Like Daughter Like Mother: Dina Lohan Charged with DWI

Dina Lohan, 50, was arrested yesterday in New York and charged with DWI, after a breath test revealed her blood alcohol level was more than twice the legal limit, ABC News confirms.
New York State Police observed the mother of actress Lindsay Lohan at around 11 p.m. driving at "a speed of 77 mph in a 55 mph zone," according to a police press release.
Lohan was pulled over in her white BMW and blew a .20, more than twice the legal limit of .08 percent alcohol concentration.
After being taken to Farmingdale, on Long Island, for processing, Lohan told police she was injured during the arrest and was evaluated by medics.

"When emergency personnel arrived and evaluated Lohan, there were no injuries and she recanted her claim," the release continued.
Lohan was issued traffic tickets for the two DWI offenses and speeding.
"She was later released to a sober third party and is scheduled to appear in Nassau County1st District Court on September 24 at 9 am," the release added.

This arrest comes less than two months after her daughter, 27, finished her three-month stint in court-ordered rehab.
Lindsay Lohan checked out of Cliffside Malibu at the end of July. The "Mean Girls" actress went to rehab as part of a plea deal stemming from a June 2012 traffic case, where she pleaded no contest to reckless driving and lying to police.

Judge Rules Josh Brent Blood Result Admissible in Spite of Recent Supreme Court Ruling
A judge refused to throw out a blood test that showed ex-Dallas Cowboys player Josh Brent was driving drunk the night of a crash that killed a teammate.
Brent's attorney argued the blood draw as illegal because it was taken without a warrant. He made the argument based on an April 2013 ruling by the Supreme Court in case from Missouri.
The Irving police officer who arrested Brent and ordered the blood raw said because of the circumstances that night, he didn't feel a warrant was necessary.
Dallas County prosecutors were happy with the ruling.
"We expected the judge to rule exactly as he ruled. We think that based on the totality of the circumstances and the law at that time - and even now - that the officers did exactly what they were supposed to do," said prosecutor Heath Harris.
The trial was scheduled to begin in September, but now has a Nov. 18 start date.
Brent faces trial for the death of teammate Jerry Brown, Jr. in a Dec. 2012 automobile wreck.
Authorities believe Brent had been drinking and driving when he crashed his car, killing his friend and teammate. His blood alcohol levels were more than twice the legal limit.
Brent entered a not guilty plea in court on Friday. If found guilty, he could get as little as probation or as much as 20 years in prison.

Lamar Odom Charged with DUI

After a week in which news about Lamar Odom was moving very quickly, the basketball player has been arrested on suspicion of DUI — for driving too slowly.
The arrest capped a week in which rumors that the "Khloe & Lamar" star was cheating on wife Khloe Kardashian Odom gave way to allegations that he had a drug-abuse problem.
Headlines screamed briefly that Odom was "missing" after a failed intervention attempt, but his agent cleared that up somewhat, telling ESPN only that the NBA free agent wasn't missing, and that Khloe knew exactly where he was.
Early Friday morning, Odom was going about 50 mph when he was pulled over on the 101 Freeway in the San Fernando Valley, L.A. Now reported. California Highway Patrol officials said he was driving in a "serpentine manner" and actually continued past three exits while authorities tried to pull him over.
He showed signs of intoxication and couldn't pass field sobriety tests, a CHP report said. He refused all chemical tests at Van Nuys jail — something that People reports resulted in suspension of his driver's license for a year, under state law.
Odom was arrested just before 4 a.m., booked around 5 a.m. and not released until around 8:30 a.m., which means he was in jail for around 3 1/2 hours before getting out on $15,000 bail, according to L.A. Sheriff's Department records.
Kardashian Odom was mum early Friday on Twitter.
We've known that the "Khloe & Lamar" couple, who wed in September 2009 after dating for only a month, haven't been photographed in public for months, and recently Kardashian Odom was snapped without her wedding ring on during a trip to the gym. All summer, there's been buzz that he had cheated on her.
Last weekend, however, the story took a turn, with TMZ sources alleging that drug use was the primary cause of the major rift in the marriage, in addition to Khloe's belief that cheating did happen.
A year ago, Khloe reportedly pressured Lamar into rehab in San Diego, the website said, where he stayed for only three weeks but managed to clean up in time for his season with the Clippers. Kardashian Odom has reportedly kept the alleged circumstances a secret from her notoriously close family until recently.
Yahoo pointed out that since the NBA has drug testing, the forward would have had to clean up during the season in order to play.
"It's a really hard time for Khloe," an unnamed source told People, which like other outlets was having no luck contacting reps on either side. "She's kept this secret for almost two years trying to save Lamar and their marriage."
The couple are allegedly effectively separated since the failed intervention, TMZ said Monday. No steps have been taken toward divorce, but the site has sources saying a split is likely. That comes a little less than two weeks after mom Kris Jenner declared to E! News that the two were definitely not divorcing.
A divorce would no doubt be a blow to fans who for years have seen the two as the real thing, despite their whirlwind romance.
Khloe has reacted strongly to all the allegations, peppering her Twitter response Sunday with profanity.
"Really hard to sit here and listen to people talk ... about my family! ... you and shame on you! I'm too protective for this ...!," Kardashian-Odom said [warning: link contains profanity].
Odom is due in court Sept. 27.

Nanny Tries to Pick Kids up from School Drunk
A San Anselmo nanny was arrested for allegedly driving drunk Monday afternoon while picking up two young children from their first day of school at Bacich Elementary School in Kentfield, according to the California Highway Patrol.
Nathalie Irene Winn, 47, was arrested at 3:20 p.m. Monday on suspicion of driving under the influence, CHP officer Andrew Barclay said. CHP units were called to Bacich at 699 Sir Francis Drake Boulevard at around 2:10 p.m. on a report that a car had repeatedly backed into a school sign.
The witness who reported the incident said that after the car stopped, a woman got out and staggered in the street. Barclay said. A CHP officer arrived on the scene, finding the car empty and waiting until the woman returned with two young children who she was picking up after school, Barclay said.
After stopping the woman and asking her about the alleged collision with the sign, the officer said she observed signs of intoxication and conducted a field sobriety test. The woman, later identified as Winn, failed that test and was arrested, Barclay said.
The two children were taken to the Marin CHP office in Corte Madera after the incident until their parents came to take custody of them.
Winn was booked into Marin County Jail, where she remains in custody.

David Cassidy Arrested for DUI
David Cassidy was arrested on suspicion of drunk driving early Wednesday morning while driving just outside of Albany, N.Y.
According to TMZ, Officer Tom Jones (yes, let's note the irony) pulled the former teen idol over for driving with his high beams on during an inappropriate time.
After Jones smelled alcohol on Cassidy's breath, he administered a field sobriety test. Cassidy blew a .1, which is over the legal limit, and was arrested and taken to a nearby jail to be booked. A press release from the local police department states that the 63-year-old was released on $2,500 bail shortly after. He is scheduled to return to Town Court on Sept. 4, 2013 at 6 p.m.
And it looks like legal troubles are piling up for the former Partridge Family star. As a result of having a previous DUI arrest in Florida in 2010, the singer is now facing felony drunk driving charges.

In return for his no contest plea for his DUI case years ago, Cassidy was given a reduced sentence of one-year probation and a six-month license suspension.
At the time, he was also ordered to perform 50 hours of community service, pay $500 in fines and attend a mandatory alcohol-education course and a DUI "victim impact panel."
Cassidy was originally busted for weaving across lanes on a state road in the Sunshine State. Per a police report, Cassidy told his arresting officers that he was tired, having popped a hydrocodone tablet earlier that afternoon. Authorities also found a half-empty bottle of bourbon in the vehicle.

Alabama's Geno Smith Charged with DUI
TUSCALOOSA, Ala. — Alabama cornerback Geno Smith was arrested by Tuscaloosa County Sheriffs early Sunday morning, according to an online arrest report.
Smith, a sophomore, was in competition for a starting cornerback job, was held on $1,000 bond.
"This is obviously not the kind of behavior we expect from our players," coach Nick Saban said in a released statement. "I don't have all of the details at this point and will handle it appropriately once I've had a chance to review the information."

Smith, a four-star recruit from Atlanta, played in 13 games as a true freshman with a start against Georgia in the SEC title game. He had nine tackles and two pass breakups. He would have been at least used as a nickel back this season.

Miguel Arrested for DUI in LA
LOS ANGELES (AP) — R&B singer Miguel has been arrested in Los Angeles on suspicion of drunken driving.
A spokeswoman for the California Highway Patrol says the 27-year-old "Adorn" crooner was pulled over in his BMW X6 just after 2 a.m. Thursday for speeding and driving with tinted windows.
She says officers administered field sobriety tests, and a preliminary test measured his blood alcohol level at 0.10 percent. The state's legal limit is 0.08 percent.
Miguel won the Grammy for best R&B song earlier this year for "Adorn." He also duets with Mariah Carey on her single "#Beautiful."
A spokeswoman for the singer, whose full name is Miguel Jontel Pimentel, did not immediately provide comment about his arrest.

Alcohol Suspected in Crash that Killed Five Members of "Texas"
AMARILLO (AP) -- Alcohol is suspected as a factor in the deaths of five members of a popular summer musical production who were killed in an auto accident in the Texas Panhandle, an official said Tuesday.
Texas Department of Public Safety spokesman Christopher Ray said members of the cast of "Texas" - a musical performed every year at the Palo Duro Canyon State Park south of Amarillo - were returning from an end-of-the-year party Monday night when the accident occurred.
Four of the dead were dancers, while the fifth worked in the box office, according to Texas Panhandle Heritage Foundation Executive Director Kris Miller. Members of the production spent the night at the foundation's offices in Canyon, comforting each other and awaiting any further details about the accident, Miller said.
Tuesday night's performance was canceled.
Their 2001 Ford Taurus sedan was attempting to turn onto U.S. 287 near Dumas, about 40 miles north of Amarillo, when it pulled in front of a southbound 18-wheeler around 11:30 p.m. and was hit broadside on the passenger's side, Ray said.
The impact sent the load from the big rig's trailer flying; it landed on top of the driver's side of the Taurus.
Alcohol is "just suspected at this time," he said.
Killed in the wreck were Andrew Duncan, 20, of Wichita Falls; Clinton Diaz, 20, of Amarillo; Amanda Starz, 20, of Timonium, Md.; Julian Arredondo, 24, of Haltom City; and Eric Harrison, 21, of Fort Worth, Ray said. All five were pronounced dead at the scene, Ray said.
Thirty-year-old Timothy Johnson of Portland, Ore., who was directly behind Diaz, the car's driver, was transported to Northwest Texas Hospital in Amarillo, where he was last reported in critical condition.
The driver of the truck, Theron McSay, 70, was reported in stable condition with head laceratons at the Amarillo hospital.
The Texas Panhandle Heritage Foundation produces the musical, which draws up to 65,000 spectators each summer. The last performance of the summer was scheduled for Saturday.

Fox Sports Reports NFL considering increasing penalties for DWI arrests
The NFL and its players' association are in discussions to strengthen penalties for drunken-driving offenses, FoxSports.com is reporting.
According to the report, the league wants players who are convicted of such offenses to receive mandatory suspensions. A union source told FoxSports.com that "players have been open to discussions and already discussed increasing discipline on DUIs."
The source added, however, that "other proactive measures beyond discipline need to be taken," including a demographic study of incidents to see if there is a trend to the arrests and a better system to communicate to players that a service is available to provide them rides when they have had too much to drink.
An announcement on stronger penalties for players convicted of drunken driving will not come, however, until the negotiations on HGH testing are finalized, the source told FoxSports.com, because that agreement will have an effect on other league policies, including the personal conduct policy.
According to a U-T San Diego database of NFL arrests, 10 players have been arrested on drunken-driving related charges since the beginning of the year.
Last December, former Dallas Cowboys defensive tackle Josh Brent was involved in a car wreck in which teammate Jerry Brown, a linebacker on the practice squad, was killed. Brent's blood alcohol level was 0.18, more than twice the legal limit in Texas and he is facing an intoxication manslaughter charge.
