Custody Rights in California - A Masterpost

So due to an anon, I discovered something very interesting about custody rights in California. 

As background, I am a law graduate from Australia. I didn’t study Family Law (it is an elective here) and I do not know California as a jurisdiction/their law at all. This does not constitute legal advice in any way. 

Here, I am simply putting together what appears to be the legal state of custody in California as per articles and information that you can access through Google. This is public information and anyone, regardless of education, can easily access and interpret this. 

RIGHTS OF AN UNMARRIED FATHER:

- Unmarried mothers: ‘When it comes to child custody for unmarried couples in California, the law explains that unwed mothers automatically gain custody of their children when they are born. As an unmarried mother, you don’t have to take any legal action to assert your custodial rights. You are fully responsible for taking care of your child and determining his or her living arrangements, education, and health care. ‘

- Unmarried fathers: ‘According to the law pertaining to child custody for unmarried parents in California, you as a father who isn’t married have no rights to your child if you haven’t established legal paternity. That’s because the law immediately assumes that married parents are the legal parents of the child, but this is not so with unmarried parents trying to figure out child custody.’

- What about a birth certificate? ‘It’s not enough to have your name listed on the child’s birth certificate. Establishing legal paternity is the only thing that will give you the right to see your child and to make decisions regarding his or her wellbeing. In addition, if you have established legal paternity, you can stop the child’s mother from relocating with your child. Otherwise, your child’s mother may move away and even deny you visitation rights no matter how much you may object to this.’

ABANDONMENT: 

‘California Family Code section 7822(b) explains that the court will consider the following as evidence of intent to abandon the child: The parent or parents have left the child and failed to provide identification for the child (An example of this is providing a birth certificate); The parent or parents have failed to provide support for the child for an extended  period of time; The parent or parents have failed to communicate with the child for an extended period of time.’ (Emphasis added). 

WHAT COULD THIS MEAN? 

If the law suggested by the article is correct, then a father would not have any parental rights over a son without a positive paternity test. It is irrelevant that he is on the birth certificate. This means that the mother has the sole discretion in regards to his education, health etc and the father has no legal say, nor a right to visitation or custody. 

Louis, as far as we know, doesn’t have a positive test and doesn’t appear to have tried to take his rights to court. 

Further, if a father were to not contact a son for an extended period, coupled with eg no financial support, living in another country etc, the mother could file for abandonment.

no that’s not what it means. It means THE SITE has the exclusive. Boob guy sent his legal paperwork and gave the story to Celeb TM so Celeb TM can say they have the exclusive because they got the inside scoop from boob guy

Eh maybe I’m just used to being negative but This whole article is just too perfect to be leading anywhere , like they are talking about the theories of f being b’s half brother and no way would whoever is in charge of bg let the real truth show , even if it’s just speculation . Besides how relevant is this site ? Are they even known bc this is the first time I’ve heard of them 🧐

the guy who runs the site is pretty well known for his old site The Dirty (which actually got sued twice - both turned out favorable for him in the end). It was a no holds barred kind of reporting that got him in some trouble.

he apparently knows brody so that’s interesting. Now the site wasn’t really known to me. It has 50,000 followers on instagram...which is not that much but not nothing. 

But i really can’t tell if this is planned or just boob guy going off on his own. I will say - the guy made an article that painted louis in a pretty good light in spite of it all so that’s interesting.

Its too perfect-like the other week we had reminder how the kid is louis mini me in big outlest so when they end it he doesnt look like a fool but here on gossip site we are presented with all the other options and who wants to dig it they are helping them.pock whatever you want and louis doesnt look like a bad guy in any case

yeah...i mean there’s definitely some stuff that seemed interesting (you saw me listing a few of them even before this). it’s hard to say but the article was very positive/neutral to louis and really made it seem like she’s a gold digger.

we’ll have to see if anything comes from this or it spreads - the choice of gossip site was so weird to me because most people would go straight to tmz...who covered briana in the past and louis so they’d be familiar
