Federal judge rejects GOP-led challenge seeking to invalidate nearly 127,000 votes in Democratic-leaning county

The lawsuit is a major last-minute challenge to voting rules in closely watched states ahead of the election, in which some officials have made special accommodations amid the coronavirus pandemic.

The Republican plaintiffs immediately appealed the ruling to the 5th US Circuit Court of Appeals.

“When you balance the harms you’ve got to weigh in favor of that – in counting the votes,” Judge Andrew Hanen ruled after a nearly three hour hearing. The judge noted that people have been voting using the drive-thru tents since mid-October and the petition to invalidate those votes was filed only late last week.

Hanen, an appointee of President George W. Bush, rejected the Republicans’ arguments on a technical matter, but also said he would have ruled against them since the lawsuit was filed well after thousands of people had voted.

Sunday, the all-Republican Texas state Supreme Court denied a similar petition on drive-thru ballots. Roughly 10% of the votes cast in-person during the early voting period have been cast at those sites.

In a separate case in Nevada on Monday, a judge rejected a Republican lawsuit seeking to halt early counting in Clark County, which includes Las Vegas, over the stringency of signature-matching computer software and how closely observers can watch votes being counted.

President Donald Trump and Republican officials have repeatedly made baseless claims of voter fraud and sought to cast doubt on measures including voting by mail and the use of dropboxes.

Judge warns about drive-in sites for Election Day

Throughout the hearing in Houston, Hanen appeared to grapple with the idea that nearly 127,000 people had already voted in the drive-thru polling centers and whether, if he invalided the process, they would be able to vote on Election Day.

“A lot of people would say, ‘Gee, if I had known there was a question about voting drive-in, I would have parked my car and walked to the polls,'” Hanen said.

Reading his ruling, Hanen noted that the case may be appealed to the New Orleans-based appeals court, and suggested that were it returned on appeal, he may move to stop Harris County from offering drive-thru voting on Tuesday.

Hanen said Texas election law requires ballots to be cast inside a building, and, “I don’t find a tent to be a building.”

“I would not vote in a drive thru out of my concern whether that’s legal or not,” Hanen said, ordering Harris County to maintain records of ballots cast at those sites on Tuesday in the event of future legal challenges.

Harris County Clerk Chris Hollins said drive-thru voting will continue on Election Day.

“We will have drive-thru voting open tomorrow. We will count those votes. And we want to make clear that voter access in Texas and in America is a constitutional right that we will protect,” Hollins said after the hearing.

“We will give voters on Election Day the same rights, the same conveniences that every other voter has had during the early voting period,” Hollins added.

During the hearing, Christina Ford, an attorney representing Democratic parties that intervened in the case, emphasized the potential difficulty to voters who cast their ballots to try and cast a new one.

Ford said that provisional ballots do not have a check box on them to reflect that the voter had cast a ballot at a drive-thru location and that if a voter is found to have intent to vote twice it is a criminal offense.

Voters relied on county officials, Ford said, and invalidating their ballots would “cause mass confusion” and create a “frantic situation with voters trying to figure out if they could cast a provisional ballot.”

Texas Democratic Party Chair Gilberto Hinojosa said the lawsuit never should have been brought in the first place.

“Texans who lawfully voted at drive through locations should have never had to fear that their votes wouldn’t be counted and their voices wouldn’t be heard,” Hinojosa said. “This lawsuit was shameful and it should have never seen the light of day.”

Former Vice President Joe Biden’s campaign called the ruling a “victory for Texas voters.”

In a statement, the campaign’s Texas State Director Rebecca Acuña said: “Today is a victory for Texas voters and the more than 120,000 Texans who followed the rules, made a plan to drive-in vote, and exercised their constitutional right.”

The hearing began at 10:30 a.m. CT, but public access was limited at the start.

Reporters and other members of the public were granted access to a teleconference about an hour after the hearing began. A phone line that had been set up for access broke down as the hearing was about to begin. Reporters inside the courthouse were held in the lobby and not allowed into the courtroom due to social distancing measures put in place due to the coronavirus pandemic.

About 90 minutes after the hearing began, those reporters were eventually allowed into the courtroom.

Steve Vladeck, Appradab Supreme Court analyst and professor at the University of Texas School of Law, said the lawsuit fits a broader pattern of GOP-led lawsuits claiming voter fraud.

“Like so many 11th-hour voting-related suits filed by Republicans in recent weeks, this suit has almost nothing to do with voter fraud,” Vladeck, who has intervned on behalf of the defendants, wrote in an op-ed published in The Washington Post.

“Rather, it’s the latest in a consistent and cynical line of suits — in Wisconsin, Pennsylvania, Minnesota, among others — that appear motivated by partisan gain, assuming that the exclusion of any set of ballots from Harris County … is good for Republicans.”

Judge is no stranger to controversy

Hanen was appointed to the bench in 2002 by then-President Bush and now serves in the Houston Division of the Southern District of Texas, which sits in Harris County, the state’s most populous county and a Democratic stronghold.

Hanen is no stranger to controversy. Back in 2016 he blocked President Barack Obama’s push to expand the Deferred Action for Childhood Arrivals program as well as another program aimed at parents of legal immigrants. At one point as a part of that litigation, he was infuriated by actions taken by lawyers at the Department of Justice, causing him to issue a 29-page order that began by quoting a scene in the movie “Bridge of Spies.”

Hanen also quoted from “Miracle on 34th Street” before concluding by ordering the attorneys who appeared in plaintiff states to go through a legal ethics course.

The case 10 drive-thru voting locations Harris County set up for early voting, which ended Friday, and Election Day. The 10 locations are connected to traditional polling locations.

While curbside voting in Harris County is limited to voters with a disability and located at all polling sites, the drive-thru voting locations are open to all voters.

The federal challenge argues that drive-thru voting violates the US Constitution, which says state legislatures decide how elections are run. The plaintiffs also argued it violates the equal protection clause of the 14th Amendment, in that the county is adopting a manner of voting that has not been adopted by other Texas counties.

Jared Woodfill, a Houston lawyer representing the plaintiffs, argued that Hollins was acting on his own by implementing the practice of drive-thru voting, but Hollins has staunchly defended the practice of drive-thru voting, calling it a safe and legal option amid the pandemic that’s been repeatedly backed by the courts and election officials.

Before the hearing, Hollins told Appradab’s Jim Sciutto on “Newsroom” Monday that should the nearly 127,000 ballots be invalidated, the county is going to use all available resources to reach out to the voters impacted by the decision.

“We are prepared to marshal all county resources, including emergency response technology, to reach out to 127,000 of the potentially affected voters,” he said. “We do have tomorrow, Election Day, and we’re going to do whatever we can to get them out there and make sure that their voices are heard and that their votes are counted.”

On Sunday, the American Civil Liberties Union and the ACLU of Texas, representing several people who used the drive-thru option in Harris County, filed a motion to intervene in the case on behalf of the county.

Joy Davis-Harasemay, a 44-year-old Houston voter who is one of the Texans named in the motion, has “both asthma and spondylitis, a degenerative spine disease that makes her unable to stand for long periods of time,” according to the ACLU, which argued she would be disenfranchised if the votes are invalidated.

“The push to toss the ballots of nearly 127,000 Texans in Harris County is unconscionable and illegal,” Sophia Lin Lakin, the deputy director of the ACLU’s Voting Rights Project, said in a statement. “It appears to be an attempt to undermine a true and accurate vote count and improperly influence the outcome of the election.”

New story in Politics from Time: Most of the 750,000 People in U.S. Jails Are Eligible to Vote. These Advocates Are Fighting to Get Them Registered

Nigel Alexander Clay hadn’t planned on voting. He’d been detained in Arlington, Va. for misdemeanor charges since late summer 2019, and didn’t think voting from jail was possible. So when Chris DeRosa, the Arlington chapter leader of the advocacy group Spread The Vote came to the jail to ask if any detainees wanted to register to vote in Virginia’s 2019 elections, Clay jumped at the chance.

“Being in jail, it’s easy to think, ‘Man I don’t matter. The world is moving on without me,’” the 28-year-old tells TIME. “Having my voice heard and having my vote counted… just having that option is a beautiful thing.”

Clay researched the candidates running in Virginia’s 2019 elections, including the local commonwealth attorney, sheriff and county board members, filled out his mail-in ballot, returned it, then called his local registrar’s office to confirm it’d been received. “It just gave me some hope,” Clay says. “Even though [you’re] going through some tough times… don’t forget you can still vote. This is a democracy.”

Spread the Vote has now partnered with more than 50 jails across the U.S. in a broad new initiative, Vote By Mail in Jail, which is organized in partnership with the nonprofit Vote.org. The advocacy group has more than 150 volunteers researching jails’ voting infrastructure, training jail program officers and counselors on how to facilitate vote by mail, and sending postcards to incarcerated people explaining how to cast their ballot in 18 states. The organization aims to reach 15,000 people in 300 jails across more than 25 states by the general election on November 3.

Other groups are doing similar work across the country. In Wisconsin, the non-profit All Voting is Local and ACLU of Wisconsin analyzed vote from jail policies and presented recommendations to county sheriffs and clerks across the state. In Illinois, voting access advocacy organizations, including Chicago Votes, have successfully pushed for legislation that makes ballots more accessible in jails throughout the state.

But advocates say they’re still in the early stages of a long battle. Across the country, there’s little consistency, or oversight, of jail voting, and the roughly 750,000 people in U.S. jails represent one of the most often-overlooked and difficult-to-reach populations, especially in places where law enforcement is uncooperative or misinformed. The majority of those in jail have not been convicted of felonies, and are therefore eligible to vote, and many are behind bars simply because they cannot afford bail for minor offenses. Their access to the ballot is blocked not by legal issues, but logistical ones. Because a disproportionate makeup of jail populations are people of color, this disproportionately marginalizes them as voters in this context as well.

This de facto disenfranchisement can affect more than these individuals’ lives. Especially in close contests, voters in jail can determine the outcome of local races for sheriffs and judges, who enforce and interpret policies that directly affect the lives of the incarcerated.

Much of the national conversation around criminal justice reform and voting in recent years has focused on those with felony convictions. It’s only recently that reform measures aimed at voters in jail, who are often serving time for misdemeanors, began gaining traction. “As the community of reformers expanded, people kept searching for the ripple effects of mass incarceration,” says Marc Mauer, senior adviser to The Sentencing Project, a criminal justice reform advocacy group. “And increasingly there’s heightened discussion about the jail voting issue along with that.”

“It definitely will open your eyes”

Jen Dean, the co-deputy director of Chicago Votes, a voting-access advocacy group, remembers talking with a woman at Cook County Jail in March 2018 who was waiting to vote for the first time in her life. The woman told her that she never would have voted had she not been in jail, and that she couldn’t wait to get out so she could register her whole family to vote, too, Dean recalls. Dean had registered the woman to vote and had been with her when she requested her absentee ballot.

When Dean returned for subsequent voter registration drives, this same woman had been her division’s “gatekeeper”—the person who helps command the room’s attention. All right ladies, calm down, give her the floor, everybody be quiet. The gatekeeper is often instrumental in helping an advocate like Dean present the case for why voting is important. “I will never forget her. She just validated everything that I do, from…voter registration through actually submitting your ballot when you are in the worst environment in the world but you still give a shit for some reason,” says Dean. “That is everything.”

Chicago Votes has registered eligible voters in Cook County Jail, one of the largest jails in the U.S. with a daily jail population of more than 5,000 people, through its Unlock Civics initiative since 2017. According to Chicago Votes, roughly 100,000 people pass through the facility each year and more than 90% of them are eligible to vote. Over the years, the voting-access group has worked with jail administrators to increase access to voter education, registration, and ballot access; set up processes for registering and voting; and trained teams of volunteers on everything from cultural sensitivity, like what language they should use, to serving as poll watchers.

But there were still gaps that needed to be addressed. Illinois switched to same-day voter registration in 2014, but incarcerated people at the jail weren’t offered that access, and if they were arrested after the absentee ballot deadline, they could be disenfranchised. To address those problems, Chicago Votes—backed by a coalition of voting access and criminal justice reform groups—succeeded in pushing the state legislature to pass a bill in 2019 requiring jails across the state to facilitate vote by mail and turning Cook County Jail into an official polling location. It was the first jail in the U.S. to do so.

Sean Allen, 36, who was incarcerated at Cook County Jail pretrial—and voted from there both in the 2018 midterms and the 2020 primary—said the transformation has been meaningful. “Jail [makes] you look at who is the state’s attorney, who is the sheriff of the county, and of course the different laws,” Allen says. “I won’t say for everybody, but it definitely will open your eyes as far as who you’re voting for and what’s going on.”

Due to the COVID pandemic, jail administrators have limited visitors and internal programs in recent months. That includes voter registration, a matter of concern for Dean. “I am definitely concerned about the fact that nobody has been inside that jail doing voter registration this whole summer, and we have an election coming up in November,” she says.

A “cross-section of historically marginalized voters”

In 1974, the U.S. Supreme Court case O’Brien v. Skinner ruled that eligible voters in jail can’t be denied the right to vote because they’re incarcerated. But the Court largely left it up to states and municipalities to figure out how to ensure people in jail could vote. And since the 1970s, says Dana Paikowsky, a fellow at the nonprofit the Campaign Legal Center (CLC), that hasn’t really happened. There have been “very few instances of action being taken to affirmatively address jail-based disenfranchisement at a state level and even locally,” she says.

That is, in part, the problem that voting access advocates are facing in Wisconsin. A county jail analysis published by All Voting is Local and ACLU of Wisconsin found that more than half of Wisconsin counties that responded to their inquiries did not have written policies for how incarcerated people could register and vote, and only one—Kenosha County—had systems in place to make that happen. None of the counties that responded to the advocacy groups’ requests for information said they had a way to track when people in jail asked to register to vote.

Shauntay Nelson, the Wisconsin state director for All Voting is Local, says her group has been in talks with Wisconsin county jails to determine whether they would be able to get lawyers or election officials — what the group calls a “jail voting social worker” — to administer the voting process behind bars. The organization also offers a training program that enables volunteers to pursue voter registration at local jails.

Counties’ failure to proactively offer people in jail access to registration and balloting has an inordinate impact on people of color and the poor. “When you’re talking about who is in American jails, you’re also talking about a sort of cross-section of historically marginalized voters,” says Paikowsky, who works on CLC’s initiative to help facilitate voting in jails across the country. Jail populations are disproportionately Black, Latino and Native American, and disproportionately homeless and low income, she adds. The median bail for felonies is $10,000, or around eight months of income for the typical person detained in jail, according to a report from the criminal justice reform think tank the Prison Policy Initiative.

Enfranchising people in jail is about more than just securing an individual’s right, Nelson argues. “When an eligible voter is denied the fundamental right to vote, not only is their voice silenced, but also the voices of their families and their communities,” she says. “It further alienates these communities from a political process that’s supposed to work for them.”

The power of a few thousand voices

Voting access organizations say they see both good news and bad news on the horizon. On the local level, there seems to be rising interest in the issue, as more volunteers look to get involved, says Jennifer Costa, the director of volunteer training at Spread the Vote. Some days, she says, she receives more than 100 calls from volunteers.

On the national level, the challenges remain formidable. Garien Gatewood, the program director of the advocacy group the Illinois Justice Project, which backed the Illinois legislation to facilitate jail-based voting, says that much of their work is stymied by a lack of a national conversation around the issue. The work being done in Illinois could easily serve as a model for other states, he says, but there’s no national coordination. “There is a leadership vacuum in getting this ball rolling on the national perspective,” he says.

But the path forward is clear, advocates say: states should establish polling places in jails to allow Election Day voting (as Cook County Jail has done); mail voting should be made more widely available; consistent voter education and registration should become the norm; and states should implement oversight measures. Kat Calvin, the founder and executive director of Spread the Vote, says there’s no good reason people in jail should not have the same access to the ballot as anyone else. “They’re being counted in the census. They’re still citizens and there’s no reason that they shouldn’t be able to vote,” she says. “Their lives are being controlled by the system. They should be allowed to elect people in that system. And yet we have the exact opposite of that.”

Jail populations could also be deciding factors in many local elections. In a 2019 article published in the Harvard Civil Rights-Civil Liberties Law Review, Paikowsky of the Campaign Legal Center looked closely at La Plata County, Co., which has a population of around 51,000. She found that a 2014 Colorado House of Representatives race had been decided by just 168 votes and a 2016 Colorado State Board of Education primary had been decided by just 51 votes. The population of La Plata County Jail — which included 142 eligible voters in August of 2016, according to The Durango Herald — could have made a difference in that outcome. Yet Paikowsky found that only one voter had cast a ballot from the jail in the past 20 years.

Wisconsin, an important swing state, is in a similar situation. Wisconsin’s jail population of about 12,500, most of whom are eligible to vote, could add up: As the All Voting is Local and ACLU of Wisconsin report notes, the state swung for Donald Trump over Hillary Clinton in 2016 by just over 22,500 votes.

Clay, the 28-year-old who has since been released from the Arlington, Va., jail, says that for him, the act of voting is clarifying. While in jail, “it’s easy to get depressed and lose sight of what’s going on,” he says. But casting a ballot, he says, ‘[helped] zoom my perspective out for the bigger picture: that it’s very important, even if you’re in jail, wherever you are, to vote.”

Looking at 1968 to Learn How to Survive 2020

It’s been suggested recently that this is the worst year in modern American history, which would make it worse than 1968, when both Rev Dr Martin Luther King, Jr and Robert Fitzgerald Kennedy were killed, plus a US Presidential Election brought to power Richard Milhous Nixon and the Uber-corrupt Spiro Theodore Agnew. This year we’ve already had COVID-19, the resurgence of the struggle for equal treatment under the law for People of Colour (which has been essentially ignored and left un-dealt with for well over a century), plus a complete nitwit of a President* who seems to be trying to create either a ‘Police State’ or an ‘untouchabe Emperor Structure of Governance,’ and we’re not even half-way through the year yet!

Check out the GIF through that link. See? That’s 1917. And that’s only what we have film of, and the first instance of human trafficking in what we now call the United States was in the early 1600s.

So… let’s take look at what people had to deal with in 1968, not with an eye to state we’ve got it so bad right now and to feel hard-done-by in comparison to the ‘Boomers,’ but to see what they dealt with, and then considering what we can learn about how they didn’t go insane while dealing with all the crap they had to. This way, we can protect our mental health in order to get through what we’ve got now.

I’ve grouped events to the end of May into three chronological blocks — Civil Rights (mostly U.S. events, but also elsewhere), General (political events of mostly non-North American locales), and the Vietnam War (including other formalized military events not directly part of the Vietnam conflict) — with the mid-March protests at Howard University being placed in both the ‘Civil Rights’ and ‘Vietnam’ categories, owing to both of those being fundamental to the causation of that particular event.

While I’m not about to list all of the things that have happened to us in the last five months (this has taken me a good five hours to assemble, for one thing), it’s probable that 2020 is a fair equal to 1968, if not actually surpassing the collective effect of the earlier year by this point in the calendar.

Want to Throw a Wrench in Trump’s Mass Deportation Machine? Act Locally.

People Power activists in Wisconsin convinced their local government to protect people from Trump's anti-immigrant agenda.

In September, the board of supervisors in Dane County, Wisconsin, passed a resolution to protect immigrants from the Trump administration’s mass deportation agenda.

The board, which represents the half a million people who live in Dane County, endorsed the ACLU’s Freedom Cities campaign and its nine model policies, which shield immigrants from discrimination, unjust government targeting, and attacks on their privacy.

This didn’t just happen on its own. The victory was the culmination of months of persistent activism from the local People Power group that I have been involved with since March. And this is just the beginning of our work.

I got involved in People Power earlier this year, and as a new activist, I was excited that the ACLU created a concrete blueprint that gave us clear, step-by-step guidance on how to advocate for the Freedom Cities agenda.

With the ACLU’s support, we began organizing in our communities, holding monthly People Power meetings and regular talks with local law enforcement and elected officials, and reaching out to local partners and allies.

As part of our immigrant rights work, we spoke with six different law enforcement agencies and built personal relationships with the sheriff and key members of the county board who have experience working on immigration-related legislation.

Before these meetings, some officials were under the wrong impression that they had to work with ICE, but we were able to turn many of them into allies, urging them to take steps to make sure that immigrants don’t get ensnared in Trump’s deportation machine.

These meetings also helped us learn about the right actions to take to shepherd our resolution through the legislative process.

Now that the board has passed the Freedom Cities resolution, we have a new tool to hold our local law enforcement agencies accountable to make sure that they aren’t complying with unconstitutional policies and the anti-immigrant agenda coming out of the Trump administration.

Sometimes it is hard to know the best way to go about making an impact where you live, but the Freedom Cities guide was an excellent on-ramp to activism, providing us with straightforward guidelines on exactly how to go about our advocacy work. We have continued to work on immigration issues with the county sheriff’s office and have also started lobbying our representatives in Congress to support the Dream Act.

We also know that we must support other organizations doing critical work in Wisconsin. Our People Power group is working with a local interfaith partnership and has helped raise money to allow Voces de la Frontera, a Wisconsin-based immigrant rights group, to hire a community organizer in Madison. It is with these groups and others that we are fighting back against a new attempt in the state legislature to punish local municipalities which limit their cooperation with ICE.

As we continue to advocate for immigrant rights and start our Let People Vote initiative, People Power members in Dane County are excited to continue the fight to make sure the Constitution works for everyone.

The decision to fire Gary Xu Gang, one of three curators of the biennale, came after a professor at Wesleyan University claimed on social media that Xu has been sexually assaulting women going back 20 years, including when he was an associate professor in the Department of East Asian Languages and Cultures at the University of Illinois, Urbana-Champaign (UIUC). The accusation was posted on a Chinese online forum, and although that post was later deleted, it prompted a woman to offer what she said was photo evidence of the misconduct—she posted pictures of bruises on her face she claimed came from Xu, suffered while they were in a relationship during his tenure at UIUC. She also shared her emergency request for protection that was filed with local authorities. Xu has denied all allegations, but after an internal investigation, the biennale decided to fire him. “Given that the center’s attitude and mission is to spread positive energy of art, we, after deliberate consideration, decided to terminate our cooperation with Xu Gang for the 2018 Shenzhen Biennale,” the statement read. Shepherd became director in 2017 and initiated a search project for the two missing artworks, which she entitled “Antioch Reclaimed,” and found the mosaics buried under the museum’s lawn last year. The mosaics, extricated earlier this month, are undergoing a major conservation process inside of an outdoor lab, where museum visitors can watch the project unfold. While the museum is unsure of why the 2,000-year-old works were buried underground, they are planning for a permanent installation of them, following a travelling exhibition set for 2020.

Any kind of information recorded by a gallery or art world business—from the personal tastes of a collector, to the events they’ve attended, to their dietary restrictions—would be subject to the rule, the Financial Times reported. While certain information, like who owned a work as part of its provenance, can be kept indefinitely, other personal data will have to be deleted in a timely manner, as there are stiff fines for noncompliance. But the regulation doesn’t govern intangible details of the intricate personal relationships that define the art world—that is, so long as the most gossipy tidbits, such as who is blacklisted from buying a work, aren’t written in a spreadsheet.

The mega-gallery announced that it would represent the artist worldwide and present shows of her work across its multiple outposts, starting with an exhibition in New York in 2019. Sherald became something of a household name earlier this year when the National Portrait Gallery unveiled her official portrait of former First Lady Michelle Obama, alongside Kehinde Wiley’s portrait of Michelle’s husband, Barack. “Drawing loosely upon the American Realist tradition, Sherald subverts the medium of portraiture to tease out unexpected narratives, welcoming viewers into a more complex debate about accepted notions of race and representation, and situating black heritage centrally in the story of American art,” Hauser & Wirth said in a statement. The artist has been represented by Chicago’s Monique Meloche Gallery, and while Hauser & Wirth is now planning to represent Sherald globally and exclusively, a correction to a story in ARTnews indicated that Monique Meloche will still work with the artist on some level.

10 A London arts and textiles teacher won a $1 million prize after being named the best teacher in the world.

Andria Zafirakou, who teaches at a northwest London community school (the U.K. equivalent of a public school) in one of the poorest areas in the country, is the first British winner of the annual Global Teacher Prize, presented by the Varkey Foundation. Zafirakou made forging a better school environment and relationships with her students a top priority. She learned basic phrases in languages such as Gujarati, Hindi, and Tamil in order to better communicate with pupils. After visiting the homes of some students, where she found noise and overcrowding, Zafirakou added additional lessons during the day and on the weekend to give kids quiet places they could study and work. She also overhauled the curriculum “to make it relevant to pupils,” The Guardian reported. She has yet to say what she’ll do with the prize money, which will be paid out in installments, but in her speech after receiving the award in Dubai, she highlighted the importance of the arts. “I have seen how the arts help students to communicate. The arts help to give so much confidence and really create incredible young people,” she said.
