Mua xe cũ, mất trắng tiền cọc vì “xuống tiền” cảm tính

Xe cũ - không ít khách hàng ôm phải "quả đắng", hoặc mất trắng tiền cọc, hoặc nhận chiếc xe lỗi với quyết định vội vã của mình.

Tiết kiệm được hơn 400 triệu đồng, anh Lý Anh Sơn (35 tuổi, trú tại quận Nam Từ Liêm, Hà Nội) quyết định đi mua một chiếc xe cũ. Theo những thông tin được rao trên một số trang mua bán xe hơi, anh tìm được một chiếc Mazda 3S đời 2014 rất “vừa miếng” tại một salon xe cũ trên đường Nguyễn Văn Cừ (quận Long Biên, Hà Nội).

Tâm lý háo hức khi mua ô tô lần đầu, lại chưa có kinh nghiệm về xe cộ, anh Sơn đã nhanh chóng bị nhân viên bán hàng tại salon “thôi miên” bằng những lời có cánh. Chiếc xe hơn 5 năm tuổi với ngoại hình long lanh, nội thất sạch sẽ khiến anh không do dự, xuống ngay tiền đặt cọc 20 triệu đồng và hẹn 1 tuần sau lấy xe.

Tuy vậy, 3 ngày sau đến lấy xe, anh Sơn cùng một người bạn có kinh nghiệm kiểm tra thì phát hiện, xe từng bị tai nạn khá nặng, phần đầu móp méo, ảnh hưởng đến cả máy. Lúc này, anh Sơn quyết định không lấy xe và đề nghị salon hoàn lại tiền đặt cọc. Phía salon từ chối thẳng thừng với lý do anh Sơn đã xem kỹ xe rồi mới đặt cọc, việc cọc tiền là tự nguyện chứ không ai ép buộc.

Sau cuộc đàm phán nảy lửa, cuối cùng hai bên thống nhất “cưa đôi” số tiền đặt cọc. Anh Sơn đành ngậm ngùi mất 10 triệu đồng do sự nhanh nhảu quá mức cần thiết.

Không được “may mắn” như anh Sơn, anh Nguyễn Viết Giang (29 tuổi, trú tại huyện Thường Tín, Hà Nội) dù đã rất cẩn thận nhờ một người thợ làm tại một xưởng sửa chữa ô tô ở gần nhà cùng đi xem xe. Thế nhưng, anh vẫn dính quả đắng không ngờ.

Cuối năm 2019, anh Giang cùng người thợ xem chiếc Toyota Innova đời 2015 tại một salon ô tô cũ tại quận Cầu Giấy . Sau cái “gật đầu” của người thợ cùng đi, anh quyết định lấy luôn chiếc xe này về vừa phục vụ gia đình, vừa chạy dịch vụ khi rảnh rỗi.

Sau thương vụ mua xe này, anh Giang "cảm ơn" người thợ xe 3 triệu đồng. Thế nhưng, một thời gian chạy xe, chiếc Innova 5 năm tuổi rất hay hỏng vặt.

“Có hôm, khi đưa vợ con về ngoại, chiếc xe đi như bị hụt hơi, cứ giật giật rất khó chịu. Một người chú bên đằng ngoại cũng là thợ xe đã xem qua và khẳng định, chiếc xe này trước đây đã chạy dịch vụ rất nhiều và đã bị tua lại công-tơ-mét đến cả chục vạn km”, anh Giang bức xúc kể lại.

Sau đó, anh Giang đã gọi điện đến salon trước đây để trần tình thì tình cờ phát hiện salon này cũng đã phải “cắt” từ 5 - 7 triệu đồng cho người thợ sửa xe nọ. Anh Giang chỉ biết tự trách mình vì đã quá tin tưởng người thợ kia, phải ngậm ngùi ôm "quả đắng".

Cách đây 1 tháng, một người phụ nữ tên G.B. ở tại TP. Hồ Chí Minh gây xôn xao trong cộng đồng mạng khi "tố" một salon cũ tại quận Tân Bình đã bán cho chị chiếc Toyota 86 cũ có chất lượng kém. Chị G.B sau khi đặt cọc 50 triệu đồng cho salon này mới mang xe đến đại lý chính hãng kiểm tra.

Cũng như các trường hợp trên, chị B phát hiện xe lỗi, đã quay lại yêu cầu salon trả tiền cọc và không lấy chiếc xe này nữa nhưng salon không chấp nhận. Lý do cũng được salon này nêu ra, đây là tiền cọc để mua xe chứ không phải tiền cọc để chị đi xem xe để rồi "không thích thì không lấy".

Sự việc trên vẫn đang tranh cãi chưa có hồi kết, thậm chí hai bên còn "dọa" đưa nhau ra toà để làm rõ việc này.

Cần chú ý điều gì về pháp lý khi mua xe cũ

Tranh cãi sau khi đặt cọc mua xe cũ là câu chuyện khá phổ biến, nhất là với nhiều người chưa có kinh nghiệm mua xe.

Ông Dương Trung Kiên – chủ một salon ô tô cũ tại Khu đô thị Nam Trung Yên (quận Cầu Giấy, Hà Nội) cho rằng, thông thường, khách hàng chỉ đặt cọc khi thực sự đã ưng và chốt lấy chiếc xe đó. Việc đặt cọc mua bán xe kèm cam kết giữa các bên thường thể hiện rõ trong văn bản và được hai bên đồng thuận.

“Đối với các salon lớn, có uy tín, những hạng mục cam kết chất lượng như: xe chưa từng bị ngập nước, không bị tai nạn hoặc động cơ nguyên bản,… sẽ được ghi thẳng vào hợp đồng đặt cọc để khách yên tâm”, ông Kiên nói

Tuy nhiên, ông Kiên cũng chỉ ra rằng, nhiều cơ sở kinh doanh làm ăn chộp giật có thể ỉm những điều khoản này đi hoặc chỉ cam kết “mồm” nhằm tạo lòng tin ban đầu. Lúc khách hàng phát hiện ra xe lỗi thì đã bị “cầm đằng lưỡi” rồi.

Là một người có kinh nghiệm trong việc làm các thủ tục mua bán ô tô, Công chứng viên Đào Duy An - Giám đốc một văn phòng công chứng tại Hà Nội phân tích, khi khách đã “bồ kết" "em xe" nào thì quyết định đôi khi nhiều cảm tính. Khi đó, khách thường chủ quan và dễ “dính chưởng” với nhân viên sales.

“Thường thì bạn sẽ bị họ thuyết phục đặt cọc thật nhanh, số tiền đặt cọc từ lớn đến nhỏ dần tùy theo độ hào phóng của bạn. Đôi khi bạn tặc lưỡi và nhanh chóng xuống tiền đặt cọc và có thể có nhiều rủi ro xảy ra”, ông An nói.

Theo ông An, sau khi đặt cọc, khách hàng nên đến một văn phòng công chứng để làm các thủ tục mua bán, giấy tờ xe sẽ được xem xét bởi những người có chuyên môn thẩm định, tránh những sai sót hay vấn đề về pháp lý.

Trao đổi về vấn đề trên với VietNamNet, Luật sư Dương Đức Thắng – Phó giám đốc Công ty Luật Myway (Đoàn Luật sư TP. Hà Nội) dẫn chiếu điều Điều 328 Bộ Luật Dân sự 2015 quy định về đặt cọc. Ông cho biết, về nguyên tắc, khi khách hàng mua xe và salon đã ký hợp đồng đặt cọc mua xe với nhau thì hai bên đã phát sinh quyền và nghĩa vụ của mình và phải tuân thủ các điều khoản trong hợp đồng.

“Thông thường, khách hàng đem xe đi kiểm tra, phát hiện ra nhiều lỗi thì khách hàng không thể yêu cầu trả lại xe và đòi lại tiền đã đặt cọc mà phải chấp nhận mất toàn bộ hoặc một phần số tiền đặt cọc. Việc này tuỳ vào thoả thuận cụ thể với salon trong hợp đồng”, luật sư này bày tỏ quan điểm.

Theo ông Thắng, để đảm bảo quyền và nghĩa vụ của mình, khách hàng cần xem xét kỹ tình trạng xe, trao đổi với salon ô tô cho xe đi kiểm tra rồi mới đặt cọc hoặc để tránh những rắc rối về sau.

Điều 328 Bộ Luật Dân sự 2015 quy định: Đặt cọc là việc bên đặt cọc giao cho bên nhận đặt cọc một khoản tiền hoặc kim khí quý, đá quý hoặc vật có giá trị trong một thời hạn để bảo đảm giao kết hoặc thực hiện hợp đồng;

Trường hợp hợp đồng được giao kết, thực hiện thì tài sản đặt cọc được trả lại cho bên đặt cọc hoặc được trừ để thực hiện nghĩa vụ trả tiền; nếu bên đặt cọc từ chối việc giao kết, thực hiện hợp đồng thì tài sản đặt cọc thuộc về bên nhận đặt cọc; nếu bên nhận đặt cọc từ chối việc giao kết, thực hiện hợp đồng thì phải trả cho bên đặt cọc tài sản đặt cọc và một khoản tiền tương đương giá trị tài sản đặt cọc, trừ trường hợp có thỏa thuận khác.

Lời khuyên của chuyên gia khi đi mua xe cũ:

- Bạn chỉ nên mua xe cũ nếu bạn thực sự am hiểu về xe, biết tự đánh giá xe. Trường hợp không am hiểu thì nên tìm người thân tín giúp đỡ, hạn chế tối đa việc thuê người thứ ba thẩm định chất lượng xe.

- Chọn mua xe ở những salon có uy tín, có cam kết mạnh mẽ bằng văn bản về chất lượng chiếc xe.

- Đọc kỹ các điều khoản trong hợp đồng đặt cọc, nên thương lượng với salon đặt cọc ở mức hợp lý, không nên đặt cọc quá nhiều.

- Khi đã đặt cọc xong, hãy chụp ảnh lại toàn bộ các chi tiết của chiếc xe, đồng thời yêu cầu niêm phong xe để tránh bị hỏng hóc, tráo đổi phụ tùng trong thời gian chờ lấy xe.

- Khi mua bán xe, yêu cầu bên bán đến văn phòng công chứng (hoặc bạn mời công chứng của mình) đến công chứng chứ tuyệt đối không sử dụng hợp đồng công chứng khống để tránh rủi ro về pháp lý.

Built 86 years apart, two vehicles in The Henry Ford’s collection say a great deal about changing technology -- but they say even more about our society's changing values.

1916 Woods Dual-Power Hybrid Coupe

The Woods Motor Vehicle Company, established in 1899 as one of America's earliest automobile producers, was one of the biggest makers of battery-powered electric cars. But, by the early 1910s, the popularity of electric cars was waning. Gasoline-powered cars went farther on a tank of gas than electric cars went on a single battery charge, and filling an empty tank was easier and quicker than recharging batteries. These key shortcomings became more important as car owners drove their cars longer and longer distances. The Woods company sought to meet the challenge by building a car with two power-plants -- a clean, quiet, electric motor fed by batteries and an internal combustion engine fed by gasoline. The Woods Dual-Power automobile appeared in 1916.

Driving a Dual-Power was different from driving an electric or gasoline car. The driver manipulated levers to vary the balance between the gasoline and electric motors. THF103732

Driving a Dual-Power was considerably different from driving either an electric or a gasoline car. The driver began by moving a lever on the steering wheel to get the car rolling under electric power. When the car reached the speed of 20 miles per hour, the driver moved another lever to engage a clutch connecting the electric motor to the gasoline motor, starting the gasoline motor. By manipulating the levers, the driver varied the balance between the gasoline and electric motors; the car could run on both power sources at the same time, or either independently.

But the Dual-Power seemed to solve problems customers didn't have in 1916. The 48 miles-per-gallon figure claimed for the car meant little to a driver who could afford the Woods' $2,650 price. And the Woods' 35 miles-per-hour top speed was no better than a $740 Model T Ford sedan's. Woods didn't even advertise the Dual-Power's lower exhaust emissions, because automobile pollutants were of little concern at that time. It also seems that the Dual-Power was not as smooth and trouble free as the ads and brochures suggested. Woods re-engineered the car for 1917, but potential buyers were not impressed. The Dual-Power -- and the Woods Motor Vehicle Company itself -- vanished in 1918.

2002 Toyota Prius Sedan

Ratchet forward to the 1990s. Automakers around the world were confronted by rising gasoline prices and stringent regulations on tailpipe emissions. Japanese giant Toyota set out to design a new car that dramatically improved gas mileage and dramatically reduced exhaust emissions. Toyota engineers probably never heard of the Woods Dual-Power, but in 1994 they settled on a dual-power design, combining a small gasoline engine with batteries and an electric motor. The first hybrid Toyota Prius went on sale in Japan in December 1997, and in the United States in August 2000.

Operating a Prius was simple -- a sophisticated computer system controlled both the electric and gasoline motors, smoothly shifting power between the two. THF91042

Although the Prius drivetrain was similar in principle to the Dual-Power's, operating a Prius was much simpler. The driver merely turned the ignition key, pulled the transmission selector lever into "D," stepped on the gas, and drove away. A sophisticated computer system controlled both the electric and gasoline motors, smoothly shifting power between the two. Sometimes the computer system used the gasoline engine to recharge the batteries. It even shut the engine off when the car stopped and started it up again as needed. The Woods engineers would have given their eye teeth for such technology. Woods sales staff might have given their right arms for the Prius' popularity.

Toyota's Prius hybrid sold well in Japan and even better in the United States. By 2005, Prius accounted for nearly 10% of Toyota's American sales. Part of that popularity was due to Prius' reliability, good performance, and considerable amount of interior room for its size. Part was due to Prius' excellent gas mileage -- over 40 miles-per-gallon on the highway and over 50 mpg in stop-and-go traffic. But it could take several years for savings on gasoline to make up for the several thousand-dollar price difference between a Prius and a comparable, conventional Toyota Corolla -- even with federal tax subsidies for hybrid cars.

For many people, what a car doesn't do -- use lots of gasoline, emit lots of pollutants -- has become as important as what it does do. THF205087

What really sold many people on the Prius was environmental responsibility. Driving cars with lower emissions and higher gas mileage was The Right Thing To Do, whether it reduced out-of-pocket expenses or not. Furthermore, driving a Prius told the world that you were Doing The Right Thing. The Prius became hip, especially among intellectuals and celebrities. Movie stars took to arriving at the Academy Awards in Priuses rather than limousines to demonstrate their concern for the environment. Even after other car makers such as Ford, Honda, Saturn and Nissan added hybrids to their lineups, the Prius retained its cachet.

The stories of the Dual-Power and Prius tell us that the definition of what we want an automobile to do is always evolving. Yes, we want cars to take us where we want to go. And taking us there in high style, or high comfort, or at high speed is often still important. But, for many people, what a car doesn't do -- use lots of gasoline, emit lots of pollutants -- has become as important as what it does do.

In 2019, around 17 million cars were sold in the markets. SUVs were popular in the USA and electric car sales grew by 75%.Wrapping up 2019, the fourth quarter wasn’t the most impressive sales month. Don’t get too worked up over the President's actions against the environment

Every week seems to bring another attack by the Trump Administration against laws and regulations that have been instituted by prior administrations to protect the environment and fight climate change. The most recent is the campaign to deny California the right to set stricter automobile emissions standards than federal limits. It has caused yet another uproar among environmentalists and liberals and glee among climate change deniers and conservatives and will undoubtedly lead to many years of legal battles. But what is reality? In fact, this move, and all the others, are just meaningless actions that do little more than pander to the Administration’s fossil fuel campaign contributors and excite the hardcore Republican base ahead of the upcoming elections. The reality is that technology and market forces are driving the world inexorably and at an increasing pace toward a renewable energy future, despite the last-ditch efforts of the President and his supporters. Let’s look at some of the higher profile actions.

Automobiles

Denying California’s waiver on automobile emissions goes hand-in-hand with the prior announcement that the administration would rollback automobile mileage requirements set by the Obama Administration. On the surface, this appears to be an extremely serious setback for consumers, the environment and climate. Depending upon the outcome of the various legal challenges, there could certainly be a short term impact. But the transition to Electric Vehicles (EVs) is underway and picking up steam. Looking at California trends as a precursor to what is likely to happen nationwide, the state is experiencing falling total car sales for the third straight year (Fig. 1).

In contrast, EV sales have been increasing rapidly, and by mid-2019 EVs, including hybrid non-plug-in vehicles, represented 13% of new car sales (Fig. 2).

The big question is how quickly that 13% will grow and continue to displace Internal Combustion Engine (ICE) vehicles.

Historically, EVs have been quite expensive compared to their ICE counterparts; however, as the cost of batteries has dropped dramatically over the last few years, so has the cost to build an EV. Nevertheless, the purchase price of an EV such as the Tesla Model 3 is still higher than a similarly sized ICE vehicle, and purchase cost is the primary driver for US car buyers. But the real economic comparison should be on what is called the total cost of ownership (TCO), which includes purchase price, fuel, maintenance and insurance costs over the life of the vehicle, and resale value. There have been a number of TCO comparisons between the Tesla Model 3 and competing ICE vehicles over the past few years. The general consensus has been that the Model 3 TCO is less than other premium sedans from Audi, BMW, etc, but slightly more than mass market sedans such as the Toyota Camry. However, LoupVentures just updated its comparison with recent data on insurance and resale value, plus the latest purchase cost.  In particular, resale data shows that the Model 3 holds its value much better than its competitors. As a result, the TCO for a Model 3 is now less than the best selling sedan in the US, the Toyota Camry (Fig. 3).

So the answer to “how quickly” depends on when consumers start to think beyond initial purchase price to the total costs of ownership (TCO). Once consumers realize that they will get a superior product at a lower total cost over time, the transition will begin to accelerate dramatically. Throw in the continued drop in price for batteries and the expanding options as other auto makers begin to offer new EV models, and a date around 2025 for California EV sales to reach parity with ICEs is not unreasonable. In such a scenario, auto mileage standards are pretty much immaterial. In fact, reducing standards makes the TCO of ICE vehicles less competitive and will likely drive the rest of the country to more quickly follow California’s lead.

Light Bulbs

How about the uproar over light bulbs? Several weeks ago the administration issued a decree to roll back the Bush and Obama era attempts to improve lighting efficiency by phasing out incandescent light bulbs. But, here, we are well beyond the early adoption stage of new technology, i.e., light–emitting diode (LED) bulbs. The energy required to power an LED bulb for the same illumination is about 90% less than that of an incandescent bulb. The life of an LED bulb is about 20 times that of an incandescent, and the initial cost of LED bulbs has dropped dramatically and is approaching the cost of incandescent bulbs (you can now buy a 4-pack of off-brand 60W LED bulbs at Home Depot for about $6 or $1.50 apiece). Figure 4 compares today’s common bulb types and illustrates the dramatic savings possible for LED over incandescent bulbs.

In fact, the cost savings in electricity will pay for the initial cost of the bulb in less than one year of use. Manufacturers could give their incandescent bulbs away, and it wouldn’t stop the transition. Coal Power

President Trump made saving the coal industry a cornerstone of his election campaign and his administration. How has that worked out so far? In June 2019 the EPA issued the Affordable Clean Energy (ACE) rule, an amendment to the Clean Power Plan, with intent to extend the life of the US fleet of aging coal power plants. Shortly thereafter, in July 2019, Blackhawk Mining filed for Chapter 11 bankruptcy, making it the eighth major U.S. coal producer to file bankruptcy since November 2017 and the fifth so far in 2019.

Since 2010, 289 coal-fired power plants have closed, representing over 50% of the plants and 40% percent of US coal generating capacity, with 50 of those closures coming after November 2016. And that trend isn’t slowing with an additional 51 pending closures having been announced by utility companies.  As a result, and for the first time in history, in April 2019 US electrical power generation from renewable sources exceeded generation from coal (Fig. 5).

By 2025, this number grows to 86 percent of the coal fleet” The result: no new coal plants will be built in the US, and the existing plants will continue to be shut down.

Another focus of the Administration has been to open up the Arctic National Wildlife Reserve (ANWR) in Alaska to drilling and eventual production of oil (Fig. 6).

But again, what is the true risk of extensive development of ANWR?  There have been several recent actions in Congress to try to block the drilling, there is the likelihood of lawsuits in the near future, and there is the chance that significant oil reserves don’t even exist in the region. But the greatest risk, again, is the impact of technology. With the world inexorably moving to replace fossil fuel based energy with renewables, the oil industry is facing a point of peak oil demand in the next 5-10 years. In the meantime, it’s all about low-cost, quick turnaround production. In the US, that means shale oil which has boomed due to technology advancements in horizontal drilling and hydraulic fracturing (fracking). Why would oil companies invest many billions of dollars exploring for and producing oil in ANWR in hopes of (maybe) generating profits in 10 years, when they can invest a fraction of that and start making money almost immediately? ANWR development isn’t going to happen, but it makes good headlines.

The US may go kicking and screaming into this renewable energy future, but go it will.
