A Fairytale

Thorns Have Roses

Once upon a time, in a far off land, there was a small village a half-day’s ride from an elaborate castle. They were simple people, those who lived in the village, and most worked land owned by the nobles in the castle. The rest were engaged in the usual forms of peasant labor-- forestry, carpentry, and the like. 

It mattered very little to the villagers what the nobles did--tithe and tax came due regardless what the gentlefolk got up to--so no one paid much mind when the lord and lady went off to their city house and left the young lordling in charge. He was the same breed of impatient, entitled, and cruel as his father, but the steward who dealt with the village had a soft voice and a kind hand, so no one much paid attention to the lordling’s temper tantrums. 

And then, the spring tax came due, and no one came to collect it. 

It is at this point, children, that we must take a moment to name our cast of characters. The young Lordling was named Idris by his parents, but in their absence was only ever addressed as My Lord, to the point that it may as well have become his name. The steward is called Dai, though his wife, Mair, generally referred to as Mrs. Taylor, is the one actually in the story. She will be the voice of hope in the story when things grow dark. The gardner, like the steward, will appear in mentions, but only as Da, from his son Gwyn, who will carry the bulk of the tale from the castle’s side. He’s a bright young thing, and he loves deeply and totally, but unlike his Da, has little gift for plants. This will be important.

In the village, the important players are few: Rhosyn, of course, will be the most important. Every story needs a hero, and Rhosyn will be ours, though there is nothing in her to suggest any likeness to the great heroes of old. She is soft-spoken, gentle, kind. But you must remember, children, that kindness in a cold world is the bravest act of all. Perhaps more important to note, Rhosyn keeps a garden behind her father’s house, and sells flowers to supplement their family’s income. Her mother is dead, because this is a fairy tale and the mother is always dead, and her sisters have all already married men of the village. Rhosyn’s father, Rhys, will actually be the one to kick-start this little drama, and Rhosyn’s neighbor, childhood friend, and, should you ask the little old ladies of the village, potential love interest, Ioan will be the one to end it, quite inadvertently. 

Our story begins, truly, in the castle on the hill, in the month of February. Spring taxes will not be due for another two months, and My Lord was, as per usual, paying little attention to the upkeep of his ancestral lands, and all attention to the imaginary tournament he was having against his shadow on the sprawling lawn between the great gates and the road. His sword was in his hand, and he had a beastly temper, but for the sake of our story and the woman on the road, he did not truly understand what it means to take a life, so when the woman on the road plucked a rose from the massive bush that sprawled over the fence to the road, My Lord sent her tumbling to the ground with his fist, not his blade. He roared down at her pointless words meant to indicate his power over her, his ownership of all around, and his rage at being thusly violated. 

The woman looked up at My Lord, and in her eyes it was clear he had no power over her, and lightning seared through the cloudless sky.

My Lord stumbled back as though struck suddenly with dizziness. “What did you do?” he demanded. “What did you do?”

The woman got up, very carefully. There was no mark on her face; indeed, she appeared as though he had never struck her at all. “If you love your bush so much, sire,” she said very slowly, “Then I tie you to it for eternity.” She sneered at him; she should have been beautiful, but the disdain turned her face ugly. “Until you find it in your hollow chest to be truly selfless, you and all you deem yours will be tied to the fate of that bush.” And then she was gone, quite entirely, leaving My Lord to grapple with that particular announcement on his own. 

The village was perhaps lucky that My Lord had a small mind, and rarely considered anything beyond what was in front of him at any moment, but the village escaped the curse, almost certainly because My Lord cared for little but his own affairs. When tax collection came and went without any actual collection, the village cast a few skeptical glances uphill, but quietly counted their blessings and moved on with the harvest. When summer tithe passed without note, the village argued about sending a message, and decided not to, though most kept the money they owed their landowner squirreled away, for when the devil finally came calling. When the fall tax passed without sign of the steward, they met again, decided again to do nothing, and parted ways, outwardly steady, but mostly rejoicing. And it surprised no one when Ioan muttered ‘good riddance’ under his breath as the meeting broke up. 

Rhosyn’s neighbor and friend was the man of his household, as his father had died in the fields the summer before Ioan and Rhosyn turned nine. A debt after a bad harvest had worked the man to death. There was no love lost between Ioan and My Lord, though My Lord had no idea Ioan existed, let alone considered himself his archnemesis. This fact would only have made Ioan more angry, so no one brought it up. 

So life in the village went on. Rhosyn’s father went to the woods each morning to gather fuel for the forge in the smithy, and spent his afternoons keeping the village in tools and horseshoes. Rhosyn tended the garden, sold her flowers, and pitched in wherever her help was needed, with laundry, with baking, with child-minding. 

All that said, the story does not actually become particularly interesting until December. And it happens by chance that Rhys’ search for woodfall took him further up the hill than normal on the same day that Mrs. Taylor, Gwyn, and two young men from the castle guard had ventured down the hill a ways to draw water from a place in the river less perilously iced over than the crossing nearest the castle. 

As they passed on the road, Mrs. Taylor said a polite good morning to Rhys, who replied with a distracted good day and carried on. However, when he was out of earshot, Mrs. Taylor turned immediately on Gwyn and demanded, “Did you see that?”

Gwyn, who had been watching his feet on the icy path, said, alarmed, “What, what?”

“His flower!” Mrs. Taylor hissed.

Gwyn blinked. Because now that she had said it, he had seen the vibrant pink flower pinned to the man’s lapel. A flower, in beautiful bloom, in December. It was, if your life were as Mrs. Taylor and Gwyn’s lives had become, a miracle.

“Go, go, follow him! Quick, boy!” Mrs. Taylor demanded.

Gwyn, the youngest of the group, and also the fittest--the two guards looked, if anyone were honest, a tad grey in the face, but no one wanted to mention it--of them, scrambled to obey, setting off at a brisk trot in the direction the man had gone.

Gwyn followed Rhys all morning, trying to stay out of notice, but he wasn’t very good at it. Rhys had noticed him almost immediately, but, for pity and amusement, said nothing till they were almost back to the village. “Well?” he asked, stepping out from behind the tree he’d hidden behind till Gwyn caught up.

“Oh,” Gwyn said, ducking his head. “I’m sorry, I just.” He swallowed nervously. “I can’t- I- where did you get that flower?” he finally blurted.

Rhys hadn’t been sure what to expect from the shivering and wet lad stammering in front of him, but it certainly hadn’t been that. “What?”

Gwyn closed his eyes very tightly for a long moment. “Your flower,” he repeated, eyes still closed. “Where did you get it?”

Baffled, Rhys told the truth, as one should, and in this case, it paid off, though not immediately. “My daughter grows them.”

Gwyn opened his eyes and looked pleadingly at the man before him. “May I meet her, sir? It’s terribly important.”

Rhosyn was not the only person in the world who thought flowers were important, Rhys reflected as he led the young man through the village; good. More people should value beauty over utility, and certainly over money, he thought. 

“I’m Gwyn,” Gwyn added after a moment. 

“Rhys,” the man answered, leading the way through a small garden gate beside a house. “And my daughter, Rhosyn. Cariad, this is Gwyn. He asked about your flower.” He tapped the bloom pinned to his collar.

Rhosyn smiled. “Hallo,” she said. “It’s a hellebore. They bloom in midwinter.”

Gwyn bit his lip. “What about Roses?”

Rhosyn tipped her head curiously. “What about them?”

“Are you any good with roses?”

Rhosyn beckoned Gwyn across the yard. “They’re dormant right now, but it’s almost time to prune them again,” she explained. She carefully folded back part of the cloth she had covering the bushes. “They’re not really winter plants.”

“But if a bush was dying, could you save it?” Gwyn pressed.

Rhosyn frowned. “It would probably depend on why it was dying. But maybe.” She put a gentle hand on Gwyn’s shoulder. “What’s the matter?”

“The rosebush is dying,” Gwyn said softly. “We’re cursed, you see,” he explained finally. “My Lord, I work up at the castle, and My Lord, he, well, it was awful, but she cursed us, said our fates would be tied to the rosebush, and now the bush is dying. My Da was trying his hardest, but he’s an arborist, not a real gardner, but he was all we had. And then he got sick too.”

“Wait,” Rhosyn said gently. “Sick too?”

Gwyn nodded. “We’ve all been getting sick. First the steward, then the marshal and the chamberlain, and then my Da. Pretty soon there won’t be many of us left.” Gwyn shrugged helplessly. “Everything was fine for a while, but then the rosebush started getting spots, and then we started getting sick.”

“Spots?” Rhosyn asked.

Gwyn nodded. “Dark spots, and the leaves went lighter around them, and then started falling off.”

Rhosyn nodded. “Black spot. Pretty bad.”

“Can you tell me how to fix it?”

Rhosyn pressed her mouth together. “No,” she said slowly.

Gwyn drooped, but nodded, like he’d expected it. 

“But I can come and see if I can help.” Rhosyn said.

Rhys snapped, “No. I forbid it!” 

“Tad,” Rhosyn pleaded.

“No,” Rhys said. “And that’s final.”

Gwyn seemed to be biting his tongue against words, but he bowed his head, said “Thank you sir, miss,” and showed himself out of the garden. 

He was not so collected on the long walk back to the castle, but stress, disappointment, and fear will overcome anyone, and a wise man, even one so young as Gwyn, finds no shame in tears. Gwyn’s cheeks were still wet when he entered the castle, but he’d composed his report for Mrs. Taylor on his walk, and he’d found the bright side. 

“I know what it’s called now,” he told her. “Black spot. I can see if there’s anything in the library, at least.”

Mrs. Taylor patted his face kindly. “Good work, dearie,” she said warmly. “We’ll be all right, you’ll see.”

She was right, of course, but Gwyn had no way to know that, and didn’t have the faith to believe her. 

Rhosyn, meanwhile, was following in the footsteps of any number of heroes before her, who had been forbidden to do a thing by a trusted and loved authority figure, and proceeded to decide, in the comfort of her rightness and the solitude of her own mind, to do the thing anyway, obstacles be damned. 

She knew her father would never come around, and while her instinct, honed by years of friendship and mischief, was to find Ioan for help, she knew her friend well enough to know that the plight of the servants in the castle would not overbear his distaste for My Lord nearly enough to make him a useful companion. Also, he had the blackest thumb of anyone she’d ever met, and many of her seedlings had died under his care. 

So it was that Rhosyn waited until her father was deeply engrossed in his forge, wrapped a traveling cloak around her shoulders, and started her journey uphill. It was late in the day, and even her brisk walk could not cover the distance to the castle in anything short of the usual time, and so it was quite dark by the time Rhosyn arrived, and she was quite hungry. 

Like all young people--and old ones too, though they are less likely to admit it--Rhosyn was, though sweet-tempered and lovely when easy and well-fed, much akin to an ogre, or a bear with a sore paw, or some other such grumpy metaphor, when tired or hungry, and in this moment she was both. 

This is just to say that the first meeting between Rhosyn and My Lord was not exactly auspicious. My Lord said several words that you should never repeat where your grown ups can hear them, and Rhosyn informed My Lord that he was both self-absorbed and vacuous, meaning, she informed him, snidely confident he did not know the word, that the space between his ears was a vacuum, lacking in any substance at all.

Mrs. Taylor managed to avert disaster by sweeping Rhosyn off to the servants’ wing for a late dinner and to find her a room, and Gwyn stepped in to explain to My Lord why the girl was there at all, since that particular fact had not come up during their impromptu shouting match. 

“Fine,” My Lord snarled, shoving Gwyn out of his path as he stormed back towards the suite of rooms that was his. “Just keep her out of my way!”

Gwyn bounced off the doorframe, steadied himself, and left the entryway without replying, fully aware his master expected obedience regardless of Gwyn’s feelings on the subject. However, in this case, he was more than willing to exert his considerable skills in Staying Out Of The Way to keep Rhosyn, who he felt was much too good to be in what he considered an awful place, as far away from My Lord as he could, because he wasn’t sure the castle would survive them coming together a second time.

Morning dawned, as mornings do whether anyone is ready to face them or not, and this one was particularly cold and clear. Rhosyn joined the servants for a hasty breakfast, and was somewhat startled by the small number of people moving about. Gwyn beckoned her to join him, and waved around the small gathering. “You met Mrs. Taylor--she’s the housekeeper. Carys was in the scullery, but she does all the cooking now that the cook is down.” He waved at a warm-eyed, round-faced girl in her mid-teens; Carys waved back. Gwyn gestured to the two ashen soldiers on Mrs. Taylor’s other side. “Sion and Tref are all that’s left of the garrison, and they mostly help with fetching and carrying, and taking care of the horses. Tegan’s the last of the laundresses left, and Tomos was the butler’s apprentice.” The last two were clearly brother and sister, and both had spots of high color in pale cheeks, but smiled warmly for Rhosyn. 

A castle like this should have had a staff of over a hundred people. Indeed, this particular castle had a staff of 147, including the cavalry garrison but not counting My Lord or his parents. However, 140 of them were sleeping so deeply they might have been in comas, had the still-conscious denizens of the castle known that word, so the servants’ kitchen was quiet that morning, and quieter still than even eight people ought to have been, since four of them were obviously ill, and trying to hide it.

“Can you save the rose, miss?” Tegan asked.

Rhosyn examined the people around her. Only Mrs. Taylor had any kind of cheer in her face; the others looked like they were bracing themselves for bad news, and Rhosyn hated it. She hated their brave faces, their hopeless eyes, their rueful, accepting mouths, and the casual slant of Gwyn’s shoulders that said clearly that he appreciated her effort, but didn’t dare expect anything. There is nothing more terrible than people who cared about each other trying to be brave for the sake of the others. “I’m damn well going to try,” she answered, standing determinedly. “Take me to it.”

Gwyn bounded to his feet. “What do you need?”

“Milk,” Rhosyn said. “For sure. And soil, straw, burlap.”

“Gwyn, take Rhosyn to the shed. I’ll follow along with the milk. Tref, dear, go lay down. You look awful,” Mrs. Taylor ordered.

“Ma’am,” Tref said softly. His voice was a husky rasp. Sion helped him out of his chair, and they stumbled off, leaning on each other.

Rhosyn gritted her teeth and followed Gwyn.

They detoured through the garden shed, and Rhosyn confronted the bush with a bucket of soil in one hand and pile of burlap and a rake gathered awkwardly to her chest with the other, Gwyn trailing after her with a pile of straw. Rhosyn lay her materials down and bent to examine the bush closely. 

Then she resolutely began stripping any of the remaining leaves that had spots on them, and casting them behind her. That brief task done, she used the rake to clear all of the fallen leaves, brush, and other debris that had gathered around the base of the rosebush. 

“Can I help?” Gwyn asked after a moment.

“Take the leaves I pulled off and everything that I’ve raked off and burn it,” Rhosyn replied. “And bring a lot more soil when you come back.”

Gwyn saluted and obeyed. 

When he returned with the wheelbarrow of soil, Rhosyn and Mrs. Taylor were coating the bush in milk. 

“Perfect,” Rhosyn said. Then they mounded soil over the base of the bush, all but burying it, heaped straw over the mound of soil, and then wrapped the whole bush in burlap. “It really should have been wintered like this all winter, but it’ll be okay, I think. It’s a strong bush. Well established roots, good soil.” She spared a look around the rest of the grounds. “You didn’t have a chance to winter any of the plants, did you?” she asked Gwyn. 

He shook his head.

Rhosyn smiled at him, and took his arm. “Let’s do that, then. Keep our hands busy.”

And so for the next five days, Rhosyn and Gwyn tended to the trees that had been his Da’s pride and joy, and the garden that sprawled between them. Gwyn listened to Rhosyn as she talked about plants, about her family, about the village, and about the places she longed to go. Gwyn, in return, told her about his family, the little village across the mountains where he’d been born which he scarcely remembered, those of the staff she’d had no chance to meet, and, quietly, desperately, brokenly, about his desire for another kind of master, one worth serving. 

In return, Rhosyn told him about how Ioan had declared himself My Lord’s archnemesis, and Gwyn laughed for the first time since Rhosyn had known him. He looked, suddenly, much younger, and Rhosyn realized that he was probably closer in age to Carys than to her, and her heart broke a little, once again, that so much had been put on him. It was the same clench in her heart from three mornings before, when Sion and Tref had both failed to come down to breakfast, from the day before when Tomos had collapsed in the entryway and had to be carried to bed, from that morning when Mrs. Taylor has coughed, just once, but quite wetly. 

It was with this tightness in her heart that Rhosyn met My Lord for the second time. She and Gwyn had been working in the great beds beside the gates, and had come in the front entrance for once, instead of the servant’s entrance near the kitchen. It might have been bad luck that brought them there at the same time as My Lord, but was probably more likely fate, since it wouldn’t do for this tale to avoid the obvious tropes of the genre. 

Gwyn, with the ease of practice and the thrill of an acute terror in his stomach, stepped up smartly to My Lord and began to report their progress with the gardens, gesturing discreetly behind him for Rhosyn to step behind him and carry on out of the hall. 

My Lord barely let him start talking before he snarled, “I thought I told you to keep her out of my way!” 

There is no way to answer that particular accusation, when made in that tone of voice-- truth, lies, deflection, all would only anger My Lord more, and so Gwyn simply ducked into a bow, and murmured, “Forgive me, My Lord.”

Rhosyn, who had been obeying Gwyn’s desperate wave and leaving, stopped short, startled, appalled, and more than slightly angry. She turned smartly on her heel, just in time to see My Lord lift the wicker chair by the coat rack and swing it at Gwyn.

Gwyn had good reflexes and unfortunately too much practice dodging objects hurled by his master, and managed to avoid anything but a glancing blow to the shoulder, but the chair still knocked him to the floor as it passed him to shatter on the wall. Ears ringing from the way his head had bounced off the floor as he rolled, Gwyn looked up just in time to see Rhosyn haul back and slap My Lord across the face with all the wiry strength her willow-tree frame possessed. “You are a bully!” she cried as she struck him.

Rhosyn was no delicate noblewoman-- her life’s work was menial labor outdoors. The stinging sound her palm made on My Lord’s cheek was loud in the suddenly silent hall, and the force of it knocked My Lord back a step and a half until his shoulder hit the wall. 

My Lord, for his part, pressed his own hand to the throbbing mark on his face and stared at Rhosyn like he’d never seen anything like her in his life. Indeed, you can be certain he had never seen anything like her in his life; the only young women of his acquaintance were serving girls, and would never have dared look at his face, let alone strike it. 

And then, to the great shock of all three of them--himself even more than the others, perhaps--, My Lord crumpled to the floor and burst into tears-- ugly, messy, sobbing tears, of a kind no one does well, and often elicits nothing but disgust from those unfortunate enough to bear witness. Indeed, Gwyn felt an uncomfortable squirm in his stomach and fled the scene. 

Rhosyn, however, stepped forward and gathered up the crying man-child and stroked his back. She murmured soothing nothings against the crown of his head, as she remembered her father doing for her as a small child, and told the usual lies about how everything was okay. There was pity stirring in her heart for this awful beast of a man, who’d never had anyone give him boundaries. 

He made it worse by gasping, “Why are you being nice to me?” between sobs. 

Rhosyn sighed softly and petted his hair. “Because you’re crying,” she answered. “And no one deserves to be shouted out when they’re already upset.” And Rhosyn knew, from her time with the children in the village, anger had never yet made someone stop crying, and it wasn’t likely to do so anytime soon. She was also wise enough to know that you couldn’t blame a child for how he was raised, and this particular man-child was very much a product of his upbringing, and while regular discipline could help him learn better, a kind and gentle role model would do just as much. 

“But I’ve been awful to you!”

“Yes,” she agreed. 

He sobbed harder. 

“And to everyone else here.” She stroked his hair again, trying to get him to look at her. 

He shook his head, still buried in her shoulder. “It’s all my fault!”

Rhosyn nodded. “Yes,” she agreed again. “Your selfish bad temper has jeopardized the lives of everyone who has ever cared about you, and you very nearly drove off the only person who might be able to save them.” 

It was a succinct summary of events, and Rhosyn delivered it without a trace of emotion. My Lord wailed in response. 

“Now,” Rhosyn said, “You have a choice. Wallow in your own selfish misery and lose everything, or get yourself together, and fix your mistakes.”

“How can I fix this?” he demanded, finally looking at her. 

Rhosyn met his eyes. In the unfair way of the world, even after crying he was actually quite attractive, with almost electric blue eyes made brighter by their puffy red rims, artfully untidy dark hair, and strong lines of nose and jaw highlighted by the tear tracks. “You go wash your face, eat your lunch, and meet me and Gwyn in the garden to start trying to fix things. And you stop being such an asshole to everyone.”

This was a tall order, but My Lord was willing to try, so he nodded, stood, and started to leave. 

Rhosyn cleared her throat. 

My Lord stopped, confused, and looked back at her. She appeared to be waiting for something. 

“You’re welcome,” she said gently after a moment, when it became clear he didn’t know what she wanted.

“Oh, thank you!” he said, pleased to understand. 

Rhosyn smiled at him, and left the entryway. 

This is as good a time as any to have another time skip--the only thing you’d miss in the next two days were Carys and Tegan going to sleep and not waking up, Mrs. Taylor’s cough getting very bad indeed, and Gwyn and My Lord having hilarious-but-not-really, stilted, awkward conversations while Rhosyn coughed quietly in the background every time My Lord started to lapse in his goal of ‘not being an asshole to everyone’. You might also miss Gwyn starting to shake a little when he had to exert himself, but only if you were not-watching very closely.

On his third day working with Gwyn and Rhosyn in the garden, My Lord lost his temper again. However, to his credit, he neither threw anything, nor directed his anger at Gwyn and Rhosyn. He was learning. But Mrs. Taylor had needed to go lie down after making breakfast, and My Lord was understandably upset that their hard work in the garden was not being reflected in the health of his household. 

Gwyn stood back, torn between the desire to run away and the instinct to put himself between his volatile lord and the young woman facing him down. He did neither, aware both that Rhosyn had a far better chance with My Lord than he did, and that My Lord actually wouldn’t hurt him anymore. He’d apologized for the chair, and everything else, even. 

“Plants are alive,” Rhosyn was telling My Lord. “And living things work on their own schedule, not yours.” She was definitely talking about more than just plants. Gwyn knew it, and it was starting to look like My Lord knew it too. “You have to be patient, and to trust, and accept the fact that you can’t control everything.”

“But I want to control everything,” My Lord said petulantly, and made a face that indicated he knew exactly how irrational he was being. “I just want everyone to be okay.”

“I know,” Rhosyn said softly. “And they will, My Lord. I’ll make sure of it. Your roses are going to be fine. But things may not actually get better before spring. The bush is dormant right now, so while the fungus isn’t getting worse, it isn’t getting better either.”

My Lord started pacing. “But even if- even if it gets better, we’re still-- everyone is still tied to the stupid thing!” He stopped, stared at her in anguish. “They’ll never stop being in danger!”

“Then I’ll stay,” Rhosyn said. “And take care of the bush.”

Gwyn would have loved to see the pole-axed look on My Lord’s face, because he did not doubt that My Lord was wearing the same stunned, baffled look he always wore when Rhosyn was nice to him despite his having spent more than two decades on this earth being an asshole, but Gwyn’s world had started spinning, and he had to sit down immediately.

The next thing Gwyn knew, Rhosyn and My Lord were kneeling on either side of him. “I’m okay,” he insisted once he realized what was going on. “I’m fine,” he said. 

He was absolutely incorrect, but it wasn’t like they didn’t all know what was wrong with him, and also not like there was anything to be done. 

Strangely enough, it was My Lord who fussed and patted him down after helping him up, insisting Gwyn go lie down for a while, drink water, have some soup.

Rhosyn, eyes worried but smile kind, gently pried My Lord off him and sent him inside to “just sit a bit, then you can come back out when you’re feeling a bit better.”

Once again, this timing might have been luck, but was most likely fate. His trip inside to sit, shaking and achy for half an hour at the table in the servant’s kitchens, led once again to Gwyn being in the entrance hall at exactly the right moment. 

Perhaps you have wondered, my children, what was going on in the village in the roughly week and half that Rhosyn had been at the castle. For one day, Rhys had kept the whole thing to himself; he knew his daughter, and he figured she had gone to see for herself. He thought she’d come back within a day--after all, what could she do with an enchanted rose bush? When a day came and went with no Rhosyn, he went to Ioan to ask his opinion. 

Ioan, as he was prone to doing, jumped immediately to the wrong conclusion and assumed My Lord had kidnapped her, which Rhys dismissed out of hand--what could My Lord possibly want with his daughter? He certainly didn’t seem to be the one concerned about the rosebush. It took another two days for the village to acknowledge that Rhosyn was certainly gone to the castle-- there had been a market in the next village over, and some had insisted Rhosyn might have gone there. After that, the village took another two days arguing about what to do. In that time Ioan had walked uphill, seen Rhosyn and My Lord in the grounds of the castle, seemingly arguing quite vehemently (they had been, about whether or not it was appropriate to use bedlinen to cover plants for the winter; Rhosyn said no, My Lord said, well why not?), and come back to insist she had been kidnapped. Then a day to figure out what, how, and what they needed, and then the walk uphill. 

Which is all to say, an angry mob led by a frightened father and a young man with a chip on his shoulder, convinced that a young woman of their village had been kidnapped by a monster, arrived at the gates of the castle right about the same time Gwyn, still shaking and achy, crossed through the entrance hall on his way to the side door where he had left Rhosyn and My Lord bedding down the lilies of the valley south of the nobles’ wing. 

Gwyn, thinking quickly, slipped out the great gate and put his back to the seam just before the mob--pitchforks and torches and all, he thought with some sense of hysteria, but there is a reason cliches exist, and this was absolutely a cliched mob, down to the utterly incorrect assumption that had rallied them in the first place--reached them. He had to cough, once, before he could make his voice work, but thankfully, his appearance had so startled them that he had a moment of silence into which to demand, “What do you want?”

“Get out of the way,” Ioan demanded. 

Gwyn had no idea he was looking at the same man of whom he’d heard so many stories. All he could see was the hunting rifle pointed at his face. “No,” Gwyn answered, and the shake in his voice wasn’t fear, it was the illness that was also making his hands, pressed to the wood of the door behind his hips, tremble. “What do you want?”

“Your lord’s head on a pike,” Ioan answered. It was rather overdramatic, really, but the situation was actually quite out of Ioan’s control at this point, and he felt now he had to live up to the image he had accidentally assumed. 

Gwyn thought for a moment about the concern in My Lord’s eyes when he’d collapsed earlier in the day, thought about My Lord’s hesitant laughter when Rhosyn told a joke, thought about the way My Lord had argued with Rhosyn and Gwyn hadn’t been afraid for her or himself, thought about his master feeding Mrs. Taylor slow spoonsful of soup before she’d finally succumbed to sleep. He bared his teeth. “Over my dead body.”

There was a stir of unease among the townsfolk, who had been startled out of the mob mentality by the unexpected appearance of another player in the drama their lives had become, and they as a group and as individuals were remarkably unwilling to murder random bystanders. 

Ioan, however, had a goal, a vendetta, and an image to upkeep. “That can be arranged,” he said, unaware that he sounded a bit like he was reciting from one of Rhosyn’s overwritten romance novels. “Move, or I’ll shoot.”

Gwyn was helped--or perhaps hampered--by the fact that, as far as he knew, he had very little life left, and even less to live for. Indeed, as far as a quick survey of his circumstances suggested, the only thing left he had to live for was a master finally worth serving, who might be saved if the sound of a gunshot gave him time to get away. He lifted his chin. “I’m not moving.”

One important detail, not yet mentioned: when Gwyn set his back to the seam in the gates, he did not quite perfectly center himself, putting one shoulder on the seam instead of his spine. This is important, because in the moment Ioan shouldered the rifle to fire it, My Lord opened the gate. 

My Lord pushed the left-hand gate, the one more fully behind Gwyn, open as hard and as fast as he could, also shouting “NO!” for good measure. The gate knocked Gwyn, already weak and unsteady, straight off his feet, and the shout made Ioan adjust his aim just slightly, meaning the shot, which would have taken Gwyn straight in the chest, took My Lord agonisingly, painfully, and quite not fatally, through the shoulder. 

As Ioan reeled with the sudden remorse of shooting someone, Gwyn shook his suddenly clear head as if to muddle it back up again, and My Lord rolled on the floor biting his tongue not whine in an undignified manner that it hurt, Rhosyn stormed around the corner to demand in a ringing voice, “What in hell is going on here?”

My Lord did not manage to bite his tongue hard enough to avoid blurting, “He shot me!” 

Ioan just after but not intended as a reply, said, “We’ve come to rescue you!”

Rhosyn stared at them all in silence for a long beat. “Gwyn, sweetheart, are you okay?” she asked after a long moment of staring, narrow-eyed, at the assembled villager-mob. 

“Fine, I’m fine,” Gwyn said slowly, trying to figure out why, while that fact was true, it felt wrong. He was, of course, confused because aside from the awkward fall, he was also suddenly no longer cursed after having been so for almost a year. 

“Put pressure on it, dear,” Rhosyn told My Lord, meaning his shoulder. 

When this prompted only a groan and some unhappy whining noises, Gwyn moved to help. My Lord made a much louder groan and several more unhappy whining noises when Gwyn put as much pressure on the wounded shoulder as he could.

Meanwhile, Rhosyn turned back to her village. “You,” she told Ioan, “Are an idiot. Rescue me from what?”

“Um,” Ioan said slowly, beginning to recognize the depth of his overreaction. “From him?” he said, waving at the pitiful pile of blood and whining noises that was the evil landowner. 

Rhosyn stared at him for a long moment, just to impress on him exactly how stupid that statement was, and then she sighed loudly, and said, “I guess you lot better come in. Hi, Tad,” she added to Rhys. “Don’t suppose Aled came along?” she asked. Aled was the town surgeon. 

“Here,” Aled said, coming forward. The stocky man helped Gwyn move My Lord into the drawing room, where Mrs. Taylor met them with water and bandages. She laughingly fended off Gwyn’s desperate hug, and went to get some thirty-odd villagers comfortable in the great hall, but paused to hug Rhosyn along the way. 

When Aled finished bandaging and tying off, he ducked his head to Rhosyn and let a footman show him to the great hall. Rhosyn smiled to see the castle coming to life again, servants moving about and candles and fireplaces being lit again. 

My Lord made a tiny mournful noise, only because he thought he was alone, and he had reached the stage in his development where he actually tried quite hard to keep the fact that he was desperately unhappy from those who were important to him. He had, of course, been keeping his desperate unhappiness from Rhosyn for approximately two and a half days, exactly how long he had been aware of both the fact that he was wildly in love with her, and that she was so far out of his league that they were playing different sports, not that he would have understood that metaphor. He was now even more unhappy, because while it would have been terrible for her to stay, take care of his rosebush, and continue to be out of his league, it was going to be even worse for her to leave, and probably find someone good enough, who she could love back. 

“What’s the matter?” Rhosyn asked, brushing his hair out of his face with the same tender gesture she used to move plant limbs and vines out of her way. “Does it hurt? I can see if Mrs. Taylor has something for the pain.” She was not oblivious to the actual cause of his upset, because while he had grown enough to want to hide his distress, he couldn’t actually do it. However, she also wasn’t going to let him have anything without asking for it; it would set a terrible precedent, and he’d been progressing so well. 

“I’m fine,” he lied, quite unconvincingly. I have said before there is little more awful than someone putting on a brave face for someone he cares about, and the unsteady smile My Lord pasted on was even worse for how uncomfortably it sat, his face far more accustomed to petulance or demand than courage. “And now there’s no need for you to stay and care for the rosebush. You can go home.”

Rhosyn searched his face for a long moment, long enough that the sad smile slipped off it and displayed the sorrow and the worry beneath. “I could,” she agreed in the same soft voice she had always used to agree with him when he said things he didn’t want to hear. Then she coughed the same soft cough she had always used to tell him there was something else he needed to say.

My Lord stared at her, uncertain. But he did what he always did when she expected things of him, and told the truth; even when it wasn’t the right answer, it was always what she wanted to hear, and it had always helped them get to where he needed to be. “I’ll miss you,” he admitted, devoting his entire attention to avoiding her gaze.

“Idris,” Rhosyn said very gently. 

Idris looked at her in shock. No one had called him by name in more than a decade. 

“The rosebush may not determine everyone’s fate any more, but your gardner is more like an arborist and could probably use some help with the bushes and flowers anyway. And you have a wound that will need more care than your exceptionally busy housekeeper will likely be able to give.”

Idris opened his mouth, and then shut it again. He could not have claimed to misunderstand what she was offering; he knew she meant to stay. What he could not fathom was why she would want to stay here when her entire life was back in the village. 

All he knew was who he had been, and he could not understand how, despite what friendship she had found in his household, she could want to stay anywhere near someone like him. He could not see, as she did, all the ways he was not that man any more, the changes he had made because it was the right thing to do, the courage in his heart to let go of pride, old beliefs, and mistakes, and the steady foundations of the good man he would eventually become. 

“Ask me to stay,” she said softly. 

“Stay,” he pleaded. 

And of course, she did. And in the spring, the roses bloomed.

If a Regency young woman with a very young child suddenly found herself a widow, what would be her options for living? Would it be unheard of to go anywhere else but back to her family, or could she perhaps give her child to relatives and become a lady’s companion? It’s for an idea I’m tossing around for Charlotte Lucas in a potential fanfic, but I haven’t got anything finalized yet and I was curious about how realistic the idea would be

It would depend on her husband’s property and means. If her child is a son, or the terms of her husband’s will enable his daughters to inherit, she could easily remain in residence upon his estate or in his home, if it is owned outright. (In the case of Charlotte Collins, it would be a little different as the clergyman’s living would be given to a man able to fulfill the duties to the parish. However, if Mr. Bennet had already died at this point and the Longbourn estate gone to Mr. Collins, then Charlotte’s son would be the legal holder of the property. There would be some shuffling around with trusts and guardianship of the estate until he might be of age but those are details to sort out only if necessary.)

More generally, a widow would be entitled to a dower share of the income from her late husband’s property for the remainder of her life, at least one-third (or more, if the husband made such a provision in his will,) of all monies collected from rents and/or crops grown on the land, and the current holder of the property could not sell or dispose of it until the widow was dead. If the property was mortgaged or other debts remained to be paid off, (the widow being legally responsible for these payments,) this would effect her income, however, and so this right to a dower share was by no means an assurance of a stable and comfortable income for her and any children to live on. Under such circumstances (and if the present heir was not her child and wished to move into the inherited house,) she might well find it easier or more affordable to try to find a place to live with friends or relatives. (As we see Mrs. Clay move back to her father’s house with her two children.) Any man who married a widow would assume the responsibility for her first husband’s debts, if there were any left. An 18th century custom known as ‘smock’ or ‘petticoat’ weddings allowed a woman to essentially declare bankruptcy by coming to the wedding ceremony barefoot and clad only in her shift or petticoat (some sources also claiming the bride would appear wrapped in a sheet or even nude,) and the man marrying her would then not be called upon to settle any of her existing debts. (Saucy or humiliating? Hard to say.)

Later in the century, wills would tend more to provide trust-arrangements for widows’ incomes, and many heirs contested dower rights in wills, to the point that dower was formally repealed in law in 1833, leaving many widows without the common law claims former generations had relied upon to survive.

A woman’s dowry–the portion of her father’s fortune and property given with her as part of her marriage contract–as well as any inheritances she received from her mother should also revert to her control. (Mrs. Dashwood is forced to maintain herself and her three daughters on the interest derived from her dowry, which is hardly enough to sustain them. She also takes the items which were a party of her marriage portion–that set of beautiful plates that Fanny Dashwood so envies. Thankfully, Mrs. Dashwood is offered Barton Cottage on low rent from a distant cousin, Sir John Middleton.) A marriage contract protected this lump sum of a woman’s dowry as provision for her widowhood, which is why, for an heiress, an elopement was a risky venture–upon the instant of her marriage, her husband might then dispose of her entire fortune exactly as he wishes, and, should he then die, leave her with nothing.

Austen’s own lifelong friends, the Lloyds, encountered such a situation, when the widowed Mrs. Lloyd and her daughters Martha and Mary were offered a home in the parsonage at Deane, which was held by Jane’s father, who had been a friend of theirs. Three years later, Jane’s brother James wished to marry and took over the parsonage, so the Lloyd women had to move, again. Several years later, the widowed James married Mary Lloyd; and, after the elder Mrs. Lloyd’s death, as well as Rev. Austen’s, the widowed Mrs. Austen, Cassandra, Jane, and Martha, banded together as friends to stretch their limited incomes as spinsters and a widow. They went to live with Frank Austen, a Naval man, who, by taking in his mother, sisters, and Miss Lloyd, allowed him to see his mother was looked after and that his own wife, who was then expecting a child, should not be by herself while he was away at sea. Ultimately the women later settled at Chawton, where they continued to live after Jane’s death, and at age sixty-two, Martha married the widower Frank, herself.

As to incomes and occupations, if a widow had her own house and the place could be made suitable, she might take on lodgers, or–if she was educated enough–open a school. If her husband ran a shop or a farm, she might also continue to do so, herself–though this was decidedly un-genteel. If she must find her own way, a genteel widow could take a place as a housekeeper, a governess, or a lady’s companion. (Perhaps for wealthier friends or relations, perhaps not.) If she is working, it is likely her child would be placed in the care of someone else, for a fee–either at a school (if the child is old enough) or in a home in the country in the care of a woman with a good character, perhaps herself also a widow of some means. Widows also tended to live in more densely-populated areas and towns, as opposed to rural situations, if they were unable to provide their own personal means of transportation beyond going anywhere on foot. (London and Bath were full of widows, with the population of the latter having a higher proportion of women than men at roughly 60%.)

Socially, a widow’s position was a tricky one. She did not automatically gain guardianship of her own children unless her husband’s will stipulated so; and there was often some disdain if a widow re-married too quickly–or even at all. (Mourning would take at least 12 and up to 18 months to complete.) While a man re-marrying soon was seen as the norm, particularly if he had children or wanted them, a woman with ample enough provision to live on who chose to re-marry, anyway, could only be doing so for one reason: sex. Seriously. General opinion held that once a woman has Known a Man, she will continue to have Needs until her dying day and a Good Widow just RESISTS these unholy urges but nobody is perfect and sometimes you just gotta find yourself a new husband and get on that dick ASAP. Some people will totally judge her for it, but, y’know, everyone understands that a lady requires regular rogering. (Austen’s own duplicitous Mrs. Clay and Lady Susan are examples of this, while more virtuous widows like Mrs. Bates or Lady Russell remain independent and–presumably–chaste for the remainder of their lives.)

For Charlotte in particular, the Church of England made no provision for the widows of clergymen, so her home and her husband’s stipend would no longer be hers as of the moment of his death, so it’s entirely possible and likely that she might return to Lucas Lodge for a time, or go elsewhere to seek her living.

On 9th April 1747 Simon Fraser, Lord Lovat, the leading Scottish Jacobite rebel was beheaded on Tower Green.

A longer post than normal from me as in my opinion Simon Fraser was one of the most interesting characters in Jacobite history. A man of contrary, he was known to be very kind to the lesser clansmen taking a paternal interest in their affairs. A quote regarding him says that...."Generally he had a bag of farthings for when he walked abroad the contents of which he distributed among any beggars whom he met. He would stop a man on the road; inquire how many children he had; offer him sound advice; and promise to redress his grievances if he had any" In his own estimate, he took care his clansmen were ‘always well-clothed and well-armed, after the Highland fashion, and not to suffer them to wear low-country clothes’ Lovat was also a brute of a man forcing a young woman into marriage and raping her in an attempt to legitimise the union. Lovat has become more well know lately thanks to Outlander, where in their world he is grandfather to the main protagonist Jamie Fraser and played brilliantly by the fine Scottish actor Clive Russell. Back in the real world he has been in the news only this year, I shall cover that at the end of this post.

Born in 1667 into the ancient clan who fought with distinction in the Wars of Independence – Sir Simon Fraser was one of the co-victors of the Battle of Roslin and his sons were close friends of Robert the Bruce, Alexander marrying Bruce’s sister Mary – Simon was the second son of Thomas Fraser of Beaufort who was closely related to Lord Hugh Fraser of Lovat, chief of clan Fraser.

Simon became his father’s heir when his elder brother was killed fighting alongside Bonnie Dundee against the forces of King William III at the Battle of Killiecrankie in 1689. He was still nowhere near being clan chief, however, and took himself off to Aberdeen University from which he graduated in 1695. Lord Hugh Fraser, the 9th Lord Lovat, was a weak man who unexpectedly signed over the clan leadership to Simon’s father in 1696.

Lord John Murray, Earl of Tullibardine and the most powerful man in Scotland, disputed the succession and fell out spectacularly with Simon in Edinburgh. The young Fraser hothead duly went north to Castle Dounie to try and persuade Hugh’s widow Amelia to give him the hand of her daughter, also Amelia, in a dynastic marriage that would seal his succession. Tullibardine was having none of it and moved his niece to the Murray stronghold, Blair Castle, where he planned to marry her off to Alexander Fraser, heir to the Lordship of Saltoun.

Simon retaliated by kidnapping Alexander and frightening him away, and to make matters worse in October, 1697, he went back to Castle Dounie and forced the widow Amelia into a sham wedding, raping her to consummate the “marriage”.

Tullibardine ensured Simon and his father were declared outlaws and when old Thomas died in 1699, Simon was unable to legally claim his title as 11th Lord Lovat which later passed to one Alexander Mackenzie who had legally married the younger Amelia.

Simon Fraser somehow managed to persuade King William that he was no threat, despite having his own personal army, and he was pardoned in 1700, only to be declared an outlaw again the following year over the forced marriage and rape.

Simon went off to the court of the Stuarts in France where he devised the plans that were eventually used in the 1715 and 1745 uprisings. Long before the former, however, Simon was double dealing, giving Queen Anne information about the plans of James, the Old Pretender. He was found out and King Louis XIV clapped him in jail for three years.

Even after he was released he was prevented from travelling to Scotland and thus missed the Act of Union which he opposed.

Still desperate to get his Lovat title and the chieftainship of his clan back, Simon sided with the forces of the new King, George I, during the ’15, and was given back his title as a reward, with Alexander Mackenzie imprisoned for being a Jacobite. The two men would fight in the courts for the next 15 years as to who was entitled to the income of the estate. Simon eventually won and spent his time building up the Fraser estates and wealth, even taking command of one of the Independent Companies of Highland soldiers established by the Hanoverian regime – the Fraser Highlanders.

As I said early Fraser was a man of contrary and to me was very like "Bobbing John" The Earl of Mar another Jacobite who a tendency to shift back and forth from faction to faction, no sooner had Fraser built up this "Hanoverian" army that he started openly campaigning for the restoration of the Stuarts. The Government responded by cancelling his military role.

When Bonnie Prince Charles landed in Scotland he was still playing games.

He allowed his sons to fight for the Stuarts, but stayed at home himself “loudly lamenting the wilful disobedience of children,” as Sarah Fraser has put it. Lovat did meet Charles, however, and expressed his anger at the lack of “siller” which he knew would be necessary for a successful campaign. They met again after Culloden, at which Clan Fraser fought bravely and suffered many casualties, and Lovat advised the prince to get away and re-form his forces. Charles fled through the heather, as we know, and made it to France while anyone associated with the Bonnie Prince was hunted down. The Duke of Cumberland’s troops were not taking any more games from Fraser and burned Castle Dounie.

Lovat managed to make it to Loch Morar but was captured there while hiding in a hollow tree. Although approaching his 80th birthday, The Fox was taken south to London.

He pled not guilty but his trial was a formality and he must have know his fate would be the same as previous nobles, the Earls of Kilmarnock, Balmerino and Derwentwater who were executed for treason the previous year.

At his trial, ever the Fox he insisted strongly upon his affection for the reigning family. Such were the characteristics of Simon Fraser, but of course he was found guilty the sentence, hanging, drawing and quartering was commuted later to a mere beheading by the King.

In a way, Lovat had the last laugh. Newspapers and pamphlets of the time recorded that as he was led out to the scaffold on Thursday, April 9, 1947, a wooden stand that had been erected near the Tower to seat crowds eager to see the execution collapsed sending hundreds plunging down. At least nine people died and dozens were injured, which amused Lovat – the phrase ‘laughing your head off’ is said to date from that event.

According to a woodcut print made on that fateful day, Lovat “with some composure laid his head on the block which the executioner took off with a single blow.”

As I mentioned at the top Lovat has been in the news lately, Simon had requested burial at the family mausoleum at Wardlaw near Inverness and the government initially agreed but changed its mind thinking his body could become a rallying point for further trouble. He was therefore buried in the floor of the chapel within the Tower of London, St. Peter ad Vincula. The chapel was refurbished in the 19th century and the floor was relaid. One of the coffins uncovered during the works had the nameplate of ‘Lord Lovat’. The names of those found are now recorded on a plaque on the wall of the chapel.

Fraser folklore, and written in several books says that his body was spirited away from London, the stories even go so far as to name the boat ‘The Pledger’ that sailed north to The Beauly Firth, where he was taken to the family mausoleum, there is even a plaque in the crypt that reads “In this coffin are laid the remains of Simon Lord Fraser of Lovat who, after twenty years in His own Land and abroad with the greatest distinction and renown, at the risk of his own life, restored and preserved his race, clan and household from the tyranny of the Athol and the treacherous plotting of the Mackenzies of Tarbat. To preserve an ancient house is not the greatest credit. Nor is there any honour for the enemy who despoiled it. Although that enemy was strong in his plotting and unrelenting warfare, yet Simon who was also skillful and cunning defeated him in war."

Last year the headless skeleton inside the coffin was exhumed to be examined by experts from the University of Dundee in January this year they announced that the bones in the coffin did not belong to Simon Fraser, but to a young woman. So it looks like his body did end up rotting in The Tower's Chapel.

Can you help answer a question for me? Are dukedom's in the UK just titles now? Or do they bring rights to land and income with them like they used to? (I started out trying to look up what Prince Harry's title might be when he gets married, since they had to reach so far back and revive the Duke of Cambridge for William, and then started wondering about the depth of what modern titles entail but I wasn't getting close to an answer with Google).

Uh, I’ll try to help. Be warned I am American and am only going off my extensive research to answer.

Long story short, Dukedoms are just titles now--and titles that don’t mean as much as they used to. They are not necessarily entailed with land and property as it would have been done up until WWI, but many families decide themselves to leave the land and property to the eldest son, who will be named Duke of Suchandsuch.

WWI and WWII changed the look of nobility and land ownership, because the government leveled such high death taxes during that time, and many nobles lost their properties because they couldn’t pay for them or because they didn’t have enough money to maintain. That’s why so many great houses now are in a national or private trust. Or they allow house tours and weddings and such, because it’s just too expensive to keep grand houses open.

I’m going to use the Duke of Devonshire as an example to explain. Though Chatsworth House is the seat of the Dukes of Dev, it now belongs to a private trust that the Duke heads himself. So, yes, he owns the land and property (and several other estates across the UK), but it is not entailed in such a way that it MUST pass to his eldest male heir. He has said, however, that he and his wife already had the talk with their kids (one boy, 2 girls) that they were leaving the land and properties to the son as it was tradition and should stay with the title. The girls will get an inheritance, but likely only money, and I’m sure with the right to use Devonshire property should they need it, but at the behest of the trust.

Many Dukes and their families, for the reason of insolvency in their family’s history, are landless dukes. So, in title only.

Now... about Harry. If you haven’t found the information, the odds makers have his title becoming the Duke of Sussex (most likely) or Clarence upon his marriage. These titles were absorbed into the royal family long ago, so I imagine if any property remained when that happened, it went back into the royal trust. But that’s where it will remain. Harry will likely be given some land and a home, like Will and Kate were given Anmer Hall in Norfolk by the queen. They are not necessarily properties that belong to the Cambridge title, it was just handed to them as a gift at the pleasure of their sovereign.

And lastly, there’s the Duchy of Cornwall. This is, perhaps, the only title in England that still mandates that land pass with it. The Duchy of Cornwall--the only Duchy in England, everything else is dukedoms--is the title specifically given to the sovereign’s heir. It provides the heir with an income, now totaling about 18 million pounds a year and with properties worth 800 million pounds. This title can only be bestowed on the oldest son of the monarch, so it’s likely Will and Kate will become the Duke and Duchess of Cornwall after QEII passes (long may she reign) and Charles becomes king.

So, no, Harry is not entitled to any land when he receives a title at marriage. It all depends on what the Queen or his father want to give him. Yeah, it can be grand being a royal, but, to me, it seems really crappy not knowing where or what your life is going to look like based on the whims of your family members.

An Unorthodox Proposal

Trade Secret Litigation

A trade secret is information that derives actual or potential value from not being known to the public and that is subject to reasonable efforts to maintain its secrecy. A trade secret can consist of formulas, patterns, compilations, programs, devices, methods, techniques, or processes. In fact, protection of trade secrets can cover everything from microchip design to religious practices. Some of the most famous examples of trade secrets include the formula for Coca-Cola and the algorithms behind Google’s search engine. However, information does not need to be famous for it to warrant trade secret protection. In fact, many valuable trade secrets are valuable precisely because the public does not know about them.

Every state allows an owner of a trade secret to seek legal relief when that trade secret has been disclosed or used without authorization. Moreover, nearly every state has adopted a version of the Uniform Trade Secret Act, which was originally published by the Uniform Law Commission in 1979. This act sets forth specific requirements and procedures that are unique to trade secret claims. As Utah attorneys, we’ve handled several of these cases.

Because trade secret cases are a particularized area of intellectual property law, attorneys who deal with trade secrets must be familiar with the procedural and substantive nuances of misappropriation claims. Why Paternity Is Important

In Utah, before custody or any other parental rights are given to a child’s father, paternity must be established. Paternity determines who is the legal father of a child. Many fathers are unaware that having their name on a child’s birth certificate is not enough to establish paternity.

Paternity is important because it not only gives the child’s father legal rights and responsibilities, but it also offers protections for the child. Once paternity is established, a child may be put on his or her father’s health insurance plan and is entitled to receive benefits, such as Social Security or veterans benefits. The child also has inheritance rights in the event that the father passes away.

Paternity is also important for the unmarried mother because it entitles her to receive child support from the child’s father.

Establishing Paternity

Paternity can be established in one of the three ways:

Voluntary Declaration of Paternity (VDP) — This is a legal acknowledgement of paternity that is often signed by the parents along with the birth certificate when the child is born.

Administrative Paternity Order — Paternity can also be established administratively through the Office of Recovery Services if a parent applies for child support and paternity is proven.

Judicial paternity — This is the most powerful way of establishing paternity because it is the form of paternity that enables the ORS to set up or enforce custody or parenting time arrangements with the child. To obtain a judicial order of paternity, either parent or both parents have the right to petition to court, establishing paternity.

As soon as paternity has been established, the unmarried parents will stand in the same position as divorcing couples.
