Birthright citizenship is a right enshrined in the 14th Amendment of the Constitution. Trump using an executive order to say his administration ‘isn’t going to recognize’ the U.S.-born children of undocumented immigrants is not lawful. His administration will argue it is, fold it into fear mongering ideas of immigrants ‘invading’ the country (deliberate language to argue for the shut down and militarization of the border). Trump’s administration will argue that by crossing illegally, undocumented parents forfeited their children’s right to citizenship (while the admin also makes seeking asylum/refugee status impossibly difficult).

This EO is a banner, red meat to his base, but it is spitting in the face of the most important part of our Constitution. The 14th Amendment is the second founding of our democracy, an attempt to enfold Black former-slaves into the Vox populi. Birthright citizenship is a direct response to Justice Taney’s Dred Scott decision that was a major spark of the Civil War (the opinion stated Scott, an escaped slave, “had no rights which the white man was bound to respect”). Literally birthright citizenship is a response to the legal/constitutional subjugation of a race of people, an attempt to ensure we do not go down that road again.

The fact that this is happening on MLK Day is just so infuriating and heartbreaking.
