s bombast proclamations of global domination, and overwhelming lack of candor, have rendered the Harvard Law School graduate a laughingstock in many legal circles.
Pierce is still, however, commonly seen as the straw stirring Hecht’s actions, as well as the driving force behind the intimidation tactics.  Pierce, who claims to have been a tank platoon leader in the United States Army, takes his faux machismo passionately; for example, a report by Meghan Tribe in Law.Com, quotes Pierce:
“We are building an army of killers on a highly collaborative platform. In addition, we have a culture obsessed with winning and bringing maximum value to clients.” – John Pierce, January 3, 2019
Pierce subsequently attacked Tribe on LinkedIn in a falsehood-ridden post with his disciples lending support.  Former Pierce Bainbridge partners Michael Pomerantz, Thomas Warren (Warren Terzian), Johanthan Kortmansky (BraunHagey & Borden) and, you guessed it, David Hecht endorsed Pierce’s nonsense.
Indeed, the Pierce modus operandi seems to be to threaten by e-mail.
For example, Pierce threatened a former client by email, the client reported Pierce to the California State Bar and included an opinion that Pierce is a “menace to the legal society.”
Pierce threatened a lending company named Newtek by email in September 2018; in early October 2018, Newtek denied Pierce’s request for a $ 1 million SBA loan secured by a client’s $ 6 million home;  the denial was related to Pierce’s obligations to the Internal Revenue Service (IRS) as well as California state tax authorities.  (Public records show Pierce has around $1.5 million in tax liens, e-mails show he owes $21,000 month alimony, and Pierce claims to be the sole guarantor of a $65,000,000 Pierce Bainbridge debt to Virage Capital Management.)
To complete the trifecta, Pierce also threatened former partner and whistle blowing Don Lewis by email.  Lewis’s ex-partners, all who have been sued by him, were on the email. Lewis says, “despite their fiduciary duties of care, they all did nothing.”  (Denver G. Edwards pictured, joined after Lewis, but has been accused, along with Christopher N. LaVigne (Withers Bergman) of “lying under oath” to smear Lewis.)

The Mysterious Richard Silverstein of Loan Annex
An individual who may have some answers, but to date has largely stayed out of the fray, is Richard Silverstein the Founder of Loan Annex.
Silverstein is pictured above with promotional material from his LinkedIn page.  The Loan Annex founder filed a sworn affidavit in federal bankruptcy court at the end of last year stating:  “Throughout 2019, I was engaged by Pierce Bainbridge as their consultant for the purpose of arranging financing for the firm.” 2019 is when both tranches of the $65 million Virage deal were struck.
Interestingly, Silverstein’s affidavit was filed to support the claims of a lender named Counsel Financial; Pierce Bainbridge was allegedly in discussions with Counsel Financial about financing in March 2019.  In line with the Gangland theme, the underlying debtor claimed in an affidavit:  “A colleague of mine derided these tactics as ‘Mafia-style’ intimidation, but even the Mafia had a code about attacking family members.”  The tactics had to do with alleged e-mail threats from a lawyer for Counsel Financial.
More Questions:  What’s Going on with Talon LF, LLC
Recently leaked solicitation materials for potential investors in a litigation fund intricately intertwined with Pierce Bainbridge may also shed light; the name of the fund is Talon LF, LLC.
Two ex-Pierce Bainbridge partners, Doug Curran (BraunHagey & Borden) and Thomas D. Warren (Warren Terzian), as well as Pierce are listed as closely affiliated.
The Talon investor solicitation materials appear to have several issues, but there are two glaringly puzzling representations.
“Vertically integrated with PB w/ a success rate on contingency cases of 97%”. (From cover e-mail accompanying the materials)
A chart which represents a positive investment rate of return (“IRR”) for litigation funder Pravati Capital, which apparently failing to indicate that Pravati declared a $9,157,072.95 default.
Are these representations true?  Are they materially misleading? Are they fraudulent?
Issues surrounding the clearing of the Pravati default raise more Gangland type flags.  A former firm client, Gustavo Escamilla, President of Greenway Nutrients, says he “has strong reason to believe that Mr. Piece and his firm Pierce Bainbridge accepted bribes ”from individuals with “criminal backgrounds” and  “used this bribe money to pay down some, or all, of an over $9.1 million [Pravati] default.”
Escamilla has also developed a compelling timeline, which suggest his claims may be valid.
The General Counsel & Blind Eye:  Carolynn K. Beck
On the issue of Pravati, ex-firm General Counsel, Carolynn K. Beck, now a partner at Goldstein & McClintock, was intricately connected to Pravati.  She is alleged to have misrepresented, with Pierce, a case value to Pravati by well over $900,000,000.00, and documents appear to support the same.  In addition, a Philly lawyer has sued Beck individually, the other named partners and Pierce Bainbridge claiming the case value presented to Pravati was wildly overinflated. The Philly lawyer worked the same case for 16 months before Pierce Bainbridge took over.
Beck joined her new firm with Craig Bolton; the duo reportedly worked very closely together at Pierce Bainbridge. Bolton was apparently involved in litigation funding efforts, including the alleged discussions with Counsel Financial in March.
A cavalcade of severe misconduct happened under Beck’s watch:  lies under oath, violations of ethical rules, deletion of evidence, misogyny from the top, potential double-pledging of firm collateral, Pierce siphoning funds from firm accounts, the list goes on.
Beck as General Counsel for the firm, appears, at best, to have done nothing to stop it.  A type of Gangland consigliere who seems to have made an internal oath to never get in the way.
As an example, written communications indicate Beck was aware of Pierce using firm accounts as a personal piggy bank back in October 2018.  A text that Lewis received from the firm’s bookkeeper, just days before being banished, strongly suggests the Goldstein & McClintock partner was in the know.
Subsequent to this October 2018 message, the Firm, under Beck’s watch, would go on to rack up a $65 million debt from April 2019 – April 2020, find itself a defendant in three cash advance lawsuits (where upfront cash was provided in exchange for alleged firm receivables) and see a mass exodus of attorneys starting in October 2019.  Beck’s apparent willful turn of a blind eye is not consistent with the role of a General Counsel.
Camille Varlack, Kevin Cash & The Future
Beck left the firm around a month ago; a Law360 article said Chief Operating Officer and Deputy General Counsel Camille Varlack and Chief Financial Officer Kevin Cash were running Pierce Bainbridge while Pierce was on a forced leave of absence. Both Varlack and Cash are not part of the original Pierce Bainbridge inner circle; but their role in leadership positions, with apparent visibility into the firm’s finances is noteworthy.
With a firm boasting so many red flags, the possibility of a wide-ranging Pierce Bainbridge bloodbath seems more likely by the day. Cash and Varlack may be subjected to some hard questions about what they knew, when they knew it and what they did about it.
Giuliani, some would say, has learned from the mobsters he used to prosecute and has pulled off Gangland tactics for years, while remaining relatively unscathed.  It remains to be seen if this brat pack of attorneys Rudy hired have what it takes to keep ahead of the tsunami of severe issues that are closing in on them.

The “Felonious & Controversial” Political Clients of the Embattled Pierce Bainbridge Law Firm
Pierce Bainbridge Beck Price & Hecht is an imploding law firm beset by allegations of corruption.  Adding to the distressing picture is the clientele the firm appears to have attracted.  The firm has only one trial ‘victory’ in over three years, scores of cases initiated thrown out before trial, and counts convicted felons (Michael Avenatti and George Papadopoulos) and a political lightning rod (Rudy Giuliani) in their eclectic group of high-end clients.
The seeming adverse consequences for a slew of entities who have been “touched by Pierce Bainbridge” has raised additional questions about the firm.  They include Littler Mendelson (sued), Putney Twombly (sued), Pravati Capital (sued), Virage Capital Management (estimated $65 million debt), West Coast Business Partners (cash advance lawsuit), Slate Advance LLC (cash advance lawsuit), Creative Capital Funding (cash advance lawsuit), as well as other law firms for ex-Pierce Bainbridge partners, such as, Armstrong Teasedale, Bathaee Dunne, BraunHagey & Borden and Goldstein & McClintock.
The cavalcade of recent revelations suggests an environment where ethics and honesty have taken a back seat; and continue to validate the long-standing allegations of ex-partner Don Lewis who blew the whistle on the firm’s financial shenanigans.

Lewis recently saw another accusation seemingly confirmed when firm founder John Mark Pierce announced a “rehab” stay in Law360.
Recent events cast a July 2019 letter Lewis sent to all Pierce Bainbridge partners and Putney Twombly Managing Partner Daniel Murphy, in a new light – it is an illuminating read; the recent events include:
Pierce’s public admission of reportedly “seeking treatment for substance abuse and other addictive behavior;”
The firm’s “estimated $65 million debt” – amassed in around one year – to litigation funder Virage Capital Management; and
Lawsuits from three cash advance lenders for failure to fulfill payment obligations related to around $1 million in upfront cash backed by alleged firm receivables.
The letter raises questions about Christopher N. LaVigne (Withers Bergman) and Denver G. Edwards who Lewis has said he later learned “lied under oath” in clandestine filed sealed affidavits.  It also touches on S. Jeanine Conley of Littler Mendelson engaged in deceit and Michael Yim of Putney Twombly ran an “sham investigation”.  Lewis accuses the group, and others, of engaging efforts to humiliate and defame him through the weaponization of #MeToo in order to deflect from severe financial and other issues at the firm.
The Featured Pierce Bainbridge Political Trio of Clients
Rudolph “Rudy” Giuliani.  Giuliani retained Pierce Bainbridge in connection with the Ukraine fiasco. The circumstances surrounding the engagement are unclear, a report in the New York Times suggests established firms rejected the former New York City Mayor; perhaps Rudy landed at Pierce Bainbridge because he and firm founder John Mark Pierce are, according to Pierce, “good friends.”
Pierce’s life appears immersed in turmoil; his reported issues include (i) named as an individual defendant in six lawsuits, (ii) $1.5 million in tax liens, (iii) $21,000/month alimony obligation, (iv) personal guarantee of the $65 million Virage debt; (v) forced leave of absence for securing a payday loan in the firm’s name and (vii) the recent trip to “rehab.”  Giuliani himself is no stranger to controversy and pushing the ethical envelope.
The Giuliani representation seems a microcosm for the apparent unstable Pierce Bainbridge operations; the timeline below is enlightening.
November 6, 2019 – Giuliani tweets that Pierce Bainbridge then-partners Eric Creizman and Melissa Madrigal are his legal representatives for the Ukraine fiasco, as well as Robert Costello of Davidoff Hutcher & Citron.
January 27, 2020 – Creizman and Madrigal announce they are leaving Pierce Bainbridge for Armstrong Teasedale. The duo departed after about 20 other lawyers had already left the firm. In the next two months, around 40 more attorneys would leave Pierce Bainbridge leaving only a handful.
February 2, 2020 – Pierce addresses the Creizman and Madrigal departures by stating: “I will personally be working on Rudy’s matters along with my partners, Tom Warren and Tom Frongillo, both of whom are nationally renowned white-collar lawyers.”
February 25, 2020 – Pierce reportedly secures a payday loan at a residential address in Queens, New York.
As a result of this, as reported in Law.com on March 10, “Pierce Bainbridge Leader John Pierce Is on Leave Amid Financing Questions.” (Tom Warren is named Acting Managing Partner in Pierce’s place.)
March 4, 2020 – Law.com reports that Tom Frongillo quit Pierce Bainbridge.
April 15, 2020 – Law 360 reports: “Pierce Bainbridge to Shut Down After Mass Resignations.”
April 16, 2020 â€“ïżœïżœLaw.com reports: “‘Total fake news,’ says Pierce Bainbridge’s founder about reports of the firm closing its doors.”
April 20, 2010 – Law.om reports that Acting Managing Partner Tom Warren quits to start his own firm, Warren Terzian. Warren’s co-founder is Dan Terzian who was promoted to partner at Pierce Bainbridge earlier this year.
April 23, 2020 – Law.com reports that Pierce was in a “treatment facility,” among a series of additional troubling issues at the firm.
The LawFuel.com coverage includes details gleaned from leaked investor solicitation materials, about a  litigation fundraising entity intricately connected to the firm, Talon LF, LLC.  Pierce, Warren, and ex-Pierce Bainbridge United States Managing Partner Douglas Curran (BraunHagey & Borden) are listed as affiliated Talon individuals. The Talon solicitation materials, and accompanying documents, appear to contain misleading representations about the Pierce Bainbridge litigation track record.
To recap:  Over a six-month period, five Pierce Bainbridge partners – Eric Creizman, Melissa Madrigal, Tom Frongillo, Tom Warren, and John Pierce – were tabbed to represent Giuliani.  Four quit, the other, Pierce, was placed on a force leave of absence for financial shenanigans and received treatment for substance abuse. A Law360 report also surfaces, which Pierce denies as “total fake news,” that the firm is headed for extinction.  One would imagine this is not what Giuliani had in mind; however, it is unclear if Rudy even knows or cares, as there appears to be no public reports of Pierce Bainbridge doing any meaningful legal or other work for Giuliani.
Bonus Point.  Rudy is a long-time colleague of Marc Mukasey of Mukasey, Frenchmen & Sklaroff LLP.  They were law firm partners for around ten years at Bracewell Giuliani and Greenberg Traurig.  Giuliani is widely referred to as “Trump’s personal lawyer,” Mukasey has been characterized by Yahoo as “the lawyer at the center of Trump’s universe;” Mukasey, however, has declared to Law.com that his shop is a “Trial Law Firm, Not a Republican Law Firm.” The Mukasey firm represented Pierce Bainbridge in the Lewis lawsuits for several months.  Mukasey recently withdrew from representing the firm and Lewis’s former partners citing ethical concerns.
Regardless of one’s political leanings, an individual associated closely with Team Trump withdrawing for “ethical” reasons is newsworthy.  Lewis has credited Mukasey with “doing the right thing,” and juxtaposed his conduct with Littler Mendelson and Putney Twombly, who Lewis has stated “appear, like my former partners, to not have the same level of integrity.”
Michael Avenatti.  As the Daily Beast reported, Avenatti was arrested in January during a disciplinary hearing at the California State Bar, while accompanied by then-Pierce Bainbridge partner Tom Warren (Warren Terzian). Shortly thereafter, in a matter where he appears to have had other counsel, Forbes reported, “Avenatti Convicted Of Extortion, Faces Up To 47 Years In Prison.” Less than two weeks later, ABC News reported: “Avenatti says he plans to make the credibility of porn star Stormy Daniels the central issue when his client faces trial on charges he cheated her of book deal proceeds,” Warren, then with Pierce Bainbridge, is referenced as a lawyer handling the matter. As for his arrest in California, Business Insider reported that “Avenatti has been arrested and accused of money laundering while awaiting trial on fraud charges.”  It is unclear if Warren or Pierce Bainbridge are involved in defending those charges, however, the timing of the accused money laundering overlaps with Avenatti’s representation by the firm.
Like many before him, the Avenatti tweet suggests that he bought the apparent legal snake oil that John Pierce and Pierce Bainbridge have seemingly sold to many. A few of the strikingly misleading public statements which may have duped Avenatti and others are below.
“[W]e have better cases, get better results, and have more fun than any firm on the planet.” – John Pierce, January 3, 2019 (Reality: The firm has one trial victory in over three years, a net verdict of $500K.)
“We litigate 10 times better, 10 times faster, and at a fraction of the cost. It is not a linear difference-it is exponential.” – John Pierce, February 3, 2019. (Reality: The firm amassed a “$65,000,000.00 debt in around one year.)
We are the best litigation firm on the planet, we fight on behalf of every single client every day. like honey badgers, we win almost everything we touch, and within a few to several years we will be the most dominant and profitable global litigation firm.” – John Pierce, October 21, 2019. (Reality: The firm lost around 80% of their attorneys over the next few months, only a few remain.)
Bonus Point.  Perhaps, however, this was simply a “birds of a feather” connection.  The Pierce led firm ran up a reported $65 million debt in a year, while Pierce reportedly has around $1.5 million in tax liens, and secured around $1 million from three cash advance entities against alleged firm receivables, each of whom have sued Pierce and the firm.  Furthermore, then-partner Christopher N. LaVigne (Withers Bergman) expressed severe concerns about the Pierce Bainbridge tax situation in the Fall of 2018.
Similarly, a Daily Beast article is titled:  “Michael Avenatti Lived the High Life While Owing Millions to IRS,” and the by-line continues: “. . .court records reveal the lawyer and his companies owed millions in unpaid taxes and judgments.”
George Papadopoulos.  Like Giuliani, Papadopoulos is an ally of President Trump; Pierce is an unabashed Trump fan as well.  Ex-Pierce Bainbridge partners Christopher N. LaVigne (Withers Bergman) and Caroline Polisi (Armstrong Teasedale), along with Pierce, represented Papadopoulos leading up to this prison stay for lying during the Mueller-Russia investigation.  (Tweets from Papadopoulos and his wife Simona shed light on the Pierce Bainbridge relationship.)
Pierce, Polisi and LaVigne filed court papers in an effort to delay Papadopoulos’s prison stay. The motion was unsuccessful.  In a written opinion of United States District Court judge Randolph Moss expressed displeasure with the “11th hour filing,” which “fails to identify any case in which a court has ever granted such an injunction;” Judge Moss also noted that Papadopoulos, who apparently waited until the last day to make the motion, “has only his own delay to blame” for the negative outcome.  Papadopoulos then went to prison for lying under oath.
Papadopoulos’ own Pierce Bainbridge lawyer, LaVigne, has been accused by Lewis of “lying under oath.” Lewis’s allegations could be a serious matter for LaVigne, particularly because written records show, months earlier, LaVigne messaged Lewis after learning of Pierce’s financial hijinks and advised Pierce should be reported.  (A screenshot of the LaVigne and Lewis exchange is below, the “P” in Lewis’s initial message refers to the firm’s bookkeeper.)
LaVigne’s knowledge of Pierce’s siphoning funds, and opinion that Pierce should be reported, had already raised the stakes. The recent revelation that the firm received a $28.5 million infusion shortly before LaVigne filed his alleged sworn falsehoods, appears to amplify potential issues.
Lavigne was a long-time ice hockey teammate of Lewis, they have known each other for over ten years; Lewis has said: “Chris was of the clear opinion that John Pierce is a ‘backstabbing,’ con man, yet he lied under oath to smear me and to protect the illicit financial activity from which he continued to be handsomely paid. Chris is a quintessential sell out.” (The photo below, included in a NPR article, pictures LaVigne on right of the screen, Pierce on the left, and Polisi and Papadopoulos in the middle.)
Bonus Point. In line with the “birds of a feather” suggestions, at least with regards to potential ethical issues, Polisi has been criticized in relation to her representation of Papadopoulos. An article by Casey Michel, includes the by-line: “CNN keeps having Caroline Polisi talk about the Russia investigation –without telling us who she’s working for.” In response, Polisi said she informed CNN of the relationship and added: “What the networks do is not my choice.”  (Extra Bonus Point.  The Giuliani tabbed Eric Creizman, prior to joining Pierce Bainbridge, penned a self-aggrandizing email (included in full by LawFuel here), in which Creizman derided Polisi – his associate at Creizman LLC, and partner at both Pierce Bainbridge and now Armstrong Teasedale – as well as LaVigne.)

The issue of “choice” has become a hot button topic for Lewis’s former partners.  It appears this group stuck with the firm while on notice of severe financial and other issues.  All of Lewis’ ex-partners chose to remain at the firm, despite the fact that six new senior partners (five experienced in white collar crime) quit less than five months after Lewis’s complaint was filed.  An article in Forbes characterized Lewis’s complaint as an “explosive and detailed” account of  “serious financial improprieties.” Yet, unlike the departed six senior partners – one being Deborah Renner (now at FINRA), a key lawyer involved in unwinding the fraud of Bernie Madoff – each of Lewis’s former partners, all of whom joined the firm before the departed six, remained with the Pierce Bainbridge for months after the six new senior partners, including Renner, had quit.
In light of this timing, if authorities take a close look into Pierce Bainbridge operations, Lewis’s ex-partners will presumably come under heavy scrutiny; they are Andrew Lorin (unknown), Amman Khan (Khan Law Office), Caroline Polisi (Armstrong Teasedale), Carolynn K. Beck (Goldstein & McClintock), Conor McDonough (unknown), Christopher N. LaVigne (Withers Bergman), Craig Bolton (Goldstein & McClintock), David Hecht (Hecht Partners), Douglas Curran (BraunHagey & Borden), Eric Creizman (Armstrong Teasedale), James D. Bainbridge, Jonathan Sorkowitz (The Law Offices of Jonathan Sorkowitz), Maxim Price ( unknown), Melissa Madrigal (Armstrong Teasedale), Michael Pomerantz (unknown) and Patrick Bradford (unknown). Denver G. Edwards, who started after Lewis, and is a member of the Middlebury College Board of Trustees, is also a defendant and, like LaVigne, accused of “lying under oath.”
Whether any of them end up in situations similar to the “felonious and controversial” clientele remains to be seen.  Whatever the case may be, given the torrent of troubling news, the “birds of a feather” tune is one they will likely continue to hear for the foreseeable future.

The LawFuel.com coverage includes details gleaned from leaked investor solicitation materials, about a  litigation fundraising entity intricately connected to the firm, Talon LF, LLC.  Pierce, Warren, and ex-Pierce Bainbridge United States Managing Partner Douglas Curran (BraunHagey & Borden) are listed as affiliated Talon individuals. The Talon solicitation materials, and accompanying documents, appear to contain misleading representations about the Pierce Bainbridge litigation track record.
To recap:  Over a six-month period, five Pierce Bainbridge partners – Eric Creizman, Melissa Madrigal, Tom Frongillo, Tom Warren, and John Pierce – were tabbed to represent Giuliani.  Four quit, the other, Pierce, was placed on a force leave of absence for financial shenanigans and received treatment for substance abuse. A Law360 report also surfaces, which Pierce denies as “total fake news,” that the firm is headed for extinction.  One would imagine this is not what Giuliani had in mind; however, it is unclear if Rudy even knows or cares, as there appears to be no public reports of Pierce Bainbridge doing any meaningful legal or other work for Giuliani.
Bonus Point.  Rudy is a long-time colleague of Marc Mukasey of Mukasey, Frenchmen & Sklaroff LLP.  They were law firm partners for around ten years at Bracewell Giuliani and Greenberg Traurig.  Giuliani is widely referred to as “Trump’s personal lawyer,” Mukasey has been characterized by Yahoo as “the lawyer at the center of Trump’s universe;” Mukasey, however, has declared to Law.com that his shop is a “Trial Law Firm, Not a Republican Law Firm.” The Mukasey firm represented Pierce Bainbridge in the Lewis lawsuits for several months.  Mukasey recently withdrew from representing the firm and Lewis’s former partners citing ethical concerns.
Regardless of one’s political leanings, an individual associated closely with Team Trump withdrawing for “ethical” reasons is newsworthy.  Lewis has credited Mukasey with “doing the right thing,” and juxtaposed his conduct with Littler Mendelson and Putney Twombly, who Lewis has stated “appear, like my former partners, to not have the same level of integrity.”
Michael Avenatti.  As the Daily Beast reported, Avenatti was arrested in January during a disciplinary hearing at the California State Bar, while accompanied by then-Pierce Bainbridge partner Tom Warren (Warren Terzian). Shortly thereafter, in a matter where he appears to have had other counsel, Forbes reported, “Avenatti Convicted Of Extortion, Faces Up To 47 Years In Prison.” Less than two weeks later, ABC News reported: “Avenatti says he plans to make the credibility of porn star Stormy Daniels the central issue when his client faces trial on charges he cheated her of book deal proceeds,” Warren, then with Pierce Bainbridge, is referenced as a lawyer handling the matter. As for his arrest in California, Business Insider reported that “Avenatti has been arrested and accused of money laundering while awaiting trial on fraud charges.”  It is unclear if Warren or Pierce Bainbridge are involved in defending those charges, however, the timing of the accused money laundering overlaps with Avenatti’s representation by the firm.
Like many before him, the Avenatti tweet suggests that he bought the apparent legal snake oil that John Pierce and Pierce Bainbridge have seemingly sold to many. A few of the strikingly misleading public statements which may have duped Avenatti and others are below.
“[W]e have better cases, get better results, and have more fun than any firm on the planet.” – John Pierce, January 3, 2019 (Reality: The firm has one trial victory in over three years, a net verdict of $500K.)
“We litigate 10 times better, 10 times faster, and at a fraction of the cost. It is not a linear difference-it is exponential.” – John Pierce, February 3, 2019. (Reality: The firm amassed a “$65,000,000.00 debt in around one year.)
We are the best litigation firm on the planet, we fight on behalf of every single client every day. like honey badgers, we win almost everything we touch, and within a few to several years we will be the most dominant and profitable global litigation firm.” – John Pierce, October 21, 2019. (Reality: The firm lost around 80% of their attorneys over the next few months, only a few remain.)
Bonus Point.  Perhaps, however, this was simply a “birds of a feather” connection.  The Pierce led firm ran up a reported $65 million debt in a year, while Pierce reportedly has around $1.5 million in tax liens, and secured around $1 million from three cash advance entities against alleged firm receivables, each of whom have sued Pierce and the firm.  Furthermore, then-partner Christopher N. LaVigne (Withers Bergman) expressed severe concerns about the Pierce Bainbridge tax situation in the Fall of 2018.
  Similarly, a Daily Beast article is titled:  “Michael Avenatti Lived the High Life While Owing Millions to IRS,” and the by-line continues: “. . .court records reveal the lawyer and his companies owed millions in unpaid taxes and judgments.”
George Papadopoulos.  Like Giuliani, Papadopoulos is an ally of President Trump; Pierce is an unabashed Trump fan as well.  Ex-Pierce Bainbridge partners Christopher N. LaVigne (Withers Bergman) and Caroline Polisi (Armstrong Teasedale), along with Pierce, represented Papadopoulos leading up to this prison stay for lying during the Mueller-Russia investigation.  (Tweets from Papadopoulos and his wife Simona shed light on the Pierce Bainbridge relationship.)
Pierce, Polisi and LaVigne filed court papers in an effort to delay Papadopoulos’s prison stay. The motion was unsuccessful.  In a written opinion of United States District Court judge Randolph Moss expressed displeasure with the “11th hour filing,” which “fails to identify any case in which a court has ever granted such an injunction;” Judge Moss also noted that Papadopoulos, who apparently waited until the last day to make the motion, “has only his own delay to blame” for the negative outcome.  Papadopoulos then went to prison for lying under oath.
Papadopoulos’ own Pierce Bainbridge lawyer, LaVigne, has been accused by Lewis of “lying under oath.” Lewis’s allegations could be a serious matter for LaVigne, particularly because written records show, months earlier, LaVigne messaged Lewis after learning of Pierce’s financial hijinks and advised Pierce should be reported.  (A screenshot of the LaVigne and Lewis exchange is below, the “P” in Lewis’s initial message refers to the firm’s bookkeeper.)
LaVigne’s knowledge of Pierce’s siphoning funds, and opinion that Pierce should be reported, had already raised the stakes. The recent revelation that the firm received a $28.5 million infusion shortly before LaVigne filed his alleged sworn falsehoods, appears to amplify potential issues.
Lavigne was a long-time ice hockey teammate of Lewis, they have known each other for over ten years; Lewis has said: “Chris was of the clear opinion that John Pierce is a ‘backstabbing,’ con man, yet he lied under oath to smear me and to protect the illicit financial activity from which he continued to be handsomely paid. Chris is a quintessential sell out.” (The photo below, included in a NPR article, pictures LaVigne on right of the screen, Pierce on the left, and Polisi and Papadopoulos in the middle.)
Bonus Point. In line with the “birds of a feather” suggestions, at least with regards to potential ethical issues, Polisi has been criticized in relation to her representation of Papadopoulos. An article by Casey Michel, includes the by-line: “CNN keeps having Caroline Polisi talk about the Russia investigation –without telling us who she’s working for.” In response, Polisi said she informed CNN of the relationship and added: “What the networks do is not my choice.”  (Extra Bonus Point.  The Giuliani tabbed Eric Creizman, prior to joining Pierce Bainbridge, penned a self-aggrandizing email (included in full by LawFuel here), in which Creizman derided Polisi – his associate at Creizman LLC, and partner at both Pierce Bainbridge and now Armstrong Teasedale – as well as LaVigne.)

The issue of “choice” has become a hot button topic for Lewis’s former partners.  It appears this group stuck with the firm while on notice of severe financial and other issues.  All of Lewis’ ex-partners chose to remain at the firm, despite the fact that six new senior partners (five experienced in white collar crime) quit less than five months after Lewis’s complaint was filed.  An article in Forbes characterized Lewis’s complaint as an “explosive and detailed” account of  “serious financial improprieties.” Yet, unlike the departed six senior partners – one being Deborah Renner (now at FINRA), a key lawyer involved in unwinding the fraud of Bernie Madoff – each of Lewis’s former partners, all of whom joined the firm before the departed six, remained with the Pierce Bainbridge for months after the six new senior partners, including Renner, had quit.
In light of this timing, if authorities take a close look into Pierce Bainbridge operations, Lewis’s ex-partners will presumably come under heavy scrutiny; they are Andrew Lorin (unknown), Amman Khan (Khan Law Office), Caroline Polisi (Armstrong Teasedale), Carolynn K. Beck (Goldstein & McClintock), Conor McDonough (unknown), Christopher N. LaVigne (Withers Bergman), Craig Bolton (Goldstein & McClintock), David Hecht (Hecht Partners), Douglas Curran (BraunHagey & Borden), Eric Creizman (Armstrong Teasedale), James D. Bainbridge, Jonathan Sorkowitz (The Law Offices of Jonathan Sorkowitz), Maxim Price ( unknown), Melissa Madrigal (Armstrong Teasedale), Michael Pomerantz (unknown) and Patrick Bradford (unknown). Denver G. Edwards, who started after Lewis, and is a member of the Middlebury College Board of Trustees, is also a defendant and, like LaVigne, accused of “lying under oath.”
Whether any of them end in situations similar to the “felonious and controversial” clientele remains to be seen.  Whatever the case may be, given the torrent of troubling news, the “birds of a feather” tune is one they will likely continue to hear for the foreseeable future.
