Hey y'all! Slightly odd hypothetical food allergy and (US) legal-based question for you If you order food from a restaurant (in my case, it was Panera), and include specific simple instructions to prevent having an allergic reaction (no pickles in sandwich wrap, allergic*), and they do not do that step and you have an allergic reaction to their food, are they legally liable at all? This is purely hypothetical. Panera did mess up my order, but luckily it was very easy to see (pickles) and I just didn't eat the sandwich. Also luckily my pickle allergy only kicks in if I eat it, not just if I'm around it. Even if I did have an allergic reaction, I'm doing so much better now it'd be unpleasant but not the sort of thing that requires medical attention, so I don't think I in particular would have a case no matter what. That said, the customer service dude I spoke to took it a LOT more seriously than I expected, which is why I'm wondering the legal liability thing? Like, in large restaurant chains, is that a concern? *to fit the very small amount of letters allowed
