Running Your Business Tax Efficiently
We're more than half way through 2014: Exactly where does your business stand in regards to taxes?
Last week, a client of mine had an ugly surprise when I completed his tax return and made known he owed a lot of money to the Internal Revenue Service. His initial reaction was to be mad at the ambassador. Even so, upon careful reflection, he declared, "Well, I should have come to see you last year when my new product took off the way it did. I knew I was making a lot more money." He's correct. When there is a significant variance to your business's bottom line (in either red or black), it's time for a visit to your tax guru. In fact, anyone who manages a small business should take advantage of the mid-year off period to sit down with a tax pro to talk about their financial statements and potential tax liabilities. It's infinitely easier to strategize and put a plan of action in place today than to run around at year end upending pails of water on all the tiny fires that have been brewing all year. Here are some tips to talk about with your tax pro to bolster your tax predicament and subsequently store working capital in your bank account rather than in Uncle Sam's pocket:.
Start a retirement plan.
If you're finally a few bucks on top and do not have a retirement fund, now's the chance to create one. Here's the perk: it's deductible!
Speak with a registered financial advisor or a rep from your financial institution to identify what kind of design best suits your demands.
There are a broad range of vehicles from Individual 401(k) plans to SEP IRAs to BASIC plans that may or may not need you to involve employees in the plan.
If a plan requires employee participation, do not instantly dismiss it.
Setting up a retirement plan for your workforces could be a meaningful means to give raises that don't require the extra cost of employer paid payroll taxes. Read IRS Publication 560 for more information.
Investigate your legal structure.
Take the time to evaluate whether or not your business is operating optimally in its existing entity structure. You may have started out as a sole proprietorship and have grown out of it. It is certainly important to assess entity structure if your company is currently netting more than $100,000 per year.
Be aware that if you incorporate, you will now be required to take resources out of the business via payroll rather than simple draws.
There is a lot more paperwork involved under this status, but the tax rewards and protection that a corporation provides may turn out to be more beneficial. Always review these possibilities with your attorney and tax pro before making a choice.
Provide employee benefits.
People are our most important business asset and should be treated appropriately. There are many employee benefits that are not taxable to either the staff or the business. Look into IRS Publication 15-B, Guide to Fringe Benefits to learn more on this subject. You will save your money in payroll taxes while you develop a happier working environment for your workers.
Purchase furniture and equipment.
The IRS has always honored outlays for capital assets by providing the Section 179 Deduction. This particular deduction allows the immediate expensing of capital assets as opposed to depreciating them over their useful lives. Be informed however. This year, the limit for purchases decreased from $500,000 to $25,000. However, Congress will be looking into extending that ceiling probably sometime during fourth quarter. You can start putting money aside for the purchases now.
Perform estimates.
Take a good look at your financial statements. Run a profit and loss and contrast it to the prior year profit and loss through June 30. Are there notable changes? Are you expecting an increase or decrease in sales and/or expenses through the end of the year? It's a simple matter to export your data from QuickBooks into Excel wherein you can tinker the figures to establish what your end-of-year bottom line will be. Give that information with your tax pro to figure out if you must adjust your predicted tax payments accordingly.

Personal Financial Planning a Must - Lawyer Joe Garza Explains
Perhaps you've just recently finished school; maybe you've even found your first job, you may think it’s rather early to start worrying about your savings and where you are investing your money. That couldn’t be farther from the truth. Regardless of how you approach at it, the sooner that start saving up, the more you can expect to have later (or for a rainy day). And, starting to distribute the income you have early on will make make things far better down the road when you are purchasing a house or getting ready to retire. Becoming familiar with great financial habits can bring life-long rewards. These novice budgeting practices can help you find some financial basics and start to invest in your future.
Cover your bases.
When you begin thinking of long-term goals, be certain that you have already made a financial strategy prepared that is appropriate for your present situation. For many millenials that should include taking care of any private/government student loans you may have accumulated during school. With an interest rate of more than six percent, it’s very important that you take care of student loans as quickly as possible—especially considering government student loans are often the hardest loans to finish paying off. The current law makes it rather hard to forgive loans in the event of bankruptcy. for bankruptcy, but an important aspect of preparing a financially secure future is to address financial struggle before life gets even more financially stressful. You don’t want old debt looming over your head when you'd rather be starting your very own family or browsing for new home.
On top of paying off your debt from student loans, it is necessary to start putting away an emergency savings fund. At some point in the future, you will probably run into unexpected expenses. Events like medical bills and major car repairs happen; when they do, be relieved that you set some money aside to cover it.
Determine your professional goals.
Most people don't have their whole lives mapped out, it's not unlikely that you have a feel for your major interests and priorities. If you plan on traveling the world while you are still young, your saving program are probably going to look very different than those of someone who ultimately wants to retire early. Deciding on your goals can help you identify how much they need to save every paycheck. Some Experts have even advised young people to put aside as much as a whole third of their monthly income, with others suggesting to save at least 10% of their money. Whichever amount you decide on, be sure to put away finances for every one of your important goals (from retiring early, to traveling the world, to having your dream wedding) every month so that none of your goals gets neglected.
The benefit of good saving habits is that you won’t begin to become used to a way of life that you later find out is very expensive. It’s definitely easier to start lean and work toward a more expensive life than it is to scale back on those things you used to love.

Dallas Attorney Talks IRS and It's New Techy Tax-Filing Initiative
Every year, laws about the IRS get more involved, and change to benefit (and disappoint) different people. In '14, you will likely to see a few new additions to income tax law, including adjustments for inflation, new policies for same-sex partners, and even some infractions for {not registering health insurance either through a private seller, or the federal government. One defining element of this season's tax law may be its several-week delay, courtesy of the government's shutdown back in 2013. Nonetheless, this year will also be the beginning of a different style of national tax change — not only the amount we pay, but with the way we file.
This Year's 'Improved' Federal Tax Policy
At the beginning of the year, the Internal Revenue Service publicly disclosed a “newly revised comprehensive tax guide,” otherwise known as Publication 17: an initiative that should assist citizens file their taxes in 2014. Publication 17 boasts greater interactivity and details on “tax-saving opportunities.” In addition to Publication 17's new features is material on the American Opportunity Tax Credit, affecting college students and their guardians, and also Earned Income Tax Credit and Child Tax Credit.
Distributed by the Internal Revenue Service since the 40's, the new guide still contains educational material on reporting earnings, capital gains and losses, IRA’s and other fundamental info. However, at a towering 292 pages, it appears unlikely that your average tax-payer will find time to read the publication in its entirety. Given the increasing complexity of Federal income tax, it comes as no surprise that the IRS would announce updates to the instructions almost daily.
Less Face-to-Face Assistance
The new policy suggests a considerable transition away from face-to-face interaction, and many more digital resources to help people get through tax season in 2014.
Cuts to the IRS budgets — mostly due to sequestration — mean that there will be far fewer resources for in-person tax filing help. Rather than having a human representative, filers will be referred to a variety of online resources, including over 13k official partnering (volunteer) sites, and resources on IRS.gov - like the IRS 'Free File' program. Even very inquiries are now taken care of with online resources or through one of the IRS' various hotlines. With such a large emphasis on online assimilation, it's rational that the federal government would begin offering more of its assistance in the form of web material.
More Services Show Up on the Web
Though some people will certainly be frustrated by less help in the form of interaction with a representative, there will be people will be relieved to know that they can take care of more tax-related problems online than ever. Now, taxpayers can look at and authenticate their tax forms on the web. The IRS will also continue to give out Employee Identification Numbers through IRS.gov. Finally, to avoid handling taxpayer inquiries concerning the whereabouts of refund checks over the phone, the IRS will now handle all similar questions online as well.

Why Bitcoin May Be Facing Serious Trouble
Stock Market news nowadays would probably be rather uneventful without updates on Bitcoin, the digitally-derived currency that has struggled through volatile spikes in value since it was launched five years ago. But now, we may be witnessing the demise of the currency's baffling performance could very well be approaching. The October Silkroad takedown may have not been strong enough to stop Bitcoin in the long-term, but recent signs from China is surely not good for the once-regulation-free currency. The Times reports that “If Bitcoin is a bubble, as its critics contend, it is showing signs of deflating.”
Within the past few days, BTC China—the largest Bitcoin exchange in existence—said that it would no longer honor deposits made with Bitcoin. The news was decided just a few short weeks after the Chinese government banned large entities from trading in Bitcoins. There are even several European countries who are choosing to stop Bitcoin activity, only on a slightly smaller scale. The country of Norway has decided to emulate Germany in its decision to tack a capital gains tax on citizens’ assets in Bitcoin.
Though some may be disappointed to see the last of Bitcoin’s glory days, it's clear that for many people, Bitcoin's risks outweighed its benefits. Surely, the currency is completely uninsured, but it's also one that's been considered very easy to steal. For instance, this month, about $100m. worth of Bitcoins was taken from customers of an Internet seller of illegal drugs called "Sheep Market". But, people making unsafe purchases haven’t been the only people to suffer. Near the end of Oct., Chinese trading platform for Bitcoin trading platform, GBL, disappeared without notice, along with approximately $4M of its patrons' investments.
Experts say, the reason that Bitcoin is perfect for thieves is that “ownership” of a Bitcoin is defined by nothing more than possession to a “private cryptographic key to unlock a specific address,”. So, if someone else assumes posession of your code, then they can go and do whatever they want with your capital. It’s not even that difficult to get keys since many sites store their users' unique keys online. Also, even despite the fact that Bitcoins can be publicly traced online, laundering this money is now very easy since the operation of anonymous financial known as "tumblers".
People everywhere wondering, could digital currency continue to thrive if investigators create a way to make them more traceable? It could make a difference, but now with a huge part in the Bitcoin market missing (China) and more governments cracking down on the currency, possibilities are rapidly decreasing for it to succeed. Not surprisingly, leading analysts have long predicted that the currency is currently in a flimsy bubble that could burst soon.

Joe B Garza Explains Qatar, Syrian Conflict
TeAccording to a June 29th article in the New York Times, the country of Qatar has emerged as a budding force in the current unrest in Syria. According to U.S. intelligence and Middle Eastern officials, Qatar has been supplying Syrian rebels battling President Bashar Assad with heat-seeking, shoulder-fired missiles. The U.S. has implored its Mideast allies not to supply these weapons to the rebels, fearing that the missiles will end up in the hands of terrorists who could target civilian aircraft with them. This concern is especially pronounced given that the Syrian rebels are comprised of several loosely-allied groups, including militants linked to al-Qaeda. Ironically, the Obama administration encouraged Qatar’s shipment of arms to Libyan rebels who eventually overthrew Muammar Qaddafi.
A great many of the arms shipped by China, including the heat-seeking missiles, are Chinese-made. While Syrian opposition forces report mechanical defects in these weapons, the weapons work well enough to cause the U.S. grave concern. Internet videos have surfaced since early 2013 showing the rebels with functioning missiles.
As to why Qatar is backing the Syrian rebels, speculation among U.S. officials is that the country’s rulers believe that Assad will eventually be overthrown, and that they wish to forge ties with the eventual victors early on. In addition, the ruling family in Qatar favors a strong role for Islam in politics, in contrast to the secular Assad regime. More generally, Qatar, flush with wealth from its oil industry, may be eager to assume a role as a key player in Middle Eastern politics.
Unfortunately, the U.S. has limited leverage over Qatar because it is already indebted to the country for hosting peace talks between the Taliban, the U.S., and the Afghani government.

Recent NSA Activity Brings FISC Scrutiny
In very early June of this year, publications around the world launched stories revealing details surrounding the NSA's surveillance strategies on U.S. soil. Shortly thereafter The New York Times ran two articles illuminating some facts about the Foreign Intelligence Surveillance Court (FISC), which is responsible for handling the warrant requests submitted by the NSA.
In its early stages, the FISC typically provided warrants associating with wiretapping, however, as technological innovation (and its impact when combined with terrorism) advances, the government continues to insist that FISC's authority be expanded. Started by the Foreign Intelligence Surveillance Act of 1978, the FISC consists of a team of eleven judge and presently includes John Roberts, the United States Chief Justice. Each request from the NSA is processed by a single FISC judge, and the final court rulings can eventually be challenged in an appeals court, but since the FISC almost always approves the government's request for a warrant, appeals rarely even take place. To give an idea of how infrequently an appeal is needed, consider that the FISC recognized 1,788 of the 1,789 government requests for surveillance orders in 2012 - the only exception was the single request that the government, itself, ended up withdrawing.
The only entity who even obtains an audience with the FISC is the American Government, which is why the structure of FISC cases differs greatly from the conventional adversarial system that most citizens are familiar with. FISC judges are selected by a single individual, and their option does not need additional approval or oversight from a secondary party. By doing this of picking brand-new judges arouses suspicion that the court overlooks ideological variety, and fails to stand for the spectrum of different political that exist outside the court.
National security matters are obviously taken very seriously, still, some believe that the FISC's powers circumvent what we acknowledge as the main American Legal System. The 4th Amendment in particular gives "The right of people to be shielded in their individuals, documents, impacts, and homes, against unreasonable searches and seizures, shall not be broken, and no Warrants will release, nonetheless upon probable source ..." In its rulings, the FISC still acknowledges the precedent of the 4th Amendment, but sources like The New York times have mentioned their growing concerns that the FISC seems to be changing into a "parallel Supreme Court" with the amount of authority it has.
Historically, not many of the FISC's court choices have been seen by the public, so, understandably, they have received very little public attention, let alone criticism. But after September 11, 2001, and even as just recently as the 2013 NSA fiasco, interest in the FISC and it's function in the American legal system has greatly increased, even though the court itself is still primarily shrouded in secrecy. With unprecedented technological development that threatens to facilitate the next disastrous terrorist attack, questions surrounding the FISC's behavior might become more politically popular, and could even begin getting attention from major political campaigns in the future. More on the NSA leaks and even some of the NSA's proponents like John Bolton can be read at The Capital Press.

Opponents Have Cow Over Spitzer Candidacy
Five years ago, Spitzer publicly resigned from the position of New York Governor following the disclosure of his association with an escort service - an event that garnered national attention. While Spitzer's political persona is largely contextualized by this scandal, the recent editorial decided to consider some of his behavior during his position as New York Attorney General - not his tenure as Governor.
As New York Attorney General, Spitzer created an image as a powerful leader who was willing to face the giants of Wall Street, but Spitzer reportedly misused his position at this time, with accusations from John Whitehead (former Goldman Sachs chairman) that Spitzer would attempt to threaten cooperation out of other powerful political and financial figures. After publishing favorable editorial piece profiling the former AIG CEO, Hank Greenberg, Whitehead was met with vicious remarks by Spitzer for having supported one of Spitzer's apparent "targets". Whitehead insisted that Spitzer repeatedly told him that he would "pay the price" and "pay for what he [had] done".
Similar accounts of relentless behavior by Spitzer were reported by Thomas Donahue, who served as the president of the United States Chamber of Commerce during the time of these 2005 statements:
"Spitzer's approach is to...say, 'We're going to make a deal, and you're going to pay [money] to the state, and you're going to get rid of this person and that person, and if you don't do it by tonight, we're going to indict the company'...It is the most egregious and unacceptable form of intimidation we've seen in this country in modern times."
Spitzer has no shortage of both public and political disapproval, but despite the opposition his political image seems to have found stability. In fact, projections for the September 10 primaries suggest that he boasts a 19-point lead over his competitors among Democratic voters.

John Hancock Has Lost Tax Battle with IRS for $516 Million
The conglomerate life insurance company, John Hancock Life Insurance Co., has lost a major tax lawsuit against the IRS in recent news, to the tune of $516 million. In a decision that was made by the U.S. Tax Court that involved the disputed sum, the court has rendered its final verdict. It centered upon a series lease deductions that the company made on transactions it attests were deductible, something that was contested by the IRS and that was upheld by the court in its decision.
Judge Harry Haines heard arguments from the insurance company’s attorneys and from the IRS regarding the denied deductions. The judge issued a statement regarding his ruling this week stating that “the substance of the transactions is not consistent with their form.” He then denied the firm deductions they had entered for depreciation, rental and interest expense.
“John Hancock did not acquire the benefits and burdens of ownership” Haines wrote in his decision.
This week’s ruling signifies that largest such ruling in its class for the IRS in recent years regarding complex lease in and lease out transactions commonly referred to by acronyms LILO and SILO.
In 2008, the IRS offered companies using LILO and SILO methods a way out by offering them a flat 20 percent savings rate on their savings instead. In these types of transactions, private entities lease utility entities back to the federal government.
According to the IRS, the company was guilty of providing “sham arrangements.” The ruling will apply to 27 different transactions that the company created between the years 1997 to 2001 and will also impact its tax liability for the year 1994 as well.
