"We Are Part of Parliament and We Are the State," Says Opposition Leader Omar Ayub
Tumblr media
Opposition Leader Omar Ayub stated that since yesterday, discussions have been centered on the supremacy of the Constitution and law. He emphasized, "We are part of Parliament, and we are the state. How can we talk against the state and ourselves?"
While addressing the Opposition's National Conference in Islamabad, Omar Ayub remarked that the current government has no significance in comparison to the Form 47 holders. He suggested that the person who proposed stopping the opposition conference should be awarded a special award on March 23.
Omar Ayub further said, "We have fought the case of missing persons before the Chief Justice of Pakistan. The federal government must pay the dues owed to Khyber Pakhtunkhwa. Only political prisoners are being put in jail in this country. We are gathered here for the supremacy of the Constitution and law, and we are working to strengthen the state."
In his speech, Sahibzada Hamid Raza, the head of the Sunni Ittehad Council, stated that the conference is aimed at uniting Pakistan. He described attempts to stop the conference as a blow to the Constitution, asserting, "We say that the Constitution is supreme, and we will follow it." He credited the founder of PTI with playing a central role in uniting the opposition today.
Sardar Mehtab Abbasi, leader of the Pakistan Peoples Party, said in his speech that the problem lies in the rulers' refusal to acknowledge the Constitution and law. He added that all the leaders in today's conference are patriots, and they aim to continue their struggle through constitutional and legal means. "After this conference, we will unite and devise a future course of action," he said.
Liaquat Baloch, a leader of Jamaat-e-Islami, remarked that the youth of Pakistan are losing hope, and women's rights are being taken away. He emphasized the need to struggle for the independence of the judiciary.
Earlier, a two-member delegation from JUI-F arrived at the opposition's national conference, where Omar Ayub and Mahmood Achakzai welcomed them. The JUI-F delegation consisted of Maulana Abdul Ghafoor Haidri and Kamran Murtaza.
It is noteworthy that due to the lack of an NOC (No Objection Certificate) for the opposition's national conference, the hotel management initially refused to allow the event. However, opposition leaders forcibly opened the hotel's gate and entered.

Mustafa Amir Murder Case: 5-Day Physical Remand Approved for Accused Armagan and Shiraz
Tumblr media
In the Mustafa Amir murder case, the Anti-Terrorism Court has approved the physical remand of accused Armagan and Shiraz, handing them over to the police for an additional five days.
The main accused, Armagan, gave a statement in the Anti-Terrorism Court, claiming that he was being tortured, with no food being provided to him. He alleged that the police took him to the station and mocked him.
In the kidnapping and murder case, the accused further told the court that he was told his physical remand had been taken, and he hadn't been able to use the bathroom for ten days. He claimed he couldn't stay in police custody. The judge asked how it was possible that he hadn’t used the bathroom for ten days.
Armagan’s mother appeared in court and stated that she had surrendered her son to the police. The police submitted a report to the court regarding Armagan's arrest and the recovery of weapons. According to the report, when the police reached the accused's bungalow, the person inside did not open the door. The gate was opened by the impact of an official mobile phone, and the police entered the bungalow. From the upper floor, the accused opened fire on the police with modern weapons, injuring DSP Ahsan Zulfiqar and Constable Muhammad Iqbal. U.S. Imposes New Sanctions on Iran's Drone Program
Tumblr media
The United States has announced new sanctions targeting Iran's drone program. The U.S. Department of the Treasury stated that the sanctions target six entities based in China and Hong Kong, which act as front companies for two Iranian firms involved in the procurement and shipment of key UAV (Unmanned Aerial Vehicle) components for Iran's UAV and ballistic missile programs.
Treasury Secretary Scott Bence stated that Iran continues to seek new methods to procure essential components for its UAV weapons program through new front companies and third-country suppliers.
The statement also noted that this new action supports President Trump’s "maximum pressure campaign" against Iran. Trump initiated this campaign in 2018 after the U.S. withdrew from the historic nuclear deal with Iran during his first term.
After returning to the White House just two weeks ago, President Trump renewed his campaign earlier this month.
Despite restoring this policy, the U.S. President has expressed willingness to negotiate an agreement with Iran. However, the Islamic Republic of Iran has rejected the possibility of direct talks with the U.S. unless the "maximum pressure campaign" comes to an end.
Iranian Foreign Minister Mohammad Javad Zarif stated in a joint press conference in Tehran with Russian counterpart Sergey Lavrov that Iran’s stance on nuclear negotiations is clear: "We will not negotiate under pressure, threats, or sanctions."

Second Consecutive Match in Champions Trophy Washed Out, Pakistan vs Bangladesh Cancelled
Pakistan Finishes Last in Group A
Tumblr media
Rawalpindi: Pakistan and Bangladesh ended their disappointing Champions Trophy campaign with one point each.
The Group A match between Pakistan and Bangladesh was scheduled at Rawalpindi Cricket Stadium, but persistent rain and a wet outfield prevented even the toss from taking place. Eventually, the umpires decided to cancel the match.
The toss was initially set for 1:30 PM local time, but continuous rain forced the officials to inspect the field repeatedly. However, with no improvement in conditions, the match was officially called off.
Both teams were awarded one point each, leaving Pakistan at the bottom of Group A.
Earlier, the match between South Africa and Australia in Rawalpindi was also abandoned due to rain.
Now, only one Group A match remains — between India and New Zealand on March 2 in Dubai.
This match is effectively a dead rubber as both teams have already qualified for the Champions Trophy semi-finals. The result will only determine which team tops Group A.
Based on net run rate, Bangladesh finished with a better performance (-0.443) compared to Pakistan's disappointing -1.087.

Illegal Police Stations Uncovered in Karachi, Notification List Requested
Tumblr media
A shocking revelation has emerged regarding the establishment of illegal police stations in Karachi. The Administrative Judge of Anti-Terrorism Courts (ATC) has raised questions about the legal status of several police stations and has written a letter to the Sindh Home Secretary, demanding a list of officially notified police stations in Karachi Division.
According to sources, the ATC Administrative Judge pointed out in the letter that various law enforcement agencies, including the Counter-Terrorism Department (CTD), Special Investigation Unit (SIU), Central Investigation Agency (CIA), and Anti-Vehicle Car Lifting Cell (AVCC), are operating at different locations, but their legal status remains unclear.
The letter further stated that the Sindh government has not issued an official notification for the establishment of these police stations, which is a violation of legal requirements.
Additionally, the Administrative Judge has sent a letter to the Sindh High Court, which has now been received by the court.
The letter instructs that a list of all officially notified locations for anti-terrorism courts in Karachi Division should be provided.
The judge emphasized that the existence of unauthorized police stations raises serious concerns about the transparency and legal validity of judicial proceedings, which could become a major issue for the justice system.

Doctrine of Necessity Has Destroyed Our System: Mahmood Achakzai
Tumblr media
Mahmood Khan Achakzai, head of the Tehreek Tahafuz-e-Aeen Pakistan (Movement for the Protection of the Constitution of Pakistan), stated that the Doctrine of Necessity has destroyed our system.
At a conference in Islamabad, organized by the opposition alliance under the theme "Supremacy of the Constitution and Rule of Law," speakers emphasized that political stability is essential for economic stability in the country.
Mahmood Khan Achakzai attributed the country's major problems to the exclusion of the public from governance. He said that every human being fundamentally desires a share in the rule of law. "The fruits of the independence we gained in August 1947 have not reached the people at the grassroots level. We have not made our people stakeholders in governance. Peace and justice are interconnected—where there is justice, there will be peace."
Shahid Khaqan Abbasi, convener of Awaam Pakistan Party, strongly criticized the legislation passed by the current parliament. He argued that amendments to laws and the Constitution were aimed at undermining the justice system. He further stated that black laws like the Prevention of Electronic Crimes Act (PECA) were introduced to suppress political gatherings and protests. "Constitutional amendments were made in the dead of night, violating the spirit of the Constitution," he added.
Opposition Leader Omar Ayub accused the government of violating the Constitution and the law by trying to stop the conference. "We had to change three venues for this event. My Secretary-General, Salman Akram Raja, received an arrest warrant yesterday. The Parliament is just a few furlongs away from here, yet no one in Pakistan wants the supremacy of the Constitution and the rule of law," he lamented.

All Five Judges Agreed That Civilians Cannot Be Tried in Military Courts: Constitutional Bench
Tumblr media
During the Supreme Court hearing on intra-court appeals against the trial of civilians in military courts, Justice Jamal Mandokhail remarked that all five judges agreed that civilians cannot be tried in military courts. Justice Aminuddin stated that a larger bench is not bound by the previous ruling.
A seven-member Supreme Court bench, led by Justice Aminuddin Khan, heard the intra-court appeals against the trial of civilians in military courts.
During the proceedings, civil society’s lawyer, Advocate Faisal Siddiqi, argued that the five-member bench had issued not one but three decisions against special courts. Justices Ayesha Malik, Muneeb Akhtar, and Yahya Afridi wrote the judgments, and all judges concurred with each other’s rulings. If different judges agree on the verdict but provide different reasons, all reasons become part of the judgment.
Justice Muhammad Ali Mazhar stated that the judges had written full judgments, not just additional notes. Justice Jamal Mandokhail reiterated that all five judges had unanimously agreed that civilians cannot be tried in military courts.
Faisal Siddiqi countered the argument by Azir Bhandari regarding the limited scope of intra-court appeals, stating that he did not agree with Bhandari’s stance, which was based on Justice Mansoor Ali Shah’s note in the Practice and Procedure case.
Justice Muhammad Ali Mazhar pointed out that Justice Mansoor Ali Shah had deemed the right to appeal retroactively valid, a position he himself had opposed. He added that allowing retrospective appeals would have led to cases dating back to 1973 being reopened. Faisal Siddiqi agreed, acknowledging that limiting the appeal scope could also result in many of their appeals being dismissed.
Justice Aminuddin Khan, head of the constitutional bench, stated that a review decision is given by a judge, while an intra-court appeal is heard by a larger bench, which is not bound by the previous ruling.
Expressing his full confidence in the constitutional bench of the Supreme Court, Faisal Siddiqi was humorously warned by Justice Jamal Mandokhail that if he continued with lengthy arguments, the court might have to listen to him for three months.
Siddiqi argued that the constitutional bench could invalidate the trial of civilians in military courts without striking down specific sections of the Army Act.
After a brief break, the hearing resumed, and Faisal Siddiqi continued his arguments, stating that under Section 94, a commanding officer’s discretionary power to hand over suspects was unjustified.
Justice Naeem Afghan inquired if there was an official court order from the Anti-Terrorism Court (ATC) regarding the transfer of accused persons, to which Siddiqi responded that an order did exist but lacked justification.
Justice Jamal Mandokhail questioned whether the court itself should determine its jurisdiction or if an objection was necessary from one of the parties involved. Justice Aminuddin clarified that the court must determine its jurisdiction independently.
Siddiqi then presented a hypothetical scenario, questioning whether the court would remain silent if someone claimed ownership of the Quaid-e-Azam’s Mausoleum just because no one objected. He emphasized that while some people believe Pakistan’s judicial history is dark, it also has many instances where judges have defended public rights. He cited the F.B. Ali case, where the Supreme Court provided significant relief.
Referring to the 1980s, Siddiqi stated that "Zia-ul-Haq was the Pharaoh of his time," yet four to five judges stood up against him, saving many lives.
Justice Musarrat Hilali recalled a time when the security situation in Balochistan had deteriorated so much that judges had to stay in court overnight. She expressed hope that Siddiqi had never witnessed such circumstances.
Siddiqi maintained that transferring civilians to military custody was incorrect and that such transfers should only occur after charges had been formally filed. Justice Muhammad Ali Mazhar remarked that an individual who applies for bail after an FIR is registered is still referred to as an "accused" even before formal charges are filed.
Siddiqi further argued that only after charges are framed can it be determined whether a case falls under the Official Secrets Act. He cited the Dewan Motors case, in which the constitutional bench ruled that if the foundation of a case is flawed, the entire structure cannot stand.
Justice Naeem Afghan noted that the Anti-Terrorism Act (ATA) does not include the Official Secrets Act in its schedule, reinforcing Siddiqi’s argument that civilians should not be tried under military laws.
Justice Aminuddin questioned whether military courts had conducted trials based on provisions under the ATA. Faisal Siddiqi replied that he believed the convictions in military courts were under the Official Secrets Act.
Justice Jamal Mandokhail pointed out that the Armed Forces Ordinance is also not listed under the ATA’s schedule, yet terrorism courts conduct trials when armed offenses are linked to murder charges.
Justice Muhammad Ali Mazhar clarified that if a trial has already been conducted in a military court, a retrial is not possible. He emphasized that military courts cannot convict under the Official Secrets Act and then transfer the case to an anti-terrorism court.
Justice Mandokhail noted that the Army Act does not even provide for the registration of an FIR. Advocate Siddiqi explained that magistrates review cases before sending them to anti-terrorism courts for handing over the accused.
Justice Aminuddin stressed that if a direct application is made, the ATC judge must provide reasons in their ruling. He also inquired about the legal options available to an accused person after being transferred to military custody.
Siddiqi responded that before handing over an accused to the military, the court must be satisfied that the offense falls under military jurisdiction. He asserted that an FIR alone is not sufficient grounds for a court-martial.
Justice Mandokhail questioned whether an investigative officer can hand over an accused to another authority. Siddiqi argued that the investigating officer does not have the independent authority to transfer an accused person.
The hearing on the trial of civilians in military courts was adjourned until the next day, with Advocate Faisal Siddiqi set to continue his arguments.
