Knowledge is great, but practical application of these commands is more worthwhile than just spitting out how many tracks PT can handle, or especially listing the whole line of M-Audio interfaces. How many menus in the top toolbar? Who cares? Do you remember which command you have to find when your external pre isn't locking while musicians are staring at you? We find quick keys and a workflow and use that. I understand that knowing the navigation of the software is helpful, but NOBODY, on a daily basis, uses all the ways to start a new track, or open something, etc. They always said."We'll teach you more than the test anyway". When I did my audio degree, they didn't teach to the Pro Tools certification test. I was starting on a Final Cut Pro Level 1 cert since I was in the running to teach film editing at our school and they probably liked it more if I had the official paper. That's the thing I never understand about these cert's.

Transporting Guns: New York State Rifle & Pistol Association Inc. V. City Of New York, New York

As one of the nation’s oldest values and a historically prevailing tenet of the Constitution, the right to bear armshas surged in controversy in recent years, particularly in response to the concerning increase in gun-related crimes such as mass shootings. Although the Supreme Court has maintained that the Second Amendment protects one’s right to keep and bear arms for self-defense, it has not clarified the particular standards by which lower courts should determine the constitutionality of fire-arm regulations.[i] In 2013, New York City’s licensing rule for possessing and transporting handguns was challenged, and the question of the constitutionality of the City’s ban on moving a licensed handgun to a home or shooting range outside city boundaries eventually reached the Supreme Court, where the case was finally decided in April 2020.
Facts of the Case
Under New York City’s licensing rules on the possession of handguns, residents can apply for a premises license in order to possess a handgun at home. However, the premises license restricts the holders to always keep their handguns at “the premises which address is specified on the license,” with the exception of being permitted to transport the handgun to an authorized shooting range within the City.[ii]Most importantly, the rules prohibit premises-license holders to transport their handguns to shooting ranges or second homes outside of the City.
Three New York City residents with premises licenses—Romolo Colantone, Jose Anthony Irizarry, and Efrain Alvarez—hoped to bring their handguns to shooting competitions and target practice outside of the City, whose locations were closer to their homes than the authorized ones; Colantone also sought to transport his handgun between his residency in the City and his second home in Hancock, New York. However, these residents were barred from doing so as New York City stated that “the only permissible ranges for target practice or competitive shooting matches by NYC Premises Residence license holders are those located in New York City.”[iii]
On March 29, 2013, the three premises license holders, along with the New York City Rifle & Pistol Association, sued New York City and the New York Police Department-License Division in the U.S. District Court for the Southern District of New York. The petitioners argued that the City rules regarding premises-licensing violated the Second Amendment, the Commerce Clause, the First Amendment right of expressive association, and the fundamental right to travel. The petitioners moved for summary judgment and a preliminary injunction against the respondents. In response, the respondents cross-moved for summary judgment against the petitioners.[iv]

The district court held that the rule “merely regulates rather than restricts the right to possess a firearm in the home and is a minimal, or at most, modest burden on the right” and therefore did not violate the Second Amendment.[v] Furthermore, the district court maintained that the rule did not violate the dormant Commerce Clause, the First Amendment right of expressive association, or the fundamental right to travel. On February 4, 2015, the district court granted the respondents’ cross-motion, ruled in favor of the City on all counts, and dismissed the objection. Subsequently, the New York City Rifle & Pistol Association appealed to the U.S. Court of Appeals for the Second Circuit. The Second Circuit affirmed the District Court’s decision and ruled in favor of the City, stating that the rule did not substantially burden the petitioners’ Second Amendment rights, regulate extraterritorial economic activity, prevent the petitioners from engaging in interstate travel, or violate their right to expressive association. Persisting, the petitioners appealed the Second Circuit’s decision and were granted certiorari by the U.S. Supreme Court on January 22, 2019.[vi]

However, after the Supreme Court agreed to hear this case, the New York City Police Department changed its premises-license rules to permit a license holder to transport a handgun through the City to another residence, whether within or outside of the City’s boundaries, as long as the license holder was authorized to possess the handgun at the other residence; additionally, the City also revised the rules to allow a license holder to transport a handgun to a shooting competition or range outside of the City.[vii]

In the same week, New York State amended its Penal Law regarding premises licenses as Governor Andrew Cuomo signed a bill that allows premises license holders to transport their handguns to residences, shooting ranges and competitions, places of business, and “any other location” in which they are licensed to possess a handgun.[viii]
The Question of Mootness
Due to the subsequent amendments to New York City’s premises-licensing rules, the parties initially debated if the case should now be deemed moot by the Court. The City, or the respondents, argued that the case is moot since the policy changes practically allow the petitioners to do exactly what they had originally sought—to transport their handguns to other homes, shooting competitions and ranges outside of the City boundaries.[ix] Thus, the City holds that the dispute is gone and asks the Court to dismiss the case as there is no law to defend anymore.

However, the petitioners persisted, arguing that the case is not moot because their “injuries have not been sufficiently addressed.”[x] They stated that they want a declaration that they have a constitutional right to transport their handguns to locations where they can keep and bear them lawfully, in order to prevent the City from ever reestablishing the old rule.
Supreme Court Opinion and Ruling
Ultimately, the Supreme Court, in a per curium opinion on April 27, 2020, held that the petitioners’ claim for “declaratory and injunctive relief with respect to the City’s old rule” is moot.[xi] The Court reasoned that since New York state amended the original rule after the Court granted certiorari, the petitioners could now transport their handguns to another residence or shooting range outside of the city, which is “the precise relief” that the petitioners had requested in their original complaint.[xii]

However, the petitioners continued to argue that the new rule could still violate their rights, asserting that they may not be permitted to make stops on their way to their second residences or shooting ranges outside of the city. In response, the City claimed that such stops are “entirely permissible under the new rule,” but the Court held that they will not decide this particular dispute regarding the new rule, citing a precedent case where they maintained that their “ordinary practice in disposing of a case that has become moot on appeal is to vacate the judgment with directions to dismiss.”[xiii]

Yet the petitioners also argued that they could ask for damages in this case despite not doing so, originally, with respect to the City’s old rule. The Court pointed out that the petitioners did not seek damages in their original complaint as even the possibility of a damages claim was not mentioned “until well into the litigation.”[xiv] Therefore, the City argued that it is too late to add a damages claim, although the Court allowed the case to be remanded for the Court of Appeals and the District Court to decide the viability of such a claim, thus removing itself from the debate on this note.
Conclusion
Given that this is the first significant Second Amendment case that the Supreme Court has heard in a decade,[xv]
it was expected that the ruling may prove to be a momentous declaration of the Court’s standard for reviewing Second Amendment challenges as well as its views on the constitutionality of city-operated gun regulations. However, since New York City’s amending of its licensing rules, which practically fulfilled the petitioners’ original request, was passed prior to the Supreme Court’s hearing, the case was simply confirmed to be moot; despite the petitioners’ efforts to continue arguing, the Court abstained from producing further judgment on the heated national debate on gun control.
