The Tennessee Attorney General’s Office and the Tennessee Department of Commerce & Insurance (TDCI) are participating in a consolidated enforcement action to stop a fraudulent precious metals scheme that resulted in solicitations exceeding $68 million from at least 450 investors nationwide. The Tennessee Attorney General’s Office- on behalf of the TDCI- joined the U.S. Commodity Futures Trading Commission (CFTC), and 26 other state securities regulators to file a complaint in the United States District Court for the Central District of California alleging Safeguard Metals, LLC and Jeffrey Santulan, AKA Jeffrey Hill, solicited investors nationwide by touting precious metals at grossly inflated prices that were not disclosed. The investors in this case were advised to liquidate their holdings at registered investment firms to fund investments in precious metals, bullion, and bullion coins through self-directed individual retirement accounts. Self-directed IRAs should not be confused with traditional IRAs or other retirement vehicles. The defendants are accused of failing to disclose the markup charge for their precious metals bullion products and that investors could lose most of their funds once a transaction was completed. In many cases, the market value of the precious metals sold to investors was substantially lower than the value of the securities and other retirement savings investors had liquidated to fund their purchase. In Tennessee, nine investors were defrauded out of $2,123,014.70 in the execution of this national scheme. Many Tennessee investors liquidated their existing retirement accounts, which contained securities, to obtain funds to purchase the metals. “Don’t fall for this. It’s another nationwide scheme that is causing many people- especially our seniors- to lose their retirement funds,” said Tennessee Attorney General Herbert H. Slatery III. “Our Office will do whatever is necessary to enforce our securities laws and get funds like these back to victims.” “This is one of many large-scale precious metals investment schemes we’ve endeavored to stop since the pandemic began and we are investigating numerous more precious metals investment companies on similar allegations. To prevent any further damages, investors are advised to be particularly cautious when purchasing precious metals and to check for outrageously high commissions, spreads, or markups as high as 30 to 70 percent,” said TDCI Assistant Commissioner for the Securities Division Elizabeth Bowling. “As the market continues to fluctuate, we anticipate seeing more fraudsters capitalize on investors’ uncertainty and use fear to manipulate good people out of their hard-earned money.” “In expectation of additional precious metals investment schemes, investors are advised to check the registration of all investment products and professionals, diligently research investments, ask tough questions about the fees, markups or spreads, risks, and potential returns,” said Director of the Securities Division Financial Services Investigation Unit Michelle Stone. “If the answers seem too good to be true, or don’t make sense, protect your wallet by just walking away.” To prevent any further loss, investors are advised to: Exercise caution when purchasing precious metals and to check for outrageously high commissions, spreads or markups as high as 30 to 70 percent. Verify the registration of all investment products and professionals, diligently research investments, ask tough questions about the fees, markups or spreads, risks, and potential returns. The Tennessee Attorney General’s Office encourages investors who suspect they may have been targeted to contact the Securities Division Financial Services Investigations/Enforcement Section at (615) 741-5900.

MTSU survey: Tennessee consumer outlook hits another all-time low amid inflation worries, rising gas prices, Ukraine Outlook among Tennessee consumers has “declined considerably” since last December amid inflation worries and rising gas prices, according to the latest statewide survey by Middle Tennessee State University. The Tennessee Consumer Outlook Index registered a score of -198, down significantly from -93 in December and besting the previous all-time low -106 in September, reports the Office of Consumer Research in the Jennings A. Jones College of Business at MTSU. [gallery link="file" size="medium" td_select_gallery_slide="slide" ids="7059,7060,7061"] “This was due to deteriorating views of the current economy, more pessimistic expectations for the future of the economy, and waning beliefs that now is a good time to make large purchases,” noted Tim Graeff, marketing professor and director of the Office of Consumer Research. “Not only did all three sub-indices decline, but all indices are now negative.” The current online survey of 646 Tennessee consumers was conducted March 1-8 and has an error margin of 4%. To see the full report and previous reports, go to https://www.mtsu.edu/consumer/tnoutlookreports.php. Recent declines in the stock market have led to “growing worries” about the future value of savings and investments, Graeff said, adding that pessimism has also increased about the federal government’s ability to improve economic conditions as the U.S. and the world grapple with Russia’s attack of Ukraine. “Current events in Ukraine have caused consumers to become more concerned about potential military conflicts with other nations,” Graeff noted. “Adding to the negative outlook is Tennessee consumers’ general disapproval for the way President Joe Biden and the U.S. Congress are handling the economy. “However, there is relatively more approval for how Gov. Bill Lee and the Tennessee General Assembly are handling the state economy.” The growing pessimism is “not good news for local businesses and retailers,” Graeff continued. “Given that two-thirds of the U.S. economy is from consumer spending, even slight decreases in consumers’ outlook for the future can inhibit future economic activity and growth,” Graeff said. About the Consumer Outlook Index The Tennessee Consumer Outlook Index scores are based on consumers’ responses to 11 questions measuring their perceptions of the current economy, the future economy, jobs, personal finances, and whether now is a good time to make large purchases. The index, which includes three subindices, is computed by adding the percentage of favorable responses to each question and subtracting the percentage of negative responses to each question. For more information, contact Graeff at 615-898-5124 or [email protected]. Or visit www.mtsu.edu/consumer.

With Tax Day (Monday, April 18, 2022) approaching, the Tennessee Department of Commerce & Insurance’s (TDCI) Division of Regulatory Boards and the Tennessee State Board of Accountancy are sharing important tax-filing information to assist Tennessee consumers during this busy season. The Tennessee State Board of Accountancy protects the public interest by ensuring that persons professing special competence in accountancy meet minimum requirements to be a licensed Certified Public Accountant (CPA). To learn more about the Board’s mission, rules governing CPAs, or to file a complaint if a consumer believes he or she has been treated unfairly, visit our website. “While tax-filing season may feel intimidating, consumers should remember that licensed certified public accountants are valuable resources when preparing a tax return. Using a licensed CPA can give consumers peace of mind that they are working with a licensed professional,” said Board Executive Director Wendy Garvin. “Additionally, consumers should remember that if they believe they need more time to complete their taxes, the time to review their options is in advance of the April 18 due date." The Internal Revenue Service (IRS) began accepting and processing 2021 tax returns on January 24, 2022. The filing deadline to submit 2021 tax returns or an extension to file is April 18, 2022. Taxpayers requesting an extension to file have until Monday, October 17, 2022, to file. An extension to file is not an extension to pay taxes due. If an extension is requested, it is important that the taxpayer understand the requirements for any estimated tax due as penalties and interest could accrue until the taxes due are paid. To verify the license of a certified public accountant, visit TDCI’s website. Free Tax Preparation Some taxpayers may qualify to have their taxes prepared for free through one of two long-standing IRS programs. People with low to moderate income may benefit from this free tax help through one of these programs. Volunteer Income Tax Assistance (VITA): This program is for taxpayers who earn $58,000 or less, taxpayers with disabilities and limited English-speaking taxpayers. Tax Counseling for the Elderly: This program is for people age 60 or older specializing in questions about pensions and retirement-related issues unique to seniors. More information on these programs can be found here. Free File Program Consumers who decide to file their tax returns themselves should remember their options available through the IRS Free File Program, a public-private partnership between the IRS and many tax preparation and filing software industry leaders who provide their brand-name products for free. The program provides two ways for taxpayers to prepare and file their federal income tax online for free: Guided Tax Preparation provides free online tax preparation and filing at an IRS partner site. The service is provided at no cost to qualifying taxpayers. Only taxpayers whose AGI is $73,000 or less qualify for a free Federal tax return using IRS Free File guided tax preparation. Free File Fillable Forms are available to taxpayers of any income level. The IRS provides free electronic forms for consumers to complete. Consumers who choose this option should remember they must prepare their own tax returns using only the IRS forms, instructions, and publications. No tax preparation guidance is provided. To find out more information about the IRS Free File Program click here.

Dr. Bob Pruitt, Robertson County Schools Supervisor of Secondary Education, was endorsed for school superintendency by the Tennessee School Boards Association in December, after completing 98 hours of intensive instruction. The Superintendents Academy, administrated by the TSBA, provides training and orientation for educators seeking to add to their portfolio of leadership credentials. Pruitt, along with 14 other Tennessee education administrators, received training in more than 11 areas of responsibilities that all district superintendents must deal with. The subjects ranged from communication, both internal and external, to legal, health and finance. For his part, Pruitt said the experience was valuable to his current and future responsibilities. "It was my great pleasure to be involved in this high-quality professional development from TSBA,” he said. “The coursework covered the full depth and breadth of the curricular, cognitive, and operational demands of the superintendency. The cohort contained school leaders from all over the state, from Memphis to Johnson City, and it was a joy to hear their stories and learn from their experiences. I enthusiastically look forward to applying this new knowledge to my current role here in Robertson County, and I know the information will find further and deeper application as I move through the end of my career."
