📡▶ *1000 Network #Broadcastlaw1KN Another Modernization of Media Proposal – Eliminate the Need for Posting Station Licenses at Broadcast Station Control Point🔌💻We wrote last week about one broadcast issue to be considered at the FCC’s May 10 meeting, amending the procedures for resolving complaints about interference by new FM translators to other existing FM stations. At that same meeting, the FCC is planning to adopt another item in its Modernization of Media Regulation Initiative – a Notice of Proposed Rulemaking (see a draft of that item here) to eliminate the FCC rules that require broadcast stations to post physical copies of their license (and other instruments of authorization such as STAs or renewals), or to keep physical copies of these documents in a binder, at their control point. The FCC also asks whether translator operators should continue to have to post information at their transmitter sites as to the name, address and telephone number of the licensee and where station records are maintained. Given that all of this information is in the FCC’s database and accessible to anyone with Internet access (and as the licenses posted at the control point are not even accessible to the public), the draft NPRM, if adopted at the May 10 meeting, would propose to eliminate these rules. 🌐 #FCC Adopts New Rules on FM Translator Interference – With Some Changes🌐 At its open meeting yesterday, the FCC largely adopted the draft order on changes to its processes for resolving complaints about interference from FM translators to existing FM stations. Its final Report and Order adopting the new rules was released after the meeting yesterday. The general guidelines that we detailed in our summary of the draft order were adopted – so that complaints will generally be considered only when they are from within a primary station’s 45 dBu contour (with a potential for consideration of complaints from outside that contour through a waiver process, where the complaining station shows that there is a significant pocket of listeners outside that contour), and only when a threshold number of bona fide listener complaints have been filed.  When a sufficient number of complaints have been filed, the FCC will ask the operator of the translator to either resolve all complaints by resolving the interference complaints of each of the complaining listeners or by working with the operator of the pre-existing station. If no resolution can be worked out, the parties to the dispute are to engage a third party consulting engineer. FCC will make the final determination whether the interference has been resolved based on information provided by the third-party engineer. Do Research. #BroadcastLAW1KN #LPFM The #FCC is currently not accepting applications for new LPFM stations.   (A different type of low-powered FM radio service is currently available for applications in Alaska)   At this time, the Commission is faced with various priorities including revitalziation of the AM broadcast band which includes the ability for AM stations to operate FM translator (relay) stations.  The earliest that a window for new LPFM stations could take place is in 2021 (but more likely 2023).  This is only speculation but REC will be working to get another LPFM window sometime in our lifetime. #LowPowerFM (LPFM) is radio that within reach of many community organizations, local artists, churches, ministries, schools and government organizations. This follows a set of notices sent in early December, where the FCC first warned specific stations that there were issues with their online public inspection files (see our article here). The new email notices seem to be sent to two classes of stations – those that have done nothing to their online public files, and those that have activated the files, but not uploaded their Quarterly Issues/Programs Lists to those files. Some of the new notices follow up on notices sent in December. The current royalties (see our initial article on the decision setting current royalties here, and one that provided more details here) expire at the end of 2020. A proceeding to establish the rates for 2021-2025 is a two-year long process, and would normally begin with a request from the CRB for interested parties to file petitions to participate about now. But, even though the CRB itself is not closed because of the partial government shutdown, according to a notice on the CRB website, the Federal Register (in which the notice soliciting petitions to participate would be published) is only accepting notices relating to public safety and welfare – and the CRB proceeding apparently does not fit in those criteria. So the start of the case will be delayed by this government shutdown until the Federal Register publication can be accomplished." But rarely is there a discussion of the music royalty impact of transitioning radio listeners to these digital platforms. Hatch–Bob Goodlatte Music Modernization Act’’ became law. The law underwent a few changes on its journey to approval, adding new provisions in the Senate to those which we summarized here upon its initial passage by the House. The Act retained its same principal purposes. The driving force behind the Act was the desire to simplify the payment of “mechanical royalties” by digital music services for the reproduction and distribution of the millions of musical compositions that they use in the songs that they serve up to more and more consumers across the country.
