Acreage Holdings CEO to Speak About Cannabis at SXSW Panel
Tumblr media
Continuing a clear shift towards cultural acceptance of cannabis-related companies, one of the biggest film, music, and media festivals in the United States is about to host upper management from Acreage Holdings, Inc. (CSE: ACRG.U; OTCQX: ACRGF; FSE: 0VZ). Chief Executive Officer Kevin Murphy will appear at South By Southwest (SXSW) in Austin, Texas this coming March 15 to speak at a panel moderated by CNBC market strategist Tim Seymour. Former Republican Speaker of the House John Boehner – who is on the Acreage board of directors – will also speak at the panel. The SXSW appearance marks a turning point in cannabis visibility for Acreage after CBS turned down the company’s request to air a 30 second ad during Super Bowl LIII last month. The ad spot would have shown cannabis being used to help patients who suffer from epileptic seizures and chronic pain conditions. A longer 60 second version of the ad was later released online and can be seen below. https://www.youtube.com/watch?v=j4GpGHgOHAk Acreage’s appearance at a world famous conglomeration of conferences and performances like SXSW is just the latest in a string of efforts towards greater acceptance of cannabis. The SXSW panel is particularly of note as cannabis usage – either medical or recreational – remains illegal under state law in Texas. Ten out of 50 U.S. states have legalized recreational marijuana at this point, with all cannabis remaining illegal at the federal level. As a movement towards full nationwide legalization gains steam, MedMen Enterprises Inc. (CSE: MMEN; OTCQX: MMNFF) and director Spike Jonze teamed up last month to declare cannabis the “new normal” with a viral ad narrated by actor Jesse Williams. The issue is expected to dominate the 2020 U.S. Presidential field, with Democratic candidates seeking their party’s nomination showing early support for wide-scale cannabis legalization. So far Presidential hopefuls Kamala Harris, Cory Booker, Bernie Sanders, Elizabeth Warren, Kirsten Gillibrand, and Amy Klobuchar have all voiced some level of support for decriminalizing or full legalization. On the Republican side, last week President Trump’s administration issued a call for public comment on the potential for rescheduling marijuana. If it were pulled off the current Schedule I drug designation, companies would have more leeway on medical research and it could show a willingness on the federal government’s part to re-think prohibition. America's favorite hypocrite John Boehner will now lobby for marijuana
Tumblr media
Now that he's retired from Congress, former House Speaker John Boehner has decided to channel his inner flip-flopper and lobby for legalized weed.
Boehner announced his decision Wednesday to join the board of Acreage Holdings, "an investment company with an established footprint in the cannabis industry in the United States."
"My thinking on cannabis has evolved," Boehner said, sans winking emoji, in a tweet.
SEE ALSO: The largest protests in American history are happening now. Expect them to get bigger.
Boehner said he'd be lobbying to de-schedule the drug so we can "do research, help our veterans, and reverse the opioid epidemic ravaging our communities. research, help our veterans, and reverse the opioid epidemic."
I’m joining the board of #AcreageHoldings because my thinking on cannabis has evolved. I’m convinced de-scheduling the drug is needed so we can do research, help our veterans, and reverse the opioid epidemic ravaging our communities. @AcreageCannabis https://t.co/f5i9KcQD0W
— John Boehner (@SpeakerBoehner) April 11, 2018
The former speaker's decision comes at a time of soaring profits for the legalized cannabis industry, with $10 billion in sales recorded in 2017.
In 2011, John Boehner said he was "unalterably opposed to the legalization of marijuana or any other FDA Schedule I drug." He added, "I remain concerned that legalization will result in increased abuse of all varieties of drugs, including alcohol."
In fact, the former speaker spent much of his legislative career making life harder for drug users and instituting harsh penalties for drug sellers. In 1999, he voted to prohibit needle exchange and medical marijuana in D.C. — services that, arguably, help the the most vulnerable victims of the drug trade. In 2007, he voted against expanding services for ex-offenders leaving prison and re-entering public life. In 1999, he voted for a bill that allowed juveniles to be tried as adults for serious drug offenses.
Towards the end of his career in Congress, Boehner did signal an openness to getting people out of prison who "don't really need to be there," including non-violent drug offenders. The bill was never passed, and shortly thereafter, Boehner left Congress.
I wonder if Boehner's thoughts on all of the drug bills he signed have also "evolved."
My hunch is a giant "Nah."

Why Protecting Cannabis IP is Such a Challenge in the US
Tumblr media
Acreage Holdings CEO Muses on What Companies Can Do to Better Protect Their Cannabis IP – LPC
One of the huge disadvantages companies have in the US is protecting cannabis IP (intellectual property). The reason, says Acreage Holdings CEO Kevin Murphy is simple: it’s still illegal in the US. “Of course, the best solution to these problems would be for the federal government to legalize cannabis,” he said. Murphy wrote an opinion piece about cannabis IP in Forbes (please see link below). “That would allow for national trademark rights and immediately eliminate many of the complications the industry now faces.” Those complications are not small. Generally speaking, if an American company generates any IP, they simply file it with the United States Patent and Trademark Office. But that only applies to products that can be lawfully sold in the US. Now that hemp is legal in the US, products derived from hemp can be registered. But cannabis IP is still wide open. “At my company, we are creating and licensing IP for products around the country,” he said. “We’re seeing firsthand how dealing with (cannabis IP) requires an extra level of attention.” Companies can’t even do anything as basic as registering their name. “A brand name registered in California may be owned by someone else in Maine,” he said. “Without the ability to have nationwide rights through federal trademark law, issuing a ‘nationwide’ licence is extraordinarily difficult.” This is similar to the issues companies have securing banking services.
How Can Companies Protect Their Intellectual Property in the US? – LPC
Murphy suggests companies take a series of steps to protect their cannabis IP as best as possible. First, companies must make their IP claims enforceable in all individual states. “The challenge for cannabis entrepreneurs is that cannabis IP needs to be rigid enough to be defensible against infringement, but also flexible enough to be applied across 33 different state regulatory schemes. That’s not easy to balance.” Next, he said, companies should take the time to ensure their cannabis IP does not infringe upon anyone else’s in each state. That process takes time, he said, but it’s worth it. Finally, when expanding to other states, he suggest licensing agreements. Local companies will already have local knowledge of laws and be compliant, and ultimately help secure cannabis IP in that state. He uses the example of Colorado companies selling in California. “Such use of the Colorado-based brand in connection with sales of the products in California may, in turn, support obtaining a trademark registration for the Colorado-based brand in California.” In case you’re wondering, companies cannot register their cannabis IP in Canada and have it apply in the US. On the flip side, this is sort of a microcosm of what may come. Canopy Growth has an agreement to buy Acreage Holdings when the US legalizes cannabis. In this case, Canopy Growth IP could, in theory, be registered through Acreage Holdings in the US.
