Refresh Your Memory: Driving Rules
Flashing yellow light = slow down and be careful
Flashing red light/no traffic light = treat as stop sign
After sirens and pulling over to the right, signal and change back into driving lane
Parking uphill/downhill:

Smarter Cars = Smarter Drivers?

There are tons of updated technologies coming out every day that are designed to help drivers drive better, safer, and smarter. The real question is, are these latest technologies helping drivers to improve or are they creating inattentive drivers that depend more on their car tech to drive than on their own skill? The first thing to consider with this argument is just what technology is available then think about how it affects drivers. Here are three technologies that are becoming more popular and even standard in newer cars.
Blind Spot Monitoring and Cameras and Alarm Warnings This is one technology that is helping drivers across the board. Everyone knows that they are supposed to check their blind spot before entering another lane, before turning, and just about every time you do anything on the road. Most drivers will assure anyone that asks that they check their blind spot every time they do anything while driving, though this may be true some of the time, there are times when drivers do not check their blind spot and a wreck occurs. Blind spot monitoring does not necessarily make drivers less attentive, it helps them to make sure that they do not make silly mistakes that could have been avoided by checking the blind spot of their car.
Lane Departure Warnings/Cameras These are a bit harder to get behind. Though they do help you to watch out for drifting into one lane or another while you are driving, some people end up using it as a guide when they are not watching the road. Though it may be helpful for some that are watching the road, people that text and drive can use this technology to effectively watch their phones instead of the road. Now not all drivers that have this added to their car are going to use it as eyes on the road while they update Facebook, but the fact that the option even exists is frightening. If drivers use it for its intended purpose, it can encourage attentiveness and those who want to know can you test drive for fun, but if they are using it to do things like text or play with their phone, it becomes a major hazard.
Park Assist/Automatic Parking This is one technology that everyone can use at some time or another and it is something that many people have a tough time parking without. This is a technology that is less dangerous than some that are in many cars but it still makes you wonder. Park assist is handy if you are not really all that great at parallel parking and you parking in tight spaces. Those that have park assist can park faster with the help of the vehicle taking them out of the equation completely. Most car companies assure drivers that it is not dangerous to let the car park itself but for some old-fashioned drivers it may be a bit scary. The biggest issue with park assist is that drivers are not going to be able to park without it if it goes out one day.
The real issue is not the technology itself but rather how people are using it. If you use your lane departure to keep you safe when you are driving home after a long night, it is not that big of a deal. If you use it however to keep you in your own lane when you are not even looking at the road that is another issue entirely. If you use your park assist to get you into a space that you don't think you can navigate that is wonderful, if you use it park your car every time you get to your destination and stop parking by yourself all together you may have issues. If you use your blind spot camera to check your blind spot and stop looking all together you may have problems in the future. Overall technology does not itself make bad drivers it just gives drivers the opportunity to slip into harmful habits and become bad drivers if they are not diligent and do not continue to practice safe driving habits without the help of the technology.
Driving School is a fantastic way to ensure that you practice safe driving habits. You may also be able to attend a defensive driving school or traffic school as a way to have citations dismissed or avoid points being taken from your license.

Angie’s List Defeats Lawsuit Over Alleged “Pay-to-Play” Rankings–Strauss v. Angie’s List
Strauss spent over $200,000 on Angie’s List advertising over about a decade. After he stopped advertising, he claimed Angie’s List treated him poorly, including deindexing him from its search, then degrading his positioning in search results, and other malfeasance. All of this behavior allegedly contravenes Angie’s List’s marketing about the editorial purity of its directory and search results. He further alleges that Angie’s List falsely discloses to “consumers who search Defendant’s website that: (1) Plaintiff Strauss has “no rating or [consumer] reviews”; (2) has not met certain “criteria” to be listed on Defendant’s website; and (3) has no ‘local offers’ to extend to consumers.”
Lanham Act False Advertising. With respect to the website disclosures about Strauss’ business, the court says that Lexmark opened up Lanham Act standing to non-competitors. However, Lexmark didn’t change the requirement that the claims at issue constitute “commercial advertising or promotion” (as defined in the seminal Gordon & Breach ruling, incorporated into the 10th Circuit’s Proctor & Gamble v. Haugen case). Angie’s List’s disclosures didn’t meet that standard because they “cannot be construed as having been made for purposes of influencing consumers to buy Defendant’s goods or services.” The fact that the disclosures might have redirected consumers to Strauss’ competitors doesn’t change that outcome. The court rejected the plaintiff’s analogy to a 9th Circuit case, TrafficSchool v. eDriver, because (1) “there is no contention that Defendant offers tree care services of the kind offered by Plaintiff Strauss or that Plaintiff Strauss offers goods or services similar in kind to those offered by Defendant,” and (2) Lexmark may have superseded that case.
Statute of Limitations. The court defines the Lanham Act laches standard to parallel Kansas’ 2 year statute of limitation for fraud. Most other claims were based on activity from 2013 or before, well outside this time period.
This case reminded me of Demetriades v. Yelp, which involved false advertising claims over Yelp’s description of its review filter, and Levitt v. Yelp, which alleged that Yelp punitively cooked the ratings and reviews for non-advertisers. We still have no resolution to the Demetriades case; I checked the docket this morning, and 6+ years after filing, the court will hear summary judgment motions next month. In this case, the statute of limitations wiped out the most analogous (and most interesting) allegations, so we don’t really get answers to the perennially interesting question about when review sites can be liable for allegedly enforcing pay-to-play rules. Instead, the case devolved to look more like the YouTube remove-and-replace cases, where the video uploaders claimed that YouTube misled viewers about why the videos were removed. The YouTube remove-and-relocate cases mostly failed for other reasons, but they all failed like this one did.
