The Division Bench of Delhi High Court refused to entertain PIL as a Writ Petition on the same subject was pending before Single Judge
Waqf Welfare Forum v. New Delhi Municipal Council and Others
Writ Petition Civil 2552/2024(PIL)
Before Delhi High Court
Heard by the Division bench of Hon’ble Acting Chief Justice & Hon’ble Madam Justice Manmeet Preetam Singh Arora J
A PIL seeking quashing of public notice inviting objections and suggestions from the General Public for removal of Sunehri Bagh Masjid was dismissed on 21.02.2024.
As a writ petition 16770/2023 on the same subject is already pending before the Single Judge of Delhi High Court and in response to the prayer Delhi Waqf Board has already steps to protect the Waqf Properties.
Facts
public notice.
The Delhi High Court refused to entertain a PIL against the proposed demolition of Sunehri Bagh Mosque as a similar petition is already pending before a single judge of the Delhi High Court.
The bench questioned the petitioner for filing the PIL with similar prayers even when one petition on the same issue is already pending before the single judge.
The Bench observed that "Since appropriate measures have already been taken by the Delhi Waqf Board in discharge of its legal and executive duties to protect waqf properties, this court is of the view that no order is required in the present writ petition. Accordingly, the petition is closed,".
Submission of the Counsel for the Petitioner
Directions to the Delhi Waqf Board to discharge legal and executive duties to protect Waqf properties as per The Waqf Act, 1995 and Waqf (Amendment) Act, 2013.
Submission of the Centre, New Delhi Municipal Council, Delhi Police
The petition is more of a cut and paste work of the contentions and submissions advanced in the W.P.(C) 16770/2023 pending before the single judge filed by the Imam of Sunehri Bagh Masjid.
Submission of the Delhi Waqf Board
Senior Advocate Sanjoy Ghose, representing the Delhi Waqf Board, informed the court that appropriate steps have been taken to protect waqf properties and the Delhi Waqf Board is supporting the plea of the Imam.
He also informed the Court that the matter before Single judge was listed for the day but due to the pendency of this PIL, hearing before the single judge is adjourned to February 28.

It started innocently enough. During the reign of the later Mughals, court nobles acquired a fair amount of clout and built many grand structures and tombs for themselves. Eg: Safdarjung’s Tomb. During the reign of Muhammad Shah, one such grandee named Roshan-ud-Daula Zafar Khan built a mosque in Chandni Chowk and had its domes and peaks covered in gilt so it would live up to its pretty name, Sunehri Masjid. But less than two decades later, this venue became the sight of a rather grim vigil. By 1739, Persian invader Nader Shah had made inroads into Delhi but the natives were not about to acquiesce to his rule as quietly as Mughal royalty had. They attacked and killed Persian soldiers in the streets and when news of this reached Nader Shah, he ordered a wholesale massacre of Delhi’s citizens, while he watched from the roof of the Sunehri Masjid. In his book, The Sword of Persia: Nader Shah, from Tribal Warrior to Conquering Tyrant, Michael Axworthy describes the scene: “He went to the roof of the mosque and stood by the golden domes, looking out over the houses, shops and roof of the Chandni Chowk district. He ordered that no one should be left alive in any part where any of his soldiers had been killed, and then drew his sword as a signal that the massacre should begin.” Sarmaya

Pakistan mosque opens doors to women after 23 years
Peshawar's historic Sunehri Masjid has opened its doors to female worshippers for the first time since 1996, a move warmly welcomed by women of the city. Nearly 15-20 women offered prayers on Friday after the administration of the mosque, located on main Saddar road in Cantonment area, announced the move, reports Dawn news. Mosque officials said women will also be allowed during Eid prayers. The mosque's imam, Muhammad Ismail, said the decision, which comes days ahead of International Women's Day observed on March 8, was taken to facilitate women living in Saddar and other areas. "Before 1996, women were allowed to attend Friday prayer congregations in the upper portion of the mosque," he recalled, adding that in 1996, females were barred from praying in the mosque due to growing militancy. "Now we have opened the upper portion again so that women can offer Friday prayers alongside males in a separate section and listen to Friday 'khutba' (sermon)," Ismail said. A women who attended the prayers at the mosque on Friday along with her daughters, told Dawn news: "I am really happy, and this is a really good decision." She said the facility should be available to women for daily prayers as well. Read the full article
