still researching US adoption/fostering/etc. for my fic and the more I do the more I'm just realizing that America makes it damn near impossible to ethically take care of kids in the system I only researched in-depth for 3 states but generally from what I can tell there is literally no way for the birth family/first family to choose who gets to take care of their kid. like if you're in a bad financial spot and want idk- your cousin to have legal guardianship of your child. you just...can't do that. there are not many, or any, options for you to name someone you deem appropriate. or if you can, you 1. have to PROVE you have a "good reason" for doing this and the list for what they deem a "good reason" essentially boils down to just "if you're so sick you're dying" 2. it expires after 6 months and that sometimes means you have to apply for a 2 month court process all over again and 3. even if you manage to appoint a guardian you trust they won't be able to do things like sign school permissions or take your kid to the doctor which seems important
which means that if the state recognizes that you are not financial fit to take care of this child, they WILL put the kid into the system and they will be either fostered or adopted by complete strangers. and in the case of adoption, in a majority of cases, those strangers will cut you off completely from that child's life. which has been proven over and over again to be deeply traumatizing. and this is not even counting in how families of color, particularly Black families are disproportionally affected by having kids taken into the system. and in case you didn't know, despite adoption being marketed as "saving unwanted kids" in a majority of cases- the birth families DO want the kids. they just don't have the means to take care of them.
in a study done in Australia (so take that with a grain of salt about how it might apply to America) where they asked adoptees how the feel, they found that kids are the happiest in legal guardianship situations. where the biological parents don't loose their parental rights, but it is instead given to one more person. most state that having the option to communicate with your bio parents, and being able to choose if you want it or not, is the best. additionally, the parental rights not being taken away from the bio parents made the two families be more on an equal footing, unlike open adoptions where despite having contact with the bio families, adoptees still felt as thought their adoptive families had the final say in everything. the unhappiest group, and I mean BY FAR were people in closed adoptions. and in America, THIS option. the studies-proven best option for the adoptee, is largely unavailable. because more than anything else, the adoption INDUSTRY doesn't care what's best for the kids. they care about what the best thing for the buyer aka the adoptive parent is. the children are nothing but a product.
