A whole new Federation fleet

A while ago, I fed an online neural network a bunch of Federation starship classes and got a bunch of extremely excellent new ones. Quite frankly, after Wolf 359 and the Dominion War, I figured Starfleet could really use some new ships to fill out the ranks again, so I went back and gave the neural net some existing starship names. Video game ad collection (V.1)

More than 10,000 flyers and paper ads from (almost) all around the world.

Featuring Takeshi Kitano, Isaac Asimov, Tamori and Takahashi Meijin. When I asked on Twitter if there was a website similar to the now defunct Game Chirashi Collection (which collected Japanese flyers for console games), I didn't get a positive answer. Of course, there are websites which have some scans of flyers or paper ads, but nothing as huge as GCC. Since I have saved most of its content (with the notable exception of the Nintendo section) but have neither the time nor the will to make a dedicated website, I decided to upload what I have so you can download these scans, spread them or make your own websiste, because it's part of video game history and I don't want these files to be lost. UK Patent Law Primer: Reading through Judge Stone’s New Opinion

Geofabrics Ltd. v. Fiberweb Geosynthetic Ltd. [2020] EWHC 444 (Pat) [[2020] EWHC 444]

In the UK, Geofabrics just won a judgment of infringement against Fiberweb for its European Patent No. 2 430 238.  The parallel U.S. Patent 8,978,995 has not yet been enforced.  I thought I would walk through the decision looking at how UK Judge Mr. David Stone handled issues and their parallel US comparison.

The invention here is a fairly expensive multi-layer geo-liner for a railway. The layered product includes two support layers sandwiching a filtration layer — this filtration is the key to the invention.  The filtration layer is “normally impermeable to water” but allows water to pass upward through the layer when under high pressure (rail car).  The inventors called it a filtration layer because it only allows water to pass through and leaves behind silt and clay-fines in order to avoid erosion.

The defense offered several reasons for denying the infringement: lack of novelty, obviousness, and insufficiency of the claims and disclosure.

Novelty: The UK novelty law is substantially parallel to that of the U.S., although with a somewhat heightened enablement requirement. In a 1972 opinion, Lord Justice Sachs provided the following metaphor to the law of (land) discovery:

To anticipate the patentee’s claim the prior publication must contain clear and unmistakable directions to do what the patentee claims to have invented … A signpost, however clear, upon the road to the patentee’s invention will not suffice. The prior inventor must be clearly shown to have planted his flag at the precise destination before the patentees.

General Tire & Rubber Co v Firestone Tyre & Rubber Co Limited [1972] RPC 457.  More recently, UK courts have noted that an anticipatory references must both disclose the claimed invention as and also “enable the ordinary skilled person to perform it.” Synthon BV v SmithKline Beecham plc [2006] RPC 10 (Lord Hoffman).

In the present case, the Judge Stone found that multi-layer fabric in the prior art lacked the precise permeability spectrum claimed in the invention.

Obviousness in the UK similarly parallels the U.S. law’s Graham analysis:

(1) (a) Identify the notional [skilled addressee]; (b) Identify the relevant common general knowledge of that person;

(2) Identify the inventive concept of the claim in question or if that cannot readily be done, construe it;

(3) Identify what, if any, differences exist between the matter cited as forming part of the “state of the art” and the inventive concept of the claim or the claim as construed;

(4) Viewed without any knowledge of the alleged invention as claimed, do those differences constitute steps which would have been obvious to the person skilled in the art or do they require any degree of invention?”

Pozzoli SpA v BDMO SA [2007] EWCA Civ 558 (Jacob LJ).  The UK statute itself is simple asking is the invention “obvious to a person skilled in the art, having regard to any matter which forms part of the state of the art.” The Patents Act 1977 (as amended).  Note here that the UK statute limits obviousness analysis only to publicly-available prior art while secret prior art (such as prior filed applications) are available only for novelty analysis.

The case here focused also on two sub elements:

Obvious to try: There must be at least a reasonable expectation of success of a combination.

Long-felt want: Something often pleaded but rarely with success.  However, it can turn “apparent technical obviousness” into a judgment of non-obviousness.

In his opinion, Judge Stone again sided with the patentee — finding that although the prior art addressed under-track erosion using a barrier — it’s solution was quite different in practice.

[I]t is by no means clear to me that a skilled addressee equipped with the CGK [Common General Knowledge] would:

(a) replace an impermeable membrane with a permeable one; (b) introduce a filtering element when none is hinted at in Jay; and (c) choose a geomembrane that operated under the load of a train – that is, it would allow water to pass up through it (whilst being filtered) only under the pressure of the load of a train, and not under the pressure of the tracks and ballast in the absence of a train.

In my judgment, the Patent is not obvious over Jay.

Insufficiency: The court examined three defenses under the umbrella of “insufficiency”: Uncertainty (sometimes called ambiguity); Classical insufficiency/lack of enablement; and Lack of plausibility.  The statute provides that the specification must “disclose the invention clearly enough and completely enough for it to be performed by a [skilled addressee]”.  72(1)(c) of the Patents Act 1977.

Insufficiency – Uncertainty is basically the same as claim indefiniteness in the U.S. — requiring undue effort to understand the scope of the claims. Here, the court found that the claim requirement of being “normally impermeable” was not unduly uncertain.

Classical Insufficiency is parallel to enablement in US law — the specification must enable a person killed in the art to perform the invention without undue burden.  Here, the court found that some testing was necessary to create the claimed permeability profile, but that testing was “not unduly burdensome.”

Insufficiency – Plausibility: In the UK, the plausibility doctrine has some flavors of US utility doctrine.  Normally, plausibility will be assumed. However, courts have raised suspicion in situations where an inventor could easily file many patents based upon pure speculation of success.  One example of this might be a new medical use of a known drug (“second medical use claim”).  In that situation, the UK Courts require “some disclosure as to how or why the known product can be expected to work in the new application.”  In rejecting this defense, the court noted that a patent for a new product (as here) is “almost always” plausible.

Infringement: The court found infringement both literally and as equivalence.  For equivalence – the court applies a result-way test: “Substantially the same result in substantially the same way.” Actavis UK Ltd v Eli Lilly and Co [2017] UKSC 48 (Lord Kitchin JSC). Equivalence can be negated based upon evidence that patentee “intended that strict compliance with the literal meaning . . . was an essential requirement of the invention.” Id.  In this case, the question of what “normally” impermeable meant. The court found that the accused product fit that term or was at least the equivalent.  The basic argument on the other side was that the layer might be permeable under the weight of flood-water and in some parts of the UK floods regularly occur.

In the end, the court upheld the patent and found it infringed. The next steps in the case will be to consider remedies. The patentee has requested damages as well as injunctive relief.

  ANELLO VERDE, IL FESTIVAL INTERNAZIONALE DELL’AMBIENTE E DELLA SOSTENIBILITA’.    UN SECONDO GIORNO TUTTO GREEN PER CELEBRARE LA GIORNATA MONDIALE DELL’ACQUA CON GIOVANI PER L’AMBIENTE AL MATTINO INSIEME ALLE SCUOLE DEL TERRITORIO E UN TALK SHOW PER TRATTARE TEMATICHE IMPORTANTI.  TRA LE NOVITA’ : UN VIDEOGIOCO CHE HA COME PROTAGONISTA L’AMBIENTE. 

La terza edizione di Anello Verde, il Festival Internazionale  dell’Ambiente e della Sostenibilità  si  sta svolgerà dal 21 al 24 marzo 2019 a Finale Ligure (SV) con il contributo del Comune di Finale Ligure e con il sostegno degli sponsor Ecomission, produttore di ciclomotori e mezzi elettrici, affiancato da Riambientiamoci, format dedicato al tema ambientale;  Eco Tecnologie, produttore di stoviglie compostabili biodegradabili e Naturdet suo distributore di area, che propone anche un’ampia gamma di detersivi a basso impatto ambientale; Docks Lanterna spa leader in campo ambientale, specializzata nella gestione di servizi di igiene urbana. Anello Verde ha anche un contributo dell’ Unione Albergatori di Savona e soprattutto numerosi Patrocini tra cui figurano la Regione Liguria, la Provincia di Savona, l’Università di Genova, il Campus di Savona che ha anche collaborato con molti docenti, l’Ufficio Scolastico Regionale, l’istituto Italiano di Tecnologia, Save the Planet,  l’Istituto Tethys,  Fondazione Cima, L’ENPA, il WWF, il FIDAL La Camera di Commercio delle Riviere, l’Unione Industriali di Savona,  il Parco del Beigua, l’ Area Marina Protetta di Bergeggi e molti  Comuni liguri e non. Tra le new entry di quest’anno il Comune di Varazze, di Bormida e di Rezzo.

Anello Verde è nato dall’idea e dal progetto di Tiziana Voarino, è a cura del brand associativo  Risorse Progetti & Valorizzazione. Spiega Tiziana Voarino che si occupa della direzione “l’anello è una forma che simboleggia il collegamento, l’unione, l’essere completo, la circolarità, il “link”, crea reti di collaborazioni con lo scopo di interagire e massimizzare i risultati.  Quest’anno, Anello Verde si è ulteriormente ampliato, ha acquisito la titolarità di internazionale, ha creato un anello di collaborazione con oltre centodieci realtà  strettamente connesse alle tematiche di cui si occupa il Festival. Tra le principali nuove interazione vanta quella di Save the Planet che sarà presente al Festival.   Il programma di Anello verde è stato principalmente pensato per rendere protagoniste di un confronto produttivo le molte realtà che operano nei settori  di cui si occupa Il Festival a tutti i livelli, da locale a internazionale e far conoscere meglio le eccellenze del settore Green e Smart per dimostrare che la differenza si può fare.I settori di riferimento sono otto: Natura e Ambiente / Territorio e Valorizzazione / Innovazione e Tecnologia / Costruzioni e Smart city/ Outdoor e Sport / Alimentazione / Salute e Benessere / Sostenibilità e Ottimizzazione.

Venerdì  22 marzo, alle ore 10,  nell’ Auditorium un appuntamento dedicato ai ragazzi delle scuole dal titolo Giovani per l’Ambiente, dedicherà attenzione a celebrare il giorno stesso della Giornata Mondiale dell’ Acqua e a far loro conoscere gli obiettivi dell’Agenda per lo Sviluppo Sostenibile del 2030 e   alle ore 21, sarà la volta, al salone a Mare Boncardo di un talkshow tutto green con la partecipazione di importanti protagonisti dei settori trattati PER raccontare le loro attività, progetti, libri. Tra essi Sabina Airoldi, responsabile delle ricerche dell’Istituto Tethys nel Santuario Pelagos che illustrerà i tentatré anni di studio dei cetacei e della conservazione marina e il recentissimo traguardo raggiunto del Protocollo d’intesa che  vedrà collaborare nell’ambito della ricerca scientifica e della divulgazione ai fini della tutela del mare Il Corpo delle Capitanerie di porto – Guardia Costiera e l’Istituto Tethys ONLUS. L’appuntamento sarà presentato dal giornalista Alberto Sgarlato. Interverranno anche l’Ing. Loredana Magistri dell’Università degli studi di  Genova per quello che riguarda l’energie alternative, i sindaci di Bormida e di Rezzo a raccontarci le loro eccellenze ,Adriana Santonocito di Orange Fiber eccellenza nazionale per l’economia circolare, il titola re di Eco Tecnologie, Green’s app a illustrarci la loro attività innovativa, il portavoce del presidente di Confassociazioni  Prof. Enrico Molinari Martinelli con il suo” Non abbiamo un Planet B” e Linda Nano.

Tiziana Voarno tratterà il tema valorizzazione del territorio mediante le opere letterarie, i libri e la cultura con il libro “Varigotti Club, ultima spiaggia” riscritto su manoscritto lasciato inedito da Bruno Astori inventore del Festival del Doppiaggio Voci nell’ Ombra ed autore anche di Hotel Boncardo.   Tra i protagonisti il giornalista Marco Vallarino che illustrerà il suo libro “il Cuore sul Muro” con tema anche la Street Art. Mentre durante l’appuntamento con le scuole incentiverà i ragazzi ad avvicinarsi alle tematiche green facendoli giocare con un videogioco che ha come attore principale L’Ambiente e le sue esigenze.

Per Giovani per l’ambiente interventi della laureanda in ingegneria Adele Taramasso, interventi coordinati dalla Prof. Carla Minetti dei ragazzi del Liceo Issel di Finale, del Liceo Scientifico Grassi di Savona, di Giovani per la scienza capitanati da Simone Vallarino. Un occhio sul futuro con i temi trattati da Leonardo Parigi con il suo Osservatorio dell’ artico, la Scuola di Robotica con   per il Mare in 3 D, da   Paolo Bernat e Andrea Molinari,  dell’Osservatorio di pesca Ambientale e di Forum Italiano per i movimenti dell’ acqua con Roberto Melone e Walter Procopio dell’ Università di Genova, con un intervento orientativo collegato al Campus di Savona per le professioni e gli studi “green”.

Sabato 23 e domenica 24, presso l’Oratorio De’ Disciplinanti, a Finalborgo, si potrà visitare Green Attitude: presentazione del neo nato Centro di Educazione Ambientale  Finale Natura con immagini ed esposizioni di artisti.

Il clou sarà la Serata d’Onore con la consegna dei riconoscimenti “Anelli Verdi” alle eccellenze green e smart, nell’accezione che lo vede spesso affiancato a city, quindi intelligente. Saranno consegnati sabato 23 marzo, alle ore 21, presso l’Auditorium nei Chiostri di Santa Caterina a Finalborgo, una location suggestiva che fa immergere nella cultura e nella storia di uno dei Borghi più belli d’Italia.  Una serata di gran spettacolo che prevede anche la proiezione di  immagini che lasceranno a bocca aperta. Sarà un galà di ribalta per chi riceverà i diciotto premi, Anelli Verdi alle eccellenze green e smart per gli otto settori di cui si occupa il Festival.  Sarà consegnato anche un Anello Rosa alla solidarietà e sostegno femminili. La conduzione  altamente competente di Emanuele Biggi, co-conduttore con Sveva Sagramola di Geo su Rai 3 chiuderà l’ “anello di qualità” che caratterizza l’intero evento.

  Intanto è già partita a inizio mese la campagna Plastic Free Tribe per aggregare, con la raccolta della plastica prevista per la mattina del 24 marzo, in tutti i comuni della Liguria e oltre che aderiranno, cittadini, associazioni, giovani, studenti e operatori. Il modulo di adesione è sul sito del Festival www.anelloverde.it, ed è di facilissima compilazione con invio immediato.  Potranno aderire anche artisti che realizzeranno con il materiale raccolto delle opere d’arte, capolavori di riciclo.

Plastic Free Tribe sarà accompagnato dall’omonimo Contest fotografico che prevede come premi due  supporti fotografici  messi in palio dal network ed e-shop Onnik.it, composto da oltre trenta siti dedicati alla fotografia professionale, con strumenti, accessori e materiali utili ai fotografi di ogni livello.  

Il Festival si concluderà domenica 24 alle ore 17, con il concerto del Duo Luca Lucini e Matteo Faloni in collaborazione con Società dei concerti di Finale Ligure per Anello Verde in Musica, la musica che unisce.
