Patna: Former Bihar MP Anand Mohan Singh walked out of jail in the early hours today amid a huge row over the Bihar government's prison rule change that cleared the path for his release.
The current location of Singh, who has served 15 years in jail for abetting the murder of an IAS officer in 1994, is not known. His son and Rashtriya Janata Dal (RJD) MLA Chetan Anand is unreachable on phone and the family's house in Saharsa is locked.
The gangster-turned-politician was initially to be released around 7 am. But the sudden change of plan was reportedly made to avoid the media.
Singh was out on a 15-day parole for his son's wedding. During the break, he spoke to media. He returned to jail only yesterday.
The former MP's release from jail comes after the Nitish Kumar government in Bihar tweaked the jail rules. Earlier, anyone convicted in connection with the murder of a public servant on duty was not eligible for a remission in sentence. This was changed by the Bihar government, paving the way for the release of 27 convicts, including Singh, who have served 14 years or more behind the bars.
The move has sparked a huge controversy, with Nitish Kumar government drawing fire from the Opposition BJP. BJP's MP Sushil Kumar Modi, also Bihar's former deputy Chief Minister, has said Mr Kumar had sacrificed law to stay on in power with support from ally RJD.
Singh, who represented RJD in Lok Sabha, is considered a prominent Rajput face. And his release is being seen as a move to attract Bihar's upper caste votes in the 2024 general election. The release also comes against the backdrop of Mr Kumar meeting Opposition leaders to stitch a joint front to take on the BJP in 2024.
Singh, who faced multiple cases, was found guilty of instigating a mob that lynched district magistrate G Krishnaiah, a Dalit IAS officer, in 1994. Krishnaiah was attacked by a mob protesting with the body of Chhotan Shukla, another gangster-politician of Anand Mohan's party, who had been killed a day earlier. Singh was sentenced to death by a lower court in 2007, but the Patna High Court later commuted the penalty to life imprisonment.
The late IAS officer's wife has expressed disappointment over Singh's release. Speaking to NDTV, Uma Krishnaiah said, "We don't agree with the move. It's in a way encouraging the criminals. It sends out a message that you can commit a crime, and go to jail but then get freed and join politics. The death penalty was good."
The Central IAS Association, the top body for bureaucrats in the country, has slammed the move. "Such dilution leads to impunity, erosion of morale of public servants, undermines public order and makes a mockery of administration of justice," it has said.
Bahujan Samaj Party chief Mayawati, too, has criticised the Bihar government's move that paved the way for Singh's release, calling it an "anti-Dalit" step.
Speaking to the media during his parole break, Singh had responded to the uproar over his release. Taking a dig at the BJP, he had said sarcastically, "A decision has been taken in Gujarat due to pressure by Nitish Kumar and RJD. Some people have been released and greeted with garlands." Asked if he was referring to the Bilkis Bano gangrape case, he said, "Yes, that's what I am referring to". BJP is in power in Gujarat.
He had said all the 27 people whose names are in the list for remission of sentence have served their time in the jail. "It's not that the state government is letting people walk free just like that. There is a Supreme Court directive."

New Delhi/Patna: The Bihar government today notified the release of 27 prisoners, days after amending the Bihar Prison Manual that triggered a massive opposition backlash. Among those who will be released is former MP Anand Mohan Singh who was convicted in the 1994 murder of bureaucrat G Krishnaiah.
G Krishnaiah, then Gopalganj District Magistrate, was killed by a mob allegedly provoked by Anand Mohan Singh. The gangster-turned-politician was sentenced to death in 2007 by a lower court in Bihar. The Patna High Court, however, commuted it to life imprisonment; that order was upheld by the Supreme Court in 2012.
Earlier this month, the Bihar government had removed the clause which had forbidden the remission of jail term for those convicted of murdering a public servant on duty.
In its notification, the state’s law department said that the new rules were for prisoners who have served the actual sentence of 14 years or a sentence of 20 years with remission.
“In light of the Bihar state sentence remission council meeting on April 20, the decision was taken for the release of prisoners having served actual sentence of 14 years or sentence of 20 years with remission,” the notification said.
The change in rules and Anand Mohan Singh’s release has stirred up huge controversy, with Mayawati’s Bahujan Samaj Party (BSP) terming the change in rules as “anti-Dalit”.
“The move by the Nitish government to prepare the release of Anand Mohan after changing rules in the case of the brutal murder of extremely honest IAS officer G Krishnaiah, who belonged to a poor Dalit family from Andhra Pradesh’s Mehboobnagar (now in Telangana), is being discussed for negative and anti-Dalit reasons in the whole country,” Ms Mayawati tweeted on Sunday.
She asked the Nitish Kumar government to reconsider the decision, saying that Anand Mohan Singh’s release would anger the Dalit community.
BJP’s IT Cell head Amit Malviya also hit out at Nitish Kumar. “Can someone who is leaning on a criminal syndicate, to hold on to power, be the face of India, even as opposition leader?” Mr Malviya tweeted on Monday.
The ruling Janata Dal (United) hit back at the BJP, with a “B-team in UP” jibe also at Mayawati. In a tweet, JDU leader Rajiv Ranjan Singh said that the change in rules was aimed at getting the common man and special prisoners on a uniform platform.
The change in the Bihar prison manual benefits Anand Mohan Singh, a Rajput leader with considerable influence on his caste voters.
For the last two years, several politicians from the Rajput community have been demanding Singh’s early release. Even Bihar Chief Minister Nitish Kumar has on multiple occasions hinted that he “stands by his former colleague”.

India is a secular country, and its Secularism existed since the commencement of “India.” There is no better country on this planet to equate with India Secularism. By definition “Secularism in India means equal treatment of all religions by the state.” India is the only country on this planet earth where one can find survival and free practice of every religion. Nearly 22 national languages and 1,652 mother languages (local languages) spoken in India. Is it not captivating and a unique mannerism of this great nation “India”? Indeed, we are a great nation, and Secularism is entrenched all over India which does not require any proof or justification.
From ancient days to the modern world nothing has changed for ordinary people. However, In the 21st century our political masters, white collar Naxals-Terrorists, Mullahs, Foreign-funded NGO’s and many other individuals and organizations are trying to twist and alter the entire discourse of real Secularism. Well! These forces are trying their best to find the means of their existence and trying to stay relevant.
India is witnessing a new dimension in the Secularism phenomena, i.e., failing to pay attention to a particular religion means there is a threat to Secularism. I ask the question – why someone will ignore Hindus? Why political masters across parties giving no importance to the majority, i.e., Hindu’s? Why are political masters acknowledging, showcasing and celebrating Ed – Iftaar party, Muharram, importance to skullcap and green color? Why degrading saffron color or not recognizing majority populations festivals and rituals? Narratives built green vs. saffron, Narratives built Durga puja vs. Muharram, and yes Narratives are constructed Hindus vs. Muslims. How come one religion can be secular vs. others. It is sad, but narratives are built by shameless politicians, white collar Naxals-Terrorists, Mullahs, Foreign-funded NGO’s that Hindus are not secular or less secular vs. rest of minorities.
It has become routine that our chief minister’s, Prime Minister, President, and many political party leaders organize Iftar party on tax payer’s money but no celebrations for majorities. I am not against religion, but I have a firm view that if there is appeasement of only one religion, then Hindu should stop paying taxes. I believe in “Appeasement for None and Development for all.” Religion is a personal matter of belief, and it cannot be exploited to define India’s Secularism. Government ideal duty is to refrain from the religious issue and must not use tax payer’s money to appease one religion vs. others. The government is for all, not of any particular faith, so it is not appropriate to pay more attention to one specific religion.
It all started since India independence and even before by Nehru, Jinnah and many more. We have congress leaders like Digvijay Singh who praises terrorist Hafiz because he is Muslim and Congress party supports him. Sonia Gandhi cries for Batala House encounter for Muslim appeasement. Owaisi is another Muslim leader who speaks venom against Hindus. Congress party stands with Ishrat Jahan who was a terrorist. In Bihar Laloo Yadav, a convicted politician plays M-Y (Muslim and Yadav) card to appease Muslims. In Utter Pradesh, Samajwadi Party leader Mulayam Singh Yadav gives a public statement that he feels proud in killing Hindus who were doing Kar Seva. West Bengal Chief Minister banned Durga puja rituals and allowed Muharram to appease Muslims. This list is endless but to name few are like Lawyers like Kapil Sibal and Prashant Bhushan, a judge like Katraju, Maulana like Bukhari, Politicians like Laloo, Kejri, Owaisi and Azam Khan, Students like Khalid, Omar, and Kanhaiya. Professors like Nivedita Menon, NGO’s like Teesta Setalvad and many more, the list is endless.
In Godhra sad incident, hundreds of Hindu and Muslim both killed, but entire political class and foreign-funded NGO’s stood for Muslims because that makes them secular. Across the country, foreign-funded NGO’s are running shops of forceful conversion. If we speak against conversion, then someone like Jhon Dayal runs to America to lodge his complaint. We have seen forceful religion conversion in Kerela and many parts of the country. We have leaders like Mamta, Laloo, Mulayam and Rahul Gandhi who are showing solidity for illegal Rohingyas Muslims because of this suite their narrative of secularism. Lacks of Hindus were butchered and thrown out of Kashmir, but no one stands for them because it does not fit in the political description of secularisms.
Enough is enough and we the people of India must not tolerate idiotic theory and narrative of secularism. We live in a Hindu majority nation, and absolutely no one can dare to teach us dirty tricks of secularism. The fact is that our country filled with white color criminals and that is the biggest threat to our secularism. We the people of India need to wake up against white collar Naxals-criminals-terrorists and must break selective secularisms propagated by many.
I believe in India secularism, i.e., absolutely development for all and appeasement for none.

Anti-sedition law: Is it a necessary evil?
On the night of December 17, 1995, a large consignment of weapons, including AK-47 rifles and several hundred rounds of ammunition, was airdropped from an aircraft in the Purulia district of West Bengal. The weapons were confiscated by the police after the locals informed them about the mysterious event. A Dane named Niels Holck, also known as Kim Peter Davy, was later found to be the kingpin behind the operation, and the Central Bureau of Investigation slapped sedition charges in the case.
In the Kedar Nath Singh judgment, the Supreme Court narrowed down the scope of the anti-sedition law, saying that mere criticism of the government was not seditious unless it incited violence or disturbed public order.
The sensational events captured the imagination of the public and the political circles: there were allegations that the arms drop was plotted to destabilise the Left Front government of Jyoti Basu in West Bengal. The CBI issued a statement in 2011 dismissing claims that the operation had the nod of “political forces” at the Centre.
An illegal act of this sort, that has the potential to incite an armed revolt against an elected government, can best be described as a seditious act and not just a terrorist plot.
Loknath Behera, a senior IPS officer involved in the investigation of the Purulia arms drop case, said the anti-sedition law should be used sparingly since it entails heavy punishment up to life imprisonment. Moreover, it is also a difficult offence to prove in court. “Sedition cannot be invoked for small offences,” he said. “It has to be used judiciously in the context of the Kedar Nath Singh [vs the State of Bihar] judgment [of 1962], where the constitutionality of Section 124A of the Indian Penal Code was tested and upheld.”
In the Kedar Nath Singh judgment, the Supreme Court narrowed down the scope of the anti-sedition law, saying that mere criticism of the government was not seditious unless it incited violence or disturbed public order. This meant that if the law was not read in the context of this interpretation, it threatened to engulf any expression of opposing opinion—written or spoken—qualifying it as incitement of hatred or disaffection towards the government.
In the last few years, the National Investigation Agency (NIA) has slapped sedition charges in a series of cases. Leaders of the proscribed organisation Sikhs for Justice (SFJ) and terror-accused in Kashmir to politicians and activists protesting the Citizenship (Amendment) Act in 2019 became the accused in these cases. The NIA, set up in the aftermath of the 2008 Mumbai terror attacks, has mixed experience in courts on sedition cases. While the agency successfully proved the charges in some, it failed in many others.
“The anti-sedition law has its relevance,” said a senior NIA official. “When a banned outfit like the SFJ, which propagates the idea of a separate Khalistan state, enters into a social media campaign besides invoking the anti-terror law, such activities also attract penal provisions defined under IPC Section 124A which explains the offence more clearly.”
But there has been a plethora of cases where courts have acquitted the accused. Recently, the NIA court in Guwahati acquitted activist and MLA Akhil Gogoi and three others in a sedition case slapped against them during the height of the anti-CAA protests in Assam in 2019.
Successive governments have used the anti-sedition law with impunity to quell dissent. The result is that several writers, journalists, cartoonists, politicians, activists and students got entangled in the dreaded colonial-era statute. And, the level of sedition charges has stretched the imagination of the law itself.
Two months ago, a sedition charge was slapped against an Assam woman for using a table cloth that resembled the national flag while celebrating Eid. In June, the Guwahati High Court granted her bail. In another instance in Punjab in 2020, a political leader was accused of sedition when he posted a message on social media about the lack of ventilators during the pandemic. The bail order by the Punjab and Haryana High Court termed the use of sedition in this case as an “overzealous exercise of power” by the police. The trial is yet to commence.
The courts are now dealing with several cases of visibly apparent misuse of the anti-sedition law, and this has drawn the ire of the Supreme Court. On July 15, the Supreme Court asked the Union government as to why it was not repealing the provision used by the British to silence people like Mahatma Gandhi.
“Is it still necessary to keep this statute even after 75 years of Independence?” asked the three-judge bench headed by Chief Justice N.V. Ramana, while agreeing to examine the pleas filed by the Editors Guild of India and an army veteran, challenging Section 124A. The bench issued a notice to the Union government and pointed out that the conviction rate in sedition cases is extremely low.
Section 124A was inserted into the IPC by the British in 1870. Repealing obsolete and archaic laws was a poll promise of the BJP. After it came to power, more than 1,200 redundant laws were struck off. A special committee has been set up in the prime minister’s office to review archaic laws and make recommendations to the government. But the final word on making changes to the Code of Criminal Procedure, IPC and anti-terror laws like the Unlawful Activities (Prevention) Act (UAPA) and National Security Act lies with the Union ministry of home affairs (MHA). The ministry has constituted a five-member committee to look into overhauling such fossilised legislations, or removing them.
With the review of the sedition law on its table, it is not the first time Home Minister Amit Shah and Home Secretary A.K. Bhalla are burning the midnight oil. The first option is to revise the draconian legislation to make it in sync with the changing times. Second, to issue guidelines based on the directions of the Supreme Court, and third, to strike it down if it has outlived its purpose.
“There is a need for wider consultation on the matter,” said D. Raja, general secretary of the Communist Party of India. “The government should consult stakeholders and get public opinion while making changes to any laws.”
In 2012, the UPA government had walked a few steps to review the anti-sedition law but developed cold feet. A group of ministers was then constituted to suggest changes based on recommendations of the law commission. Former home ministry officials said the view taken was to retain the law after revising the definition for sedition. Several changes were proposed including replacing disaffection against “government” with disaffection against “Parliament, state legislature, Constitution, national flag, national anthem and national emblem”, and reducing the punishment for sedition to a seven-year jail term with a fine. But the proposals never saw the light of day. In the meantime, law enforcement agencies were asked to avoid misuse of sedition and make use of other provisions in the IPC to deal with similar offences of a lesser category.
In the mid-1980s, the Union home ministry had shown greater political will when it came to drafting a law to quell separatist tendencies. P. Chidambaram, former Union home minister told THE WEEK: “In 1987, the Terrorists and Disruption Activities (Prevention) Act was drafted and passed in the context of the rising terrorism in Punjab. It was intended to be a temporary law.” Chidambaram, who was then minister of state for internal security, sat down with M.K. Narayanan, the then director of Intelligence Bureau, and a senior Punjab police officer, to draft TADA that encompassed a wide range of activities, including protests of all sorts. For the first time, it made confessions before a police officer admissible in court, put restrictions on bail and gave enhanced powers to detain suspects. TADA was in force between 1985 and 1995.
According to police officers of that era, the law was grossly misused. Over the years, the Supreme Court read down the application of the law to prevent its misuse. “Safeguards were introduced and the law was upheld by the courts, but still, the law was misused,” said Chidambaram. “The Congress government under P.V. Narasimha Rao allowed the Act to lapse.”
Shantanu Sen, former joint director in CBI who was then deputy inspector general in Punjab Police, said: “I was part of the consultations that drafted TADA. While it was useful at one time to fight terrorism and organised crime in Punjab, I am not mourning its end.”
In western countries, said Sen, various forms of incarceration are there: individuals can be put under house arrest and other steps taken to control their movement if they are found on the wrong side of the law which are not heavily punishable. “But here, the situation of an undertrial is the same as that of a person who is convicted for a crime,” he said. Sen added that simply because the sedition law is being misused, it cannot be struck down. “However, the government should immediately bring provisions to control its misuse,” he said.
The danger, according to law enforcement officers, is that it may open a pandora’s box of new forms of misuse. Also, offences that strictly qualify as seditious speech or writing might be stretched as offences under some stringent laws like the UAPA.
The recent death of the 84-year-old Jesuit priest and activist Stan Swamy, an accused in the Bhima Koregaon case, while being in judicial custody, raised several questions on the use of draconian laws like the UAPA. Swamy was booked under various sections of the UAPA; there was no sedition charge against him. He had already spent nine months in jail, before his death on July 5, waiting for his trial to start. There are many others like Swamy, booked for sedition and anti-terror charges, waiting in jails for years awaiting trial.
Undeniably, state police have different experiences with sedition, owing to their different social concerns and history of crime and terrorism. The number of cases varies from state to state. According to the National Crime Records Bureau (NCRB), the Maoist-infested state of Chhattisgarh had just one case filed under Section 124A in 2019. Whereas Karnataka had 22 cases, Assam had 17 and Jammu and Kashmir 11.
Vishwaranjan, former director-general of police, Chhattisgarh, explained why there was no need to invoke too many sedition cases in the state. “There is no denying that the Maoist literature, speeches, actions were all seditious,” he said. “But until their claims were backed by seditious activity that could damage law and order, we arrested them under normal sections of the IPC.”
M. Mahender Reddy, director-general of police of Telangana, said sedition is used only against top Maoist cadres who use the ‘barrel of the gun’ to threaten the state. N.R. Wasan, former special director in CBI, said in his career spanning 36 years he never used sedition against any accused. “There were all kinds of cases under investigation, from insurgency to Naxalism, but I did not feel the need to use it,” he said.
There have been efforts by state governments to ensure judicious use of the anti-sedition law. In 2015, the home department of Maharashtra issued a circular asking police stations to issue guidelines to prevent the misuse of the law. The circular mentioned that words against politicians and government servants cannot be termed as sedition, obscenity or vulgarity does not fall under sedition and a legal opinion must be obtained in writing from a law officer of the district, giving reasons why the charges are being invoked.
Shishir Hiray, a special public prosecutor in Maharashtra, points out that there are many provisions to prevent unnecessary arrests which can be used to stop the misuse of laws like sedition. “For example, Section 41A of the CrPC has penal provisions that can be invoked against an investigating officer if he flouts the rules of arrest,” he said.
P.D.T. Achary, former secretary- general of the Lok Sabha, said Article 19(2) of the Constitution authorises the government to impose reasonable restrictions on the freedom of speech and expression. And, it is under this umbrella that sedition exists on the statute book to date. Achary, however, noted that the problem persists in the law which is arbitrary and unjustifiable at any stage. “The Supreme Court should strike it down now,” he said.
Parliamentarians have time and again argued about the number of sedition cases in the country under different governments. The method of calculation varies as in some FIRs Section 124A is not a primary offence but a secondary one. This is one of the reasons why figures of the NCRB on sedition cases are at odds with the numbers recently revealed by Article 14—a portal run by a group of lawyers, journalists and academics which has tracked sedition cases between January 1, 2010, and December 31, 2020. Their data showed a massive 96 per cent rise in cases since Narendra Modi came to power. The home ministry officials said they have started maintaining a separate database on sedition since 2014, unlike the UPA regime when all sedition cases were clubbed with IPC cases.
Lt General Shokin Chouhan, former chairman of the Ceasefire Monitoring Group in Nagaland, said: “More than numbers, the cause for disaffection toward any government needs to be addressed. Whether it is the Central or state government, lack of [good] governance breeds disaffection.”
Lubhyathi Rangarajan, a lawyer who heads the Article 14 project, said inherent in the meaning of sedition lies a stigma—it is desh droh (traitor) in several Indian languages. While the word sedition awaits a final decree on its fate, the silver lining is that it is never too late for the government to build the affection of people.

Plot: Even though they struggle to make ends meet, Namdeo (Jitendra Joshi) and Ganga (Veena Janmkar) live a peaceful life with their children Laxmi (Gauri Ingawale) and Subhan (Mihir Soni). Namdeo, who works as a gardener, will go any heights to fulfill the wants of his family. He even does some extra work and bears all pains with a smile. However, their simple life turns ugly when they are faced with a number of obstacles.
Namdeo receives unconditional family-like support from his friend Magic Mamu (Siddharth Jadhav) and his wife Saira (Manasi Naik).

Review: Parents are always expected to work hard to present a better or a comfortable life to their children. But how acceptable is when children take up the responsibility to better the lives of their parents? Such an unusual yet interesting question is explored in Sudesh Manjrekar’s Kutumb. The characters and some of the events surely succeed in moving the audience but due to the writing and execution (in some parts), the film turns out to be just a one-time watch.
During the initial moments, the writers and the director use the visual medium very intelligently. The nature of the four characters, the love between them, their problems and their everyday life is described without much use of dialogues. And once Siddharth Jadhav’s character is introduced, the proceedings get a booster. But there was no need to include two songs without any gap to prove the dancing skills of the two kids. Despite that, the first half manages to lay a decent foundation.
Kutumb Marathi Movie 2006 Watch
The events that follow are appealing alright. But now the film starts treading on predictable lines. An over-emotional scene (not possible to reveal more), involving one of the main characters, appears silly. But what hurts the most is how the audience is made to watch a dance reality show for a long duration later on. The pre-climax and the climax should have been framed in a way that it gets the audience rooting for the kids.
A very interesting fact is observed in a number of Mahesh Manjrekar’s films including Kutumb. The main protagonist receives tremendous help from a supporting character who is Muslim by religion. Apart from Kutumb (where Jadhav plays Joshi’s friend), this is seen in his earlier films Kurukshetra, Viruddh, Vaah! Life Ho To Aisi!, Mee Shivajiraje Bhosale Boltoy and Shikshanachya Aaicha Gho. Co-incidentally, in three of the six films mentioned, Jadhav has played the concerned character.
Technical aspects like cinematography (Ajith Reddy) and background score can be included in the plus points. The editing is fine but it should have been tighter during the dance reality show scenes. Ajit-Sameer and Abhijit Kawthalkar’s music suits the film. Dialogues (Pravin Tarde) are effective and moving.
The performance area is the biggest plus point. Jitendra Joshi is brilliant as he pours his heart out while playing a caring father and husband. He is on a roll this year. Vena Janmkar too gets into the skin of her character with perfection and presents a realistic act. Gauri Ingawale and Mihir Soni deserve huge applause for not only giving mature performances but also showing some terrific dancing skills.
Siddharth Jadhav presents a lovable act. Manasi Naik is likable too. Vaibhav Mangale plays the bad guy well while Bhalchandra Kadam, his sidekick, is not bad either.
Overall, Kutumb can be seen once if you prefer emotional family dramas. The film will need positive word-of-mouth to succeed at the box-office. It will face opposition from next week’s awaited No Entry Pudhe Dhoka Aahey.

However, of late,India,s democracy appears unable to course correct despite repeated elections .It is important to recognise that it was not always so.In a spectacular course correction ,the Indian electorate had defeated Indira Gandhi after the Emergency in1977,Unlike in Bihar this time,the Opposition then had included stalwarts of Indian politics such as Morarji Desailly, Atal Bihari Vajpayee and George Fernandas. They may have benefited from the tailwind of the Jayaprajkash Narayanan movement but they were recognisable as politicians with long experience in public life. A necessary element in the course correction Indian politics needs would be inner-party democracy within the Opposition parties.Ater all,democracy can be restored only through democracy. Inner-party democracy alone can ensure that parties promote the ablest and seek accountability from their leaders.A hopeful reading of the Bihar verdict would be that India's democracy is maturing .The demons has shown it's impatience with family rule. NEW DELHI: The Supreme Court’s idea of setting up enough number of special courts for speedy trial of sitting and former MPs and MLAs facing criminal charges has gathered momentum with the endorsement of as many as 23 high courts, although Madras HC has reversed its 2018 backing for the SC directive. Amicus curiae and senior advocate Vijay Hansaria and advocate Sneha Kalita have filed a report in the SC, which is scheduled to hear the matter on Wednesday, saying 23 HCs — Allahabad, Bihar, Bombay, Chhattisgarh, Calcutta, Delhi, Gauhati, Gujarat, Himachal Pradesh, J&K, Jharkhand, Karnataka, Kerala, Madhya Pradesh, Manipur, Meghalaya, Orissa, Punjab and Haryana, Rajasthan, Sikkim, Telangana and Uttarakhand — have responded to SC orders and given details on various queries raised by the bench.

There’s a popular perception that politicians are able to circumvent or delay judicial proceedings using clout. Speedy closure to such cases is important to change the perception. The setting up of special courts should happen as quickly as possible. This will be good for politicians too. Either way, their careers would no longer be on hold. They, and the public, will know whether the cases against them are legitimate or politically motivated.
On October 6, an SC bench of Justices N V Ramana, Surya Kant and Hrishikesh Roy, tasked to implement the earlier orders passed by the court on this issue, had sought details from HCs about pending criminal cases against sitting and former MPs and MLAs and subsequently inquired about the adequacy of special courts to deal with the backlog of such cases in each state. Madras HC, which had in September 2018 endorsed the setting up of special courts to expedite snail-paced trial against tainted politicians, submitted a report of the ‘Criminal Rules Committee��� of the HC comprising Justices P N Prakash, G Jayachandran and N Sathish Kumar and questioned the constitutionality of special courts. It recommended that Tamil Nadu be exempted from this SC devised mechanism for speedy trial against tainted politicians. The Madras HC committee said, “Special courts can only be ‘offence centric’ and not ‘offender centric’. The existing court structure in Tamil Nadu, which is robust, is more than enough to deal with the cases involving MPs and MLAs. The HC CJ is requested to bring this fact to the notice of the SC and get exemption from establishing special courts… and permit restoration of status quo ante.” Restoration of status quo ante, as sought by Madras HC, would mean politicians would enjoy a protracted trial. The amicus termed the Madras HC committee’s view as erroneous and said, “It’s on record that a large number of cases, including heinous offences, are pending in the courts not only for years but for decades.” “In such circumstances, a special mechanism for speedy trial of these cases cannot be flawed.”
