Blog Post #2 : Earthseed Community

Explain TWO (2) real-life issues that make it necessary to create your Earthseed community. What are you seeking shelter from?

One real-life issue that makes it necessary to create my own Earthseed community is financial distress due to inflation in the economy that makes it difficult to live in America, especially among minority communities. Due to such issues, I would create an Earthseed community that aids in providing shelter to help restore a sense of security in these people. I would establish a resource bank that gives every individual a place to live free of rent among other basic necessities. Another real-life issue that I would create my community to aid is against the U.S. Foster System. The system is filled with children who are in need of homes and lack mental health care, basic necessities, medical care, and support. In my Earthseed community I would shelter against homeless children who are in need of homes who seek drugs and alcohol due to the system failing them. My community would enable a safe place for everyone in need of a home, a meal, and basic necessities while enabling a fresh start or a new beginning to all with the help of one another.  

Quote two (2) Earthseed verses from Parable of the Sower and show how you will apply them to your community. You may be creative in your interpretation.

“ Kindness eases Change” (Chapter 15) 

This verse from Parable of the Sower will be applicable to my Earthseed community because acts of kindness are more powerful than money and enable real change. I would reform a social system that upholds kindness, protection, and safety to help one another as a family. This would leave behind all forms of capitalism, profiting, and competing behind, and would help my community see that with kindness the possibility of a new life is possible. 

“Embrace diversity, unite or be divided,  robbed, ruled,  killed by those who see you as prey. Embrace diversity or be destroyed.”  (Chapter 17)

This verse will be applicable to my Earthseed community as it will be a community that embraces all diverse backgrounds and is free of all discrimination, capitalism, and hierarchies. We will embody a community that is united and grows together without leaving one behind. We will enforce the idea that together we are strong and together we achieve real change without hurting one another. My Earthseed community will be welcoming to every race, color, gender, and sexuality and be liberated of all evil. 

Explain WHERE you will create your Earthseed community to be safe.

I will create my Earthseed community to be safe within the Santa Clara de Asis Mission due to its terrible history of colonization and forcing religion to the indigenous people and robbing them of their land. I will regain this land to honor the indigenous blood that once lived there. I will harness and keep this land safe and help shelter my people through different means of protection without letting anything happen to the sacred space we are in. 

Who can join your community and why? Who can’t join? Why not?

Anyone can join my community as long as they're open minded, kind, and open to grow as a community. I refuse to let anyone who wants to be the sole leader of the community join, since I will instill the idea of partnership and union without one leader or one person having all the power. I will follow communist ideas and let the people decide for their own needs and decisions. Anyone who is racist, elitist, colorist, sexist, ableist, or homophobic will be dismissed and not let in the community. Those who follow White Supremacy ideologies will not be welcomed. I will open my doors to those who follow ideas of collectivism and kinship. I will give priority to anyone from historically marginalized communities who are homeless and lack basic necessities. 

What will your leadership model be for your community?

My leadership model for my community will be based on community and helping one another grow. I want to focus on intellectual growth and having an open mind to different ideas and beliefs. I want everyone to be an active role model for the community and serve one another to the best of our abilities. I want everyone to understand what quality life is and ensure that we all live comfortably and safely without any leaders, power positions, or capitalism in place. 

Create a FUTURE TECHNOLOGY (one on the horizon, not something like teleportation or time travel) to help improve life at your Earthseed community.

For my Earthseed community, I would create a future technology focused on renewable solar energy. I would place solar panels all over the mission that will convert sunlight into electricity, which can then be used to power the homes within the mission along with heating and cooling systems. In addition, in cooler months I would use renewable wind energy to generate electricity. Finally, I would create a filter system within my community to filter drinkable water solely for us to bathe, drink, and use for our crops. With these technologies I will ensure that we are living in a more sustainable way by helping the environment around us. 

Explain/show how your Earthseed community will SURVIVE.

My Earthseed community will survive by having a river nearby providing us with fresh water, finding ways to provide free food for all community members through farming and crop sharing, all while instilling values of community and sharing. Finally, to keep the community safe I will implement a safe security network that will alternate shifts throughout the day ensuring that everyone is safe.  We will have no money, therefore, everyone will learn  how to trade and help each other by sharing skills and knowledge that they possess. 

Explain/show what TWO steps your Earthseed community will make to build a better future, i.e. education, housing, conservation, farming, etc.

One step to my Earthseed community that will help to build a better future is having a school for children and adults to help their intellectual growth. These schools will also teach community members on how to farm to keep one another in touch with our roots and so everyone can take an active role within the community. Finally, I will create safe spaces that allow for resources to help the communities mental and physical health as this will be a priority to ensure that everyone is getting the help and medical care they need. All of these resources will be free of cost and will make sure that everyone is given the care and treatment that they need without having to worry about the financial burden of medical bills.

Groot considers the array of questions for several long moments with a ponderous look on his wooden face. Then he holds up a finger (a branch?) and lifts his other arm, upon which his personal computer is located. He dials in a series of commands; moments later, visages begin to appear in bright holography above his arm, faces of the people he considers friends and family... and presumably, opinions he shares.

To say one person is a hero, and to call another a super hero, suggests they are not equal. But it is not the body that makes one extraordinary. It is the resolve to do what must be done. The Destroyer's face dissolves, to be replaces by the visage of Carol Danvers. Her eyes are narrowed, and her tone is one of frustration. "'Criminal'? Director, a bank robber is a criminal. Someone who's happy to hurt others while robbing the bank? That's a villain. And a villain who goes on to use the money he stole to fund efforts to hurt everyone he possibly can? That's a super villain. There are those who need to be put in jail... and then there are those that need to be stopped. No matter what. I didn't get into this business just for the law and order bit. I'm here for justice."

And then, Spider-Man appears, holding his hands up as though trying to convey something important. "When's the last time Jonah used his bullhorn to help anyone or anything but his own career? That doesn't sell subscriptions. Being divisive does. It's all a bunch of nonsense and it's not gonna stop me from... look, I can't sit still when people are in trouble. If you can do things to help people, but you don't... then it's on you."

8. A bright-eyed and (literally) bushy-tailed young woman with red hair and large front teeth wavers into the shot. She offers a large grin. "Oh! One of my favorite people in the world? Uhm, probably Dr. Banner. He's so smart an' nice!"

There's a stricken response from off-camera. "The Hulk?!"

Squirrel Girl's face scrunches up. "No, no, not him, he's huge an' gets pretty mean sometimes. Dr. Banner's different."

"But they're the same person!"

"No, they aren't," she argues. "The Hulk sometimes does the right thing an' sometimes he does the selfish thing. A lotta the time, he breaks stuff an' hurts people because he can't control himself bein' angry. Doesn't make him a bad guy but he's really not good to be around that much. Dr. Banner? He's always tryin' to do the right thing. He messes up sometimes but his heart's in the right place. He's the kinda guy that hangs out with the super hero crowd but doesn't think he is one. He could be spendin' time with us or with the regular folks who got regular problems an' he fits right in, but you always know the good ones from the bad, 'cause he's hangin' out with the good ones. An'... really, I think, the only way you know you're a super hero or not is when someone like that wants to hang out with you. Good people who, okay, maybe they can't do what we do, but what's wrong with that? We do what we do 'cause we have to. An' so does anybody who doesn't have all these weird abilities. You don't need a mutant power or to fall into a black hole or whatever... you just gotta... I dunno. Be the kinda person Dr. Banner would wanna hang out with."

She breaks her contemplative face and grins again at the camera holder. "Hey, but don't get me wrong, you're one'a my favorite people, too!"

Groot pauses the hologram in place, then looks to Beth, gives her a measured smile, and points at the odd mutant's freckled face, as if to emphasize that last point... and then he gestures to Beth herself.

I know that there's chatter on the internet about it being purposeful to somehow avoid getting sanctioned, but that's highkey incorrect and what they did would actually potentially implicate them MORE.

quick breakdown of legal ethics: you have a duty to your client and a duty to the court. you can't tell any of your client's secrets, but you also can't lie to the court or knowingly allow someone else to lie.

the "knowingly" is important here: if a client lies to you and then you repeat the lie, that's okay. the entire point of confidentiality and privilege is so that clients can be honest with you. if a client has all that protection and lies to you anyway, that's not a you problem. the issue is if you know they're lying: you need to do all you can to prevent them from lying, and if they start to give false testimony despite you telling them not to, you need to stop the proceedings IMMEDIATELY to talk some sense into your client, or, failing that, withdraw as counsel. it is that serious.

so, quick recap:

client: I could not have possibly robbed that bank, I was on vacation in the bahamas! lawyer: okay. your honor, my client couldn't have robbed that bank, they were on vacation in the bahamas. opposing counsel: hahaha, I have caught you in a lie! here are photos of you at the bank when you said you were on vacation!

^^ this is safe for you ethically.

client: I totally robbed that bank, but I want to tell everyone I was on vacation in the bahamas. lawyer: okay. your honor, my client couldn't have robbed that bank, they were on vacation in the bahamas. opposing counsel: hahaha, I have caught you in a lie! here are photos of you at the bank when you said you were on vacation! and they're pictures your attorney had access to, so they knew you were lying about the vacation, too!

^^ this is NOT safe for you ethically because you participated in lying to the court.

(sidebar: withholding information isn't unethical and is, in fact, part of confidentiality. if I know a client of mine is doing drugs when they're supposed to be in rehab, I cannot be compelled to tell that to anyone, at all, even if that means that I'm aware a crime is being committed. disclosing information like that is itself malpractice.)

so, knowing all that, consider what facts we have:

reynal is like the 12th lawyer jones has had. jones had other lawyers when he refused to comply with discovery requests.

somehow, despite the case changing hands multiple times, reynal ended up with a full on clone of Jones' phone that was in his possession. note that not disclosing this, by itself, is NOT unethical. it's a problem for jones but reynal can't be compelled to give up information about his client if jones doesn't allow him to.

despite apparently knowing that jones was lying, reynal allowed him, multiple times, to lie under oath about why he didn't produce anything in response to discovery requests.

it would not make sense for reynal to deliberately set himself up for a malpractice suit AND sanctions for lack of candor toward the tribunal.

so, my money is on it being an accident. lawyers fuck up all the time, and they fuck up in this specific way all the time, and there are rules in place to deal with potential fuckups (like how here, bankston contacted them about the slip-up and gave them a full ten days to claw that info back before using it as evidence). but fucking up so badly that you don't correct your mistake for days? with a case this public and a client this high-profile? THAT'S AN UNUSUALLY BAD FUCKUP.

the best part is they politely gave alex jones’s lawyer the opportunity to fix their mistake and they DIDN’T DO IT. smh shaking my head
