Smile Direct Club customers 'gutted' and 'left in lurch'

Customers of Smile Direct Club have told the BBC how they feel “left in the lurch”, “outraged” and “gutted” after the remote dentistry firm shut down.

Chantelle Jones, 32, paid a total of £1,800 to straighten her teeth before her wedding next year. While her top teeth had aligned, she was waiting for new moulds for her bottom teeth.

“I’m not sure if I’m going to get any money back,” she said.

Dentists have also expressed “great concern” for stranded patients.

Late on Friday, it emerged that a last-minute rescue attempt for Smile Direct Club had failed as the company was weighed down by debt.

“I found out in a TikTok video that they’d gone bankrupt. I think it’s an absolute disgrace how they have treated customers,” says Chantelle from Churchdown in Gloucestershire.

“The worst thing about it is… the app has not closed down but when I click on the chat button it’s not there. They seem completely uncontactable and I’m just left in the lurch.”

Oliver, a photographer from Kent, spent £799 with Smile Direct Club just under two weeks ago in the hope of straightening his smile.

“I’m gutted. It’s a fair chunk of money and I feel a bit numb about it really,” he says.

Founded in 2014, the orthodontics company styled itself as a disruptor to the “bricks-and-mortar” dental industry.

In traditional dentistry, “train-track” braces and clear aligners are fitted by dentists and orthodontists themselves, or a trained orthodontic therapist, after an in-person consultation.

Many customers were drawn to US-based Smile Direct Club because of lower prices, and the fact that they typically take the moulds for their aligners themselves at home.

The Nashville-based firm debuted on the Nasdaq stock exchange in 2019 and it was once valued at about $8.9bn (£7bn).

But it failed to turn a profit and in late September the firm filed for Chapter 11 bankruptcy protection in the US. At the time it had nearly $900m worth of debt, according to Fortune magazine.

And late on Friday the firm said it had made the “incredibly difficult decision to wind down its global operations”.

It said that any orders that have not yet been made or shipped have been cancelled, and apologised for any inconvenience caused. It recommended that if customers in the US, UK and elsewhere want to carry on with their treatment, they should get in touch with a local dentist.

There would be more information on refunds, it said, as the bankruptcy process determines next steps.

It has angered some customers, however, by saying that the “lifetime smile guarantee” it previously offered was no longer valid, while those with payment plans set up are expected to continue making payments.

Teah from the West Midlands told the BBC that she had paid a £135 deposit for her aligners about two weeks ago.

The treatment, which typically takes about four to six months, cost £1,739, which Teah was planning to pay back using the Smile Direct Club payment plan.

She says she feels “outraged and anxious” about the fact she is still being asked to make payments.

“It is not right that I [am expected to] pay such a large sum of money even though I didn’t receive any treatment or merchandise from them.”

The BBC has contacted Smile Direct Club for comment on Chantelle, Oliver and Teah’s experiences.

What should Smile Direct Club customers do?

Lisa Webb, consumer law expert at the organisation Which?, said that many customers would feel “adrift” due to the company going bust.

She pointed out that where refunds would be available, they will be handed by liquidators. “But customers will be at the back of a long queue of creditors so this is unlikely to amount to much, if anything at all,” she said.

She recommended that anyone in the UK who is still waiting for products, and has not had their order cancelled and paid via credit card, could also try to claim their money back via Section 75 under the Consumer Credit Act.

Dental bodies have also spoken out after the firm’s collapse.

The British Dental Association (BDA) said that it had raised concerns about the company offering plastic aligners remotely and the potential risk of misdiagnosis with regulators.

“Dentists are left to pick up the pieces when these providers offer wholly inappropriate treatment,” said BDA chair Eddie Crouch.

“It shouldn’t take a bankruptcy to protect patients from harm. It requires decent laws and effective regulation.”

And Anjli Patel of the British Orthodontic Society suggested that the firm was avoiding responsibility for customers’ treatment in a way that was “nothing short of scandalous”.

It is calling on watchdogs in the UK to ensure any firm providing orthodontics directly to patients in the UK are held to high standards.

Smile Direct Club vigorously defended its practices throughout and said consistently that customers’ treatments were reviewed by licensed professionals, while risks were listed as well.

In the statement on its website, the company said that it had “improved more than two million smiles and lives”.

But that is no consolation to those who now find themselves out of pocket with incomplete treatment.

Both Chantelle and Oliver regret being attracted by Smile Direct Club’s cheaper prices.

“I should have gone to my own dentist. Although it was more than double the amount of money – I was quoted £4,500 – I would have rather paid that looking back in hindsight,” says Chantelle.

Neither are hopeful of getting their retainers or their money back.

“I went cheap, and the whole phrase ‘buy cheap buy twice’ comes to mind,” says Oliver, adding that he was asking his bank for help and wanted to “fight his corner”.

This is going to be a post of praise for someone but also a little lesson for people not in the photography industry.

So many times people see my advertisements and think that the photo sessions should be free. I don't know what they're smoking or have been into but it must be interesting.

On Days of a shoot, it's usually 3 hours of prep time getting gear settled and ready. Getting cards cleared and backed up, batteries charged, cleaning up the studio from the shoot before, etc. Also on any given day, I could be using up to $100,000 worth of equipment for the shoot. As much as I love to think of a photo fairy waving their wand at me and giving me free gear that also costs photographers a lot.

I always wonder how people can't understand this but it never surprises me. What does surprise me is when I meet clients and friends like that of Miss Kimberly... Several weeks ago.

Kimberly Spaulding signed up for her 15-minute call where we discuss what she's looking for, details, and other options. She started to tell me her vast story of having every important job under the sun. Literally, there is no talent this one doesn't have nor experience to Go with it. Her resume is so extensive that many times future employers didn't believe it could even be real. That's how astonishing this woman is.

Before we were even finished with the phone call I sent her the invoice to pay, which is required because I need to block the day, hire the most fantastic makeup artist in Nashville, and prepare for their shoot. No different than putting money down on a wedding, or a restaurant reservation, if you don't show we lost revenue. Let me tell you about this chick! Not only did she understand the assignment but she paid her invoice before we even were off the phone. Little did I know she would be showing up to HER photo shoot with a bunch of extra clothing she just happened to have brand new with tags on it, to pay forward to the next woman's photo shoot. She wanted to add it to "Goldy's Closet" to make sure that I had every size card for future friends and clients.

This woman has an absolute heart of gold. We had one of the most spectacular photo shoots to date. One of her requests was a leather jacket in a specific size. I posted on Facebook in our community and lo and behold this wonderful neighbor said, I've got two for you to choose from. I was blown away by the kindness she gave to strangers she'd never met.

Kimberly rocked not only those leather jackets but one studded punk rock jacket from a famous band in the UK. I've been saving it for a special occasion and clearly, we found one!

Her theme for the photo shoot was "contrast". And that every shot was. She was combining nightgowns and negligees with leather jackets and top hats adorned with big red flowers. She literally put together so many outfits that look like they were straight from the pages of Vogue. I was so proud to see someone with golden long blonde hair other than myself taking risks and pushing herself out of her comfort zone.

I will let the photos speak for themselves so that you can see how clearly beautiful this woman is on the outside. But I wish you could have spent the day with us and learned about her inner beauty because it shines brighter than any light I've ever seen.

Synopsis: What do you do when the man who holds your career comes to you with an ultimatum, that not only affects you but the lives around you? That is what is happening for Sparrow Lake, she thought she would start 2020 with just her close friends and family, but when Tony Stark shows up at her family's Smokey Mountain home, with fellow country star Bucky Barnes and their manager, that was not going to happen.

Stark Record’s owner Tony Stark held a press conference Thursday morning in Nashville, to announce the engagement of two of his top-selling artist Bucky Barnes and Sparrow Lake. The couple first sparked rumors when they performed their new singles Center Point Road and I Will Fall, which both happen to be duets with each other, at Stark Records Take Over Grand Ole Opery. Fans of both Bucky and Sparrow took to Twitter with their speculations but were shot down by Sparrow Lake’s guitarist, Clint Barton, who tweeted; “What happened to the days when artists could collaborate and it didn’t mean they were in relationship?” It was quickly retweeted by Sparrow’s siblings Bey Lake and Peter Parker, as well as Bucky Barnes best friend Steve Rogers. 

Tony broke the news saying, “It is my pleasure to announce the engagement of two of my record labels artist Bucky Barnes and Sparrow Lake. The couple have worked hard to keep the relationship as private as possible for the past thirteen months, but know they are ready to share it with you all. As the fans have been speculating for a while they were together, both Sparrow and Barnes are open with fans, they felt it was the right thing to do. They are working on setting a date for their wedding and are happy to have their relationship out in the open. Stark Records, couldn't be more happy for Barnes and Sparrow, they make a great couple. I look forward to seeing what the future brings them. Thank you.” 

In Tony Stark fashion he didn't stick around to take questions from the press, but just hours later Sparrow posted to her Instagram, where she showed off her ring with the caption, “My soul said yes.” Just minutes later, Bucky Barnes posted a photo of Sparrow Lake makeup-free, with the caption, “So glad you said yes, so we can take over the world together.” If that doesn't melt your heart, I don't know what will!

Wednesday, January 8th, 10 AM - Great Smoky Mountains, Eastern Tennessee 

The house was alive giggles from Birdie as she ran after Jojo, who held her scrunchie in her jaw. Clint laughed at his daughter's antics reminding her to be careful between puffs of breaths. Bey sat on the couch, guitar in lap, phone beside them as they recorded a demo for a pop star. Sparrow sat with her mother, Maggie, sipping on a new tea she had gotten while in Canada with her father Bruce. This was how Sparrow imagined her break, before she hit the studio, with her family, her friends just relaxing. 

“Mr. Lake, Hayes is reporting that Mr. Stark is coming up the driveway, I wasn't aware we were expecting him today.” Kaius, frowned as he walked in listening to his Bluetooth earplugs. The security guard was known for not liking Tony Stark’s chaotic fits, as he liked to call them. Bruce looked up from his book, pulling his glasses off confused before shaking his head. 

“We weren't aware he was coming to visit.” pulling himself up from the chair, Bey followed suit laying their guitar on the couch. “Why don't you go ask Mags to put the coffee on and I’ll go see what Mr. Stark is here for.” patting Kaius on the shoulder, he made his way out the front door pulling his bomber jacket closer to his body as she black SUV came to a stop.

Bruce watched on as Happy Hogan opened the door for Tony Stark, followed by Sam Wilson, his daughter's manager, last but not least Bucky Barnes got out. Bucky looked annoyed as Sam spoke to him, but shook his head before he smiled when he saw that Bruce was watching them. Sam waved to Bruce as he took a bundle of bouquets from Happy, Bruce provided a head-nod of acknowledgment. 

“Good morning Bruce, would it hurt to get cellphone reception up here?” Tony climbed up the steps while gazing up at the maestro of recording music. “Also I hear a congratulation is in order, 4 grammy nominations, that makes what 60 in total your career so far?” Bruce shook Tony’s hand when they met at the top of the stairs. 

“Don’t go congratulating me just yet Mr. Stark, I haven't won yet. As for cellphone reception, my Verizon network works just fine, I was able to call my sister and heard her crystal clear.” Bruce peered down the shorter man, as they waited for the other two gentlemen to reach the porch. Tony scoffed as he pulled his cellphone out to see his name network only had two bars. 

“Is there a chance that Miss. Sparrow has risen yet from slumber?” stuffing his cell back in the pocket of his jeans, as both Bucky and Sam came up behind him. 

“She rose with the sun today. Mr. Stark, we weren't expecting you today, any of you. Not that I'm not happy to see you Sam or Bucky, but this Sparrow’s vacation as well as mine, so if you don't mind me asking, what is it your here for?” Bruce leaned against the banister his arms crossed over his chest, keeping the heat in. Before any of the visitors could speak, Sparrow had opened the front door, her mother's Mexican serape around her shoulders. 

“Sam, Mr. Stark, what a surprise, I just checked with Sarah, she said you didn’t call or e-mail to say you were coming by. Bucky it’s so good to see you.” stepping out onto the porch, Sparrow laid a kiss to Bucky’s cheek, before doing the same to Sam, her eyes staying on Tony the whole time. Clint and Kaius stood vigilant in the doorway. 

“I thought you’d give your team a break, we also needed to talk in person, at best interest.” Tony kissed Sparrow on the cheek as he took his sunglasses off and looked at her with a fond smile. Sparrow pulled away, taking one of the bouquets off Sam’s hands. The anemone’s stood out against berries, lilies, cotton, and roses. 

“Let's go inside then, it's warm and my mother put a fresh pot of coffee on and she’s about to take a tray of snickerdoodles out of the oven.” Kaius and Clint broke away from the doorway allowing the group to pass by, Bey was holding Birdie upside down by her legs, making the little girl giggle. Maggie stood in the entrance of the living room hands on her hip, an apron around her waist looking at the men. 

“You best remove your shoes before you mess up my house, I had these floors cleaned before Christmas so my angels could eat off them,” Maggie ordered the group, referring to Birdie, Clint’s daughter, and Jojo the family's dog, when she meant angels. Bucky made no protest and was quick to take off his worn cowboy boots, while Sam handed over the matching bouquet to her before he slipping his Timberlands off. Tony sighed before he took a seat at the bench in the entrance, pulling off his Adidas. Maggie kissed Sam’s cheek before she took both hers and Sparrow’s bouquets into the kitchen to put them in water.

Bruce leads the group into the dining room, sitting at his usual head of the table. Sparrow sat beside her father to the left, the windows casting a rainbow effect to her. Tony sat down with Bucky between him and Sam, facing Sparrow as Clint came in and sat down beside her. Sam opened his jacket to pull out a file and setting it on the table, immediately Sparrow's stomach dropped. 

“Sparrow, I assume you've seen the charts since you and Barnes put your singles out at the end of November.
