Article 13 and the End of Intermediaries’ Liability As We Know It

But in 2016, in the frame of the Digital Single Market agenda, the Commission published a proposal for a new directive that would hold online intermediaries responsible for copyright infringing content. This change of policy provoked the ‘Article 13’ concerns, which overwhelmed the internet world.
What is limited intermediary liability E-Commerce Directive provides that Information Society Services Providers (ISSPs) are not liable for mere transmission of, caching and hosting illegal content, on condition that they expeditiously restrict illegal content when asked so. Furthermore, no general monitoring obligation can be imposed to them. This limited liability system allowed online industries to boom.
What would article 13 mean for online businesses All versions of the new directive -discussed during the legislative process- intended to introduce an exemption to the above regime by requiring ISSPs to secure the rights holders’ permission before making copyrighted user-uploaded content available to the public. In other words, online platforms would have to conclude licensing agreements and probably apply upload filters to stay compliant.

Reactions The news hit the cyberspace like a bomb. Open letters from the civil society and very important figures on the internet markets and academia (including the co-founder of Wikipedia, Jimmy Wales), addressing EU leaders, severely opposed to the reform. From Silicon Valley lobbyists to simple users, everyone was talking about the end of the internet as we knew it.

Youtube’s reaction was the strongest; not only did they raise the “#SaveYourInternet” campaign with pop-ups and videos, but also the CEO, Susan Wojcicki, made two blogposts on 22 Oct 2018 and 12 Nov 2018 claiming, inter alia, that “this legislation poses a threat to both your livelihood and your ability to share your voice with the world” and that “creator economy is under threat”. Creators also responded with numerous videos such as the following one from PewDiePie (one the most successful youtubers worldwide):

The Final Text On 17 April 2019, the final version of EU “Directive on copyright and related rights in the Digital Single Market” was adopted and the text of article 17 (former article 13) indicates some compromise. The scope was narrowed to “online content-sharing service providers” and content uploaded for special purposes (e.g. parody and quotation) was exempted. Moreover, a liability-mitigation mechanism was introduced under which platforms shall not be held liable, if they make ‘best efforts’ to obtain a license and to restrict unauthorised content. What is left from this case is a reform of the EU’s intermediaries’ liability regime that may be in (almost) no stakeholder’s interest. Copyright holders will earn remuneration from a smaller audience and users’ ability to produce and consume content will be reduced. Finally, unequal burden will be put on platforms; the big ones will cope using their expensive Content ID technologies, while the smaller will struggle harder than ever to claim market share.

So the European Parliament approved of Article 13 (now 17) and this means Tumblr will probably be history for everyone in the EU or at least quite restricted, same for YouTube.
I am devastated.
My dear followers from all the other continents of the world, we really fought hard, we demonstrated over weeks, on Saturday was the biggest one yet and the politicians sitting in the Parliament are ignoring our voices, our opinion. They switch up our arguments, they spread false assumptions about our reasons to be against this article and are also implying we’re bots and been bought by american companies like Google and Facebook to stop this madness.
While I hope you all know this is not true, I am absolutely frustrated by this outcome and this way of doing politics. I have always been involved into politics in my country and the EU and I cannot believe that those politicians are this stupid to completely IGNORE the fucking future of their union, of their countries.
I’m not sorry for the rant, but what is happening here is not right.
(I know other countries have it worse and that I live a pretty good life in germany, so don’t come at me saying this. This is a different debate and I agree with you.)

The US-guys always had the support of us Europeans with ACTA and SOPA and whatnot to fight against it ... where was the help of the US when we Europeans might have needed them to raise our voice against this **** idea of some old white guys who don’t know how the internet works?
I mean... when content creators can’t post anything the people in the US will realize that not everyone lives in their country... Europe is large... there are many content creators here who will suffer.

Article 13
So, Article 13 just passed the second stage of voting in the European Parliament. Before everyone freaks out, the law has NOT banned memes, you will still be able to post content from your favourite TV shows/films/bands, it will very likely not affect you at all.
Article 13 is mainly designed to stop people from using copyrighted music on their websites, and from pirating entire episodes of TV shows. That means you can still post Doctor Who gifsets and be just fine, but linking to the entire episode on a dodgy pirate sight might get you in trouble.
It is true that Article 13 introduces the need for large websites to use ‘upload filters’ to screen content, but again, it will not screen out your memes. The only real problem with this is that song parodies are under fire if they’re too close to the original song, which is...not great, but not the devastating internet-ruining law I’ve seen people label it as.
Article 13, in essence, makes it harder for people to pirate content, but it will not actually limit your ability to post edited content about your favourite things, like gifs, video edits, fanart, or fanfiction. At the very worst, sites like Tumblr and Twitter will have to pay a licensing fee to allow their users to post content from copyrighted media, but that’s out of your hands as a user. It will not affect you personally.
So if you’re freaking out right now, my best advice to you is, don’t. You will be fine. If you still want the law to be stopped or changed, the European Parliament uses a ‘trilogue’ system of voting, meaning that there are three rounds of voting on new bills, and Article 13 has only just passed round 2. If you want to stop or change the law, call or email your MEP before the third round of voting.
But other than that, don’t worry. The EU isn’t taking away your memes, and I promise we will all be fine.

This pisses me off to no end. The fact that no one is talking about how Germany Parliament is about to vote on the EU copyright directive law implementation that will require the use of uploadfilters to restraint German users from publishing on use generated platforms. So if you see your German friends disappearing from social media and other platforms, don't be surprised. Soon it will be all users in European countries members.
France wants to do much worse by making uploadfilters mandatory with no safeguard for users. We're fucked guys. We're fucked and no one inside or outside of the EU is talking about it. I'm stressed as hell, angry and hopeless. I wish this was talked about as much as US copyright laws. I wish this post would go viral and we might get some support 😭😔

It's really important! It's our digital future in Europe. If European Parliament is voting for Article 13 (also for 11 and 12) then we will have a dark future for the free internet.
It seems many other European countries don't know about the new copyright law but it's important for ALL people who uses the internet and upload every day!
Only Germany and Poland are strong active against Article 13 with demonstrations. Please help them to avoid this stupid law!
We citizen of Germany are harassed by our own government as bots. We aren't humans, we were paid by Google, and we can't think for ourselves, we are stupid and young, we haven’t enough follower on Twitter to tell our opinion… but the European commission also harassed the people who demonstrated in Cologne on 23rd February 2019 as mob! Disrespectful!
Please help us! We need you and your help!
Europe-wide demonstrations against Article 13 are on 23rd March 2019!
