In the final days of 2024, a federal judge in Florida’s Northern District issued a ruling rejecting a preliminary injunction against a new Florida Department of Corrections (FDC) policy targeting transgender inmates. This policy, introduced on September 30, 2024, frames gender dysphoria as a “short-term delusion,” restricting access to gender-affirming care, permitting hormones only in “rare instances” deemed constitutionally necessary. The FDC bulletin also suggests psychotropic medications and psychotherapy as sufficient alternatives to medical transition, ignoring widely accepted medical guidelines. The American Civil Liberties Union (ACLU), representing plaintiff Reiyn Keohane, challenged the policy, arguing it strips transgender inmates of essential care and dignity. Under the policy, trans women in Florida prisons are denied access to gender-aligned clothing and grooming standards, with confiscation of canteen items and head shaving mandated for non-compliance. According to the ACLU’s October 2024 complaint, inmates face invasive examinations to assess breast size for bra eligibility, subjecting them to dehumanizing treatment under the guise of policy enforcement. The ACLU sought immediate relief, filing for a preliminary injunction to halt these measures.
In his 23-page decision, Judge Allen Winsor, a Trump appointee with a record of anti-LGBTQ+ rulings, dismissed the injunction request. Winsor’s opinion misgendered Keohane, describing her as “a male who self-identifies as a woman.” He argued that the FDC’s policy does not constitute a blanket ban on hormone therapy, despite evidence showing the policy effectively forces the detransition of hundreds of inmates. Winsor claimed that Keohane, having navigated extensive bureaucratic hurdles to preserve her care, faced no “imminent injury” and therefore did not meet the criteria for emergency relief.
Regarding social accommodations, Winsor acknowledged the harm but dismissed its significance, arguing that denying long hair and gender-appropriate clothing does not rise to the level of “grossly incompetent” care or an Eighth Amendment violation. Misrepresenting the World Professional Association for Transgender Health (WPATH) guidelines, Winsor claimed that social transition is not medically necessary and suggested psychotherapy as an adequate alternative. This echoes debunked “conversion therapy” approaches that lack scientific evidence and have been shown to increase risks of self-harm and suicide among transgender individuals. Winsor’s reasoning reflects broader anti-transgender rhetoric typically used in debates about transgender youth but now increasingly applied to adults. The “wait and see” approach for minors, which relies on therapy to suppress gender dysphoria, has long been debunked as ineffective and harmful conversion therapy. Evidence consistently shows that medically necessary care for transgender individuals leads to overwhelmingly positive outcomes, with detransition rates remaining exceedingly low. Laws restricting transgender healthcare, by contrast, have been linked to significant increases in suicide attempts among transgender populations.
Even trans prisoners are entitled to gender-affirming care, and forced detransition of them is morally wrong.

A federal court struck down Alabama’s congressional map on Tuesday, after GOP state lawmakers refused the court’s mandate to draw a second majority-Black district.
The three-judge panel wrote that it was “deeply troubled” that the state legislature declined to draw two majority-Black districts. The same court ruled last year that it should draw a second majority-Black district to comply with the Voting Rights Act. The Supreme Court affirmed the ruling from the lower court earlier this year.
An independent court-appointed expert will now draw Alabama’s congressional map for the 2024 election. Republicans in the state are expected to appeal the decision, which could eventually make its way to the Supreme Court again.
“This is a significant step toward equal representation for Black Alabamians,” said Eric Holder, the former Democratic attorney general who now helms the party’s main redistricting organization, which backed the lawsuit. Holder added that the court rejected “the state’s blatant attempt to diminish those rights in defiance of both this court and the Supreme Court of the United States.”
Drawing a second-majority Black district in the state would likely lead to a second Democrat being elected. Currently, the state has a 6-1 delegation, with the only Democrat — Rep. Terri Sewell — coming from the state’s only current majority-Black district.
The cases in Alabama — Milligan v. Allen and other consolidated lawsuits — were backed by civil rights organizations and Democratic Party-aligned groups. They charged that the original map Republicans drew after the 2020 census, which had only one majority-Black district, violated the Voting Rights Act by diluting the power of Black voters. The three-judge panel agreed, writing in its decision last year that only two majority-Black districts or “something quite close to it” would fix it.
Earlier this year, the Supreme Court affirmed the lower court’s findings that the old Alabama map likely violated the Voting Rights Act. The ruling was a surprise for many court watchers, who had anticipated that the nation’s top court would use the case as an opportunity to chip away at the landmark piece of legislation that the Roberts court has repeatedly targeted.
Republicans in Alabama effectively thumbed their noses at the courts when given the opportunity to redraw the lines. The GOP-dominated legislature ultimately drew a new map that once again had just one majority-Black district and one with a Black voting age population of just under 40 percent. Alabama Republicans argued that they were complying with the law, saying the challengers did not prove the new maps violated the Voting Rights Act and that they were not compelled to draw a second majority-Black district to remedy any violation.
During oral arguments and in court filings, Alabama Republicans signaled that they would likely appeal any decision tossing out the lines.
The three-judge panel — Circuit Judge Stanley Marcus, who has been appointed to posts on the federal bench by both President Ronald Reagan and Bill Clinton, and District Judges Anna Manasco and Terry Moorer, both appointees of President Donald Trump — rejected those arguments.
“The law requires the creation of an additional district that affords Black Alabamians, like everyone else, a fair and reasonable opportunity to elect candidates of their choice,” the judges ruled Tuesday. “[The new map] plainly fails to do so.”
They also said they did not need to give the legislature another chance to redraw the map, saying there is no need to provide “a second bite at the apple” after state lawmakers made no effort to comply with the Voting Rights Act.
The Alabama litigation is just one of several ongoing redistricting lawsuits in the South that could ultimately lead to more Black and Latino representation — and more Democratic seats — in Congress.
On Tuesday, hearings kicked off in a lawsuit in Georgia that similarly alleged that the congressional map prevents Black voters from having the opportunity to elect candidates of their choosing. Hearings in a Louisiana suit are also set to resume next month. And a state judge in Florida ruled over the weekend that the state’s congressional map weakened the power of Black voters and must be redrawn, a ruling that is expected to be appealed by Republicans.
All told, as many as 13 states could see new lines before the 2024 election.

Chatkontrolle ist kein "nationales" Thema
USA, Kanada, Großbritannen und nun auch die EU
Nicht nur in der EU geht das Gespenst der Chatkontrolle um, in Großbritannien ist das entsprechende Gesetz durch und auch in Kanada ist das Thema aktuell. Interessant ist, dass die Diskussionen zu diesem  "weitreichenden Versuche westlicher Demokratien, die Online-Sprache zu regulieren" bereits seit fünf Jahren durch die Politik geistert. Damit zeigt sich, dass der Wunsch nach Online-Zensur nicht erst als Reaktion auf COVID entstanden ist.
Seit dem 19. September 2023 gilt das Gesetz zur Zensur von Online-Inhalten im Vereinigten Königreich. Am 29. September 2023, also nur 10 Tage später kündigte die kanadische Radio-, Fernseh- und Telekommunikationskommission (CRTC) an, dass alle Online-Streaming-Dienste, die Podcasts anbieten, sich registrieren lassen und den gesetzlichen Kontrollen unterwerfen müssen. Und in der EU gilt der Digital Services Act (DSA), der Online-Unternehmen verpflichtet, ihre Plattformen aktiv zu überwachen.
Outsourcing der Zensur
Wie die New York Times berichtet, zwingt der Gesetzentwurf Online-Plattformen dazu, "proaktiv nach anstößigem Material zu suchen und zu beurteilen, ob es illegal ist", anstatt sie zu zwingen, erst zu handeln, nachdem sie auf illegale Inhalte aufmerksam gemacht wurden.
In den USA ist man bereits einen Schritt weiter. Dort haben sich Menschen (und NGOs) gegen solche Maßnahmen gewehrt. Die US-Regierung hat mit der Kennzeichnung von Material, das entfernt werden soll, die verfassungsmäßigen Rechte auf freie Meinungsäußerung eingeschränkt und dagegen gab es juristische Schritte. Am 8. September 2023 bestätigte das Fifth Circuit Court of Appeals einen Teil der einstweiligen Verfügung der Vorinstanz und verbot dem Weißen Haus, dem Surgeon General, den Centers for Disease Control and Prevention und dem FBI, Social-Media-Unternehmen zu beeinflussen, um „Desinformationen“ zu entfernen. Leider hob das Berufungsgericht wieder Teile der ursprünglichen Verfügung auf.
So ist es Beamten der Agentur für Cybersicherheit und Infrastruktursicherheit (CISA) weiterhin erlaubt den Unternnehmen Anweisungen zur Zensur zu geben und die CISA  wird weiter eine zentrale Rolle bei der Zensur der Amerikaner durch die Regierung spielen.
Welche "Desinformationen" sind gemeint?
Das bleibt im einzelnen Auslegungssache, eindeutig festgelegt sind nur wenige Begriffe
Pornografie und sexuelle Ausbeutung von Kindern
Informationen, die Selbstmord, Selbstbeschädigung oder Essstörungen fördern
"Fehlinformationen über Impfstoffe" und andere "gesundheitsschädliche Inhalte"
Bei den "gesundheitsschädlichen Inhalten" können Veganer, Vegetarier und Fleischesser sicher sehr verschiedene Ansichten haben. Die Verantwortung für das Sperren der Informationen obliegt aber nach allen Gesetzen (egal ob in Nordamerika, GB oder EU) stets den privaten Anbietern. Da denen empfindliche Strafen in der Höhe von 4-10% ihres Umsatzes drohen, werden sie sicher vorsichtshalber proaktiv handeln und ihre Zensurbefugnisse mit übermäßiger Härte einsetzen.
Das globale Internet wird fraktioniert
In der EU wurde uns versichert, dass es nur gegen die Großen, z.B. die Big5, ginge, da der DSA von Unternehmen mit einem Jahresumsatz von 10 Millionen und mehr spricht. Kanada und Großbritannien zeigen, dass es auch die Kleinen treffen wird. Im verlinkten Artikel lesen wir:

Kanadas neues Online-Nachrichtengesetz verpflichtet "marktbeherrschende Plattformen" dazu , "Nachrichtenunternehmen zu entschädigen, wenn deren Inhalte auf ihren Diensten verfügbar gemacht werden" - was an das fehlgeschlagene deutsche Leistungschutzrecht (LSR) erinnert. Darauf erklärte Facebook am 1. Juni 2023: "Um dem Online News Act zu entsprechen, haben wir damit begonnen, die Verfügbarkeit von Nachrichten in Kanada zu beenden ... Nachrichtenlinks und -inhalte, die von Nachrichtenverlagen und Sendern in Kanada gepostet werden, können von Menschen in Kanada nicht mehr eingesehen werden".
Egal ob uns Nachrichten wegen des Geld Verdienens vorenthalten werden oder es um politische Zensur geht - wir setzen uns weiter für Informationsfreiheit und Transparenz ein. Allein das Wissen, dass alle unsere Nachrichten künftig mitgelesen und "überprüft" werden, ist ein schwerer Eingriff in unsere Grundrechte.

William Eugene McAnulty, Jr. (October 9, 1947 - August 23, 2007) was the first Black justice to serve on the Kentucky Supreme Court and the first Black person to ever hold a cabinet-level position in Kentucky state government. He was appointed to the state Supreme Court by Kentucky Governor to fill the spot of retiring Justice, he was elected to keep the position the following November.
He was born in Indianapolis to Ann Moss and William McAnulty, Sr., a mailman. He and his two sisters. Before enrolling in Indiana University, he worked in the Indiana governor’s office as a clerk.
After earning his BA at Indiana University, he earned his MA in Education. He earned his JD from the University of Louisville.
He became a judge for the Jefferson County Juvenile Court in Louisville. He was elected to the Jefferson Circuit Court. He rejoined the private practice at the business law firm Greenbaum, Doll & McDonald, where he became a partner. He took the Chief Judgeship after being reelected to the Jefferson County Circuit Court. He was elected to the Kentucky Court of Appeals, his last position before joining the Kentucky Supreme Court in 2006.
He earned the Henry V. Pennington Outstanding Judge of the Year Award; the Louisville Bar Association Judge of the Year Award; the Kentucky Trial Attorneys Association Award; the Metro United Way’s Allen Society Leadership Award; the Thomas C. Simons Leadership Award; and the Distinguished Alumni Award from the Louis D. Brandeis School of Law at the University of Louisville. He was involved in the community and was a member of the YWCA Spouse Abuse Center, Kentucky Youth Advocates, and the Children Placement Project.

Grab a coffee at the Golden Pear in Southampton, New York, drive due south almost a mile straight down Main Street, take a left onto Gin Lane. It’s just a five-minute drive. As your GPS will tell you, you’ve arrived. The storied street, one of the most exclusive in the Hamptons, runs parallel to the ocean. It’s filled with grand old shingled homes, some built in the late 1880s, hidden from view behind hedgerows of privet, a hardy shrub first brought to the Hamptons by English settlers in the 1600s.

From your turn onto Gin Lane, it’s another 0.7 miles to number 376. Here sits a cedar-shingled house—which you can’t see from the street—built in 1888 on the Rosa rugosa dunes for railroad tycoon Robert Olyphant, the great-great-grandfather of actor Timothy Olyphant. The house is rumored—but never proven—to have been designed by Stanford White, the Gilded Age starchitect and accused sexual predator. White was 47 when he allegedly raped 16-year-old Evelyn Nesbit and 52 when Nesbit’s then husband, multimillionaire Harry Kendall Thaw, shot him dead. The house, first known as Eden Cottage, has direct access to the beach. Film buffs may recognize it from Woody Allen’s 1978 movie, Interiors. Its own feature coffered ceilings, nine fireplaces, and French doors galore.
In 1990, Carl Spielvogel, the late ad mogul, and Barbaralee Diamonstein-Spielvogel, the landmarks expert, bought the 12-bedroom house. The Spielvogels hired White’s great-grandson, architect Sam White, to restore the home, which they called Bonnie Dune—the home’s name since the turn of the century. Then they decided they needed a bigger place.
Enter Louise Blouin and John MacBain. The couple bought the estate for a reported $13.5 million in late 1997 and renamed it La Dune. The house had just been through a storm—perhaps it was an omen—but a steel bulkhead had been installed, and the sale went through. There was no bulkhead, however, to protect the MacBains’ marriage from the elements, which in the Hamptons includes a certain type of striving that can be as destructive as it is all-consuming.
As the MacBain family settled in, they built a second house on the Hamptons property, with interiors by the late Francois Catroux, a decorator to aristocrats, Russian oligarchs, and rich Americans. The guesthouse features nine bedrooms, eight baths, two powder rooms, a home theater, and a billiard room. Both homes boast gyms, saunas, and staff quarters. The compound sits on 4.2 prime oceanfront acres, with 19 bedrooms between them, two pools, and a sunken all-weather tennis court.
Blond, beautiful, and wildly ambitious, Blouin had made a fortune with MacBain, creating an international classified ad empire. La Dune was the perfect place to show off their success. But the couple, who brought their own strengths to the business, were growing apart. By 2000, they had divorced. Blouin began to travel the jet-setting art world circuit with auctioneer Simon de Pury, chairman of Phillips, de Pury & Luxembourg, who had become her boyfriend following the breakup of her marriage; de Pury hired her to be CEO. By 2003, her relationship with de Pury, and his company, had come to an end, and she moved into art publishing.
As she moved into the art world, Blouin launched a foundation, held “art Davos”–style “global creative leadership summits,” and handed out awards to world leaders (Bill Clinton), billionaires (Carlos Slim), Nobel Prize winners (Elie Wiesel; some neuroscientists), and famous artists (Jeff Koons). She threw parties for her foundation at places like the Venice Biennale with her then boyfriend Prince Andrew in tow. Her big ideas explored creativity and the brain, and using culture to promote world peace. Only her ego was bigger. She put her name in front of all her publications and websites. Blouin had an eye for talent but a manic nature, bombarding her staff with nonsensical staccato emails.
“She was fun. She was creative. But no one on her team took her seriously,” says a former publicist. And while Blouin would generously fly some staff on private jets for ski trips and invite others to work retreats at La Dune, allegations swirled that she cut people’s pay, fired them, or stiffed them altogether. In interviews with VF, ex-staff call her a “liar,” a “sociopath,” and “vindictive.” “A kinder word would be ‘delusions of grandeur,’ ” said one former executive. Blouin’s companies have also been sued by a landlord, a printer, and many others—according to reports and staffers interviewed by VF. The New York Post dubbed her the Red Queen for her penchant for wearing the color and for her Alice in Wonderland “off with their heads” management style. “She thought she was a genius, but she just wasn’t,” says one former senior staffer. “She presented herself as this brilliant businesswoman, a thinker, and a kind of tech visionary—like some kind of global figure in a Steve Jobs way.”
And now Blouin has finally lost La Dune. The estate was sold in a bankruptcy sale this winter. What has happened since then is not totally dissimilar from other stumbles and scandals in Blouin’s long public history: She is crying foul and unfair play, mulling her options to sue everyone from her brokers to the auction house that sold La Dune—even The New York Times, for an interview she gave after the sale. “Ms. Blouin contacted us to raise what she believed to be inaccuracies,” says a spokesperson for The New York Times. “We carefully reviewed those concerns and concluded the story was accurate as published. We stand by the reporting.”
The first time I spoke to Blouin, it was by phone, on her final night at La Dune. It had been more than a quarter of a century since she had first bought the Gin Lane estate. Her voice was calm, even, unemotional, and slightly regal, like Judi Dench’s fictional spy chief, M, in the James Bond films. That was the first of two long interviews. What followed was a flurry of emails, texts, and phone calls—I stopped counting after 50. At one point she sent me a digitally constructed “evidence” board, like the kind you see in the movies, featuring pictures of and red arrows around the people whom she claims have conspired against her. It would be incomprehensible to even try to detail it here. To sum it up, she has a lot to say.
For one thing, she insists, she does have empathy, and that’s why she went into the arts, and took care of her mother when she had Alzheimer’s disease, and her husband following a ski accident in 2015. She also says she is only just now unraveling a massive fraud orchestrated by key members of her publishing team, to the tune of millions. When she found out, she says, she shut down and transferred the New York office overseas.
The last time Blouin spoke with Vanity Fair for this story, she wanted to underscore points she’d emailed, texted, and called about. “I don’t pay things. When you are a chairman and CEO of a global company, you don’t pay things,” she said via Zoom. And then, a few breaths later, “I paid everyone, they stole the money on the other side.”
Some ex-staff interviewed by VF also believe there were some irregularities, but not on the scale that Blouin alleges. Others say their work practices were standard. Blouin claims the Manhattan district attorney opened an investigation; the DA declined to comment.
As for the house, “she has seller’s remorse,” said John Allerding, a lawyer for Bay Point Advisors, Blouin’s last lender. If there had been a minimum reserve bid, “we would have had no bidders and we would be in the same position as we were when we got involved in September 2022: two properties that nobody wanted, generating expenses.”
The Department of Justice has an ongoing investigation involving federal withholdings from Blouin’s employees’ paychecks that were never sent to the government. Blouin has lodged her own complaint against the government. When reached by VF, an IRS investigator and the IRS spokesperson declined to comment. From Europe, Blouin tells VF the company allocated money to pay the withholding but that it never made it to the federal government. She says she had nothing to do with any “fraud” because she didn’t run her company, and that she welcomes the IRS investigation. “The truth will finally come out,” she says.
“The Big Apple ate me,” Blouin says in another call, with a laugh. “I wasn’t lucky in New York.”
The house on Gin Lane is far from Dorval, the Montreal suburb where Blouin grew up in comfort, one of six children. Her parents ran an insurance brokerage. She went to private schools and sailed competitively. According to the Toronto Star, she traces her heritage on her mother’s side to Jacques Viger, the first mayor of Montreal, elected in 1833. Blouin attended McGill University but never graduated. She annulled her first marriage, to David Stewart, an RJR-Macdonald tobacco heir. In 1987, Blouin married MacBain. A Rhodes scholar and son of a Liberal member of parliament, MacBain was a rising star at Power Corporation, which was owned by the family of Blouin’s brother-in-law, Paul Desmarais Jr., who came from one of Canada’s wealthiest families. As the MacBains’ business grew, the couple moved to Europe and summered at La Dune, where they enjoyed family life with their three children and threw lavish parties. But MacBain did not share Blouin’s social ambitions, some say, and the couple grew apart.
Two years after buying La Dune, in 2000, the marriage was over but the parties continued. Calvin Klein, Ross Bleckner, and Bianca Jagger were among the many guests. Blouin sold her share of the business to her ex-husband for a reported $200 million. The men she dated during this new chapter—including Simon de Pury, the “Mick Jagger of auctioneers,” and Prince Andrew—were also drawn to La Dune.
For many years, La Dune was Blouin’s calling card, luring stars and their hangers-on through the oceanfront doors. But over time, it became an albatross. By 2018, a $26 million mortgage required additional lenders. In 2023, the compound was both in bankruptcy protection and on the market for an astonishing $150 million. It was also for rent for millions of dollars. “If she could have gotten a renter at $2 million or $3 million for the summer, which was possible, she would have been able to service the loan,” a broker who once worked with Blouin told VF.
Those who walked through the compound during its final months on the market told VF that it had great bones, but there was something tragic about it. One banker, who attended a lunch prepared by Blouin’s private chef on a terrace overlooking the ocean last summer, ultimately turned down her refinancing request.
“When people live above their means against assets they have or inherited in order to tread water, it typically doesn’t end well. Nobody thought it was worth $150 million. It felt like Grey Gardens, with faded Hiroshi Sugimoto seascape photographs on the wall,” he says. Such grand old houses, he notes, “get really beaten down by the ocean.”
Ultimately, on a cold winter night in January this year, Blouin lost La Dune in a live foreclosure auction that lasted a little longer than five hours, at Sotheby’s New York offices on the Upper East Side. The sale was the first time Sotheby’s auctioned real estate live alongside art, in a collection titled “Visions of America.”
“This should be a series on Netflix,” a would-be buyer whispered, referring to all the drama.

US District Judge Allen Winsor has already heard arguments on the state's motion to dismiss Disney's lawsuit. The basis of Disney's lawsuit is similar to that of Warren - that they were retaliated against because they exercised speech that was protected by the First Amendment. The timing of the 11th Circuit's ruling in the Warren case could not have come at a more opportune time for Disney, since Judge Winsor has not yet made his decision and the 11th Circuit's decisions are binding on his court.

*** On September 7, 2023, responding to a rise in mass shootings and gun-related deaths, New Mexico Governor Michelle Lujan Grisham (“the Governor”) issued Executive Order 2023-130 (“EO”) declaring a state of public health emergency “of unknown duration” due to gun violence. Exec. Order No. 2023-130, (Sept. 07, 2023). The Governor's EO directed the New Mexico State Departments of Public Health, Homeland Security and Emergency Management, and Public Safety to collaborate with the Governor's officer to provide a coordinated response to implement the EO. The following day, on September 8, 2023, New Mexico Department of Health Secretary Patrick M. Allen (“Secretary Allen”) issued a “Public Health Emergency Order Imposing Temporary Firearm Restrictions, Drug Monitoring and Other Public Safety Measures” (“PHO”) pursuant to his authority to preserve and promote public health and safety. PHO (N.M. Dep't of Health Sept. 8, 2023). Among other prohibitions in the PHO, Section (1) restricts open or concealed possession of a firearm by any person, other than by a law enforcement officer or licensed security officer, “within cities or counties averaging 1,000 or more violent crimes per 100,000 residents per year since 2021 according to [the] Federal Bureau of Investigation's Uniform Crime Reporting Program AND more than 90 firearm-related emergency department visits per 100,000 residents from June 2022 to June 2023 according to” the Public Health Department. Id. at § 1(A).*** 1. Plaintiffs Will Suffer Irreparable Harm Absent an Injunction The Court also finds that Plaintiffs have shown they will suffer irreparable harm if a temporary injunction is not issued. “A plaintiff suffers irreparable injury when [a] court [is] unable to grant an effective monetary remedy after a full trial because such damages would be inadequate or difficult to ascertain.”*** 3. The Temporary Restraining Order Will Not Be Adverse to the Public Interest Plaintiffs have shown that the Temporary Restraining Order will not be adverse to the public interest. As the Tenth Circuit has stated, “it is always in the public interest to prevent the violation of a party's constitutional rights[.]” Hobby Lobby Stores, Inc. v. Sebelius, 723 F.3d 1114, 1145 (10th Cir. 2013) (citation omitted). Moreover, a state “does not have an interest in enforcing a law that is likely constitutionally infirm.” Chamber of Com. of U.S. v. Edmondson, 594 F.3d 742, 771 (10th Cir. 2010). Although the State of New Mexico raises important safety concerns, at this stage it fails to demonstrate that the public safety concerns overcome the public's interest in preventing constitutional violations. *** 4. The Balance of Equities Favor Plaintiffs The balance of equities weigh in favor of issuing a TRO. As noted “it is always in the public interest to prevent the violation of a party's constitutional rights[.]” Hobby Lobby, 723 F.3d at 1145; see id. at 1147 (finding that the balance of equities favored First Amendment plaintiffs where they faced “the Hobson's choice between catastrophic fines or violating [their] religious beliefs.”) Because the PHO likewise subjects “[a]ny person or entity” to “civil administrative penalties available at law,” the Plaintiffs face the choice of either facing fines or violating their Second Amendment right to carry a firearm in public for self-defense. Id. Accordingly, the Plaintiffs have shown that the balance of equities weigh in their favor.***
