It mainly includes the behaviour of one spouse towards the other which causes suspicion in the mind of the party who is filing for divorce that it is unsafe to live with him/her. 3. Desertion as a ground for divorce- Section 13(1)(ib) When one spouse intentionally abandons another spouse without his/her consent or without any reasonable cause is called desertion. It is withdrawal from the matrimonial obligation. 4. Conversion as a ground for divorce- Section 13(1)(ii) If a Hindu cease or ceases to be Hindu by converting himself into another religion than the other party who is still a Hindu is entitled with the right to seek divorce under this section. Also, if children are born to him/her after the conversion gets disqualified from inheriting the property of any of their Hindu relatives. 5. Mental Disorder: Unsoundness of Mind- Section 13(1)(iii) Before 1976, unsoundness of mind for one year was a ground for judicial separation and if it continues till three years then it will be a ground for divorce. But after the 1976 Amendment, no period is prescribed and moreover, it includes all types of mental cases, sub-normality and abnormality. 6. Presumption of death- Section- 13(1)(vii) If a person is not heard of being alive from his/her near or dear ones or his/her relatives for a period of seven years then he/she seemed to be legally dead. But in case he/she was married before, then their spouse can seek divorce on such a ground. In this case, no alternate decree of judicial separation is passed.

 It is further argued by the Counsel for FC that in Indian Law as well, death caused by rash or negligent Act not amounting to culpable homicide is covered under Section 304-A of Indian Penal Code, 1860 (IPC), while offence of culpable homicide is defined under Section 299 of IPC and punishable under Section 304 of IPC. Thus, it is argued that the offence of Section 318 of Crimes Act is at par with provision of Section 304-A of IPC which is only punishable upto 2 years of imprisonment. Moreover, the other offences charged against FC i.e. Section 24 of Crimes Act and Section 21(2) of the Foreign Passports Act (Law Enforcement and Security) Act 2005 are pari materia with Section 279 r/w Section 338 of IPC and Section 12 (1) (d) of Passports Acts under Indian Law, both of which offences do not carry imprisonment more than 2 years.  It is further contended by Counsel for FC that under Extradition Act, 1988 of Australia, extradition offence is defined as an offence for which the maximum penalty is death or imprisonment, or other deprivation of liberty for a period not less than 12 months. Thus, even as per the law of Extradition of Requesting State, extradition is permissible only with respect to offences for which penalty is for a period not less than 12 months. Since, the offences made out against the FC under Indian Law i.e. Section 279/338/304-A IPC and Section 12(1)(d) of Passports Act do not carry any mandatory minimum sentence of one year and are punishable for any period of imprisonment upto 2 years, thus, the offences in question do not fall under the category of ‘Extradition offence’.

Sep 26, 2022 10:41 IST New Delhi , September 26 (AF): Bollywood actor Jacqueline Fernandez on Monday arrived at the Patiala House Court which had summoned her in connection with the Enforcement Directorate case related to Rs 200 Crore money laundering case involving conman Sukesh Chandrashekar and others. Actor Jacqueline Fernandez's lawyers have moved a bail plea in the money laundering case. Additional Sessions Judge Shailender Malik sought a response from the ED on the bail plea, till then her regular bail is pending before the court. At the request of Jacqueline's lawyer, the court granted interim bail to Jacqueline on a bail bond of Rs 50,000. The next date of hearing is October 22 this year. Earlier on Wednesday, the court issued a summons to the actor to appear before it physically on September 26 this year On August 17, this year, a supplementary chargesheet filed by the Enforcement Directorate in the Rs 200 crore extortion case against conman Sukesh Chandrashekar in a Delhi Court mentioned the name of Bollywood actor Jacqueline Fernandez as an accused. The Additional Sessions Judge Praveen Singh on Wednesday after taking cognizance of the supplementary chargesheet, directed the newly made accused Jacqueline Fernandez to appear before it on September 26, 2022. The court also directed ED to supply a copy of the chargesheet to all the accused in the present case. Meanwhile, a lawyer appeared for Delhi Police Economic Offences Wing (EOW) which is also probing the same case informed the court that Jacqueline Fernandez was recently asked to appear for it on August 29, 2022, but she didn't appear so we have issued a fresh summons to her to join the investigation. To that lawyer appeared for Jacqueline assuring that she will join the investigation and co-operate with the probe agency. Jacqueline Fernandez has also been summoned by ED several times in the matter for the purpose of investigation. Advocate Prashant Patil appeared for Jacquline and stated that she has always cooperated with the investigation agencies and attended all the summons to date. "She has handed over all the information to the best of her ability to the ED. ED's earlier chargesheet did not mention her name as an accused but mentioned the detail of the statement recorded by Bollywood actors Jacqueline Fernandez and Nora Fatehi in the matter. According to ED's earlier Chargesheet, Bollywood actresses Jacqueline Fernandez and Nora Fatehi examined and stated that the actresses got top models of BMW cars, the most expensive gifts from the accused Sukesh. ED chargesheet clearly stated that "during the investigation, statements of Jacqueline Fernandez were recorded on 30.08.2021 and 20.10.2021 Jacqueline Fernandez stated she received gifts viz three designer bags from Gucci, Chanel, and two Gucci outfits for gym wear. A pair of Louis Vuitton shoes, two pairs of diamond earrings and a bracelet of multi-coloured stones, two Hermes bracelets. She also received a Mini Cooper which she returned." "According to ED, Sukesh was confronted with Jacqueline on October 20, 2021. Jacqueline Fernandez stated that Sukash Chandrasekhar had arranged private jet trips and her hotel stay on different occasions for herself. Statements of Nora Fatehi were recorded under section 50 of PMLA, 2002 on September 12, 2021, abd October 14, 2021, wherein she stated that she got a booking for a charity event and during the event, she was gifted a Gucci Bag and one iPhone by Leena Paulose. (Wife of Chandrashekhar) Nora further stated that Leena Paulose had called her husband and put the phone on the speaker where he thanked her and said that they were her fans. She then announced that they would gift her a brand new BMW car as a token of love and generosity. According to ED, during the investigation, searches were conducted at various places linked to Sukesh Chandrashekar and his associates. During the search, 16 high-end vehicles were seized under section 17 PMLA and these cars are either in the name of the firms of Leena Paulose or in the name of third parties. It is further submitted that it has emerged that Sukesh knowingly created the structure for layering and transferring proceeds of crime and thus, actively participated in the process of money laundering. Tanu desperately waits to reunite with Rishi who returns to India. Veerendra and his wife Sharda are killed in a terrorist attack. Tanu's aunt Bani lies to Rishi's family that her own daughter Neha is Tanu. His alliance is fixed with Neha while Tanu gets engaged to the Jalandhar-based Pawan Malhotra.
Rishi slowly develops a soft corner for Tanu. After many circumstances, he learns about Tanu's identity. She realises her love for Rishi and they marry. To save him from being shot to death by Neha's boyfriend Sandeep, Tanu sacrifices herself and dies sadly. Her spirit appears in front of a shattered Rishi and tells him that she will return for him.

Tanu reincarnates as Sandy's niece Tanuja Sikand and lives in a village near Amritsar. Rishi is now heartless and has lost his faith in love, having turned into a successful business tycoon. His grandmother Preeti develops a bond with Tanuja. Tanu's sister Ahana has married Rishi's brother Manpreet, and they have two children. Sandy reveals to Tanuja that he shot Tanu to death.
Fire breaks out because of a short circuit and Rishi and Tanuja are injured. Tanuja's face is badly burnt in the accident while saving Rishi. Xampp and wamp. Preeti mistakenly gives Tanu's photo to the doctor for plastic surgery. Tanuja gets Tanu's face, and comes to know about the same. She is shocked.
Rishi accuses Tanuja of purposely changing her face, and throws her out of the Bedi house. Rishi's friend Malaika arrives from America. He agrees to marry her. As Raj sees Malaika with her boyfriend Shekhar on wedding day, he asks Tanuja to become Rishi's bride and they marry.
It was Shekhar and Malaika's plan to ruin Rishi's company because he was Rishi's business rival. Closeness increases between Rishi and Tanuja. Gradually, Rishi starts to fall for Tanuja when their misunderstanding is cleared. Malaika is exposed, and thrown out of the house. Rishi and Tanuja consummate their marriage.
After some other twists, Katyani tells Tanuja that she is unlucky for Rishi. Tanuja demands divorce from Rishi thinking she is unlucky for him; both sign divorce papers. His half-brother Poorab Bohra demands 51% of the shares of his company to exact revenge on Raj. Knowing Poorab's intentions, Tanuja arranges for the property to be signed over to her with the help of Raj and Preeti.
Rishi gets engaged for marriage to Rano's friend's daughter Netra, to make Tanuja jealous. As he forces, she signs the property over to the Bedis. Tanuja leaves. Rishi goes to stop her at the railway station, but as she declines to return, he slaps her in anger during the argument and she finally sits in the train before realising she is pregnant with his child.

Rishi is disheartened to learn that Tanuja is Abhishek's wife (in real fake) and has a daughter, and tries to get her back in his life. He tries to make Tanuja remember their past. Netra discovers that Tanuja is just Abhishek's caretaker and friend not wife. She reads Natasha's birth certificate and learns that Rishi is her biological father.
Rishi, after seeing Abhishek's love for Natasha, decides to leave Tanuja's life. Rishi finally learns that Natasha is his daughter indeed. He informs his family that he is Natasha's father. Abhishek, who has fallen in love with Tanuja, learns of her past with Rishi. Rano sends a legal notice for Natasha's custody.
During the custody case, Rishi learns that Tanuja is Abhishek's caretaker. Abhishek proposes Tanuja who earlier refuses but later insists that he marry her to obtain Natasha's custody. Rishi creates problems in the wedding. He decides to marry Netra to obtain Natasha's custody. Tanuja learns that Rishi and Netra aren't married and assumes that they instead have a live-in relationship.
Realising his love for Tanuja, Rishi leaves Netra and stops Tanuja's marriage, reasoning that their divorce application was rejected years ago. Abhishek accuses Tanuja of cheating on him. Tanuja reveals to Natasha that Rishi is her father. Natasha tells court judge that she wants to live with both her parents.
Tanuja is ordered to stay in the Bedi house for six months. Netra now vows to ruin Tanuja. Abhishek creates misunderstandings between Rishi and Tanuja to separate them. After many circumstances, Tanuja realizes her mistake as Rishi tells her the truth, and apologises to him. They reconcile. Jealous, Netra vows to kill Rishi and Tanuja.
Netra bribes a mechanic to tamper with the car brakes in which Rishi and Tanuja are. Abhishek finds her plan but is late to warn Tanuja. The car falls off a cliff and Abhishek takes them to the hospital. Netra is arrested. Tanuja dies in the hospital. Depressed, having lost Tanuja after Tanu, heartbroken Rishi kills himself with poison.

Rishi and Tanuja are reborn as Ranbir Kapoor and Kritika Kohli, respectively. Ranbir is a famous football player in (Canada) and Kritika lives with her mother Malini near (Ludhiana). Ranbir has blurry flashbacks of his past birth in his dreams.
Believing that her husband Arun died, Malini is shocked to see him on news and reaches Mumbai with Kritika to track him down. Ranbir also arrives in Mumbai with his family for a football match.
While Malini searches for Arun at a mall, a fire breaks out, with Kritika and Ranbir there. Kritika exits safely and Ranbir stays inside to help Malini, who is rushed to hospital.
Hospitalised, Malini tells her that Arun is alive and gives his address to Kritika and dies. Kritika learns that her father, Arun has married again to Parminder a.k.a. Pammi and has two daughters, Jiana and Ishani. Arun tells Pammi that Kritika is his niece as she enters the house and lives with them.
Later, Kritika meets Ranbir for first time and they have argument. When she is appointed as intern of an advocate Vikas Sharma. Ranbir's father Balraj becomes involved in a legal battle over custody of his mansion with its caretaker Aayush Batra. Vikas is Ayush Batra's lawyer.
Kritika is harassed by a local contractor Ashok but Ranbir saves her. Jiana (Kritika's half-sister) and Akshay (Ranbir's cousin) fall in love. Ranbir develops feelings for Kritika and they become friends.
Aayush's daughter Malishka drugs and tries to seduce Ranbir. As he rejects her, she frames him for molesting her and files a case. Ranbir is arrested by police but Akshay bails him out.
Eventually, Ranbir wins the case with Kritika's help. Malishka tries to kill his family by burning down the house. Ranbir expresses his love to Kritika but gets unconscious after a pillar falls.
Kritika recalls her previous lives and awakens Ranbir to remind him, who also recognises her and they hug each other and unite, ending the series.

This is an interactive session with detailed information shared on the topic.
Description of the Guest speaker
Mr Satyam Dwivedi is a Rajiv Gandhi National University of Law, Patiala graduate who secured a tier 1 law firm job. He has done an intensive amount of internships since his first year of law school while starting his journey with an internship in one of the most lucrative law firm, Karanjawala and Co. to be followed by Cyril Amarchand and Mangaldas and currently working at L &L Partners. He has worked in the Dispute Resolution Department in all of these firms. He has ventured in all levels of law firms with a belief that you should work with dedication at whichever place you are working in.

Mr Anubhav Garg is a Management Trainee at LawSikho after securing a PPO at his internship with iPleaders (a subsidiary of LawSikho in blogs on legal content) for content writing and event manager. He is currently pursuing his BBA LLB from Guru Gobind Singh Indraprastha University, Delhi. He has demonstrable experience in the field of business laws and functioning of courts and Tribunals in this matter. Q. What are the steps of the recruitment process of these law firms?
(Satyam) It is divided into fresher hiring and lateral hiring. The fresher hiring deals with two ways of hiring- Pre-Placement Offer and the On/Off-Campus hiring. The process starts with a questionnaire based on general topics to be filled by the candidate. In the case of PPO, the individual needs to identify the needs and area of interest of the earlier team to secure a PPO as only the same team can offer it. The clarity about the area of interest should be present. The last step is the interview round which intends to test the knowledge of the candidate on relevant legal aspects. 
Q. What kind of performance is expected from an intern to be considered for a PPO?
(Satyam) The interns and the junior associates are assigned with research work in the beginning. The efficiency and the sincerity towards the work provided while reflecting the knowledge of law is a major benchmark. The writing skills should be up to the mark without compromising on punctuality. The effort towards your work is the most essential element. (on NLUs preference) The law firms due to limited demand and an unlimited supply of lawyers avoid this hassle by approaching tier 1 law schools. But the bias is not there as such as there are a pretty good number of non-NLU students working in these firms. 
Q. What are some common mistakes students make in their CVs or cover letters that reduce their chances of securing an internship/job in a tier 1 law firm?
(Satyam) You should visit international university websites (Harvard and Oxford) to read the samples from their students or surf LinkedIn to search for tier 1 law firm profiles to learn about it. You should try to get maximum internship experience right from the first year and also engage in mooting which is closest to the real simulation of litigation. Always write research papers on a specific field to show your interest and also convince the employer of your area of interest. 
Q. What are some extracurricular activities that need to be there in the CV to increase its strength?
(Satyam) The academics play a major role in the CV as it is a way to filter candidates by the law firms. Adding to this, the mooting experience and the research papers/articles are testimonies to your writing skills. You must be able to identify your interest while doing these activities at the earliest. The core element of the recruitment process in a tier 1 law firm depends on the innate knowledge of the laws you have learnt throughout your law school (on personal experience). The internship must be based on the area of interest and hence the application in those firms that specialise in that field. I followed the reverse process of learning law by studying the reasoning behind the introduction of the different statutes.
Q, What are some of the additional qualifications required to secure the job in the tier 1 law firm?
(Satyam) The additional qualification, such as LLM, increases the odds of you being recruited by these tier 1 law firms. The scholarship in the international universities or completion of the degree from some reputable university is a preferred option by all of these firms. I would suggest you to opt for corporate law as many courses are available on SEBI or NSE websites. Additionally, the modules provided by private websites based on the practical working aspect also helps a lot. 
Q. What are some of the employment challenges faced by young lawyers during the initial time of their career?
(Satyam) The basics learnt in law school should be remembered, the deadlines are short and the pressure is extreme while you are working in the tier 1 law firm. The law firms are a service-based industry that requires commitment from their employees, so the deliverables need to be quick. The challenges are extreme but the seniors are there to guide. The working hours are high and it becomes important to make up your mind to completely commit yourself to work before joining the firm. The job of the associate is different from the partner, where the associate is required to cater to the demands of their employers.
Q. What is the role of networking in landing a job with the tier 1 law firm and how to network in a professional way?
(Satyam) The employers at tier 1 law firms should be approached in a friendly manner as they do understand the ordeals of the candidates seeking a job with their law firm. There are a lot of avenues to network through online forums or visit seminars or workshops to meet professionals. The individuals should apply in the maximum number of firms as they can. The students seeking answers to simple queries can never be pushy and they should approach their seniors. Most often, the experienced people share their knowledge with juniors. 
Q. How to stand out as an intern in the law firms? What are some possible aspects where some improvement can help an intern fetch a PPO?
(Satyam) When you are competing with multiple interns of similar law school experience, your knowledge of law is the factor that distinguishes you from others. Whatever work you are assigned should be delivered on time to the concerned team. In cases when everyone shares equal knowledge of law, the understanding of the practical aspects more than the theoretical aspects of law makes the ultimate difference. The nuances of practice works better than theory through books. The opportunities need to be grabbed as they come to you.
Q. How to build cordial contact/connection with the already working associates in the law firms?
(Satyam) One way is to volunteer to assist these associates or the teams these associates work with to complete a task assigned. This way you communicate with them in a professional manner. You can also raise questions which can be answered by these associates once they know you personally and professionally. Be upfront and humble to them while communicating. If you are dedicated and focussed towards your work, this networking automatically follows. You can always approach them for small talks to seek answers to some issues you are facing and no one refuses to interact when someone approaches them. 
Q. What is the major difference between the litigating law firm and the individual practice at the court?
(Satyam) The requirements of the clients are different in both of these. The volume of cases with the senior advocate is high. On the other hand, the volume of cases for the dispute resolution department of the law firm may not be as much. The difference in the complexity of matters is present in both of these. The majority of law firms work in criminal or corporate matters. The level of research work is extreme at these law firms, as opposed to the litigant lawyer. 
Q. How do we overcome the lack of physical internship in this lockdown period and do virtual internships an alternative to these physical internships?
(Satyam) I would suggest everyone to follow the approach of the reverse study of law to polish your understanding of the law. You should always understand the practical nuances of each sphere of law to gain some positive benefit from it. Try to attain as much practice knowledge as you can by reading material and manuals available online, go in detail and fetch as much information as possible. The stress management is important so one should identify itself before venturing into the law firms.
