The National Campaign Against Torture (NCAT) in its “India: Annual Report on Torture 2019” reported that a total of 1,731 persons died in custody during 2019, i.e. death of about five persons daily.[13] Out of which 1,606 deaths were reported in judicial custody and 125 deaths in police custody. Out of the 125 deaths, 93 persons (74.4%) died during police custody due to alleged torture/foul play while 24 persons (19.2%) died under suspicious circumstances in which police claimed they committed suicide (16 persons), illness (7 persons) and injuries (1 person) while the reasons for the custodial death of five (4%) persons were unknown.[14] Most of the victims of torture belong to the weaker sections of the society. Doctors, nurses, and other health care workers have immense pressure on their shoulders as the front-line warriors in the battle against this virus. Hospitals and clinics are overburdened with a rising number of positive cases and health care workers are fighting tooth and nail to combat the pandemic. In this context, a medical profession by the name of Jerryl Banait filed a Writ Petition as a Public Interest Litigation (PIL) before the Supreme Court praying for various directions to be issued in reference to the pandemic. The 13th Law Commission report stated that- The proper function of the Indian Penal Code is to create offences and not merely to forbid. A penal code forbids only what it declared punishable. There are laws other than the Indian Penal Code performing the same function. We suggest that the words “any act forbidden by the Indian Penal Code” should be deleted and a wider expression be substituted thereof so that penal laws other than the Indian Penal Code may also be included. There are several drawbacks in the Act of 1861 which restrict the productivity of police. The Police Act, 1861 is silent about the basic rights of a police officer during their service. They are expected to be present managing all the fields effectually right from traffic on the roads and escorting the VIPs to handling heinous crimes and public furore. But one forgets that they have the same working capacity as other employees and require rest in the same manner. Police in India struggles to maintain their work-life balance. Elections are inalienable to any democratic system and in order to ensure the free and fair conduct of elections, an efficient and dynamics electoral law is needed. Law, by its very nature, needs to be modified regularly or else it either fails to perform its functions or it itself withers away. Indian electoral system faced the absence of reforms for a very long time. While electoral systems in most of the countries are regularly updated as per the needs of the society. In India, however, there has been a severe lack of reforms in the electoral law which has greatly affected the efficiency of our democracy. Introducing reforms in any system is not an easy task as a change is always resisted by a large number of people who see status quo as the only acceptable position. Children of prisoners and detainees are among the most vulnerable and yet incredibly ignored categories of children. They are often referred to as the ‘orphans of justice,’ the ‘Cinderella of penology,’ or the ‘forgotten victims of crime.’ Early life experiences have lasting effects on human development, and therefore, children should be protected from such traumatic experiences to the extent possible. The childhood trauma, neglect, and abuse owing to either imprisonment of a parent or upbringing in prison are bound to have detrimental effects on their development. The situation is worse when the parent in question is the mother, as the children are naturally dependent on them because she is the primary caregiver.
