The escapade has raised profound concerns about child safety, airport security and parental challenges. An in-depth look at how "Michael", now at the age of 18, managed to execute his audacious escape, what came next, and how his adventure was received globally. HR Advice Perth: Key Legal Case Underlines Employer Compliance Responsibilities
The Fair Work Ombudsman (FWO) has recently initiated legal action against a Gold Coast-based transport company, AWT Transport Pty Ltd, as well as its accountant, Robert Reynolds. This legal step follows an FWO investigation that began after a casual driver employed by AWT Transport between February 2019 and August 2021 requested assistance over potential underpayment issues.
The investigation concluded that AWT Transport may have underpaid the driver’s kilometre-based rate as per the guidelines of the Road Transport (Long Distance Operations) Awards of 2010 and 2020. In November 2022, the FWO issued a Compliance Notice instructing AWT Transport to recalculate the driver’s pay and provide the required back payment. The FWO alleges that AWT Transport failed to address this directive, with no valid justification.
The case also involves Mr. Reynolds, an external advisor authorised by AWT Transport to address the Compliance Notice. However, it is alleged that he did not fulfil these obligations, marking the first instance where the FWO has taken legal action against a third-party advisor due to compliance failure. The FWO claims AWT Transport was obligated to pay $11,917 to fulfil the Compliance Notice, with potential penalties of up to $33,300 for AWT Transport and $6,660 for Mr. Reynolds. Additionally, the FWO seeks a court order mandating that the outstanding amount, along with applicable interest and superannuation, be paid to the driver.
Anna Booth, Fair Work Ombudsman, reiterated the importance of compliance with workplace laws, stating that the FWO will act decisively when employers fail to meet their legal obligations. "We act to uphold employee rights, and this case serves as a reminder that non-compliance can also affect third-party advisors," said Ms. Booth.
The case was brought before the Federal Circuit and Family Court in Brisbane, with a directions hearing scheduled for 4 November 2024. The FWO encourages employees with concerns about their pay or entitlements to reach out for assistance.
