One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. Hello, I would really appreciate any one who can help me out with this, personally i am so disgusted with the government and the way the country is run that i don't know much about politics as i stay away from it for my own stress levels. Two months ago my nephew took his own life, as well as a variety of mental health problems (Which of course also go's uncared for in this country) other reasons he couldn't cope to live in society was that he couldn't get a job (200+ job application attempts) he discovered that to increase his chance of getting a job he would learn to drive so he can get to A to B. After going into approx. 90% of his life savings he managed to take driving lessons and even managed to pass his test. At this point he couldn't get insured because he discovered even if he was in a FULL TIME job he couldn't afford it. Yes he was male and was an adolescent. But he didn't want to drive to show off , have a nice car . Etc. he wanted a car to get to A to B to increase the chances of getting a job. I want to know who is in charge of car insurance etc. (department of transport??) so i can write to them and explain the situation which makes me sick to my stomach thinking about. Everyones aware the government are trying to get young drivers off the road, but to then expect them to find a job even in this tough climate is beyond me. Some background first, i was hit from behind whilst stationary in traffic the other week by a works van. the damage was not too sever that i couldn't limp back home (sore and car bashed but still alive) got the other drivers details at the scene and reported the incident to my insurance company. As the accident was not my fault my insurer passed this to their dedicated Non-Fault (NF) accident claim company (i'll not name them at the moment) who in turn provided me with a hire car and collected my car to have it assessed for REPAIR. At no point was writing off the car mentioned. Then i got a call from the garage dealing with my car (NF appointed) a week later telling me of the damage and repair value and that the engineers working for the NF, different company again, were going to deem the car a write off, CAT D as i later found out. Now the fun part - the engineers have made an offer for settlement and to write off of my car, which is a good 500 below what is would cost to replace it with a like-for-like car in my local area (replace cost circa 2.8k-3k) they are adamant they will not repair my car even though the repairs would cost LESS than the write off - because the repair is too close to the market value and they can make a killing on salvage apparently. so fighting this out at the moment. NOW FOR THE QUESTION: They have advised me that should i wish to keep the car after they write it off (which i want to avoid if at all possible) i can accept the settlement and pay them a salvage fee to retain my car. This i understand as technically they buy my car when they write it off and then i have to buy it back. The problem is that they have a flat 30% !!! salvage fee which on their offer would almost negate me being able to get the repairs covered. What i really need to know is if anyone else has been in this position and if there is a maximum salvage fee they can charge - bearing in mind that this is my car to start with - and if there is any way i can make them drop this percentage. Forcing them to drop the percentage might not only let me repair the car after retaining but might also swing in favour of repair instead of write off if they cannot justify such a big payout for themselves. Any help here would be appreciated fast as i'm still bouncing between the parties here to get this resolved. In case your wondering the damage constitutes a bumper rear panel and a kink in the boot floor - VERY repairable.""

Hey, I'm in 7th grade and my advanced academics class is doing a project on what our goals and daily life will be after we graduate high school. The final part of the project deals with the management of taxes and insurance and stuff like that. I'm pretty sure I've covered everything I need to, except for one aspect: life insurance. I'm not exactly sure if I need it, because I don't really know if I'm actually going to have people dependent on my paycheck. Here's my lifestyle: I'm going to live in Santa Monica, California as an occupational therapist in an apartment with a roommate. My mom's family and my dad's family will most likely keep residing all the way across the country on the east coast, with my brother in college and my younger brother in middle school. My problem is this, In July 2007 A man in a huge truck with a trailer hinge back up out from a parking space, it I saw him and the only thing I could at the time is speed up so he would not hit the middle of my car. He ended up hitting the side bumper and ripped it off. I have A 1999 Cryshler Sebring. It truely was a hard hit. I have put over 700.00 and still more problems. So my question is what do you think my chances are If I take it to the manufactor and they will rule in my favor. The Insurance Co-ordinator says if they say it was from the accident then they will pay for it. Straight from the start right after the accident my car kept dyeing out, so I had to drive it like a standard car with my feet on the gas and brake at the same time. So in the end , last I have heard there is a short somewhere so I took it to Spitfire and place that specializes in electrical problems and he told me my computer is bad. First of all the things my battery kept dyeing out, my car would not start up in the mornings,I took it to Auto zone and my battery was fat, swollen no good. Bought a new one, then I took it to a man at midas , he said I needed a valve cover gasket and he showed me my spark plugs we filled with oil, fixed that. Now Midas ran a scan and said I had either a bad map sensor or a short. Changed the map sensor the car is still barely running, so then another place said it was a short but had it for two weeks and could not find the short . I would like to know , if the guys Insurance is still on the hook for all the problems I have had with the car since the accident. Low income health insurance?

One of my friends recently came to US from a different country. She sold whatever she had and came to US with 25000$. Recently since she was sick she had to go to emergency room for three days. The problem is she did not have any kind of health insurance. Somebody in the hospital told her that she might be eligible for special kind of low income insurance. Her salary is 900$ per month and she get some help from her brother to be able to pay for rent and living costs. Here is my question: does having 25000$ in the bank account disqualify her for this low income insurance? Do they expect that she pay nearly all these 25000$ for the cost of her visit to emergency room? She was asked to provide all the documents regarding her bank accounts, rent she pays and documents showing her income. She is living in Bay area.""
