Nikita Rees-Wilson and her husband enjoyed a honeymoon in Greece last fall. Like many, they returned home to Cambridge without any luggage. “We did our due diligence,” Rees-Wilson said. “We filed all the paperwork for the missing baggage claim.”
The couple tracked their baggage with Apple AirTags. They watched as it sat in Montreal for roughly a month before being shipped out to a facility in Etobicoke in the Greater Toronto Area.
The excitement was because we were heading back to Toronto to visit a processing facility. However, their suitcases remained there for more than three months. They called Air Canada countless times but did not receive help retrieving their bags. That’s when the police got involved. Officers obtained a warrant to search the Etobicoke storage facility.
In a statement, Toronto police said it was determined that a charity organization contracted by the airline carrier had lawfully obtained the luggage after it had not been claimed. The luggage was transported to a storage facility in Etobicoke.”
Rees-Wilson said we figured if we got the police involved, they could seize this luggage because it’s our personal property. Meanwhile, Air Canada told Global News: Our goal is always to have baggage arrive with customers. We are working to resolve this matter.
The airline did not provide additional information about its current lost luggage policies nor the name of the charity with which it is affiliated. Passenger rights advocate Gabor Lukacs called Air Canada’s actions “theft.”
“This is the most egregious baggage-related issue I’ve seen in my 15 years of being a passengers’ rights advocate,” Lukacs said. Toronto criminal defence lawyer Marcus Bornfreund echoes Lukacs’ concerns, saying, “the airline is not lawfully in possession of that bag. It was delayed, lost and then found.”
While the couple has since been reunited with their possessions, Rees-Wilson says her experience can happen to anyone and encourages people to hold airlines accountable.
She tells Global News she has been financially compensated by the airline but is considering taking further legal action.

An Ontario woman whose luggage was left behind while travelling with Sunwing over the holidays says the AirTag she packed shows her bag has been sitting near the tarmac at Toronto Pearson Airport for more than two weeks.
The couple’s flight was scheduled for 6:30 a.m., but four back-to-back delays saw their departure time pushed back to approximately 10 a.m.
When the plane took off, Greaves said she could still see her bag sitting on the tarmac.
Upon landing in Varadero, Cuba, Greaves said she received an alert from Sunwing notifying her that her bag would not be flown to Cuba at all, that it wouldn’t arrive in time, and that she would be reunited with it upon her return to Toronto.
The couple says they went the duration of their trip without any of their belongings and purchased what they could from local markets.
The whole time, Greaves said the AirTag she secured inside her bag indicated the luggage was still on Pearson’s tarmac, near an Air Canada hangar.
On Jan. 2, Greaves says she was told airline staff couldn’t locate her bag in the designated warehouse.
But, to this day, Greaves said her bag hasn’t moved from the tarmac. Since Greaves returned home, she says she’s been back and forth with Sunwing, attempting to convince them to retrieve her purse. She offered to hand her phone over to a staff member and let them retrieve the bag using the AirTag without her, she says, but so far, her efforts have been unsuccessful.
The Greater Toronto Airport Authority says each airline, not the airport itself, is responsible for baggage delivery, “including warehousing and staging of bags, reuniting passengers with their baggage, and providing guidance on where and how to pick up bags.”
When reached for comment, Sunwing says it continues to make “every effort to reunite customers with their bags that did not accompany them on their journeys.”
Greaves says the problem, however, is that her bag is not at central baggage or the sorting facility and doesn’t seem to be moving at all, according to her AirTag.
Sunwing has prepared passengers for the “unprecedented operational challenges” over the holidays.
In a joint statement issued on Jan. 5, Sunwing Travel Group CEO Stephen Hunter and Sunwing Airlines president Len Corrado said they were "incredibly sorry for letting customers down."
This apology, however, hasn’t changed the fact that Greaves is without her belongings.
According to Sunwing policy, a checked bag is deemed lost if it is not located within 21 days from the date it was supposed to be delivered to you, so Greaves has to wait until Monday before she can apply for reimbursement. Even when she does, it will only reimburse up to CAD 2,000.

Notes on surfboard
Up to two surfboards can be placed into one surfboard bag. One set of windsurfing gear comprises one board, one mast, one boom, and one sail.
We may be unable to check items due to cargo hold space limitations.
Other sports equipment will be handled as normal baggage and will be charged an extra baggage fee under JAL regulations if weight or size is over the free baggage allowance.
