February 20, 2004.
The City of Fort Worth, Texas (hereinafter “City”) respectfully requests that the Court set aside its order of expunction in the above-styled cause because the??ity did not receive reasonable notice prior to the expunction hearing as required by statute.

The City has standing to bring this motion under TEX. CRIM. PRO., ?? § 3(a), which states,
“The person who is the subject of the expunction order or an agen?? protesting the expunction may appeal the court's decision in the same manner as in other civil cases.” (Emphasis added.)
The petitioner, David L. Tuckness (hereinafter “Tuckness'), was required to give notice under TEX. CRIM. PRO., ART. 55.02, § 2(b)(8), which provides that the petition shall provide a list including “any political subdivision of this state … that the petitioner has reason to believe have records or files that are subject to the expunction.”
Tuckness was required to include the City in his petition for expunction, but did not do so.
Therefore, the expunction order is defective.
Tuckness is a corporal in the Fort Worth Police Department. On January 14, 2003, Tuckness was temporarily suspended from his employment without pay pursuant to the Civil Service Act, TEX. LOCAL GOV'T CODE, § 143.056(a). Exhibit B.
The basis of the temporary suspension was State of Texas v. David L Tuckness, Cause Number CCL021853.
On August 27, 2003, Tuckness filed an appeal of the temporary suspension pursuant to TEX. LOCAL GOV'T CODE, § 143.056(e). Exhibit C.
The appeal letter was filed by Tuckness's attorney, Phil King.
Tuckness's appeal was scheduled to be heard before Don B. Hayes, Hearing Examiner, on February 3, 2004. Exhibit D.
On that date, both Tuckness and the City appeared with their respective counsel before Mr. Hayes.
At the hearing, Mr. King argued that the record of Tuckness's misdemeanor complaint had been expunged and, therefore, the City was prohibited from introducing evidence of the complaint at the hearing pursuant to TEX. CODE CRIM. PRO., ART. 55.03.
Mr. King argued that the City must prove that Tuckness had been charged with a class A misdemeanor, but it could not do so because the records of that charge were expunged.
Mr. King produced a certified copy of the order of expunction at Tuckness's civil service hearing.
Exhibits E and F.
The City was not notified of the order of expunction before the civil service hearing.
Exhibit A. EX PARTE, v. David Lee TUCKNESS., 2004 WL 5185128 (2004) Because of his temporary suspension and civil service appeal, Tuckness and his attorney Phil King both knew that the City was in possession of records that were subject to the expunction order.
However, the City did not receive notice of the expunction hearing within a reasonable time before the hearing.
Therefore, the expunction order does not meet the strict procedural requirements of the statute and must be set aside.

“Courts have no equitable powers to extend expunctions beyond that allowed by statute.” Texas Dep't of Public Safety v. Wiggins, 688 S.W.2d 227, 229 (Tex. App. - El Paso 1985, no writ). Exhibit H.
In an unpublished case, an order of expunction was set aside because the State Board for Educator Certification received an order of expunction four days after the hearing was held.
The statute requires reasonable notice to the entity before the hearing.
The order of expunction did not meet the statute's procedural requirements, so the trial court was reversed and the order was set aside.
“The procedures listed in the statute are mandatory and must be complied with in an expunction proceeding.”

Likewise, the Tuckness order of expunction should be set aside because the City did not receive notice of the petition and hearing.
Even though the City, unlike the Board for Educator Certification, was not listed on the Tuckness order as an entity directed to expunge records, the City was still required to receive notice because Tuckness had reason to believe that the City had records that would be subject to expunction due to his civil service appeal.

The City further requests that the order of expunction be set aside on its merits.

The City has an interest in keeping the temporary suspension on Tuckness's disciplinary record in the event that he commits similar behavior in the future.

Prior acts can be used to assess the gravity of discipline to be imposed in the future.
Plaster v. City of Houston, 721 S.W.2d 421, 423 (Tex. App. - Houston, 1st Dist 1986, no writ). Exhibit J.
If the misdemeanor charge were removed from his file as Tuckness is requesting, the City may not be able to use the occurrence as a basis for imposing more serious discipline later, if necessary.
The City is not conceding the argument that the charge would be removed from Tuckness's file, but the issue is pending before the hearing examiner, Mr. Hayes.
Additionally, the City requests that the order of expunction be set aside on the merits because Tuckness did not meet his burden to establish that the charge against him was dismissed because of mistake, false information, or other similar reason indicating absence of probable cause at the time of the dismissal to believe that he committed the offense as required by TEX. CRIM. PRO., Art. 55.01(a)(2)(A)(ii).
“Expunction is only available when all the statutory conditions are met.” Katopodis, 886 S.W.2d at 457. Exhibit G.
The burden is on the petitioner to prove that the statutory conditions are met for expunction.
Barker v. State, 84 S.W.3d 409, 412 (Tex. App. - Fort Worth 2002). Exhibit K.
The motion for dismissal filed by the County Attorney of Parker County falls short of establishing the statutory requirement for expunction of records.
The motion states that the “State has insufficient evidence to proceed with trial.” Exhibit L.
Additionally the motion states that the “complaining witness has requested that this cause be dropped, and the prosecutor feels it would be appropriate to comply with said request.”

The motion does not say that the dismissal was requested because of mistake or false information.
Furthermore, the motion does not say or even imply that there was a reason indicating absence of probable cause at the time of the dismissal to believe the person committed the offense.
In the Barker case, the State filed a motion to dismiss because the victim was not cooperating.
Without the testimony of the victim, the State did not have the evidence to go forward with the case. Barker, 84 S.W. 3d at 412. Exhibit K.
The court said that this basis for dismissal did not meet the requirement for expunction.
“A motion by the State to dismiss because of inability to locate the complainant is not evidence that presentment of the indictment was based on mistake, false information, or other reason indicating lack of probable cause.”

Likewise, the Parker County Attorney's motion to dismiss because the complaining witness requested that the cause be dropped is not evidence that the misdemeanor charge against Tuckness was based on mistake, false information, or other reason indicating lack of probable cause.
Because the statutory requirement is not met, the order of expunction should be set aside.

The design provides a new safe and supportive facility for 750 students from Pre-K through 5th grade. In addition, it incorporates next-generation learning and collaborative environments for both students and teachers.

The new 210,000 SF CTE campus embraces sustainable design, including a geothermal HVAC system, energy-effective cool roof, solar panels, and xeriscape site design. In addition, the new facility hosts over 12 career and technical programs of study for students from both district high schools and the collegiate academy and dual credit courses. One of the career and technical programs highlights is the culinary arts courses that teach students the planning, directing, and coordinating activities of a food and beverage organization with the hospitality industry. This program is conducted in a 4,000 SF culinary arts suite, including a 1,600 SF culinary arts lab/commercial kitchen, cooler/freezer, pantry, laundry, office, classroom, and bistro.
Project partners, Steele & Freeman, Inc., recently announced Bill R. Johnson CTE won the state-level Outstanding Construction Award from the AGC Texas Building Branch for the Educational Facilities 3 (Over $30 M) category. After winning first place in the TEXO, The Construction Association Distinguished Building Awards, this project was eligible for the award.

The Strickland Middle School project includes additions and renovations to modernize the 60-year-old beloved legacy campus. The new design incorporates next-generation learning features which align with Denton ISD's current curriculum concepts and state-of-the-art technology. The new two-story seventh- and eighth-grade wing features small and large collaboration spaces and a storm shelter and science labs. The sixth-grade wing incorporates similar collaboration features and includes an ESL hub, a controlled front entry embedded into a right-sized administrative addition, and a two-story library/media center located in the heart of the current campus. The new library/media center was created by removing the first floor above the basement and raising the roof to introduce clerestory windows allowing abundant natural light into the space.

The upgrades include the main building and gym locker rooms with a 44,645 SF addition, a new secured main entry, and a renovated stair tower at the existing east end. In addition, this project includes renovated administration and cafeteria spaces, expanded art rooms, an entirely new library and classroom wing, a new Collegiate Academy, and expanded music program spaces. Additional upgrades throughout the campus include updated restrooms, collaboration areas, and improved handicap accessibility.

The Gerald D. Young Agricultural Science center provides ample space for student exhibitions, expanded parking, and future space requirements. These facilities incorporated within this phase include a multi-purpose outdoor covered arena, a multi-purpose show arena, an enclosed pavilion for temporary housing of animals, and a student project center. The facility design incorporates sustainable, high-performance concepts of the "Collaborative for High-Performance Schools" (CHPS) program. The facilities use increased natural light, improve indoor air quality, incorporate sustainable materials to enhance the educational environment, and provide a maintenance-friendly facility for Katy ISD.

As the district's only comprehensive high school, the new Sherman High School campus includes core academic spaces, indoor and outdoor athletics, fine arts, and many Career and Technology shops and labs. Over the summer of 2017, the Building Bearcats committee of parents, teachers, business, and community leaders gathered to establish the facility needs of Sherman ISD. They set a course of action, asking the Board of Trustees to vote for projects, including constructing a new Sherman High School on a new 97-acre site replacing the current SHS (built in 1950). A group of six United Airlines employees has filed a lawsuit against the company in response to its decision to make Covid vaccinations mandatory for staff.
The carrier announced in August that all workers, barring those eligible for a medical or religious exemption, would need to get fully vaccinated by 27 September.
Anyone who refuses will be placed on temporary leave from 2 October.
The six plaintiffs have all refused the vaccine on religious or medical grounds, with four asking for exemption due to their belief that the vaccine was “derived using aborted foetal tissue”.
“United’s actions have left Plaintiffs with the impossible choice of either taking the Covid-19 vaccine, at the expense of their religious beliefs and their health, or losing their livelihoods,” says the lawsuit, reports the Fort Worth Star-Telegram.
The plaintiffs are captain David Sambrano, aircraft technician David Castillo, station operations representative Kimberly Hamilton, customer service representative Debra Jennefer Thal Jonas, flight attendant Genise Kincannon, and captain Seth Turnbough.
Jonas and Turnbough both declined the vaccine for medical reasons; the former due to an allergy to eggs and penicillin and a previous Covid infection and the latter because he has multiple sclerosis, saying his neurologist advised him against getting vaccinated.
The class action complaint was filed on Tuesday at the US District Court for the Northern District of Texas-Fort Worth Division.
United is one of numerous airlines that have made vaccination mandatory for staff.
Virgin Australia and Qantas have introduced similar policies, while Wizz Air is making vaccination compulsory for inflight workers.
British airlines have been more cautious when it comes to implementing such measures.
Speaking at an Airlines UK event in February, Shai Weiss, chief executive of Virgin Atlantic, said: “My personal view is that the individual’s right to govern their own body is essential.
“We will do everything we can to promote [vaccination], and explain the merits of being vaccinated for yourself and for your loved ones and for society as a whole.
“But before we take that extra step and say ‘If you don’t have a jab you don’t have a job,’ I think that’s a step too far.”
Steve Heapy, chief executive of Jet2, said: “I agree, and I think that may be subject to a number of legal challenges as well.”

The Link Between Texas’s New Abortion Law and Its New Voting Laws
For decades, Republican Taliban Strategists have seen exploiting both issues as a way to hang on to power.

Just before midnight on Wednesday, the U.S. Supreme Court refused to block a Texas law that restricts most abortions after as early as six weeks of pregnancy, dramatically furthering the illiberal, anti-democratic tendency of the Roberts Court. (Chief Justice John Roberts, himself, dissented.) This decision, to permit the law to go into effect, allows the Court’s most conservative members to claim that they were abiding by the tradition of stare decisis by leaving Roe v. Wade, the 1973 ruling that codified a woman’s right to abortion, nominally intact while enabling that right to be hollowed to a husk. The Texas law, which includes no exception for rape or incest, deputizes citizens to sue both anyone who performs the procedure in violation of the law and anyone who assists the beneficiaries in any way. (Patients themselves may not be sued.) And it incentivizes them to do so with the promise of a ten-thousand-dollar reward if they prevail in court. Insurance companies, taxi-drivers, friends, donors to nonprofits, health-care workers—any and all people with even a minor role in enabling an abortion are potentially liable. The law is not only a radical departure from convention, it’s a repudiation of due process, granting standing to individuals who otherwise wouldn’t have it. A more judicious Court, rather than one with a majority of Justices selected because of their ideological opposition to abortion, would have halted the implementation of the Texas law for this reason alone.
The Roe decision took a calendar approach to abortion, allowing a woman to terminate a pregnancy for almost any reason during the first two trimesters, with some state regulation of abortion allowed after the first trimester, and more after the second trimester, at which point a fetus is viable outside the womb, and a state’s interest in protecting it becomes “compelling.” Even so, anti-abortion activists used the trimester timetable to chip away at Roe. The Court’s 1992 ruling in Planned Parenthood of Southeastern Pennsylvania v. Casey upheld a constitutional right to abortion, but eliminated the trimester timetable, which opened the door for states to determine their own standards surrounding fetal viability. Scores of restrictive statutes followed. According to the Guttmacher Institute, a pro-choice nonprofit, between January, 2011, and July, 2019, states enacted four hundred and eighty-three new abortion restrictions. The Texas law, S.B. 8, is the most recent and extreme iteration of these. At six weeks, many women do not know that they are pregnant, but, according to anti-abortion activists, that is when a fetal heartbeat is first discernible. Medical professionals, though, say that this is misleading, because at six weeks, though the cells that will eventually form a heart may have begun to emit electrical signals, a fetal heart will not fully develop for about another fourteen weeks. Nevertheless, S.B. 8 penalizes health-care providers who fail to search for a signal or who continue to treat the patient if they detect it.
Texas was already one of the most difficult places in the country to obtain an abortion. Guttmacher reports that there was a twenty-five-per-cent decline in the number of abortion clinics in the state between 2014 and 2017. In 2017, ninety-six per cent of Texas counties had no abortion facilities. Last year, Governor Greg Abbott issued a temporary ban on certain health-care procedures, including abortions, ostensibly because of the coronavirus pandemic. If the ban had been long-term or strictly implemented, women in the state would have had to travel an average of four hundred and forty-seven miles, round trip, to obtain abortion services.
What makes the Texas law especially odious is that, by empowering random individuals to enforce it rather than leaving that to officials, the authors of S. B. 8 have complicated the ability of abortion-rights advocates to block the law in court, as there is no state agent to sue. As Chief Justice Roberts wrote in his dissent, “The desired consequence appears to be to insulate the State from responsibility for implementing and enforcing the regulatory regime.” This clever subterfuge gave the Court’s conservatives an opportunity to make the disingenuous claim that they were allowing the law to stand because it was not yet clear that the defendants in the case “can or will seek to enforce the Texas law against the applicants in a manner that might permit our intervention.” The Justices further claimed that they were not ruling on the merits or the constitutionality of the law—though it is unconstitutional, according to the protections afforded by Roe—and suggested that the plaintiffs could, in theory, challenge S.B. 8 going forward. In a stinging dissent, Justice Sonia Sotomayor wrote, “Taken together, the act is a breathtaking Act of defiance—of the Constitution, of this Court’s precedents, and of the rights of women seeking abortions throughout Texas.” And what of those women? According to a report in the Texas Tribune, the day before the law went into effect, a clinic in Fort Worth saw more than a hundred women right up to the midnight deadline. The next day, they had to turn away patients who no longer met the new restrictions.
As the challenge to S.B. 8 was working its way through the courts, Republicans in the Texas legislature were busy writing similarly draconian laws to make it harder to vote, especially for people of color. S.B. 1, the bill that inspired Democratic legislators to flee the state earlier this summer in order to deprive their Republican colleagues of a quorum, was finally passed this week, and was sent to Governor Abbott for his signature. Among its provisions, the law requires monthly citizenship checks; entitles partisan poll watchers to move freely within polling sites and makes it a criminal offense to obstruct their observation of election workers; and eliminates twenty-four-hour and drive-through voting. Though the two laws address different domains, they are connected: in Texas and elsewhere in the country, a ligature of racism connects efforts to deny people of color their right to vote and women—disproportionately women of color—their right to terminate a pregnancy.
The Roberts Court’s 2013 decision in Shelby County v. Holder, which gutted key provisions of the Voting Rights Act, enabled Republican legislatures to pass hundreds of laws, such as S.B. 1, in Texas, to make it harder for people—again, particularly people of color—to vote. (The Voting Rights Act was intended to rectify the long history of denying Black Americans all the benefits of citizenship, including the right to cast a ballot.) Well before Shelby, in the nineteen-eighties, Republican strategists, most notably Paul Weyrich, who famously said that “our leverage in the elections quite candidly goes up as the voting populace goes down,” understood that to hold on to power Republicans had to do two things: keep Democrats from voting and find new Republican allies. People of color were a suitable target for their first aim, since they tended to vote, overwhelmingly, for Democrats—hence the various attempts to suppress the vote in the years before Holder, such as gerrymandering and the multitude of laws passed in its wake. Meanwhile, some evangelical Christians, who had largely eschewed politics, turned out to be ripe for conversion when they found themselves unable to obtain tax-exempt status for “segregation academies”—schools that followed what they claimed to be a Biblical mandate to keep the races apart. According to the historian Randall Balmer, in 1979, six years after Roe, Weyrich encouraged Jerry Falwell and other evangelical leaders to seize “on abortion not for moral reasons, but as a rallying-cry to deny President Jimmy Carter a second term . . . because the anti-abortion crusade was more palatable than the religious right’s real motive: protecting segregated schools.”
It is undeniable that there are sincere people with a deeply held belief in the sanctity of life, which, for them, overrides a woman’s right to control her own body, but that is not the motivation of the authors of S.B. 8. If it were, we would see those legislators apply the same standard to gun control, abolition of the death penalty, enforcement of public-health mandates, and a commitment to the social welfare of children, especially children born into poverty. Instead, those legislators appeal to “the right to life” in the same way that they invoke the term “voter fraud”—in order to consolidate their power and pursue an anti-democratic agenda.
President Biden responded to the Supreme Court majority’s decision to abet this ploy by stating that his Administration would be launching “a whole-of-government effort to respond . . . to ensure that women in Texas have access to safe and legal abortions as protected by Roe, and what legal tools we have to insulate women and providers from the impact of Texas’ bizarre scheme of outsourced enforcement to private parties.” Others reacting to the Court’s dereliction have renewed calls to add more Justices and to end the filibuster. There are also calls for Congress to pass the Women’s Health Protection Act in order to create a federal abortion law to override S.B. 8 and other anti-abortion state statutes. Still, though any of these measures has the potential to reinforce the protections codified by Roe, none of them will help the women who are being turned away from clinics now, and they won’t shield their supporters from the bounty hunters who have been authorized to track them down. And, given the glacial pace of congressional “action,” these measures likely won’t prevent other states from passing copycat anti-abortion statutes. (Within twenty-four hours of the law’s going into effect, the president of the Florida state Senate said that he was considering introducing similar legislation.)
By doing nothing to stop S.B. 8, the Court has effectively sanctioned extortion. Days before the Texas law went into effect, an activist on TikTok posted a computer script designed to overwhelm a Web site created by an anti-abortion group to report those who have violated the law; the script allows users to inundate the site with fake claims. How pathetic that a few lines of code may have temporarily offered the most effective way to protect the rights of Texan women.
