The Tuskegee Airmen were a group of African-American and Caribbean-born military pilots who fought in WWII. They formed the 332nd Fighter Group and the 477th Bombardment Group of the Army Air Forces. The name applies to the navigators, bombardiers, mechanics, instructors, crew chiefs, nurses, cooks, and other support personnel.
All African American military pilots who trained in the US trained at Moton Field, the Tuskegee Army Air Field, and were educated at Tuskegee University. The group included five Haitians from the Haitian Air Force and one pilot from Trinidad. It included a Hispanic or Latino airman born in the Dominican Republic.

Charles DeBow, L.R. Curtis, and George S. Roberts. They will become part of my the famous 99th Pursuit Squadron. List of Tuskegge Airmen.

Eagles’ 7-Round NFL Mock Draft by fan vote
Is there anything more accurate than a March mock draft? I struggle to think of anything. What about a fan poll mock draft? Now we’re cooking with oil!
Utilizing The Draft Network’s Mock Draft Machine, I conducted a series of Twitter polls that begged the question, “Who should the Philadelphia Eagles draft?” I felt this was a perfect scheme to discuss potential targets while passing all the blame onto the voters. You’ll still shoot the messenger since you probably skipped this part.

There are two types of people in this world. Those that don’t want to pay Le’Veon Bell a projected 4-year, $60M deal or draft a running back in round one. And those that do. If you’re a third type of person that believes one but not the other, you don’t count. Why? That doesn’t make any sense.
I don’t believe the Eagles will draft a running back in round one. If they did, it’s because the board fell like this. With no Wilkins or top tier offensive tackle it leaves a diminished group. If not a running back, you’re looking at top talent at the safety position. Is this the year the Eagles grab one? Or do they sign a veteran to be the third in their big dime/nickel packages? What about drafting a falling edge rusher that showed up to the Combine disgruntled and sloppy?
Jacobs is the most complete back in the class. Period. Inside, outside, receiving, blocking.. nobody possesses his well-rounded skill set. He can run you over and he can leave you looking for your jockstrap.
As the 2018 season unfolded, the Eagles’ running backs had people changing their definition of a “feature back” weekly. Josh Adams isn’t one. Wendell Smallwood and Corey Clement aren’t either. Josh Jacobs? Yes. He’s a lot closer to being one than what the Eagles’ have been trotting out after Jay Ajayi went down.
SECOND ROUND - 53RD OVERALL

The Pick: Ohio State iDL Dre’Mont Jones (34%)
This was a close one, but Jones edged out Thornhill and the Eagles decide to beef up their interior. I use “beef up” loosely, as Jones isn’t going to be a plus in the run game early in his career. Freeze frame his first step and you’ll see a quick get off with awful pad level. That causes him to be moved and wash out of plays.
That first step does allow him to win as a pass rusher though. He also possesses good flexibility throughout his body and a decent toolbox of pass rush moves. He’ll be a situational player to start as he works the rest of his kinks out. Fixing his pad level will hide the warts in his game and keep him on the field in running situations. How long you’re willing to wait on that tweak is the question.
Jones came in at 40th overall in my pre-Combine big board and was my 5th ranked interior defensive tackle when I studied the group last month. This is solid value.
SECOND ROUND - 57TH OVERALL
Available: Virginia $ Juan Thornhill, Ohio State WR Terry McLaurin, Alabama State OT Tytus Howard, Alabama LB Mack Wilson
The Pick: Alabama LB Mack Wilson (39%)
Twitter polls are a flawed process. Thornhill was in the lead and then Jon Ledyard of The Draft Network retweets the poll and Mack Wilson takes a strong step forward. It’s okay, we’ll get a safety later. Wilson is an acceptable value here and currently sits as my LB3.
If I could trade Wilson for Devin Bush Jr. and Jacobs for Memphis running back Darrell Henderson… I’d consider it. Bush is a clear tier ahead of Wilson, who was clearly outplayed by his teammate Dylan Moses. New strategy: Draft Dylan Moses next year and prosper.
As a side note, don’t sleep on Terry McLaurin here. His teammate Parris Campbell is getting all the love after running a 4.31. Make no mistake, McLaurin has the far more complete route tree and 4.35 isn’t slow.
FOURTH ROUND - 127TH OVERALL

“...raised eyebrows at the Senior Bowl with superb athleticism and overall performance. There are inconsistencies in his game, but the more troubling aspect to Edoga will be under scrutiny at the Combine. His interviews will be important, as the word is evaluators are concerned about his character. If he lands with a coach that can get through to him, Edoga’s high ceiling will be within reach and worth an early investment.”
FOURTH ROUND - 138TH OVERALL
Available: Iowa EDGE Anthony Nelson, Colorado $ Evan Worthington, Notre Dame WR Miles Boykin, Ohio State CB Kendall Sheffield
The Pick: Notre Dame WR Miles Boykin (45%)
Boykin shredded Day 2 of the Combine. Coming in at 6’3 3/4” and 220 pounds, Boykin ran a 4.42 40-yard dash, hit 43 1/2” on the vert, and literally flew 11’8” on his broad jump (99th percentile). Those that raced to his film saw some of that explosiveness on film, but also saw a good deal of refinement needed. Might not contribute significant snaps in 2019, but he could also press some others out of a job in the future.
5TH ROUND - 163RD OVERALL
Available: Rutgers $ Saquan Hampton, LSU TE Foster Moreau, Boise State QB Brett Rypien, Syracuse iDL Chris Slayton
The Pick: Rutgers $ Saquan Hampton (32%)
I breezed through some Hampton tape in search for top safeties in this group. His physical/athletic profiles are his best assets right now. With more overall development needed, Hampton will have to earn his keep on special teams before cracking the “big nickel/dime” packages. Enticing tools with which to work if he can stick.
6TH ROUND - 197TH OVERALL
The Pick: USC EDGE Porter Gustin (28%)
Dealing with bicep, toe, and ankle injuries, Gustin has only played nine games in the last two years as a Trojan. That’s a shame, because he was off to a good start in 2018. In six games he racked up 7.5 sacks before shutting it down. Gustin is a throwback player and partial maniac that can hopefully stay on the field more than the trainers’ table.
6TH ROUND - 208TH OVERALL
The Pick: Penn State iOL Ryan Bates (27%)
If the Eagles’ are looking for more depth along the line they might as well bet on an athlete. Bates quietly put on a fantastic performance at the Combine. Bates has spent time at tackle and guard and represents the type of versatility and mobility the Eagles’ covet.
You can love or hate this draft, but at the end of the day the gentle readers did better than Todd McShay. It’s a low bar, but I’m proud of all of you.

Netflix has been on a book acquisition spree over the past year, developing screen adaptations of dozens of novels, series, short story collections, and graphic novels. About 50 of these literary properties are being turned into series projects, while the screening service has announced plans to adapt only a handful into features—a list that includes Button Man by John Wagner, I’m Thinking of Ending Things by Iain Reid, Pashmina by Nidhi Chanani, and The Willoughbys by Lois Lowry.
Netflix has 139 million subscribers, and these properties will provide the streaming giant with features, series, and animated shows for the coming years. “There’s just no other substitute for the amount of work and creativity that goes into a book,” said Matt Thunell, v-p of original series at Netflix.
Adaptation has long played a role in Netflix’s development efforts, with Piper Kerman’s Orange Is the New Black (2013), Jay Asher’s 13 Reasons Why (2017), and Lemony Snicket’s A Series of Unfortunate Events (2017) all turned into ongoing series. “We have development teams who are reading all night and every weekend,” said Kelly Luegenbiehl, v-p of creative for international originals at Netflix.
Many of Netflix’s deals begin with Maria Campbell Literary Associates. In 2017, Netflix exclusively retained that agency for its book-scouting efforts to find English- and foreign-language titles to adapt from around the world, including from the U.S. “I’m on the phone with them every week, talking about what’s going on in New York, what’s new, and about library properties as well,” Thunell said. In addition, Netflix executives now attend such international literary rights events as the London Book Fair and the Frankfurt Book Fair.
Campbell’s agency has also helped the company forge deeper relationships with publishers. For example, Netflix is adapting Frank Miller and Tom Wheeler’s illustrated novel Cursed as a series and coordinating release schedules with Simon & Schuster. “That is the kind of partnership that we’re really craving,” Thunell said. “To get in early with publishers and do something that is really mutually beneficial.”
Netflix is starting to explore new relationships with authors as well. Last summer, the company inked an exclusive multiyear deal with American thriller novelist Harlan Coben, developing 14 of his projects into series and features for Netflix’s global subscriber base. The streaming company is sharing Coben’s material with global producers to get new perspectives on his work, exploring adaptations that could be made around the world. If producers overseas end up adapting one of these works, Netflix will share that foreign-language version with all of its subscribers rather than making a separate adaptation for English-speaking markets. “It’s fun to see how local producers would take that source material and get inspired to adapt it for their local market,” Luegenbiehl said.
Luegenbiehl noted Netflix’s interest in acquiring other “libraries of content” from certain authors but wouldn’t go into specifics. In November, the company announced plans for a “slate of premium animated event series and specials” based on a long list of Roald Dahl books. That series of adaptations was the result of a joint agreement with the Roald Dahl Story Company.
One Netflix project spawned its own literary offering during development. Henry Selick, director of Coraline, inked a deal with the company for an original stop-motion animation feature titled Wendell and Wild. Writer-director Jordan Peele and author Clay McLeod Chapman are working with Selick on the script, but Selick and Chapman are also writing a book based on the story for S&S. The Gotham Group represents Selick and S&S, and Eddie Gamarra—cohead of Gotham Group’s book department and a literary manager—will executive produce the project. “We’re very deep in the Netflix space,” Gamarra said. “They’ve been a great home for our projects.”
When Netflix’s creative executives discussed adapting Polish novelist Andrzej Sapkowski’s Witcher series, Luegenbiehl’s team dissuaded the producers from making a standalone film. Luegenbiehl recalled asking them, “How can you take eight novels and just turn it into a film? There’s so much material here. There’s so much that you can do.” She added, “Through a number of conversations, the producers got really excited about the idea of using the source material for a longer-running series.”
“Netflix executives can discuss the books in-depth,” said New Leaf Literary founder Joanna Volpe. “That’s why we are seeing such great adaptations: because they are reading it and getting to the heart of the books.” Volpe represents author Leigh Bardugo, and Netflix recently acquired the rights to adapt all the books in her Shadow and Bone trilogy and Six of Crows duology into a single series.
New Leaf film and television head Pouya Shahbazian first introduced Thunell to the series in 2012. A few years into his tenure at Netflix, he turned to Netflix’s treasure trove of data to reconsider the project.
Netflix divides its global viewers into “taste clusters” or “taste communities.” A New York magazinearticle counted nearly 2,000 of these taste communities that compose the streaming service’s global audience. Netflix has kept its viewership statistics and taste community designations mostly secret but revealed a few select audience figures in a letter to investors in January. The company estimated its adaptation of Josh Malerman’s Bird Box novel was “enjoyed by over 80 million member households” during its first four weeks on the service.
“There is one taste community that I’ll loosely describe as the intersection of romance and the supernatural,” Thunell said, citing fans of Twilight and the Vampire Diaries as examples. “We didn’t have an original series that catered to this audience and this taste community. That frankly gave me the confidence, after years of waiting to get into the deal, to actually do it.”
In January, Netflix greenlit eight episodes of the Shadow and Bone series, bringing together the creatives behind two popular Netflix projects: Eric Heisserer, the Academy Award–nominated screenwriter who adapted Bird Box, and Shawn Levy, who executive produced Stranger Things. “At Netflix, our entire philosophy is we want to make everything that we buy,” Thunell said. “I’m buying Shadow and Bone because I intend to make it.”
Buzzy series such as Shadow and Bone are attractive, but Netflix is not just looking for bestsellers. “It is a factor if people love the story,” Luegenbiehl said. “That’s something that we want to know about, but it’s definitely not the single determining factor in why we would adapt something.” She cited the development of The Protector, a superhero fantasy series loosely based on a Turkish novel by N. Ipek Gökdel, as an example of a successful adaptation without a global fan base. “It wasn’t even translated into English, but our producers really saw something in the inspiration of a Turkish superhero.”
Netflix shared the show (its first Turkish original) with its global subscriber base and has since renewed the series for a second season. According to Netflix’s January letter to shareholders, the show was “enjoyed by over 10 million member households” during the first month of global release on the service.
Netflix recently secured adaptation rights to Gabriel García Márquez’s One Hundred Years of Solitude—a deal that included the company’s promise to shoot the series in Spanish and film in Márquez’s native Colombia. “In the past, the prevailing wisdom would have been to have everyone speak English in order to make it a more global show,” Luegenbiehl said. But the executive found through her time at Netflix that “authentic” foreign-language properties can resonate with “universal audiences”—a realization that inspired her development teams to seek literary talent in other languages and other cultures. “We’ll continue to look to books to find new voices, especially as we’re expanding into the African continent,” she added. “There’s a lot of great literature there. We’re really actively looking to tap into some stories there that perhaps didn’t have the right platform to be told on a global scale before.”
Both executives see literary material as an irreplaceable resource. “The reason I love books—especially a book-to-series translation—is that they often provide this incredible landscape, mythology, and opportunity for worldbuilding that’s really hard to come by in the everyday pitches I’m hearing,” Thunell said.

Mrs. Jill Steed McDowell, age 66 of Millers Creek passed away Sunday, December 16, 2018 at Westwood Hills Nursing and Rehab.
           Funeral services will be held 11:00 AM Wednesday, December 19, 2018 at Reins-Sturdivant Chapel with Rev. Jamie McGuire officiating. Burial will be in Mountainview Memorial Gardens on Old Camp Road in Denton, NC.  .
           Mrs. McDowell was born May 30, 1952 in Denton to Roland Loftin and Erlene Varner Steed. She was a member of Purlear Baptist Church with the Van Ministry kids outreach, loved kids at church and worked at Walmart for 18 years as a Pharmacy Tech and as a self-check host.  
           She was preceded in death by her parents.
           She is survived by one sister; Kitty Gallimore and husband Ralph of Denton, three brothers; David Steed and wife Lois of Myrtle Beach, SC, Ronnie Steed and wife Susan, Eddie Steed all of Denton, two step-daughters; Debra Barnes, Jo B. Ponds both of Salisbury, step-son; James M. Barnes of Salisbury, eight nieces and nephews and her loving fur babies; Thelma and Louise.
           The family would like to express their extreme appreciation to her close friends and caregivers that were by her side during her battle with cancer; Jane, Kenneth and family, Sharyn, Brenda, Mt. Valley Hospice and Westwood Hills Nursing and Rehab.

Mrs. Betty Jo Byrd Staley, age 76 of North Wilkesboro passed away Saturday, December 15, 2018 at her home surrounded by her loving family.
           Funeral services will be held 3:00 PM Wednesday, December 19, 2018 at Welcome Home Baptist Church with Rev. Lyn Lambert, Rev. Ronnie Gregory, Rev. Richard Whittington and Rev. Robert Duncan officiating.  Burial will be in the church cemetery. The family will receive friends from 1:30 until 2:30 prior to the service at the church.
           Mrs. Staley was born January 31, 1942 in Wilkes County to Jessie Monroe and Ola Mae Holder Byrd.  She was a member of Welcome Home Baptist Church.

Mr. James Dewitt "Duck" Pearson, age 86 of Boomer, husband of Jeanette M. Pearson, died Thursday, December 13, 2018 at his home.
           Funeral services were held  December 18, at Reins-Sturdivant Chapel. Burial was in the Pearson Hill Cemetery.  
           Mr. Pearson was born April 5, 1932 in Wilkes County to George Washington and Pansy Holder Pearson.  He was a member of Sharon Walker Baptist Church and was self-employed as a sawmill operator.
           He was preceded in death by his parents; one daughter, Kathy Pearson; two sons, Gary Pearson and Ronnie Pearson; three sisters, Noleen Holder, Pansy Ritch, and Delight Hines; and seven brothers, Joe Pearson, Ron Pearson, Roy Lee Pearson, JC Pearson, Darrell Pearson, Bill Pearson, and Elisha Pearson.
           He is survived by his wife, Jeanette M. Thomas Clifford Faw, known to all who loved him as Cliff, joyfully entered eternity on Friday, December 14, 2018 at age 92. He was a lifelong resident of Wilkes County and a member of Calvary Baptist Church for more than sixty-five years, thirty eight of which he served as active deacon. He was a master craftsman at Green Brothers Furniture, retiring after forty years to begin his own upholstery service. Cliff spent a lifetime loving and serving his family, church, and community. His life was a beautiful example of the value of hard work, constancy, integrity, faith, and kindness.
           Cliff was preceded in death by his parents, James and Etta Bare Faw, and siblings Geneva Eller, Virginia Deviney, Pritchard Faw, and Mazella Bumgarner.
           He is survived by his wife of seventy years, Iris Rae Miller Faw; three children, Gail Leger of Wilkesboro, Jerry Faw (Crystel) of Boomer, and Sandi Gambill (Steve) of Mooresville; eight grandchildren,   and six great grandchildren. He is also survived by sisters, Louise Lovingston of Boomer and Vivian Hamby of Ferguson. Cliff will be forever loved by his wife and family including numerous nieces and nephews, extended family, and friends.
           A graveside service was held  December 16, at Calvary Baptist Church, 1624 Pads Road, Wilkesboro, NC. Memorials may be made to Calvary Baptist Church or to Wake Forest Care at Home Hospice,126 Executive Drive, Suite 110, Wilkesboro, NC 28697.  Miller Funeral Service is in charge of the arrangements.

Ms. Marsha Elaine Alexander, age 57 passed away Tuesday, December 11, 2018 at her home.
           Funeral services were held  December 16, at First Baptist Church of North Wilkesboro with Rev. John A Speaks officiating.   Burial was in Woodlawn Cemetery.
           Ms. Alexander was born March 4, 1961 in Wilkes County to Marshall Horton and Bettie Denny Alexander.  She earned her Bachelor's Degree from Johnson C. Smith University and her Master's Degree from Appalachian State University. She was employed as a Program Coordinator with TRUE Behavioral Healthcare for high risk youth. Lanie consistently volunteered with various special needs programs including the Special Olympics. She was inducted into the Hall of Fame at Johnson C. Smith University, where she played and coached various sports. Lanie was a member of First Baptist Church of North Wilkesboro Main Street.
           She was preceded in death by her parents and a sister; Deborah Wilson.
           She is survived by a son; Trae Alexander of Charlotte, four sisters; Marion (Susie) Barber and husband Julius of North Wilkesboro, Mary Wilborn of North Wilkesboro, Denise Alexander and husband Tony of North Wilkesboro and Charlotte Carter and husband Calvin of Yadkinville, two brothers Richard Alexander, Jr. and wife Lillian of Washington, DC and Tony Alexander of Anderson SC and a brother in law; Tony Wilson of VA.

Mr. Warren Vance Dobbins departed this life on Monday, December 11, 2018 at the age of 51.
           Funeral services were held  December 17, at Pleasant Hill Baptist Church with Rev. Jamie Ferguson and Rev. Terry Hunt officiating.  Burial was in Mtn. Valley Missionary Baptist Church Cemetery.  
           Mr. Dobbins was born June 19, 1967 in Wilkes County to Barbara Thomas Dobbins Brown and the late Carl Dobbins.  He was a graduate of East Wilkes High School where he played football and participated in track. Warren also attended Wilkes Community College.  He was a member of Pleasant Hill Baptist Church where he operated their sound system. Motorcycles, working on cars, art, and assisting other people gave him the most pleasure.  He also loved dogs.
           Rejoicing in his memory is his Mom; Barbara Brown, a sister; Sabrina Dobbins, three nephews; Kevin Dobbins, Phillip Waldrup and Sydne Waldrup, his maternal grandmother; Grace Thomas, numerous aunts, cousins and friends.

   Leslie Sparks,  53
Leslie Neal Sparks, age 53, of North Wilkesboro, passed away Wednesday, December 12, 2018 at his home. He was born February 27, 1965 in Iredell County to Earnest Junior and Shirley Ann Holbrook Sparks. Mr. Sparks was preceded in death by his parents; and two sons, Richard Paul Neal Sparks and Scott Hawkins.
           Surviving are his wife, Pamela Sparks, sons, Dakota Barker, Cody Hawkins both of North Wilkesboro, Harvey Wilkins of Boomer, daughters, Starfire Wilkins of Pennsylvania, Angela Sparks of Jonesville, Taneesha Kerhoulas of North Wilkesboro; seventeen grandchildren; brother, Rodney Sparks and wife Denise of North Wilkesboro; niece and care giver, Jamica Sparks and numerous nieces and nephews.
           Memorial service will be private. Miller Funeral Service is in charge of the arrangements.  
 Helen Adams, 78
Mrs. Helen "Sue" Higgins Adams, age 78, wife of Fred Adams of Wilkesboro passed away Tuesday, December 11, 2018 at Woltz Hospice Home in Dobson.
           Funeral services were December 14,   at Goshen Baptist Church with Pastor Brian Miller officiating.  Burial was in the church cemetery.  
           Mrs. Adams was born February 14, 1940 in Wilkes County to Richard Billy and Beatrice
Reins Higgins.  She was a member of Goshen Baptist Church.  
           In addition to her parents, she was preceded in death by a sister; Margie Higgins Campbell and a brother; Bill Higgins.
           She is survived by one daughter; Wanda Sparks and husband Roger of Traphill, two sons; James Adams and wife Barbara, Kenneth Adams all of Wilkesboro, two grandchildren; Nicholas Adams and wife Cortney, Kayla Greene and four great grandchildren; Mason Adams, Maddie Adams, Lyndsey Greene and Kaleigh Greene.

Mary Carolyn Cox, 68, of North Wilkesboro, passed away Tuesday, December 11, 2018 at Wake Forest Baptist Medical Center. She was born October 19, 1950 in Ashe County to Jesse Long and Elizabeth Carolyn Halsey Cox. She was a member of Calvary Baptist Church, loved her church, gospel music and singing in the choir. She was preceded in death by her parents, two brothers, Bobby and Billy Cox; and two sisters, Betty Jean and Barbara Ann Cox.
           Surviving are her son, Tommy Coffey and wife Mary Doris of Millers Creek; two daughters, Susie Adams and husband William "Bo" of Millers Creek and Brenda Stanley and husband Barry of North Wilkesboro; a sister, Judy Roten of West Jefferson; a brother, Johnny Cox and wife Peggy of Todd; two grandchildren, Kevyn Adams and Cheyenne Adams of Millers Creek; and a great grandson, Luke of Millers Creek.
           A celebration of life service was held  December 14,  at Calvary Baptist Church. Rev. Mark Hall and Rev. Russell Sheets officiated.   Curtis Wingler, 89
Curtis Dent Wingler, age 89, of North Wilkesboro, passed away Monday, December 10, 2018 at Rose Glen Manor. He was born May 16, 1929 in Wilkes County to Morgan and Jane Sheets Wingler. Mr. Wingler was a US Navy Veteran. He was preceded in death by his parents; his son, Thomas Wingler; daughter, Mary Knight; and sisters, Virginia Jenkins and Georgia Osborne.
           Surviving are several grandchildren and many special friends.
           Graveside service with military honors by Veterans of Foreign Wars Honor Guard Post 1142 will be held 11:00 a.m. Wednesday, December 19, 2018 at Mountlawn Memorial Park with Pastor Ronnie Millsaps officiating. Friends and Family can pay respect and view Mr. Wingler from 8:00 until 10:00 a.m. on Wednesday at Miller Funeral Service. Miller Funeral Service is in charge of the arrangements.

Ms. Ida Ruth Farrington Stone, 89, of Wilkesboro, passed away Sunday, December 9, 2018 at Curis Rehabilitation of Wilkesboro.
           Ida was born November 26, 1929 in Ashe County to the late John and Verdie Faw Farrington.
           Including her parents, she was preceded in death by: seven brothers and sisters.
           Those left to cherish and honor her memory include: a son, Larry Stone of Wilkesboro; a sister, Bessy Hall of Ashe County; three grandchildren, Joey Stone of Wilkesboro, Matthew Stone of North Wilkesboro, Ashley Ayers of Purlear; two great-children.
           The family will conduct a private service at a later date.

Eulah Ray Huffman, age 86, of Purlear, passed away Saturday, December 8, 2018 at her home. She was born March 31, 1932 in Wilkes County to Turner and Elizabeth Cardwell Huffman. Mrs. Huffman was a member of Boiling Springs Baptist Church where she taught Sunday School for many years and was employed as West Wilkes High  School in the cafeteria. She was preceded in death by her parents; brother, Arvel Huffman; and sisters, Eva Brown, Janette Staley and Beulah Staley.
Surviving are her husband, Allie Laverne Huffman; daughter, Vickie Huffman of Purlear and brother, James Huffman of North Wilkesboro.
           Private family graveside service will be held. Miller Funeral Service is in charge of the arrangements.

Paul Dean Bowlin, age 79, of Millers Creek, passed away Friday, December 7, 2018 at his home. Mr. Bowlin was born September 25, 1939 in Wilkes County to Alvin and Dollie Roten Bowlin. He was a member of Union Baptist Church and a switch truck driver for Lowe's Distribution. Mr. Bowlin was preceded in death by his parents; grandson, Roger Dean Day; and sister, Melba Kay Bowlin.
           Surviving are his wife, Kay Walker Bowlin; son, Michael Keith Bowlin and wife Joan of Millers Creek; daughters, Lisa Diane Sprinkle of North Wilkesboro, Angela Dawn Day and husband Dale of Millers Creek; five grandchildren, Paul Hall, Dylan Hall, Cody Bowlin, Jasmine Day, Montana Day; sisters, Mary Bowlin of Ronda, Virgie Howie of Taylorsville; great grandchildren, Colton Hall, Ellie Hall, Ayda Hollman.
           Funeral service was December 12,  at Union Baptist Church with Rev. Julius Blevins and Rev. Steve Faw officiating. Burial followed in the church cemetery.              Flowers will be accepted ow memorials may be made to Union Baptist Church Cemetery Fund, 420 Colvard Road, Millers  Creek, NC 28651.

Priscilla Alice Corliss, age 76, of North Wilkesboro, passed away Friday, December 7, 2018 with her loving family by her side at Woltz Hospice Home in Dobson, NC. She was born October 9, 1942 in Laconia, New Hampshire to Raymond and Lillian (Couture) Corliss. Priscilla was retired from Belknap County Nursing Home with 25 plus years, where she received the Humanitarian Award. She was preceded in death by her parents.
           Surviving are her son, Bruce Faw and wife Robin of North Wilkesboro; daughter, Allison Marcotte and husband Corey of Barrington, New Hampshire; grandchildren, Jacob Faw and Isabella Marcotte; siblings, Raymond Corliss, Jr. and significant other, Deb Henry and Richard Henry, Trish Corliss and Kelly Brough all of Laconia, New Hampshire.
A service will be held in the                Spring of 2019 in Laconia, New Hampshire. In lieu of flowers, memorials may be made to Mtn. Valley Hospice, 688 North. Bridge Street, Elkin, NC 28621.                        Miller Funeral Service is in charge of the arrangements.  
  Oma Osborne, 95
Oma Pauline Osborne, age 95, of North Wilkesboro, passed away Thursday, December 6, 2018 at her home. Mrs. Osborne was born March 31, 1923 in Wilkes County to Allen Lawson and Phoebee Eleanor Horne Anderson. Oma was a member of Cricket Baptist Church and enjoyed quilting. She was preceded in death by her parents; brothers, Roy Anderson, A.L. Anderson, Jr.; and sisters, Virginia Williams and Magdaline Welch.
           Surviving are her husband, Eugene Garfield Osborne; son, Allen Osborne of North Wilkesboro; daughter, Rebecca Woods of Mulberry; grandchildren, Elton Osborne, Paula Adams and husband Billy, Dana Wingler and husband Nathaniel, Laura Shepherd and husband Shane, Tara Williams; fourteen great grandchildren; and two great great grandchildren.
           Funeral service was December 8,   at Miller Funeral Chapel with Rev. Steve Smith officiating. Burial was in Mountlawn Memorial Park.

  Rev. "Bud" Gene Curtis Shepherd, Sr., 90

    Rev. "Bud" Gene Curtis Shepherd, Sr., age 90, of North Wilkesboro, passed away Wednesday, December 5, 2018 at his home.
    Bud was born April 7, 1928 in Kanawha County, West  Virginia to Clarence and Nora Wingler Shepherd. Rev. Shepherd was ordained as a minster June 9, 1956. He helped establish Mulberry Tabernacle in 1956; he was the pastor and assistant pastor from 1956-1962 and again from 1974-1992. He pastored Buck Mountain Tabernacle, Buck Mountain, Virginia from 1957-1960; pastored Blue Ridge Pentecostal Assembly in 1962 and again from 1993-1996. He then helped establish Blue Ridge Tabernacle in McGrady in 1962 and pastored there from 1962 until 1974. Rev. Shepherd helped establish Harvest Time Ministries and Christian Academy, Inc. in North Wilkesboro in August 1996. He was the assistant Pastor at Harvest Time Ministries from 1997 until the present. Bud was Founder of the International Pentecostal Assembly for the Blue Ridge District in 1969; and overseer from 1969 until 1991. In the community, he was a charter member of Mulberry-Fairplains Fire Department for 21 years; served as Chaplain approximately 18 years and as President for several years. He served on the Board of Directors for Mulberry-Fairplains Water Department for 20 years; served on the Board of Directors for Beulah Heights Bible College in Atlanta, Georgia for 22 years and was owner and operator of Bud's Grocery from 1960 until 1973. Rev. Shepherd was preceded in death by his parents; grandson, Ronnie LaPrad; brothers, Thurmond, Bob, Bill and Harley Shepherd; sisters, Nella Byrd and Carrie Taylor.
     Surviving are his wife, Margie Key Shepherd; children, Linda Kay LaPrad and husband Steve of North Wilkesboro, Rev. Gene Curtis Shepherd, Jr. and wife Janice of North Wilkesboro; four grandchildren; four great grandchildren.
    Funeral service will be held 11:00 a.m. Saturday, December 8, 2018 at Harvest Time Ministries with Rev. Gene Shepherd officiating. Burial will follow in Mountlawn Memorial Park. The family will receive friends at Miller Funeral Service from 6:00 until 8:00 Friday night.   Hester Johnson Warren, 90

On December 3, 2018, Hester Johnson Warren, 90, peacefully transitioned to her Heavenly Home. Hester was born November 2, 1928 in Wilkes County to Smith Parks Johnson and Stella Johnson Johnson. She was one of fourteen brothers and sisters.
Hester was preceded in death by her parents, her husband of 70 years, Paul Eugene Warren, sisters, Dora Martin, Carolyn Sheets, Emily McHargue, Rebecca Dickenson, Fannie Roope and Mable Holloman and brothers, John Johnson, George Johnson and Harrison Johnson.
She leaves to cherish her memory two daughters, Carol Jean Byers and husband Gary, Wanda Triplett and husband Ronnie, one son, John Parks Warren and wife, Mary, three grandchildren, Kimberly Byers Buchanan and husband Clay, Amanda Blackburn and husband Matthew and Lesley Warren and (Jessica), two great-grandchildren, Sophia Grace Buchanan and William  Harrison Buchanan of Hickory, NC, one brother, Charlie Johnson and wife Sharon of Knoxville, Tennessee, three sisters, Annie Johnson, Ruth McHargue and Lucille Rhoades of North Wilkesboro, many nieces and nephews and a host of friends.
Hester was a beautiful person with a giving heart. She worked in the cafeteria at Fairplains Elementary School and Mulberry Elementary School for forty three years where she was very concerned that every child had a good lunch. She cared for many children in the Fairplains Community and kept the Nursery at Fairplains Baptist Church for fifty plus years earning her the name "Mama Hester". In 1966, Hester was named "Mother of the Year' by Fairplains Baptist Church. In March, 2016, Hester was recognized by the church (along with Reva McLean) with a dinner and plaque for being a longtime member with Outstanding Service to the Church. She joined Fairplains Baptist Church in 1946. She was very faithful and committed. She sang in the choir, served on the Nursery Committee, the Baptism Committee, the Food Committee, the Decorating Committee and Women on Mission and was always there to serve food and snacks to the children as well as adults every year at Bible School.
Hester baked delicious cakes for all events at the church, birthdays, deaths, showers, weddings and any other special occasions. She shared her cakes and homemade bread with many people all over Wilkes County. She was a very talented person, making crafts, baskets, dolls, jewelry, Easter bunnies and vests. She loved her bead class at the Senior Center where she was working on making Chrismons for the family. She squeezed lots of living out of her ninety years here on earth. Hester was loved by all and will be greatly missed.
Funeral services will be held 2:00 PM Thursday, December 6, 2018 at Fairplains Baptist Church with Rev. David Dyer and Rev. Glenn Dancy officiating. Burial will be in Mt. Lawn Memorial Park. The family will receive friends from 12:30 until 1:45 prior to the service at the church.  
The family would like to thank Dr. Jon Thompson and his staff, Dr. Evans and staff , the staff of Wake Forest Baptist Health-Wilkes Medical Center and Wake Forest Care at Home Hospice.

Hilda Johnson Hodges, age 73, of North Wilkesboro, passed away Saturday, December 1, 2018 at Novant Health Matthews Medical Center. Mrs. Hodges was born October 12, 1945 in Wilkes County to James Howard and Velna Wiles Johnson. She was a member of Christian Home Baptist Church. Mrs. Hodges was preceded in death by her parents; her husband, Robert Delos "Bob" Hodges; and a brother, Bobby Johnson.
  Surviving are her son, Robert Keith Hodges and wife Beth of Indian Trail; grandsons, Joel Stephen Hodges and Keith Evan Hodges; sisters, Joyce Hodges and husband Marvin, North Wilkesboro, Gina Nichols of Purlear, Ruth Faw and husband Steve of Millers Creek, Susie Caldwell and husband Venson of Hays.
Memorial service for Hilda and her husband Robert will be held 2:00 p.m. Saturday, December 15, 2018 at Christian Home Baptist Church with Rev. George Crawford and Rev. Chad Hendren officiating. DGB Grab Gag: Retconning the Knights, Touching Trophies, and Good Ol' Kerry Fraser
Three Stars of Comedy
The third star: The Golden Knights are feeling it – Laugh it up now, guys. Let's see how glib you are when you go through some rough times. You know, eventually. Probably some time in 2023 or so.
The second star: Ryan Miller's three-year-old son – This kid goes right for the jugular. I respect that.
The first star: This photo – I don't say this lightly, but this might be my favorite NHL photo of all time. Sorry, Bobby Orr, you had a good run. But this one captures the yin and the yang of what the league is all about: the overwhelming excitement of a game-winning goal, and the eye-rolling annoyance of basically everything else. It's perfect.
Debating the Issues
Editor's note: Due to an unforeseen scheduling conflict, this week's regularly scheduled debate is not available. In its place, please enjoy this rerun from June 2017.
This week’s debate: The expansion draft was held last night, and the Vegas Golden Knights finally have a roster. And wow, are they ever super-good! But was it wrong for the NHL to make it so easy for the Knights to become the Stanley Cup favorites right out of the gate?
In favor: I think it was. Sure, we all want to see new teams succeed, and nobody wants to go back to the days when the Senators or Capitals were terrible for years before they could build anything resembling a competitive team. But with last night's draft, the pendulum seems to have swung way too far to the other side. Because man, as everyone agrees, the Golden Knights are stacked.
Opposed: Well I… wait, sorry, what's happening here?
In favor: I mean, sure, it would be nice if the Knights could be in the playoff race in year one. We'd all have been on board with that. But instead, the league gift-wrapped the Knights with a championship roster from day one. I mean, talk about making it way too easy.
Opposed: They… they did?
In favor: Oh for sure. Imagine being one of the other teams in the Pacific, or even the Western Conference. You've been building up a team for years, hoping to contend someday. And then suddenly, you know you have no chance next year, because the league went and rigged the expansion draft to give the Golden Knights all the good players!
Opposed: [squinting at roster] I don't see any good players.
In favor: Look closer, because as fans around the league are unanimously declaring right now and certainly not with hindsight, the Knights are loaded. What team wouldn't want to start with established superstars like David Perron, Erik Haula, and Alex Tuch?
Opposed: I mean, those players are fine, I guess. But none of them are remotely considered stars.
In favor: And then there's Jonathan Marchessault, who's virtually guaranteed to score somewhere in the range of 74 to 76 points.
Opposed: He was good last year, but he's had one career season of more than 20 points.
In favor: And then there's William Karlsson. I mean, how could the league just hand these guys a 40-goal scorer?
Opposed: I… I don't actually know who William Karlsson is. What team did they get him from?
In favor: And then there's the goaltending.
Opposed: OK, yes, that's the one position we can agree on. Marc-Andre Fleury should be fine. He lost his job to a rookie in Pittsburgh, but he could absolutely give the Knights a solid option for a few years. As long as he stays healthy.
In favor: No, even if he gets hurt early and they have to use like five different goalies, they'll be totally fine.
Opposed: I don't understand anything you are saying right now.
In favor: And besides, Fleury will be healthy in time for the playoffs, at which point he'll turn into vintage Ken Dryden and lead the Knights to a Cup. Everyone is predicting this right now, in June of 2017.
Opposed: But Fleury has a reputation for being terrible in the playoffs.
In favor: And if having the best roster in the league isn't bad enough, the Knights also have the league's best coach (who was left at the curb by the Panthers) and the best GM (who made the Martin Erat trade). They're unbeatable! Everyone can see this!
Opposed: [looking around] what alternate reality is this?
In favor: The one where the expansion draft is rigged and everyone knows the league made it too easy on the Golden Knights. Duh.
Opposed: Yeah but, that's not what's happening. Everyone thinks the Knights drafted a terrible team. Literally every single person agrees on this point.
In favor: Well, everyone is wrong. And also, everyone is going to forget all about that by the time the Knights are about to win a Cup. Within about 11 months, we're all going to be complaining that the expansion draft was rigged and this was all inevitable.
Opposed: How do you know all this?
In favor: Uh, call it a hunch.
Opposed: Man. A Stanley Cup run? I'm just not seeing it. It seems impossible right now.
In favor: Trust me, it all works out.
Opposed: Wow. I guess this Shipachyov kid must turn out to be unstoppable.
In favor: Yeah, about that…

Obscure Former Player of the Week
The Capitals actually won a Game 7 this week, and they did it on the strength of a Braden Holtby shutout. It's fair to say that that's a reversal of the typical pattern when it comes to this team. And the only thing more painful than watching the Capitals lose a Game 7 is watching the Capitals lose the equivalent of two Game 7s on one night. So this week, let's bestow obscure player honors to Bob Mason.
Mason was an undrafted goaltender out of the University of Minnesota-Duluth who signed with the Capitals shortly after playing for Team USA at the 1984 Olympics. He made his NHL debut in a handful of games that year, and spent most of the next two years in the minors while serving as an occasional backup in Washington.
That changed in 1986-87, when Mason spent the entire year in the NHL splitting the crease duties with Pete Peeters. The Caps made the playoffs and took a 3-1 series lead against the Islanders in the opening round, so you can probably guess where this is going. The Isles extended the series to a seventh game, and Mason got the start. It would end up being one of the most memorable game sevens in NHL history: The Easter Epic, a quadruple overtime thriller that ended on Pat LaFontaine's winner.
Mason's stunned reaction was one of the greatest Sad Goalie Slumps ever, and is burned into the memory of most Caps fans to this day.
Mason was picked as the third goalie for Team USA in that summer's World Cup; by then he'd signed with the Blackhawks as a free agent. He spent a year in Chicago before being dealt to Quebec and then back to Washington, and he finished his NHL career with a half-dozen appearances for the Canucks in 1991. He bounced around the AHL and IHL for a few more years before retiring, having played 145 NHL games.
Mason went on to a career in coaching, and has been the goaltending coach for the Minnesota Wild since 2002.
Outrage of the Week
The issue: Both the Capitals and Golden Knights capped off their conference final wins by touching the trophies. The outrage: You never touch the trophy! Is it justified: We can all agree this stupid tradition can end now, right?
It was cool for a while, with a neat sort of "We only have one goal" vibe to it. Then it morphed into a superstition, which was fine. But then, like everything else in hockey that's vaguely fun, it was almost immediately beaten into the ground. Playoff beards were cool too, until they became mandatory and 19-year-old kids who'd never shaved in their lives were suddenly being brow-beaten about it if they didn't show up looking like a stunt double for ZZ Top. When "Don't touch the trophy" went from suggestion to commandment, any fun drained out of it. Once the NHL marketing department starts promoting something, you know it's run its course.
But now that both teams have done it, one of two things will happen. One, they'll catch some rare strain of influenza from the trophy and the Final will be cancelled. Or two, we can all stop pretending this is a thing.
Here's hoping we over-correct by steering in the other direction, and it becomes a competition to see who can come up with the most creative way to engage with the conference final trophy. Skate it around. Dance with it. Paint a little face on it, wrap a jersey around it and make it sit on the bench during the final. Give it a name and everything. "This is Campbell, he's our backup goalie tonight."
Just touch it. Or don't, if that's your thing. But let's all stop pretending the whole thing is endlessly fascinating.
Classic YouTube Clip Breakdown
We've spent some time over the course of the year reliving the 1992-93 season, i.e. the best NHL season ever. That was 25 years ago, and it can be fun to check the calendar and see what was happening, or about to happen, during that frantic season a quarter-century ago.
Which means right about now would be when we'd get to … sigh … look, can we talk?
Maple Leaf fans, I know you're expecting it. But we don't have to do this. Just because you hit yourself in the face with a hammer 25 years ago doesn't mean you have to relive it every year for the rest of your life. Remember a few weeks ago when we did the Wendel Clark/Curtis Joseph clip? Remember how happy we all were? Back when Curtis Joseph's head exploded? Good times. We can stay that way. There's no reason to go any further.
Yeah, you're right. We really don't have a choice. Fine. Roll the clip.
So it's May 27, 1993, and no I didn't have to look that date up, thank you very much. The date has been ingrained in the heads of Maple Leafs fans ever since. Literally, in some cases—some of us got tattoos. Don't judge until you've been there.
Here's the situation. The Maple Leafs are in L.A. to face the Kings in Game 6 of the Western Conference Final. Toronto leads the series 3-2, meaning a win sends them to the Stanley Cup Final for the first time since 1967. Waiting for them there: the Montreal Canadiens. It's destiny. It's going to happen.
But first, the Kings, who apparently missed the memo about the inevitable Leafs/Habs showdown. They've given Toronto a tough game and held a 4-2 lead late in the third. But Wendel Clark tied it up with the goalie out, completing a hat trick and quite possibly the best individual game by a Maple Leaf in the modern era, so now we're in overtime. Can you guess what's about to happen?
If you said "the worst thing ever," then you win.
The Kings are on the powerplay because Glenn Anderson took the Target logo literally, and they're set up in the Leafs zone. But Wayne Gretzky's shot is blocked, and while going for the rebound he clips Doug Gilmour under the chin, drawing blood. That's an automatic five-and-a-game back in 1993. But will they call it?
Seriously, will they? I've watched this clip roughly ten thousand times and I keep waiting for the ending to change.
Gilmour goes right to referee Kerry Fraser, who confers with his linesman. Meanwhile, Harry Neale knows exactly what's up. "Wouldn't this be something if Wayne Gretzky was thrown out for a high-stick." Indeed, Harry. Wouldn't it, though.
I know the whole "Kerry Fraser has great hair" thing was beaten into the ground over the years, but good lord, he really did have great hair. Look at it. He's been skating hard for three hours at this point, and it's immaculate. Meanwhile, I get my hair cut and step outside into a slight breeze and I immediately look like Neil Hamburger. Life isn't fair.
So Fraser talks with his linesmen, who don't seem to have much to say. It goes without saying that Fraser took a ton of heat over what comes next, and to some extent the buck stops with him. But as Don Cherry pointed out two nights later, his linesmen could have bailed him out here. Any of the three could have made the call; none did. But Fraser has been hearing about it for 25 years, and most Leafs fans couldn't even tell you who the linesmen were. Did we mention the part about life not being fair?
Gretzky's guilty face here is the best. He's every little kid who ever wet his bed and really hopes mom and dad somehow don't notice.
We get a decent replay, which makes it clear that this is indeed a penalty. To this day you still hear people try to make the "It was on the follow-through" argument. Those people are liars who deserve to be in jail.
Now comes the weirdest part of the clip, especially if you're a fan that's heard about this play but never actually seen it. Neale is breaking down the replay, and just casually slips in a "They're not going to give him a penalty by the look of it," and the game just continues.
Really, that's it. Nobody's all that shocked. Pat Burns doesn't throw a fit. Gilmour barely complains. Neale and Bob Cole kind of shrug. And the game continues. That's the weird thing about this play in hindsight—at the time it happened, it wasn't actually that big a deal. Even after Gretzky scores the winner a few seconds later, the missed call was considered one part of the story. Compared to what happens when a call gets missed today, the immediate reaction was pretty mild.
I'm not sure why that is. Part of me thinks it's because before Twitter, we were actually able to process things without immediately racing towards the hottest possible take. Or maybe it's because this was a West Coast game, and it was after midnight in Toronto and we were all too tired to get worked up. Or maybe everyone just kind of assumed the Leafs were winning Game 7 at home. Whatever it was, the missed call didn't really ascend to legendary status until after the Kings won the series.
Epilogue: The Kings lost to the Canadiens, ironically with help from another controversial Fraser moment. The Leafs have yet to get this close to the Stanley Cup Final again. Fraser admits that he missed the call, but has had to deal with criticism, conspiracy theories, and random idiots ever since. And Maple Leafs fans got over it, and certainly didn't drone on and on about it for decades.
Also, I still get angry every time I see a Target logo, but that's probably just me.

Arbitration cost’s going the litigation way — Is third party funding of arbitrations the way forward in India to curtail huge arbitration costs
Introduction
A well-known example of huge litigation costs is the famous defamation case of super model Naomi Campbell, against the publishers of the newspaper Daily Mirror. The trial court awarded damages of UK £3500. The decision was reversed by Court of Appeal[1] but restored by the House of Lords[2] by a majority of 3:2. While doing so, the House of Lords ordered MGN Ltd., the publishers of the newspaper to pay the costs in the Court of Appeal and in the House of Lords. The solicitors of Naomi Campbell filed a bill of costs of UK £377,070.07 in the trial court, UK £114,755.40 in the Court of Appeal and UK £594,470.00 in the House of Lords totalling a staggering figure of UK £1,086,295.47!
According to a Press Note released by the Government of India in August 2016 the total amount currently tied up only in infrastructure project related arbitrations is estimated at Rs 70,000 crores, one can imagine the costs that would be involved by the time the entire arbitral process fructifies. Today globally, various jurisdictions have recognised the benefits of third-party funding of arbitrations and have legalised the same.
The most common benefits of third-party funding are, it can provide access to justice for under-resourced parties (as is often the case in investor-State disputes), enabling them to pursue proceedings which a lack of financing would otherwise have prevented. For parties that are adequately resourced, funding can offer a more convenient financing structure, allowing capital which would otherwise be spent on legal fees to be allocated to other areas of their business during the proceedings. This article proposes to examine the Indian legal position vis-à-vis third-party arbitration funding.
Legal position in India
In India, third-party funding is expressly recognised in the context of civil suits in States such as Maharashtra, Gujarat, Madhya Pradesh and Uttar Pradesh. This consent to third-party funding can be found in the Civil Procedure Code, 1908, (CPC) Order 25 Rule 1 (as amended by Maharashtra, Gujarat, Madhya Pradesh and Uttar Pradesh) provides that the courts have the power to secure costs for litigation by asking the financier to become a party and depositing the costs in court[3].
Currently, there is no law which expressly bars or allows third-party funding agreements in arbitration. The Arbitration and Conciliation Act, 1996 (1996, Act) governs arbitration in India. As the 1996 Act is silent on this issue, third-party arbitration agreements have been rendered virtually non-existent in India. To date, no precedent on third-party arbitration funding exists and thus these agreements are uncommon.
Debate on common law doctrines of maintenance and champerty
Maintenance refers to funding of legal proceedings by an unconnected third party. Champerty is where a third-party funds legal proceedings for a share in the proceeds.
Although not directly deciding in relation to arbitrations, following are a few decisions which dealt with the issue of maintenance and champerty. A few are as old as passed by the Privy Council:
A constitutional Bench of Supreme Court, in G, Senior Advocate, In re[4], has noted that a champerty contract in which returns are contingent on the success of the case is not per se illegal, except in cases where an advocate might be a party[5]. While making a distinction between litigations that involve lawyers and those that involve non-legal persons, it was observed that in case of the latter, “…there was, nothing against public policy and public morals in such a transaction per se….”
The Privy Council, in Ram Coomar Coondoo v. Chunder Canto Mookerjee[6], while recognising that champertous agreements are void in England, held that this principle is not applicable in India, but would apply to a transaction which is “inequitable, extortionate and unconscionable and not made with the bona fide objects of assisting a claim”. It was observed in this case that the prohibition was not absolute, but restricted to “improper objects, gambling in litigation, or of injuring or oppressing others by abetting and encouraging unrighteous suits”.
In Ram Lal v. Nil Kanth[7] the Privy Council went so far as to hold that “agreements to share the subject of litigation, if recovered in consideration of supplying funds to carry it on, are not in themselves opposed to public policy”.
In Lala Ram Sarup v. Court of Wards[8], the Privy Council observed that given the uncertainties of litigation, the financier “may be allowed some chance of exceptional advantage”.
In Vatsavaya Ventaka Jagapati v. Poosapati Venkatapati[9], the validity of a charge on the probable decretal amount in favour of the financier was upheld by the Privy Council on the ground that the financier did not derive an undue benefit and was trying to recover only the amount loaned.
Additionally, if a third-party funding agreement contains an extortionate or unconscionable objective or consideration (e.g. recovery of a gambling debt), the agreement would be rendered unenforceable under the Contract Act, 1872.[10]
Projected risks of third-party funding
Despite the benefits highlighted above, there are concerns about third-party funding of arbitration and there is a level of projected risks involved. Clear insight into the potential downsides and sufficient risk preparation are therefore essential when making a decision on funding.
Under the 1996 Act, the claimant company would have to disclose any third-party funding agreement to verify the absence of any connections between the financier and the arbitrator[11]. There are primary risks that arise out of this disclosure for claimant companies. A respondent might use knowledge of the third-party funding to block the arbitration[12] at the outset, or if the arbitration proceeds, to challenge it on grounds of it being against Indian public policy[13] or the Contract Act.
Further, the claimant company is likely to face risks such as dilution of autonomy, conflict of interest, breach of confidentiality and discouragement of settlement as part of the third-party funding agreement because of the financier’s involvement.
As mentioned above these are merely projected risks, as neither the legislature nor the executive has provided an opinion on the issue of third-party funding agreements and the courts have not had a chance to verify their validity due to the absence of these agreements in relation to arbitration.
Assuming that third-party funding agreements are rendered legal for arbitrations, the risks would be best managed by legislating strict rules regarding: (a) the financier’s right to interfere; (b) penalties for duress and threat; (c) the right to terminate the funding agreement; and (d) rules regarding confidentiality and disclosures.
Conclusion
Arbitration funding is becoming increasingly prevalent around the world with funders who are legally sophisticated and understand a wide breadth of claim types, with each funder having a varying risk profile and appetite.
The International Council for Commercial Arbitration (ICCA), working with Queen Mary University of London, has created a taskforce that has examined third-party funding in international arbitration. Public consultation on the draft report ran from 1-9-2017 to 31-10-2017, with a view to adopt the final report in April 2018 at the ICCA Congress.
American Jurist Oliver Wendell Holmes Jr. had famously quoted:
The life of the law has not been logic; it has been experience. The felt necessities of the time, the prevalent moral and political theories, intuitions of public policy, avowed or unconscious, even the prejudices which Judges share with their fellowmen, have had a good deal more to do than the syllogism in determining the rules by which men should be governed.
In keeping with the felt necessities of the time and to keep pace with current economic scenario and the global developments in international commercial arbitration, it is essential that India considers legalising third-party funding of arbitration albeit, with external regulation in the form of statutory guidelines in order to set out the parameters within which a third-party funding agreement may apply. The proposed regulation should seek to maintain uniformity in relation to these agreements, which would further assist in regulating them. Further, it would prevent unscrupulous agents from misusing third-party funding agreements by establishing the necessary limitations and penalties.
