“Bend down a little, Gare.”

“Whatever you say, your highness.”

He has glitter in his hair. The girls had a project due, and Gareth, being the loving brother that he is, offered his services. You’ve been picking chunks and flecks of glitter out of his hair for three days. He claims to have washed it since, too.

He bends a little at the waist so that you can see his hair more clearly. You use your nails to grab at a piece of purple glitter from the roots of his hair.

“Kiss my ass, Emerson.”

He pinches your side at that remark and you let out a small squeal before presenting the glitter to him, a victorious look on your face. Gareth quirks a brow, examining the intruder, and then you wipe your finger off on his shirt before turning to go to your next class.

He catches your hand before you get too far. “Hey, hey, hey, where’s my kiss?”

Gareth “demands goodbye kisses” Emerson.

You pretend to be annoyed at the premise, and he pouts so hard you bring both hands to his face, apologizing repeatedly.

“Here, here!” You kiss him, short and sweet (you are in school, after all). He tastes like strawberries. You wonder if he had some for breakfast.

“Thank you,” he says. You plant another on his nose before leaving him to it.

Gareth adjusts the bag on his shoulder and turns to head into his classroom.

“That’s just sad, man.”

Gareth wouldn’t have thought anyone was talking to him if it weren’t for the closeness of the voice. He turns his head, finding Patrick staring at him. Andy and Jason linger further behind.

“I’m sorry?” Gareth’s tone changes into something much more serious, deeper even, than what he’d been using with you.

“You, dude. You’re totally head over heels for them, and they’re way out of your league.”

Patrick turns to watch you at the very end of the hallway, where you turn a corner and then you’re out of sight. He shakes his head. “It’s just depressing, man.”

Gareth feels his face warming. “What are you talking about, McKinney?”

Patrick laughs, and it doesn’t do anything but heighten Gareth’s frustration. He doesn’t understand where this is coming from.

“You and them,” Patrick says, nodding towards where you’d walked away. “You looked lovesick, and that’s just weird to me because the two of you make absolutely no sense.” Andy chuckles, and Gareth shoots him a look. He quiets.

“They’re pretty damn smart, and could be friends with anyone they want, but pick you and your group of freaks? Yeah, that just doesn’t check out, man. It’s probably best if you save yourself the trouble and dump ‘em now. That way you won’t have to deal with it when they realize the truth.”

Gareth decides he’s had enough of this shit. “Fuck you, man. Why don’t you mind your own business? Last time I checked, your last girlfriend cheated on you with Andy, so I really don’t think you have any reason to be giving me relationship advice.”

He pushes past the other boys and into the classroom, heading straight for his seat in the back against the wall.

Gareth barely hears a word of the lecture he’s supposed to be paying attention to. He’s amazed that he even manages to take notes.

Patrick’s comments race through his mind, over and over again. They pick at his every insecurity, his every vulnerability.

What if he’s right? You’re fucking insanely smart, Gareth thinks. You could be with anyone you wanted, and he knows that. Up until that conversation, Gareth thought your choosing him had meant something. That he was special. That his friends were special, and they were all worth more than whatever the people at school thought.

Now he’s not so sure.

He tries to distract himself from his buzzing mind by paying extra attention in his classes. It only partially works. All he can think about is that maybe you really are way out of his league.

Gareth gets to the Hellfire table at lunch before you do. He sits down beside Jeff, who’s too busy arguing with Mike about something to notice that something’s wrong.

You, however, clock it before you even take your seat. His arms are crossed and he’s bouncing his knee. He’s not laughing or splitting a cheese stick with Dustin. Something’s wrong with your boy.

Eddie seems to have noticed it too. He hasn’t sat yet, but he’s walking to the table just as you are, and shoots you a look over Gareth’s head. One that says, you seein’ this? You nod.

Eddie’s known Gareth long enough to know that when he gets quiet, he’s frustrated. Gareth being quiet is never a good thing. When he’s sad, he talks about it, and he might be a bit downcast, but he’s still Gareth.

Eddie has witnessed many a Gareth outburst, and they aren’t usually pretty. He knows you can handle it though. You’re exceptionally good at calming him down.

You slide into your seat, and Gareth doesn’t even look at you. You decide to take it easy.

You rub your thumb across the bare expanse of arm under his sleeve. That gets his attention. He turns to look at you. “Hey,” he says.

“Hey.” You keep rubbing his arm. “You okay?”

Gareth uncrosses his arms and sits up in his chair. “I’m fine.”

“Don’t bullshit me, Emerson,” you say, keeping your voice low as to not cause a scene. He turns his head to look at you. You only use his last name when he’s being a pain in the ass. The thing is, Gareth doesn’t really give a shit if he’s being an ass right now.

He doesn’t feel like arguing with you. He’s too upset. Gareth is quiet for the rest of lunch, and he avoids you the rest of the day. It’s not until you drive over to his house after school that you get a chance to ask him what’s wrong.

He lets you in and leads you to his room without a word. “Gareth,” you start, “will you please tell me what’s wrong? I really don’t like seeing you like this.”

He tosses his head back, exasperated. “And you think I like feeling like this?”

“I know you don’t Gare, but I can’t help you if you don’t talk to me.”

Gareth takes one look at you, giving your most pleading and sincere eyes, and he’s done for. He runs both of his hands down his face and sits on the edge of his bed.

“After you went to class this morning? Patrick showed up and told me that the two of us being together doesn’t make sense.”

“What?” You ask, quickly becoming upset.

“He said that you’re way out of my league and too good for me and that someday you’re going to realize that I’m a piece of shit and you shouldn’t have chosen me.”

You realize his eyes are glossy and you rush to crouch in front of him, hands on his forearms. They’re warm under the tips of your fingers.

“Hey, hey, hey, don’t listen to any of his shit okay?”

“Stop,” Gareth says.

“What do you mean?” You don’t understand.

“I mean that I’m in love with you and they’re telling me that this is bullshit, that you don’t care and that you’re just going to leave me at some point and so I’m upset—”

“What?” You cut him off.

“Huh?” Gareth doesn’t realize what he says for a second. “Shit.”

You stare up at him.

“I’ve never said that before,” he tells you.

“No,” you shake your head. That knocked the breath right out of you. “But before you say anything else, I am not going to just up and leave you or something, Gareth. You’re the best thing that’s ever happened to me.”

“I chose you because you’re the best boy in the world. And because I love you, too.”

The boy in question smiles at you.

“You love me too?” He asks shyly.

You bring a hand to his cheek, and he leans into the touch.

“Yeah. And it’s okay to be upset, Gare, because he was being an asshole, but I would never leave you, okay?”

“Okay,” he says, nodding. Gareth wraps his arms around you and practically scoops you up.

“Sweetheart,” you say after a moment, pulling away from him. He looks at you, confused.

“You’ve still got glitter in your hair.”

He drops his head to your shoulder. “Dammit.”

Clyde's and Ralph Fult's life after prison and the formation of The Barrow Gang:

Ralph Fults had been released from the Eastham prison farm before Clyde on August 26, 1931. He’d gone home to McKinney to wait for Clyde’s release. The duo planned the dramatic Eastham prison break they’d talked about while swinging axes on the farm woodpile. He knew Cumie Barrow was working hard to secure a parole for Clyde, and with the prison overcrowding, it would be just a matter of time before he, too, was set free. Ralph was more pragmatic than Clyde about post-prison employment. He didn’t look for a job while waiting for his friend to get out. Instead, Ralph supported himself by gambling. It was a lot more fun than slaving away in some sweatshop. Although he himself managed to avoid being arrested, he couldn’t resist aiding in a January breakout from the McKinney jail in 1932. An 18 year old Raymond Hamilton was awaiting arraignment there on several charges of auto theft. Raymond, from West Dallas, told him he was an old friend of Clyde’s. Ralph smuggled hacksaw blades he concealed in the spines of several magazines. Raymond used the blades to cut his way out of his cell on January 27, 1932. He ended up back in West Dallas, grateful to Ralph and hoping to hear from him again.

In early February of 1932, Clyde was released from prison. He started out helping his father with small chores. His real challenge though was learning to walk without crutches after cutting 2 of his toes off with an axe weeks ago in prison. Clyde wanted to build an auto shop adjacent to the family filling station but lacked funds. He was hired, then fired, at several jobs. The Dallas police were well aware he was back, and they didn’t want him around. The old pattern of being regularly picked up for questioning resumed. Clyde swore he intended to go straight. The cops didn’t believe him. Employers didn’t have any patience for an ex-con who was regularly yanked away from work by the law. He never lasted more than a few days in any job. Clyde's sister, Nell, met a man who ran a construction crew in Framingham, Massachusetts. He said he’d hire her brother if he moved there. Clyde was reluctant to go. Bonnie hadn’t remained faithful when he was away in prison but he needed steady income to get start-up money for his auto repair business. Emma Parker claimed she told Clyde it would be fine with her if, once he’d gotten himself established in Framingham, Bonnie would move there, too. If she did tell him that, she didn’t mean it. Bonnie's sister, Billie, swore that her mother was unstinting in her appeals for Bonnie to drop Clyde the minute he left town.

Clyde went to Framingham and hated it. At first, he meant to stick it out until he’d raised enough money to come home and open his shop. Clyde went by the alias Jack Stuwart because he was afraid Dallas police would warn their Massachusetts counterparts. About 2 weeks after he’d left, he was back home. He told an angry Nell that he nearly died from loneliness in Massachusetts. More out of habit than hope, Clyde resumed job hunting in Dallas and Bonnie was thrilled to have him back. Further temptation for Clyde to give up on going straight arrived in the person of his Eastham pal Ralph Fults. Ralph eventually saw a small article in the newspaper listing Clyde Barrow as one of several prisoners recently paroled by the governor. Around the middle of March, he hopped a train to Dallas. This trip came soon after Clyde had returned to Texas from Massachusetts.

After arriving at the main Dallas station, Ralph stole a car and drove out to the Barrow service station. When he introduced himself to Clyde's father, Henry, he was told that Clyde was at work and would be home soon. That surprised Ralph, who hadn’t thought Clyde would attempt to make an honest living. It was a cold day. Henry and Cumie invited their visitor to wait inside, where L.C., Marie, and Buck’s wife, Blanche, were huddled around a wood-burning stove. When Clyde got home, he announced that he’d just been fired again. Enough was enough: Clyde informed his parents and Ralph that he was never going to work again. Previously, car theft and small-business safe crackings had been intended to supplement his honestly earned income. Now he’d devote his full attention to lawbreaking. Their long-discussed prison break at Eastham farm was now in the works. Bonnie told her mother that she’d been offered a wonderful job selling cosmetics in Houston and that sometime, very soon, she’d be moving there. Emma was delighted, less for the employment opportunity than for the fact that her daughter would get away from the malign influence of Clyde Barrow. But Bonnie was lying. Clyde and Ralph had formed a gang with Raymond Hamilton, and at Clyde’s invitation Bonnie planned to leave home and travel with them—thus the creation of The Barrow Gang.

Paxton admitted to violating state securities laws during his Republican primary race and paid a $1,000 fine for failing to register as an investment solicitor.

He described it as an administrative oversight but denied criminal wrongdoing.

In an email to supporters Tuesday, Paxton said he expects to be “fully vindicated.”

“I am looking forward to the opportunity to tell my story - which the grand jury did not hear - in a court of law. Thank you for standing with me and now walking forward with me as we continue the work we came to do,” Paxton wrote.

Paxton had been accused of defrauding investors in a Dallas-area tech company called Servergy by not disclosing that he was being paid by the company to recruit them.

A small technology firm in McKinney with 22 employees, Servergy came into public view last week when a Collin County grand jury announced the indictment of Texas Attorney General Ken Paxton related to a deal he had made to sell the company’s stock.

Over the past six years, Servergy has raised $26 million from investors to develop what it promoted as a cutting-edge computer server.

Behind the scenes, the company is under investigation by the SEC on suspicion of misleading investors through lofty claims about both its technology and deals with the likes of Amazon and Austin company Freescale Semiconductor that never materialized.

The person who recruited Paxton to work with Servergy, ex-company CEO William Mapp, was found liable by a jury for misleading investors and ordered to pay a civil penalty of $22,500. Mapp lost his job with Servergy and later had to work as an Uber driver to make ends meet, according to court documents.

Paxton didn’t tell them that in exchange for soliciting his business and political contacts, Servergy had given him 100,000 shares.

In the stock offering in 2013, Servergy would sell its shares for $2 each.

Paxton, who was elected attorney general in 2014 on a swell of tea party support, was known to invest in emerging companies.

Around the same time, the SEC was tipped off that Mapp was making misleading statements, not only about clients but about the very technology that was the foundation of the company.

In a 2013 investor presentation, Mapp had drawn up a chart touting the CTS-1000 server as superior to four competing products in terms of how much power it used, according to SEC documents.

But that was a misrepresentation, the SEC said.

Over a series of interviews with investigators, both Mapp and Smith testified the server had been tested by a third party.

But Mapp would later back off, telling investigators “he now realizes his lack of technical expertise resulted in the chart containing errors,” according to SEC documents.

SECURITIES FRAUD CASE

Paxton strikes a deal AG’s agreement to end charges includes no admission of guilt

HOUSTON — Texas Attorney General Ken Paxton and prosecutors agreed to dismiss almost 9-year-old criminal charges Tuesday if the Republican state official completes community supervision and pays about $270,000 in restitution.

Terms of the 18-month intervention agreement, announced Tuesday in a pretrial hearing that had been delayed from last week, also include 100 hours of community service and 15 hours of legal education classes focused on ethics.

Paxton was to face trial on April 15 on three felony counts, including two charges of securities fraud.

If Paxton, who was in the courtroom Tuesday, completes the terms of the arrangement, the charges will not appear on his record.

In a statement after the hearing, Paxton said he did not admit guilt under the agreement, which was proposed by prosecutors.

“For over a decade, my family and I have been dealing with the ongoing stress of these accusations and are relieved to finally have a resolution in this matter,” Paxton said.

“The prosecution came to us to begin negotiations, and we were able to come to an agreement on terms. There will never be a conviction in this case, nor am I guilty,” he said.

Restitution, service

Brian Wice, who was appointed as a special prosecutor in the case, had said earlier this year that an agreement without an admission of guilt would not be appropriate in this case.

But on Tuesday, Wice said Paxton’s decision to pay restitution offered a rare opportunity to undo any wrongdoing to the victims.

“In a typical criminal case, victims are seldom, if ever, made whole,” Wice said. “In this case, you were able to do exactly that.”

Paxton will have 18 months to pay the $270,000 to former state Rep. Byron Cook and the estate of Florida businessman Joel Hochberg, who died last year.

Wice said that, if Paxton repays money lost in the investment deal early, he would entertain cutting short his supervision of Paxton.

The agreement requires the attorney general to check in with prosecutors every 60 days.

Wice added that Paxton’s community service agreement has him volunteering at a soup kitchen or food pantry in Collin County.

Wice also read a statement from a representative of Hochberg’s estate in which the family indicated they were “grateful” for the restitution and the legal work done in the case.

Paxton will not be able to use campaign funds to pay restitution, Wice said.

Failure to pay would result in a resumption of court proceedings against Paxton in Harris County.

After nearly nine years since a grand jury indicted Paxton in Collin County, the case came to a close in a subdued five-minute hearing.

Paxton appeared relaxed in the courtroom, dressed in a gray checked suit and flanked by a sizable defense team, which was led by Dan Cogdell and included Mitch Little, who represented Paxton during his impeachment trial last year and is running for the Texas House.

Paxton spoke little during the hearing.

He first agreed to be sworn to the agreement, known as a pretrial intervention, before acknowledging to the court that he agreed to the deal.

Before District Judge Andrea Beall accepted the agreement, she noted that she had denied attempts from Paxton’s defense team to dismiss the case and that she was prepared to move forward with a jury trial next month.

But she said she had no say in any agreement struck between prosecutors and defense attorneys.

“No judge can force a prosecutor to put on evidence,” she said.

Beall also notified Paxton’s defense team that if he failed to meet any of the terms of the diversion deal court proceedings would promptly resume.

“Both sides understand that I would set a very speedy trial,” she added.

Tuesday’s events ended a threat to Paxton’s political career as well as his freedom.

It also presented another legal victory to an attorney general who, six months ago, was acquitted in the state Senate on numerous articles of impeachment.

Other suits, probe

But a whistleblower lawsuit from four former top officials remains unresolved.

They claim they were improperly fired from the attorney general’s office after accusing Paxton of bribery and other misconduct.

A lawsuit by the State Bar of Texas also accuses Paxton of violating his duties as a lawyer by misrepresenting a legal matter to the U.S. Supreme Court.

Paxton had asked the high court to overturn Democratic victories in four swing states in the 2020 presidential election, saying Texas had proof voter fraud changed the outcome.

Paxton is also under investigation by the U.S. Justice Department over the accusations made by former officials of his agency.

Cogdell, Paxton’s defense attorney in the securities fraud case, said he had not heard anything further about a federal investigation.

“I don’t talk to the FBI,” Cogdell said. “The FBI doesn’t talk to me. I don’t know what’s going on with their investigation. I know, in this case, we’re glad to have this resolved.”

Paxton was accused of soliciting investors into Servergy Inc. in 2011 without disclosing that the McKinney tech company was paying him a commission.

After Paxton lined up $840,000 from investors, about one-third of all investments into Servergy that year, the company compensated him with 100,000 shares worth $1 a share, according to court records.

Four of the investors belonged to a private investment club that included Paxton.

Club members agreed that they would watch out for each other and that nobody would exploit the group for personal gain, court records said.

Club members also told investigators that they would not have invested in Servergy had they known the company was paying Paxton.

The 2015 indictments against Paxton named two club members as victims of securities fraud — Cook, who has since retired from the House, and Hochberg.

Each invested $150,000 in Servergy.

The Securities and Exchange Commission sued Paxton, alleging securities fraud over his dealings with Servergy, but a federal judge dismissed the lawsuit in 2017, ruling that federal law did not require Paxton to disclose his payment from the tech company.

Paxton, a 61-year-old Republican, is one of the country’s most well-known state attorneys general after leading multiple legal attacks on policies implemented by Democratic presidents.

He was elected in 2014 and is serving his third four-year term.

The criminal case has dogged Paxton nearly his entire tenure as the state’s top legal officer.

Seven months into his first term, Paxton was booked into the Collin County Jail, photographed and released after grand jury indictments accused him of two counts of securities fraud, a first-degree felony, and one count of failing to register with state securities regulators, a third-degree felony.

Paxton could have faced up to 99 years in prison for the most serious charges, as well as fines.

The case has faced myriad delays as a team of appointed special prosecutors fought Collin County officials over compensation and sparred with Paxton’s legal team over where the attorney general should face trial.

Paxton’s lawyers also sought, unsuccessfully, to have the charges dismissed by three different courts.

The case has also bounced between a handful of judges in Collin County and Harris County before it landed last year in the 185th District Court in Houston, where Beall presides.

At the most recent hearing in February, one of the prosecuting attorneys withdrew from the case because of a lack of pay and a disagreement with Wice over legal strategy.

Paxton Deal Is A Loss For All Texans

Attorney general gets a pass from a court system that’s far less forgiving of others

Attorney General Ken Paxton has scored another victory, but it’s a defeat for all Texans.

With every triumph, Paxton seems more determined to exact his revenge, more emboldened to attack the people and issues he finds personally threatening or repugnant.

He does so not in the name of justice, but for payback and, worse, plaudits from the far right he courts.

We brace for what will come next.

But perhaps even more disturbing is what Paxton’s latest win says about our justice system: There’s clearly one for the everyday Texan, and another for the rich and powerful.

We’re referring to what happened Tuesday morning in a Houston courtroom.

Paxton walked out essentially a vindicated man nearly nine years after being indicted on three felonies in connection with an alleged securities fraud scheme.

Paxton struck an agreement with prosecutors to drop the cases against him in exchange for paying restitution to two men he was accused of defrauding, performing 100 hours of community service and taking classes on legal ethics.

He’s been given 18 months to do so.

But far from being the fair resolution that both sides are saying it is, the deal raises more questions than it answers.

Most glaringly, how is it that someone can be indicted by a grand jury on such serious felony charges, escape going to trial for the better part of a decade, then have those charges just go away with what amounts to a slap on the wrist?

And what of the timing? Why now and not last year or five years ago?

Special prosecutor Brian Wice said after a hearing just last month that he was not willing to strike a pre-trial agreement with Paxton that had been proposed by another special prosecutor, Kent Schaffer.

“That was, ‘Gee, let’s get you a cocktail, a hot meal and a breath mint.’ And that wasn’t going to happen on my watch,” Wice said, according to the Texas Tribune.

He also said after that hearing, in which Harris County state District Judge Andrea Beall denied Paxton’s motion to dismiss the charges, that the attorney general wasn’t above the law and that he should go to trial.

But on Tuesday he told us he changed his tune after interviewing and reinterviewing witnesses in advance of the April 15 trial date.

Though Wice felt confident a jury would convict on the two first-degree felonies against Paxton, he said he “was unwilling to roll the dice with the distinct possibility that the jury would either hang or acquit with the result being the victims would be denied full and total restitution.”

Wice also defended the deal as being much stronger than the one considered in February.

Whatever the reasons, here’s the upshot: Paxton again gets to sidestep a reckoning after a series of lucky breaks that typically don’t happen to ordinary Texans in courtrooms across the state.

And rather than act with humility in the wake of this victory, we expect Paxton to act only more empowered.

Can they feel their voting rights are safer knowing he fraudulently misrepresented 2020 election results in other states?

Shouldn’t his community service focus on providing direct assistance at a woman’s health center or shelter, or an immigration processing center to expedite acceptance of asylum-seekers? Shouldn’t this community service emphasize he is compensating the residents of this state since impeachment and insistence on resignation weren’t effective?
