Jul 25, 2022 09:53 IST New Delhi , July 25 (Always First): Bihar Chief Minister Nitish Kumar will not attend the swearing-in ceremony of President-elect Droupadi Murmu today in the national capital. This is not the first time Nitish Kumar will be skipping such an important event. Earlier also he has missed several events organised by the BJP by giving excuses, showing that there is a rift between Bihar CM and the BJP. The Chief Minister has skipped several functions where the invite came from the party's top brass. On July 17, he even missed a meeting of Chief Ministers called by Union Home Minister Amit Shah. On Friday, he again skipped dinner for outgoing President Ram Nath Kovind, hosted by Prime Minister Narendra Modi. President-elect Droupadi Murmu will take oath today as the Rashtrapati of India. Chief Justice of India NV Ramana will administer the oath to her at 10:15 am in the central hall of Parliament. This will be followed by a 21-gun salute. The ceremony will begin with the arrival of the outgoing President Ram Nath Kovind's arrival in Parliament. Murmu will deliver her first address shortly after taking an oath of the office of the President of India. Earlier in teh day, president-elect Murmu paid homage to the 'Father of the Nation' Mahatma Gandhi at Rajghat in the national capital. Later, she called on outgoing President Ram Nath Kovind and his wife Savita Kovind at Rashtrapati Bhavan. Murmu will be escorted by Prime Minister Narendra Modi, Vice-President and Chairman of the Rajya Sabha M Venkaiah Naidu, Lok Sabha Speaker Om Birla to the Central Hall. Once Droupadi Murmu reaches there, the National Anthem will be played in the Central Hall. Then, Droupadi Murmu will take the oath of office in the presence of the Chief Justice of India NV Ramana. On July 22, the former Jharkhand Governor Murmu registered a historic win over her rival Yashwant Sinha in the Presidential election, becoming the first woman tribal candidate and the second woman in the country to occupy the highest office in the country. The NDA's presidential candidate Droupadi Murmu was officially declared as the 15th President of the country after the conclusion of the counting of votes on Thursday. Initially, it took a nudge. Ramayan was airing on Doordarshan (DD). In Mumbai, the seniors in the Singh family had a plan. “We had grown up with Ramayan. We had emotions and nostalgia attached to it. We wanted our kids to know the story, too,” says Ajit Kumar Singh, a banking sector executive. The family of five comprises Singh, his wife, son, 17, daughter, 26, and his 77-year-old mother-in-law.
“In the beginning, we had to push our daughter a bit to watch the serial,” he says. Many episodes and weeks later, things have fallen into place. During the lockdown, breakfast is about the family watching Ramayan together. “Initially, I was just curious. What was this serial that held people so much in thrall in the 1980s? Slowly, it has grown on me,” says the daughter, Parul Singh.
But it’s the granny, Mandvi Singh, who is the happiest. Life in the big city is a constant chase. “Everybody was busy. We rarely sat down together,” she says. Even when people had the time, they would watch their favourite programmes — news, cooking shows or one of the many soaps — in their own spaces. “Watching Ramayan together in these difficult times is a refreshing change,” says Ajit.
The Singh family has a lot of company in these locked-down days in India. On the back of reruns of old serials like Ramayan, Mahabharat and Buniyaad, for the first time since 2015 (when BARC was launched), the state-run DD has become the topviewed channel in the country (see box).

A national lockdown that has gone on for five weeks has seen Indians embracing a quieter life. The cacophonous physical world outside has fallen silent, only to be replaced by a vibrant virtual life — experiences streaming via cable, broadband and 4G. News, fantasy, crime, comedy, mythology and pornography all jostle for attention, offering homebound Indians, the more fortunate of them anyway, endless possibilities to stay informed and escape the harsh realities and uncertainties of one of the most tumultuous times in memory.
We have been equipping ourselves with necessary gear for a while. This is a country where buying TVs for homes has historically taken precedence over building toilets. Our affinity for media has only been amplified by a surging smartphone usage (50 crore-plus handsets) and internet connections (72 crore plus), thanks to low-cost Chinese phones and the world’s cheapest data plans.

A life where the virtual takes precedence is a delight for marketers and sociologists. Flows of terabytes of data, relatively easy to measure, can offer an unparalleled peek into human behaviour, the shifting patterns and emerging trends.

Going Retro Time spent on both TVs and smartphones has gone up, with TV getting the largest share. In both variety and time, viewers are seeking more. Average weekly viewing minutes on TV rose by 38%, even as average number of channels being watched rose from 16 to 22. Some are obvious, like the sharp growth (76%) in non prime time as against prime time (which saw only a 5% uptick) viewing, even as weekly advertising time dipped by 26% to 20 million seconds. With people staying at home, TV viewing time is now spread out through the day. “Content satiates emotional and mental needs as anxiety and panic have risen. Unlike popular perception, DD’s growth has come from across income classes, with upper income households leading the surge.

“Appeal of DD’s shows cuts across segments with very sticky viewers,” he says. Encouraged, it has launched DD Retro on a pilot basis as a channel to recreate the nostalgia. Meanwhile, consumption of news has grown sharply (219%), followed by movies (73%). “We have seen a viewership surge. Morning viewing time is getting extended into the afternoon. It is also about fresh content. Unlike general entertainment channels (GEC) and sports, news is the only category that can generate fresh content under lockdown,” says MK Anand, MD, Times Network. (It is owned by Times Group, which publishes this newspaper.) GEC saw only a marginal growth of 7%.
There are two possible reasons for this. One is obvious — little availability of fresh content in a lockdown. The second reason is interesting and could offer some clues into how the battle for remote control is shaping up within homes, says Desai. Women, who are a dominant chunk of GEC viewers, may have had to re-prioritise their access to TV amid household chores and stiff competition from kids and men. Interestingly, sports channels that saw a sharp dip, with the cancellation of live sporting events, have witnessed a spike with the live-streaming of WrestleMania and reruns of Indo-Pak cricket classics.

Also, 40% of Google’s top 100 searches are related to Covid-19, says Nielsen. Time spent on chat and VoIP (19% on average, with women hitting higher at 22%) leads smartphone usage, followed by social networking (15%), video-streaming (14%) and gaming (9% on average, while 15-21-year-olds spend 11% of their time). Santanu Basu, founder, Let’s Game Now, an esports platform, has seen the user base of gamers surge from 17,000 pre-lockdown to 50,000 now. Based on data from SimilarWeb, WhatsApp, Instagram, TikTok, Facebook and You-Tube are the most popular apps in India. During the lockdown, downloads of almost all these apps have remained stable or dipped, except for TikTok, which saw a big rise. “The sweaty energy that TikTok exudes is a good representative of what is happening in the society at large,” says Desai. He says the depth and breadth of content in TikTok around Covid-19 is far richer than that in other platforms.

YouTube search trends echo some of these shifts. News, gaming, at-home workouts and recipe searches for dishes like panipuri saw a big spurt, says Kaushik Das Gupta, group head, insights and partnerships, Google India. OTT player MX Player (owned by Times Group, which publishes this newspaper), which launched seven shows in March, has seen time spent on its platform jump 2.5 times as compared with pre-lockdown days. “Our offering of Hollywood films like Baywatch and Transformers, dubbed in Hindi, is doing well,” says Karan Bedi, CEO, MX Player. Snehil Khanor, cofounder of dating platform TrulyMadly, has seen the number of active users, their engagement and time spent rise even as peak activity time has got extended.

Beyond the Lockdown Whenever the world resets to normalcy, many of these shifts might prove to have been transient. But some could stick or accelerate trends that were already afoot. OTT viewing is one of them. Virtually, all major streaming platforms have witnessed a jump in user base. Some of those users may not log out after the lockdown.
Similarly, digital transactions have witnessed interesting shifts. A recent report by Razorpay, a fintech company, based on pre-lockdown and lockdown transactions, shows that payments for utilities, IT & software, and media & entertainment saw a growth of 73%, 32% and 25%, respectively, even as sectors such as travel dipped by 87%. “Demonetisation was a short-term event. Lockdown will lead to long-term shifts. Behavioural change will be a lot stickier,” says Razorpay cofounder Harshil Mathur.
Indians are also waking up to the convenience of virtual workout coaches. Universal Music MD Devraj Sanyal has used the lockdown period to focus on his physical and mental well-being, spending two hours daily shuffling between fitness regimens. “Those two hours, I think of nothing else. It’s a great way to de-stress in these difficult times. I am 100% sure some of it will stay post-lockdown,” he says.

Why Should UP Have Least High Court Benches In India?
 Let me begin on a bitter note by expressing my profuse disappointment and utmost disenchantment with the continuous and callous disregard of more than 19 crore people living in different parts of UP which is more than 10 small states put together by Centre since 1947 till 2019! Why is it that only Eastern UP has high court at Allahabad and a single bench at Lucknow and all the other regions like Western UP, Bundelkhand and Purvanchal etc have been completely disregarded and denied their legitimate share by giving them at least one high court bench? Why no government in Centre has ever taken any initiative to correct this worst injustice since 1947 till now in 2019? It is UP where maximum cases of crimes takes place and West UP alone owes for more than half of the total cases in UP and yet it has not even a single bench of high court even though Justice Jaswant Singh Commission headed by former Supreme Court Judge Jaswant Singh categorically recommended bench for West UP in early 1980s even though on its historic recommendations benches were created in Aurangabad in Maharashtra and Madurai in Tamil Nadu and other places!

Which state has maximum population which is more than 19 crore as per 2011 census even though in public rallies UP CM Yogi Adityanath and PM Narendra Modi keep saying more than 22 crore? UP!
Which state has maximum villages more than one lakh even though no other state has more than few thousand villages at the most? UP! Which state has maximum poverty? UP! Which state has maximum cities which is more than 700? UP!
Which state has maximum crime to the extent that former UN Secretary General Ban ki moon had slammed UP as the “rape and crime capital of India”? UP! Here too which part of UP owes for more than 52% of pending cases of UP and yet has no high court bench? West UP! Which state has maximum pending cases which is more than the cases of 10 states put together? UP! Which state owes for maximum dowry deaths? UP! Which state owes for maximum custodial deaths? UP! Which state has maximum pending cases in lower courts more than 65 lakhs? UP!
Which state has maximum pending cases of communal violence and riots as we saw in Muzaffarnagar in 2013, Meerut riots in 1988, Bareilly riots, Agra riots etc all in Western part? UP! Which state has maximum pending cases of rape, molestation, murder and other crimes against women? UP! Which state has maximum strength of Judges both in high court at 160 and in lower courts at 5000? UP! Which state has maximum vacancies of Judges? UP! Which state has sent maximum PM which includes Narendra Modi from Varanasi? UP!
The larger point that I want to make here is this: Why is it that Allahabad High Court tops among all states when it comes to the number of pending cases which is more than 10 lakhs whereas most of other states have not more than one lakh cases and still Centre is busy creating more and more high court benches for them with latest at Jalpaiguri for just a handful of districts! Assam till a few years ago had 7 high court benches but after Manipur, Meghalaya and Tripura were given separate high courts, it now stands reduced to 4! But Allahabad High Court which is the biggest court not just in India but in whole of Asia with so vast a jurisdiction and also one of the oldest high court in India has just one! This is certainly most shameful!
Lamentably, even small states like Sikkim, Tripura, Meghalaya, Manipur, etc with just about 6 lakh population, 29 lakh , 36 lakh, 27 lakh have high courts but West UP with more than 9 crore population has not even a single bench of high court! Even Andaman and Nicobar islands with just 3 lakh population has bench but not West UP with more than 9 crore population!
Not just this, Centre has always ensured that this high court has maximum vacancies of Judges which is highest in country with more than half of seats which stands at 160 keep lying vacant! Is this fair? Is Centre not aware that Allahabad High Court needs “special attention” and not “special neglect”? Allahabad High Court is biggest court not just in India but in whole of Asia with maximum High Court Judges and maximum District Judges and also Judges at lower level still it has the least bench in India – only one!
Is Centre not aware that Justice Jaswant Singh Commission had categorically pointed out that West UP owes for about 57% of the total pending cases which is more than half of the total pending cases in UP still why its landmark recommendation to create a bench here to take care of nearly 40 districts at Agra with circuit benches at Nainital and Dehradun overlooked? Why not a single bench approved for UP? It must be investigated by a retired CJI or a retired Judge of Supreme Court!
Why when Sampoornanand recommended a high court bench to be created at Meerut in 1955 after more than 100 elected representatives met him and convinced him of the dire need of the same did Nehru refuse? Why when even other UP CM like ND Tiwari, Rajnath Singh and others recommended was bench not approved? Why when bench could be created at Lucknow in 1948 could a bench not be created at Meerut which is more than 700 km away? Why when Kapil Sibal wanted a high court bench to be created at Meerut when he was Union Law Minister as another Union Minister RPN Singh had disclosed but the then UP CM Akhilesh Yadav objected did Centre not listen to its own reputed and one of the most reputed jurist of India? Why Centre said that the recommendation made by Law Commission in its fourth report in 1955 recommended against creating more benches and so West UP could not be given a bench conveniently overlooked everything when it came to other states and kept on creating benches there and also overlooked that the Law Commission in its 230th report in 2009 recommended creation of more benches yet West UP and other parts of UP like Bundelkhand were overlooked for benches?
Why Centre took no time to create 2 more high court benches for Karnataka with just 6 crore population which is less than even West UP population alone and which already had a bench at Hubli for just 4 and 8 districts at Gulbarga and Dharwad respectively but for 26 districts and more than 9 crore people of West UP not a single bench was approved even though the lawyers here keep going on strike as they did thrice like once in 2001 for 6 months from July to December and for 3 to 4 months as they did in 2014-15 and for one month as they did in 2010 and for many weeks as they keep doing every year apart from the strikes on Saturdays for last 38 years and many times even on Wednesdays? Why Centre disregarded the most commendable recommendation made by one of the most eminent jurist of India – Soli J Sorabjee who as Attorney General in 2001had categorically recommended that, “Centre is empowered to create a high court bench in West UP without any recommendation from the Chief Justice or Chief Minister or anyone else in this regard”? Why Centre even disregarded what former Chairman of Supreme Court Bar Association BN Krishnamani said that, “Only by the creation of a high court bench in any of the districts in West UP will the people living there get real justice”?
Why Centre approves one more bench for Mumbai high court at Kolhapur for just 6 districts which already had 3 benches at Panaji, Aurangabad and Nagpur just recently in 2018 itself but cites 100 reasons for not creating a single more bench for Allahabad High Court in any hook and corner of UP leave alone West UP? Why Centre from 1947 till 2019 has taken the stand that, “Ask anything for UP but not a high court bench as only Lucknow deserves it”? What rubbish!
If Lucknow is capital then so are Bhopal which is capital of Madhya Pradesh, Dehradun which is capital of Uttarakhand, Bhubaneshwar which is capital of Odisha, Dispur which is capital of Assam, Raipur which is capital of Chhattisgarh and Thiruvanathapuram which is capital of Kerala yet they have neither high court nor bench! Also, Lucknow’s area jurisdiction is just 62,00 square km and that of West UP is 98,933 square km! The number of districts which come under the jurisdiction of Lucknow bench is just 12 and that of West UP is 26! The population of districts under Lucknow jurisdiction stands nowhere as compared to West UP whose population at more than 9 crore is more than any other state except UP of which it is itself a part, Maharashtra and Bihar and here too areawise West UP has 98,933 square km and that of Bihar is just 94,000 square km!
Why catchy slogans like “speedy justice”, “justice at doorsteps” and “cheap justice” not implemented for West UP and other remote areas of UP by creating more benches here? Why Mayawati wanted high court itself for West UP by recommending to Centre that it be made a separate state way back in 1995 but Centre is not ready to concede even a bench for West UP? Why is BJP a blind follower of Congress in this regard and till now has ensured that not a single high court bench is created in any hook and corner of UP except the one created already by Nehru 70 years ago in 1948 at Lucknow?
This despite the fact that former PM Atal Bihari Vajpayee had thundered in Parliament way back in 1986 as Opposition Leader demanding the creation of a High Court Bench in West UP and Yogi Adityanath who is now UP CM also himself thundered while demanding for a High Court Bench at Gorakhpur way back in 1998 right inside Parliament but 20 years later we don’t see any High Court Bench anywhere being created in UP! One can understand that Vajpayee didn’t enjoy majority but Modi has it but we see no action forthcoming on this so far even though he is taking other steps for UP like pompously inaugurating the 14 lane highway connecting Delhi with Meerut and other districts of West UP in which many crores of rupees have been spent which will reduce the time limit from Meerut to Delhi from 2 hours to just 45 minutes which is commendable but what about high court bench in West UP which is affecting the litigants of 26 districts most adversely due to which they are still compelled to travel more than 700 km all the way to Allahabad whole night without reservation many times and bear all sorts of inconveniences? When will action be taken on this score? Why can’t few crores be spared for creating a bench in West UP and other needy areas of UP like in Jhansi in Budelkhand and in Gorakhpur?
It is not for nothing that Union Minister Satyapal Singh demanded in Parliament the creation of 5 high court benches at Meerut, Agra, Jhansi, Gorakhpur and Varanasi but the real tragedy is that his own PM is not listening to him and not creating even one more bench anywhere else in UP other than the one which already exists at Lucknow! Similarly many other BJP MPs like former Union Minister Sanjeev Baliyan, Union Minister Gen VK Singh, Mahesh Sharma and other MPs like Rajinder Agarwal keep demanding benches but to no avail!
As per the Section 51 of the States Reorganisation Act of 1956, the Centre can create a high court bench in any of these 3 states – UP, Bihar and J&K directly by bringing it up in Parliament. Centre does not need any recommendation from State Government or the Chief Justice as has been very wrongly propagated for many decades! What a national disgrace that these very 3 states – Uttar Pradesh, Jammu and Kashmir and Bihar keep on grabbing the national news headlines for all the wrong reasons as crime incidents keep multiplying very rapidly and what is worst is Centre’s stupid and crazy determination to not allow a single more bench in all these 3 states!
It is incomprehensible why Centre can approve 3 or 4 or 5 benches for peaceful states like Maharashtra, Karnataka among others but not more than one for UP which has maximum pending cases which is more than 10 states put together! Allahabad High Court must be given its due honour and it must have maximum high court benches and not minimum! Disband all high court benches in India if Allahabad High Court cannot be given more benches, West UP cannot be given a bench nor can Bundelkhand or Gorakhpur (which is CM Yogi’s constituency and where BJP just recently lost) for people living so far away who face maximum sufferings because of this but which no PM has ever dared to address for reasons never disclosed!
This all-important issue directly affecting billions of litigants coming from all sections of society is lying largely unattended and untreated since many decades! But now not any longer! Allahabad High Court must get its due by creating more benches for it!
No one is safe in UP! Even lawyers and those in police are themselves not safe! Criminals know that it take ages for cases to be decided in UP as UP has least benches in India and maximum pending cases in India! Former UP High Court Chief Justice Dilip Babasaheb Bhosale in a case involving rape of few women on national highway in Bulandshahr in West UP rightly said that there is total lawlessness in UP as compared to Maharashtra where women can travel alone in night anywhere without any fear and this I have also seen myself at Pune from where I did LLB but see the difference that Maharashtra has four high court benches with latest at Kolhapur for just 6 districts and Pune is all set to get another as CM Devendra Fadnavis has approved it for which we all must applaud him but Centre must create benches in UP also! When Maharashtra can get benches in no time then why Allahabad High Court in UP which has maximum pending cases be denied its due share? Why in last more than 70 years has a single bench more not been added for UP?
Why can’t Centre take serious steps to address this cancerous problem root and branch and not just resort to baby steps and bandaid measures like reducing time limit to reach Delhi by spending many crores of rupees on creating 14 lane national highways but doing nothing at all to create more benches anywhere in UP so that people are not compelled to travel whole night to Allahabad? Why can’t this be done? Is it such a big deal? Certainly not! Only political will needed! What a crying shame that Yogi Adityanath government has the ability to bear Rs 36,000-crore for construction of 600 km Ganga Expressway for better connectivity of Allahabad with western districts of the state and which will be the longest expressway in the world but it can’t spare just few crores for creating a high court bench in West UP for which people numbering more than 9 crore are ready to bear the expenses also!

Facts About Andhra Pradesh
The forest in the state can be broadly divided into four major biotic provinces. The vegetation found in the state is largely of dry deciduous types with a mixture of teak, Terminalia, Dalbergia, Pterocarpus, Anogeissus, etc. The state possesses some rare and endemic plants like Cycas beddomei, Pterocarpus santalinus, Terminalia pallida, Syzygium alternifolium, Shorea talura, Shorea tumburgia, Psilotum nudum, etc. The diversity of fauna includes tigers, panthers, hyenas, black bucks, cheetals, sambars, sea turtles and a number of birds and reptiles. The estuaries of river Godavari and Krishna support rich mangrove forests with fishing cats and otters as keystone species. The Minister of Tourism and Culture has issued a declaration of the Telugu language as a Classical Language. The famous Ongole Bull looks similar to Nandi, the vehicle of Lord Shiva. It’s said all the stone sculptures of Nandi in all temples are modelled after the Ongole Bull. Satish Dhawan Space Centre, located on the banks of Sriharikota in the Nellore District is one of the main attractions of the state. Telugu, the official language of Andhra Pradesh, was described by Englishmen as the”Italian of the East ” for its sweetness.

Which state has maximum villages more than one lakh even though no other state has more than few thousand villages at the most? UP! Which state has maximum poverty? UP! Which state has maximum cities which is more than 700? UP!
Which state has maximum crime to the extent that former UN Secretary General Ban ki moon had slammed UP as the “rape and crime capital of India”? UP! Here too which part of UP owes for more than 52% of pending cases of UP and yet has no high court bench? West UP! Which state has maximum pending cases which is more than the cases of 10 states put together? UP! Which state owes for maximum dowry deaths? UP! Which state owes for maximum custodial deaths? UP! Which state has maximum pending cases in lower courts more than 65 lakhs? UP!
Which state has maximum pending cases of communal violence and riots as we saw in Muzaffarnagar in 2013, Meerut riots in 1988, Bareilly riots, Agra riots etc all in Western part? UP! Which state has maximum pending cases of rape, molestation, murder and other crimes against women? UP! Which state has maximum strength of Judges both in high court at 160 and in lower courts at 5000? UP! Which state has maximum vacancies of Judges? UP! Which state has sent maximum PM which includes Narendra Modi from Varanasi? UP!
The larger point that I want to make here is this: Why is it that Allahabad High Court tops among all states when it comes to the number of pending cases which is more than 10 lakhs whereas most of other states have not more than one lakh cases and still Centre is busy creating more and more high court benches for them with latest at Jalpaiguri for just a handful of districts! Assam till a few years ago had 7 high court benches but after Manipur, Meghalaya and Tripura were given separate high courts, it now stands reduced to 4! But Allahabad High Court which is the biggest court not just in India but in whole of Asia with so vast a jurisdiction and also one of the oldest high court in India has just one! This is certainly most shameful!
Lamentably, even small states like Sikkim, Tripura, Meghalaya, Manipur, etc with just about 6 lakh population, 29 lakh , 36 lakh, 27 lakh have high courts but West UP with more than 9 crore population has not even a single bench of high court! Even Andaman and Nicobar islands with just 3 lakh population has bench but not West UP with more than 9 crore population!
Not just this, Centre has always ensured that this high court has maximum vacancies of Judges which is highest in country with more than half of seats which stands at 160 keep lying vacant! Is this fair? Is Centre not aware that Allahabad High Court needs “special attention” and not “special neglect”? Allahabad High Court is biggest court not just in India but in whole of Asia with maximum High Court Judges and maximum District Judges and also Judges at lower level still it has the least bench in India – only one!
Is Centre not aware that Justice Jaswant Singh Commission had categorically pointed out that West UP owes for about 57% of the total pending cases which is more than half of the total pending cases in UP still why its landmark recommendation to create a bench here to take care of nearly 40 districts at Agra with circuit benches at Nainital and Dehradun overlooked? Why not a single bench approved for UP? It must be investigated by a retired CJI or a retired Judge of Supreme Court!
Why when Sampoornanand recommended a high court bench to be created at Meerut in 1955 after more than 100 elected representatives met him and convinced him of the dire need of the same did Nehru refuse? Why when even other UP CM like ND Tiwari, Rajnath Singh and others recommended was bench not approved? Why when bench could be created at Lucknow in 1948 could a bench not be created at Meerut which is more than 700 km away? Why when Kapil Sibal wanted a high court bench to be created at Meerut when he was Union Law Minister as another Union Minister RPN Singh had disclosed but the then UP CM Akhilesh Yadav objected did Centre not listen to its own reputed and one of the most reputed jurist of India? Why Centre said that the recommendation made by Law Commission in its fourth report in 1955 recommended against creating more benches and so West UP could not be given a bench conveniently overlooked everything when it came to other states and kept on creating benches there and also overlooked that the Law Commission in its 230th report in 2009 recommended creation of more benches yet West UP and other parts of UP like Bundelkhand were overlooked for benches?
Why Centre took no time to create 2 more high court benches for Karnataka with just 6 crore population which is less than even West UP population alone and which already had a bench at Hubli for just 4 and 8 districts at Gulbarga and Dharwad respectively but for 26 districts and more than 9 crore people of West UP not a single bench was approved even though the lawyers here keep going on strike as they did thrice like once in 2001 for 6 months from July to December and for 3 to 4 months as they did in 2014-15 and for one month as they did in 2010 and for many weeks as they keep doing every year apart from the strikes on Saturdays for last 38 years and many times even on Wednesdays? Why Centre disregarded the most commendable recommendation made by one of the most eminent jurist of India – Soli J Sorabjee who as Attorney General in 2001had categorically recommended that, “Centre is empowered to create a high court bench in West UP without any recommendation from the Chief Justice or Chief Minister or anyone else in this regard”? Why Centre even disregarded what former Chairman of Supreme Court Bar Association BN Krishnamani said that, “Only by the creation of a high court bench in any of the districts in West UP will the people living there get real justice”?
Why Centre approves one more bench for Mumbai high court at Kolhapur for just 6 districts which already had 3 benches at Panaji, Aurangabad and Nagpur just recently in 2018 itself but cites 100 reasons for not creating a single more bench for Allahabad High Court in any hook and corner of UP leave alone West UP? Why Centre from 1947 till 2019 has taken the stand that, “Ask anything for UP but not a high court bench as only Lucknow deserves it”? What rubbish!
If Lucknow is capital then so are Bhopal which is capital of Madhya Pradesh, Dehradun which is capital of Uttarakhand, Bhubaneshwar which is capital of Odisha, Dispur which is capital of Assam, Raipur which is capital of Chhattisgarh and Thiruvanathapuram which is capital of Kerala yet they have neither high court nor bench! Also, Lucknow’s area jurisdiction is just 62,00 square km and that of West UP is 98,933 square km! The number of districts which come under the jurisdiction of Lucknow bench is just 12 and that of West UP is 26! The population of districts under Lucknow jurisdiction stands nowhere as compared to West UP whose population at more than 9 crore is more than any other state except UP of which it is itself a part, Maharashtra and Bihar and here too areawise West UP has 98,933 square km and that of Bihar is just 94,000 square km!
Why catchy slogans like “speedy justice”, “justice at doorsteps” and “cheap justice” not implemented for West UP and other remote areas of UP by creating more benches here? Why Mayawati wanted high court itself for West UP by recommending to Centre that it be made a separate state way back in 1995 but Centre is not ready to concede even a bench for West UP? Why is BJP a blind follower of Congress in this regard and till now has ensured that not a single high court bench is created in any hook and corner of UP except the one created already by Nehru 70 years ago in 1948 at Lucknow?
This despite the fact that former PM Atal Bihari Vajpayee had thundered in Parliament way back in 1986 as Opposition Leader demanding the creation of a High Court Bench in West UP and Yogi Adityanath who is now UP CM also himself thundered while demanding for a High Court Bench at Gorakhpur way back in 1998 right inside Parliament but 20 years later we don’t see any High Court Bench anywhere being created in UP! One can understand that Vajpayee didn’t enjoy majority but Modi has it but we see no action forthcoming on this so far even though he is taking other steps for UP like pompously inaugurating the 14 lane highway connecting Delhi with Meerut and other districts of West UP in which many crores of rupees have been spent which will reduce the time limit from Meerut to Delhi from 2 hours to just 45 minutes which is commendable but what about high court bench in West UP which is affecting the litigants of 26 districts most adversely due to which they are still compelled to travel more than 700 km all the way to Allahabad whole night without reservation many times and bear all sorts of inconveniences? When will action be taken on this score? Why can’t few crores be spared for creating a bench in West UP and other needy areas of UP like in Jhansi in Budelkhand and in Gorakhpur?
It is not for nothing that Union Minister Satyapal Singh demanded in Parliament the creation of 5 high court benches at Meerut, Agra, Jhansi, Gorakhpur and Varanasi but the real tragedy is that his own PM is not listening to him and not creating even one more bench anywhere else in UP other than the one which already exists at Lucknow! Similarly many other BJP MPs like former Union Minister Sanjeev Baliyan, Union Minister Gen VK Singh, Mahesh Sharma and other MPs like Rajinder Agarwal keep demanding benches but to no avail!
As per the Section 51 of the States Reorganisation Act of 1956, the Centre can create a high court bench in any of these 3 states – UP, Bihar and J&K directly by bringing it up in Parliament. Centre does not need any recommendation from State Government or the Chief Justice as has been very wrongly propagated for many decades! What a national disgrace that these very 3 states – Uttar Pradesh, Jammu and Kashmir and Bihar keep on grabbing the national news headlines for all the wrong reasons as crime incidents keep multiplying very rapidly and what is worst is Centre’s stupid and crazy determination to not allow a single more bench in all these 3 states!
It is incomprehensible why Centre can approve 3 or 4 or 5 benches for peaceful states like Maharashtra, Karnataka among others but not more than one for UP which has maximum pending cases which is more than 10 states put together! Allahabad High Court must be given its due honour and it must have maximum high court benches and not minimum! Disband all high court benches in India if Allahabad High Court cannot be given more benches, West UP cannot be given a bench nor can Bundelkhand or Gorakhpur (which is CM Yogi’s constituency and where BJP just recently lost) for people living so far away who face maximum sufferings because of this but which no PM has ever dared to address for reasons never disclosed!
This all-important issue directly affecting billions of litigants coming from all sections of society is lying largely unattended and untreated since many decades! But now not any longer! Allahabad High Court must get its due by creating more benches for it!
No one is safe in UP! Even lawyers and those in police are themselves not safe! Criminals know that it take ages for cases to be decided in UP as UP has least benches in India and maximum pending cases in India! Former UP High Court Chief Justice Dilip Babasaheb Bhosale in a case involving rape of few women on national highway in Bulandshahr in West UP rightly said that there is total lawlessness in UP as compared to Maharashtra where women can travel alone in night anywhere without any fear and this I have also seen myself at Pune from where I did LLB but see the difference that Maharashtra has four high court benches with latest at Kolhapur for just 6 districts and Pune is all set to get another as CM Devendra Fadnavis has approved it for which we all must applaud him but Centre must create benches in UP also! When Maharashtra can get benches in no time then why Allahabad High Court in UP which has maximum pending cases be denied its due share? Why in last more than 70 years has a single bench more not been added for UP?
Why can’t Centre take serious steps to address this cancerous problem root and branch and not just resort to baby steps and bandaid measures like reducing time limit to reach Delhi by spending many crores of rupees on creating 14 lane national highways but doing nothing at all to create more benches anywhere in UP so that people are not compelled to travel whole night to Allahabad? Why can’t this be done? Is it such a big deal? Certainly not! Only political will needed! What a crying shame that Yogi Adityanath government has the ability to bear Rs 36,000-crore for construction of 600 km Ganga Expressway for better connectivity of Allahabad with western districts of the state and which will be the longest expressway in the world but it can’t spare just few crores for creating a high court bench in West UP for which people numbering more than 9 crore are ready to bear the expenses also!

Which state has maximum villages more than one lakh even though no other state has more than few thousand villages at the most? UP! Which state has maximum poverty? UP! Which state has maximum cities which is more than 700? UP!
Which state has maximum crime to the extent that former UN Secretary General Ban ki moon had slammed UP as the “rape and crime capital of India”? UP! Here too which part of UP owes for more than 52% of pending cases of UP and yet has no high court bench? West UP! Which state has maximum pending cases which is more than the cases of 10 states put together? UP! Which state owes for maximum dowry deaths? UP! Which state owes for maximum custodial deaths? UP! Which state has maximum pending cases in lower courts more than 65 lakhs? UP!
Which state has maximum pending cases of communal violence and riots as we saw in Muzaffarnagar in 2013, Meerut riots in 1988, Bareilly riots, Agra riots etc all in Western part? UP! Which state has maximum pending cases of rape, molestation, murder and other crimes against women? UP! Which state has maximum strength of Judges both in high court at 160 and in lower courts at 5000? UP! Which state has maximum vacancies of Judges? UP! Which state has sent maximum PM which includes Narendra Modi from Varanasi? UP!
The larger point that I want to make here is this: Why is it that Allahabad High Court tops among all states when it comes to the number of pending cases which is more than 10 lakhs whereas most of other states have not more than one lakh cases and still Centre is busy creating more and more high court benches for them with latest at Jalpaiguri for just a handful of districts! Assam till a few years ago had 7 high court benches but after Manipur, Meghalaya and Tripura were given separate high courts, it now stands reduced to 4! But Allahabad High Court which is the biggest court not just in India but in whole of Asia with so vast a jurisdiction and also one of the oldest high court in India has just one! This is certainly most shameful!
Lamentably, even small states like Sikkim, Tripura, Meghalaya, Manipur, etc with just about 6 lakh population, 29 lakh , 36 lakh, 27 lakh have high courts but West UP with more than 9 crore population has not even a single bench of high court! Even Andaman and Nicobar islands with just 3 lakh population has bench but not West UP with more than 9 crore population!
Not just this, Centre has always ensured that this high court has maximum vacancies of Judges which is highest in country with more than half of seats which stands at 160 keep lying vacant! Is this fair? Is Centre not aware that Allahabad High Court needs “special attention” and not “special neglect”? Allahabad High Court is biggest court not just in India but in whole of Asia with maximum High Court Judges and maximum District Judges and also Judges at lower level still it has the least bench in India – only one!
Is Centre not aware that Justice Jaswant Singh Commission had categorically pointed out that West UP owes for about 57% of the total pending cases which is more than half of the total pending cases in UP still why its landmark recommendation to create a bench here to take care of nearly 40 districts at Agra with circuit benches at Nainital and Dehradun overlooked? Why not a single bench approved for UP? It must be investigated by a retired CJI or a retired Judge of Supreme Court!
Why when Sampoornanand recommended a high court bench to be created at Meerut in 1955 after more than 100 elected representatives met him and convinced him of the dire need of the same did Nehru refuse? Why when even other UP CM like ND Tiwari, Rajnath Singh and others recommended was bench not approved? Why when bench could be created at Lucknow in 1948 could a bench not be created at Meerut which is more than 700 km away? Why when Kapil Sibal wanted a high court bench to be created at Meerut when he was Union Law Minister as another Union Minister RPN Singh had disclosed but the then UP CM Akhilesh Yadav objected did Centre not listen to its own reputed and one of the most reputed jurist of India? Why Centre said that the recommendation made by Law Commission in its fourth report in 1955 recommended against creating more benches and so West UP could not be given a bench conveniently overlooked everything when it came to other states and kept on creating benches there and also overlooked that the Law Commission in its 230th report in 2009 recommended creation of more benches yet West UP and other parts of UP like Bundelkhand were overlooked for benches?
Why Centre took no time to create 2 more high court benches for Karnataka with just 6 crore population which is less than even West UP population alone and which already had a bench at Hubli for just 4 and 8 districts at Gulbarga and Dharwad respectively but for 26 districts and more than 9 crore people of West UP not a single bench was approved even though the lawyers here keep going on strike as they did thrice like once in 2001 for 6 months from July to December and for 3 to 4 months as they did in 2014-15 and for one month as they did in 2010 and for many weeks as they keep doing every year apart from the strikes on Saturdays for last 38 years and many times even on Wednesdays? Why Centre disregarded the most commendable recommendation made by one of the most eminent jurist of India – Soli J Sorabjee who as Attorney General in 2001had categorically recommended that, “Centre is empowered to create a high court bench in West UP without any recommendation from the Chief Justice or Chief Minister or anyone else in this regard”? Why Centre even disregarded what former Chairman of Supreme Court Bar Association BN Krishnamani said that, “Only by the creation of a high court bench in any of the districts in West UP will the people living there get real justice”?
Why Centre approves one more bench for Mumbai high court at Kolhapur for just 6 districts which already had 3 benches at Panaji, Aurangabad and Nagpur just recently in 2018 itself but cites 100 reasons for not creating a single more bench for Allahabad High Court in any hook and corner of UP leave alone West UP? Why Centre from 1947 till 2019 has taken the stand that, “Ask anything for UP but not a high court bench as only Lucknow deserves it”? What rubbish!
If Lucknow is capital then so are Bhopal which is capital of Madhya Pradesh, Dehradun which is capital of Uttarakhand, Bhubaneshwar which is capital of Odisha, Dispur which is capital of Assam, Raipur which is capital of Chhattisgarh and Thiruvanathapuram which is capital of Kerala yet they have neither high court nor bench! Also, Lucknow’s area jurisdiction is just 62,00 square km and that of West UP is 98,933 square km! The number of districts which come under the jurisdiction of Lucknow bench is just 12 and that of West UP is 26! The population of districts under Lucknow jurisdiction stands nowhere as compared to West UP whose population at more than 9 crore is more than any other state except UP of which it is itself a part, Maharashtra and Bihar and here too areawise West UP has 98,933 square km and that of Bihar is just 94,000 square km!
Why catchy slogans like “speedy justice”, “justice at doorsteps” and “cheap justice” not implemented for West UP and other remote areas of UP by creating more benches here? Why Mayawati wanted high court itself for West UP by recommending to Centre that it be made a separate state way back in 1995 but Centre is not ready to concede even a bench for West UP? Why is BJP a blind follower of Congress in this regard and till now has ensured that not a single high court bench is created in any hook and corner of UP except the one created already by Nehru 70 years ago in 1948 at Lucknow?
This despite the fact that former PM Atal Bihari Vajpayee had thundered in Parliament way back in 1986 as Opposition Leader demanding the creation of a High Court Bench in West UP and Yogi Adityanath who is now UP CM also himself thundered while demanding for a High Court Bench at Gorakhpur way back in 1998 right inside Parliament but 20 years later we don’t see any High Court Bench anywhere being created in UP! One can understand that Vajpayee didn’t enjoy majority but Modi has it but we see no action forthcoming on this so far even though he is taking other steps for UP like pompously inaugurating the 14 lane highway connecting Delhi with Meerut and other districts of West UP in which many crores of rupees have been spent which will reduce the time limit from Meerut to Delhi from 2 hours to just 45 minutes which is commendable but what about high court bench in West UP which is affecting the litigants of 26 districts most adversely due to which they are still compelled to travel more than 700 km all the way to Allahabad whole night without reservation many times and bear all sorts of inconveniences? When will action be taken on this score? Why can’t few crores be spared for creating a bench in West UP and other needy areas of UP like in Jhansi in Budelkhand and in Gorakhpur?
It is not for nothing that Union Minister Satyapal Singh demanded in Parliament the creation of 5 high court benches at Meerut, Agra, Jhansi, Gorakhpur and Varanasi but the real tragedy is that his own PM is not listening to him and not creating even one more bench anywhere else in UP other than the one which already exists at Lucknow! Similarly many other BJP MPs like former Union Minister Sanjeev Baliyan, Union Minister Gen VK Singh, Mahesh Sharma and other MPs like Rajinder Agarwal keep demanding benches but to no avail!
As per the Section 51 of the States Reorganisation Act of 1956, the Centre can create a high court bench in any of these 3 states – UP, Bihar and J&K directly by bringing it up in Parliament. Centre does not need any recommendation from State Government or the Chief Justice as has been very wrongly propagated for many decades! What a national disgrace that these very 3 states – Uttar Pradesh, Jammu and Kashmir and Bihar keep on grabbing the national news headlines for all the wrong reasons as crime incidents keep multiplying very rapidly and what is worst is Centre’s stupid and crazy determination to not allow a single more bench in all these 3 states!
It is incomprehensible why Centre can approve 3 or 4 or 5 benches for peaceful states like Maharashtra, Karnataka among others but not more than one for UP which has maximum pending cases which is more than 10 states put together! Allahabad High Court must be given its due honour and it must have maximum high court benches and not minimum! Disband all high court benches in India if Allahabad High Court cannot be given more benches, West UP cannot be given a bench nor can Bundelkhand or Gorakhpur (which is CM Yogi’s constituency and where BJP just recently lost) for people living so far away who face maximum sufferings because of this but which no PM has ever dared to address for reasons never disclosed!
This all-important issue directly affecting billions of litigants coming from all sections of society is lying largely unattended and untreated since many decades! But now not any longer! Allahabad High Court must get its due by creating more benches for it!
No one is safe in UP! Even lawyers and those in police are themselves not safe! Criminals know that it take ages for cases to be decided in UP as UP has least benches in India and maximum pending cases in India! Former UP High Court Chief Justice Dilip Babasaheb Bhosale in a case involving rape of few women on national highway in Bulandshahr in West UP rightly said that there is total lawlessness in UP as compared to Maharashtra where women can travel alone in night anywhere without any fear and this I have also seen myself at Pune from where I did LLB but see the difference that Maharashtra has four high court benches with latest at Kolhapur for just 6 districts and Pune is all set to get another as CM Devendra Fadnavis has approved it for which we all must applaud him but Centre must create benches in UP also! When Maharashtra can get benches in no time then why Allahabad High Court in UP which has maximum pending cases be denied its due share? Why in last more than 70 years has a single bench more not been added for UP?
Why can’t Centre take serious steps to address this cancerous problem root and branch and not just resort to baby steps and bandaid measures like reducing time limit to reach Delhi by spending many crores of rupees on creating 14 lane national highways but doing nothing at all to create more benches anywhere in UP so that people are not compelled to travel whole night to Allahabad? Why can’t this be done? Is it such a big deal? Certainly not! Only political will needed! What a crying shame that Yogi Adityanath government has the ability to bear Rs 36,000-crore for construction of 600 km Ganga Expressway for better connectivity of Allahabad with western districts of the state and which will be the longest expressway in the world but it can’t spare just few crores for creating a high court bench in West UP for which people numbering more than 9 crore are ready to bear the expenses also!

Editorial: CJI Ranjan Gogoi is Determined To Ensure Sweeping Changes In Judiciary
Let me begin with a disclaimer: I have never met the new Chief Justice of India (CJI) in person nor have I ever interacted with any of his friends or relatives or close companions nor do I know any of them in any manner. But from the news and the articles which I have read about him since last few years, one conclusion is inescapable: He is a man of integrity with impeccable reputation who never tolerates any kind of wrong or injustice! Also, he does not like sycophancy in any manner and is a man of few words who yet conveys everything in that brief interaction. This alone explains why when a lawyer in court tested his luck by striking a congratulatory note, CJI Ranjan Gogoi curtly said that, “This is courtroom and let us get back to work.”
To be sure, the change of guard  in the Supreme Court with outgoing CJI Dipak Mishra passing the baton of CJI to Ranjan Gogoi might lead to a discernible change in the court proceedings as was evident right from the first day as the CJI made it clear that he will continue to be “strict and perfectionist” in dealing with cases and judicial administration. He has made it amply clear on more occasions than one that he will not tolerate indiscipline and breaking of rules under any circumstances! He is known all over for his strictness and penchant to always abide by the rule-book and he made it clear while speaking recently at a function organised in his honour by Supreme Court Bar Association (SCBA). The newly designated CJI Ranjan Gogoi who took oath on October 3 candidly said that, “I am what I am and I cannot change myself. Take me as I am – I cannot change,” while referring to SCBA President Vikas Singh’s remarks that Justice Gogoi is “strict and perfectionist” and urging him to be lenient with junior lawyers and those unprepared for any reason! What CJI Gogoi said is quite palpable and even if he had not said this, it is well known to all which he always demonstrates by his exemplary and elegant conduct while hearing cases and even otherwise if he meets someone anywhere!
Needless to say, soon after taking over as the 46th Chief Justice of India, Justice Ranjan Gogoi on October 3 began his 410-day stint which means he will have a tenure of a little over 13 months. He will retire on November 17, 2019. He has achieved a great personal milestone by not just becoming the Chief Justice of India but also by becoming the first person from the Northeast to reach the top position of the judiciary for which he certainly deserves accolades!
As things stand, President Ram Nath Kovind administered the oath to Justice Ranjan Gogoi at a brief ceremony in Rashtrapati Bhavan’s historic Darbar Hall. Justice Gogoi took the oath in English in the name of God. He succeeded outgoing CJI Justice Dipak Mishra who retired on October 2 on attaining the age of 65 years. CJI Gogoi promptly has also tweaked the Judges roster that decides subjectwise allotment of work, assigning public interest litigation to himself and Justice Madan B Lokur would hear those directed to his court by the Chief Justice.
Of course, Justice Gogoi took oath for the highest post in the judiciary that is of CJI in the presence of PM Narendra Modi and his cabinet colleagues, former PMs Manmohan Singh, HD Deve Gowda, ex-CJIs and Judges of the Supreme Court besides other political personalities. After the oath, he shook hands with the President before rushing to his mother sitting in the front row of dignitaries to touch her feet and then greet others with folded hands. This itself is the biggest testimony that how much regards he holds for his mother and very rightly so!
It is most reassuring to see that the newly designated CJI Ranjan Gogoi has promptly unveiled his plan to bring in reforms in the judicial system and fill up the vacancies, particularly in the lower courts. He assured that he will make all-out effort to fill up the posts in next 3-4 months. He minced no words in making his intentions known loud and clear by stating unambiguously that, “Time is short. We are making efforts for best results in the shortest time.”
Truth be told, the huge vacancies in the lower courts and High Courts are a stumbling block in the way of speedy justice and quick disposal of cases. There are 5,925 vacant posts of judicial officers in district and subordinate courts as of now and vacancies in High Courts have jumped to 40% on August 31 with 427 posts falling vacant and the working strength of Judges coming down to 652 against a total approved strength of 1,079. Going by the current rate of appointments of Judges in High Courts, and considering that 75-85 Judges retire on an average every year, it will take at least 15 years to fill up the existing 427 vacancies in all the 24 High Courts. CJI Ranjan Gogoi knows the daunting challenges that he is going to face ahead in days to come but he seems fully determined to task them head on and address them root and branch so that it is completely addressed!
Be it noted, the CJI Ranjan Gogoi also emphasized vocally the need to maintain the “aura and dignity” of office of Judgeship. Referring to the suggestion of Attorney General KK Venugopal who said salary of Judges be hiked at least 3-4 times to attract competent persons for Judgeship, the CJI Gogoi was absolutely right in stating it upfront that, “There will not be many takers (for judgeship) and it will not work if only salary is increased or retirement age is increased unless the dignity of the office is maintained.” Who can deny or dispute it?
While outlining his priorities as CJI, Justice Ranjan Gogoi said that he was working with his “colleagues” to put in place a mechanism to ensure quick listing of cases and to reduce the time period before filing and hearing of a case. Justice Gogoi had on October 1 disclosed that the twin issues – huge pendency of cases and justice not being accessible to the poor and marginalised sections of society – troubled him and hinted that his priorities as head of the judiciary would be to deal with these issues.” He is very rightly troubled because these are in fact the twin major issues that have been afflicting the nation since quite a long time! Who can deny this?
It goes without saying that these twin problems of huge pendency of cases and justice not being accessible to the poor and marginalised sections of society can be addressed by recruiting more Judges, setting up more high court benches especially in big states like UP which has just one high court bench at Lucknow just about 200 km away from Allahabad where high court itself is located and the other parts like Western UP which accounts for more than half of pending cases has not even a single bench of high court even though the distance from most of the 26 districts of West UP to Allahabad ranges approximately from 600 to 750 km on an average and the more than 9 crore people living here are compelled to travel so far whole night all the way to Allahabad just because there is no bench here even though Justice Jaswant Singh Commission headed by Justice Jaswant Singh who is a former Supreme Court Judge  set up by Centre in latte 1970s had categorically recommended a high court bench to be set up here yet no action was taken! Allahabad High Court is the biggest court not just in India but in whole of Asia and is also the oldest court which completed 150 years in 2016 yet it has least benches in India whereas smaller states like Assam has 4 benches, Maharashtra too has 4 benches the latest set up recently at Kolhapur for just 6 districts, Karnataka has 3 benches with 2 set up in 2012 for just 4 and 8 districts at Dharad and Gulbarga, Madhya Pradesh has two and so is the case with many other states!
Not just this, Allahabad High Court tops the states list for maximum pending cases and has more pending cases than the pending cases of 10 states put together yet no bench set up in last 70 years even though the 230threport of Law Commission of India recommended creation of more benches in big states like UP where only one bench exists created in 1948 on July 1! One fervently hopes that Justice Gogoi will take prompt steps to correct this and also create more benches in other lawless states like Bihar which has not even a single bench of high court and also ensure that all vacancies in lower courts are filled promptly so that the pending cases can be disposed of promptly!
Very few know that Justice Gogoi had qualified for the prestigious Civil Services exam which his father – late Keshab Chandra Gogoi who was the former Chief Minister of Assam had asked him to appear but he was not keen and instead preferred to become a lawyer. His father wished him best and predicted that he would one day become the Chief Justice of India and not just the Chief Minister of a State like him! His father may be no more alive but he has proved right what his father had predicted about him by his relentless dedication, discipline and determination! He joined the Bar in 1978 and practiced in Gauhati High Court. He was mentored by senior advocate JP Bhattacharjee and soon he acquired mastery in constitutional, tax and company law and was appointed a Permanent Judge of Gauhati High Court at the age of 47 in February 2001. He was transferred to the Punjab and Haryana High Court where he became Judge on 9 September 2010 and appointed Chief Justice on 12 February 2011 at 57 and was appointed Judge of the Supreme Court in April 2012 at 58.
It cannot be lost on us that Justice Ranjan Gogoi along with three other Supreme Court Judges – Justice J Chelameswar (since retired), Justice Madan B Lokur and Justice Kurian Joseph grabbed news headlines all over when they staged an unprecedented press conference which is perhaps the first in the history of the Indian judiciary to protest the arbitrary manner in which crucial cases were allotted by the then CJI Dipak Mishra to Judges who were comparatively much junior to them! Justice Gogoi had dared to risk his entire bright future because Centre which was not too happy with this could have easily sabotaged his appointment as CJI just like former PM late Mrs Indira Gandhi did while she was CJI when she superseded 3 Judges and made her own favourite as CJI but all credit to this Modi government that it did not stoop so low! PM Narendra Modi also rejected any move to increase immediately the retirement age of Supreme Court Judges from 65 to 67 as this would have directly impacted Justice Ranjan Gogoi’s prospects to become CJI and he would have retired just as Justice and not as CJI for which PM Modi certainly deserves full marks! PM Modi tweeted that, “I congratulate Justice Ranjan Gogoi ji on taking oath as the Chief Justice of India. His experience, wisdom, insight and legal knowledge will benefit the country greatly. My best wishes for a fruitful tenure.”
Truly speaking, the new CJI Gogoi began the day at the Apex Court by telling the lawyers that fresh parameters would be worked out for mentioning the matters for hearing those cases which required hearing on priority and urgent mentioning. Justice Gogoi said that, “no urgent mentioning of cases will be allowed till certain parameters are fixed for it”. Dispensing with the routine of mentioning that usually takes 20 minutes of judicial time daily, the Justice Gogoi-led Bench also indicated it will narrow the entry of PILs. Despite the no to mentioning, senior advocate Prashant Bhushan sought urgent listing of a petition claiming it involved imminent deportation of seven illegal Rohingya immigrants by India to Myanmar but the CJI stuck to his stand and told Bhushan that he would not entertain any mentioning for urgent listing and all petitions that are filed, would be listed in two or three days! CJI Gogoi added that, “If somebody is going to be hanged or evicted tomorrow, then we can understand urgency”.
Not stopping here, the CJI-led Bench also said that, “We are here to correct and monitor all ills that are there in this country. Can the court do that? Aggrieved parties must give representation to the government and follow it up.” This will certainly now deter many advocates from immediately rushing to the Supreme Court with a PIL merely on the basis of newspaper reports on social, economic and financial matters or even defence deals!
It would be worth mentioning here that CJI Ranjan Gogoi sitting alongside Justices Sanjay Kishan Kaul and KM Joseph said that, “Pass-overs will also not be allowed.” These are short adjournments to accommodate lawyers who may be occupied with other cases. The Bench hears pass-over cases after they have dealt with their others. Gogoi also signalled that he would rein in PIL filed on sundry issues rejecting one that urged the court to ask the government to consider a representation to make some changes in election laws. BJP leader Ashwani Upadhyay had urged the court to direct the government to act as per the Election Commission’s advice and reduce the 30-day period for candidates to file election expenses. Justice Gogoi asked “Are we here to request the government to consider something?” Also, the CJI Gogoi was irked to find that Ashwani Upadhyay dressed in the robes of an advocate was both the petitioner and the lawyer “assisting” his own counsel. The CJI commented on the lack of decorum and the petition was then quickly withdrawn!
It was Justice Ranjan Gogoi who was on the Bench that ruled in 2013 that no one could contest elections without a full and honest disclosure of their assets and also their educational and criminal antecedents. In 2015, a Bench of Apex Court comprising Justice Ranjan Gogoi and NV Ramana had imposed a fine of Rs 5 lakh on two public sector undertaking companies for urging the court to withdraw their appeal. The Bench lashed out saying very sternly that, “If you wanted to withdraw, why did you in first instance file it and persuade us to issue notice? This is not a drawing room where you can walk in and walk out at your own ease.” Justice Ranjan Gogoi was also on the Bench that had restricted the political parties from publishing photographs of leaders and prominent personalities other than the Prime Minister, the President and the CJI in governance-funded advertisements. He also in May had revoked a proposal from the Uttar Pradesh government that arbitrarily allowed all former Chief Ministers to retain their official residences for life long! He also in July had taken strong exception of the Centre’s nonchalant approach in not appointing a Lokpal even after competing more than 4 years in office!
Not stopping here, in November 2016, he dared to even issue contempt notice to a very eminent former Supreme Court Judge Markandey Katju for a blog post on his ruling commuting the death sentence of Govindasamy convicted for raping a girl in Kerala in 2011 saying that, “It (the blog) is an assault on the Judges and not the judgment”. In November 2017, he along with senior colleagues had sentenced Justice CS Karnan for contempt to six months in jail which he did serve! In February 2017 he was part of Bench that refused to grant an extension to Sahara Group owner Subrata Roy to deposit Rs 600 crore saying “We cannot be assembling every month for you to deposit meagre amounts.” It was Justice Gogoi who kept Jats out of the ambit of reservation for OBCs in central services and again it was he who made benefits for the Scheduled Castes state specific and also ordered that upon the death of a Hindu man, his widow would have the right to the joint family property and would not be deprived of it! It was he who as Chief Justice of Punjab and Haryana High Court had ensured that a Judge accused of corruption was made to resign after he complained about him to the Supreme Court!
Going forward, in August 2018, Justice Gogoi led a Bench that instructed Centre to put in place special courts for the speedy trial of criminal cases involving politicians. He lashed out at Centre saying that, “The Union of India doesn’t appear to be ready and prepared.” Most importantly, in September 2018, he headed the Supreme Court Bench  in which Justice RF Nariman too forms a part which is monitoring the National Register of Citizens in Assam case and said that, “What assurance? Court gives only orders.”
While delivering the Ramnath Goenka Memorial Lecture, Justice Gogoi said that hile independent Judges and noisy journalists were democracy’s first line of defence, in today’s context, independent journalists and sometimes noisy Judges too are needed. Senior advocate Kamal Choudhury who has seen Gogoi at work from close quarters as a lawyer and as a Judge says that, “Those who know him well say that Gogoi will never hesitate to take a strong view, no matter what the consequences. He is a man of strong likes and dislikes. Whether you like it or not, he will make his views clear.” He also does not like to adjourn cases on petty grounds and always lay unremitting focus on early disposal of cases which come up for hearing before him! Supreme Court lawyer Sneha Kalita says that, “He is a disciplinarian and is particular about maintaining decorum in his court.” He does not mind to even reprimand senior lawyers if they don’t conduct themselves properly while arguing before him!
No doubt, he is facing daunting challenges but he is fully geared to meet them. Vijay Hansaria who is a senior lawyer minces no words in saying that, “The Supreme Court is fragmented. It feels like there are 13 different Supreme Courts. As a captain, he has to bring everyone together.” What is most distinguishing about him making him different from others is that a common man sees him as a no-nonsense, impartial and dead honest Judge who does not believe in nepotism or favouritism of any kind and who places values above everything else and feels relaxed that for next one year at least the command of judiciary in India is in the safe hands on whom the people can pose their complete blind trust and approach whenever the need arises! Even his worst opponents have never at any given point of time dared to ever question his integrity and commitment to the nation, people and justice!
It would be worth mentioning here that the CJI Ranjan Gogoi has also revealed candidly that he and his colleagues were devising a fool-proof mechanism by which oral mentioning would become redundant. Cases filed would be listed early by default. There would be no unceremonious dropping of cases already scheduled for hearing just because the court had to accommodate a new one mentioned out-of-turn!
It must be stated here that he has just started and what we have seen till now is just the very beginning with his first day in office! It is beyond a straw of doubt that he has a lot to offer to the nation in the next 13 months and the whole nation stands with him fully and firmly watching every day of his in office with full interest! His work will speak and not just his words alone as we shall witness in the coming days ahead!
His utmost commitment can be gauged from the irrefutable fact that when lawyers appear in his court, he asks them whether their case comes under the 93 percent or the remaining seven percent which at first glance seems cryptic query but delve deeper and you find that it is because only seven percent of the cases which find their way to the Supreme Court are pertaining to constitutional matters and the Apex Court ought to be dealing only with such cases but what happens in reality is just the reverse! But this cannot happen now as long as the command of judiciary is in the firm hands of CJI Ranjan Gogoi!
