Daddy Dumplins is a play in three acts by George Barr McCutcheon and Earl Carroll based on McCutcheon’s novel. It was originally produced and staged by Earl Carroll starring Macylyn Arbuckle. 
The play takes place at Mr. Dumplins' country estate and his New York apartment.
Henry Daniel ‘Daddy’ Dumplins has been left a big fortune by a distant relative. To bring pleasure and happiness to others, he has adopted  seven children, making an addition to his family every two years. The huge fortune keeps them in comfort until the will is declared void and the money is given over to another heir. Daddy Dumplins is left without a cent and the children are returned to an orphanage. Christmas dinner is prepared in his now humble home where he has been able to have the children again for the holiday. All ends happily when the oldest child arrives with news that her real father has left her a fortune!

Maclyn Arbuckle (1866–1931) was the brother of actor Andrew Arbuckle and cousin of silent screen comic Roscoe "Fatty" Arbuckle. He performed on Broadway between 1899 and 1924 and also appeared in silent films. He was an attorney for a year before giving up the law to become an actor. 
In an unusual move, the play premiered in Canada by the Edward H. Robbins Players of Toronto. For this international opening, the title role was played by Thomas A. Wise.

Between the Toronto production and the US premiere, the leading role was recast with Maclyn Arbuckle for an October production on Broadway.

Daddy Dumplins had its American premiere at the Rochester NY Lyceum on September 27, 1920. From there, the play moved to Wilkes-Barre PA for one performance at the Grand on October 4th.

For the Wilkes-Barre engagement, a local drug store named a sundae after the play!  On October 5th and 6th the play performed at the Rajah Theatre in Reading PA. Next stop, Atlantic City!

It is said that Atlantic City was Earl Carroll’s favorite working environment and playground. Daddy Dumplins followed his play The Lady of the Lamp, which opened in Atlantic City in August 1920. His iconic revues The Earl Carroll Vanities were nearly all tried out in Atlantic City before moving to Broadway. For several years he also judged the Miss America pageant in Atlantic City.

The play opened in Atlantic City at the Woods Theatre on October 7, 1920. Although this was Carroll’s first solo producing effort, he rented the Boardwalk theatre of his former producing partner, A.H. Woods.  At age 27, Carroll was declared the youngest producer working in the theatre.

Carroll wrote the play while staying at the Traymore Hotel in Atlantic City during the winter of 1920.  The Traymore began as a small boarding house in 1879 and expanded and to become one of the city's premier resorts. By the early 1970s the hotel was abandoned and severely run down. It was imploded and demolished in 1972, a full four years before legalized gambling came to Atlantic City.

When the play opened in Atlantic City, he again stayed at the Traymore, registering the nine children (ages 3 to 13) cast members and understudies, as well as their attending nursemaids and stage mothers.

Not only did the play feature children, it also featured a dog! Rags was rescued from the pound and incorporated into the play.

After AC, and before NYC, Daddy Dumplins visited the City of Brotherly Love at the Lyric, the Nation’s capitol at Poli’s, where a free school matinee was performed on November 4th.  Just before moving to the Big Apple, it played Stamford CT.

Daddy Dumplins opened on Broadway at the Theatre Republic (now the New Victory) on 42nd Street on November 20, 1920, and played through January 1921, closing after 64 performances.

The children of the cast also to involved in the NY Daily News’ new shoes drive for underprivileged kids. 
After finishing their engagement at the Republic in mid-January 1921, the play moved to Brooklyn at the Majestic, then to the Lyric in Bridgeport CT and Yonkers NY.

After Yonkers, Arbuckle left the play and was replaced by Louis Mann. Carroll took the opportunity to re-write the script and re-titled the play to the grim moniker The Final Decision. That title was met with dismay, so Carroll instead chose the more apt His Sweethearts. Mann’s more svelte frame would require him to pad his costumes to conform with the image of the paunchy ‘Santa Claus-like’ figure of lore. Like his movie star cousin Roscoe (aka ‘Fatty’), Maclyn was known for his girth.

But before the curtain could rise on Mann’s reinterpretation, the production was postponed. Instead, the title reverted to Daddy Dumplins and the original script was licensed for stock and amateur performances.

In January 1921, as Daddy Dumplins was wrapping up on the East coast, Maclyn Arbuckle’s cousin Fatty starred in the silent film Brewster’s Millions, which also had a story written by George Barr McCutcheon, the author of Daddy Dumplins. While not exactly the same plot, the two scripts dealt with a man who inherits a fortune from a relative - with consequences. Brewster replaces Dumplins children with prospective brides. In reality, Brewster’s success led to McCutcheon writing Dumplins.

The film opened in Atlantic City at the Virginia Theatre on the Boardwalk on March 22, 1921. It inspired remakes in 1926, 1935, 1945, 1985, 2018, and one now (2022) in pre-production from Nasser Entertainment.  
The story had also been a Broadway play in 1906. It tried out at the Apollo Theatre in Atlantic City, but that’s another blog!

It’s February!!
Hi everyone!  It is Black History Month, LGBTQ+ History Month, and Aromantic Spectrum Awareness Week falls in this month as well!  You can expect a lot of content from us here, so prepare for that!
I’ll try to focus on a particular subject whenever I post, but today is going to be a bit of a smorgasbord.
 1. The 1619 Project
You might have heard this project mentioned once or twice and you can be forgiven for not being aware of the controversy surrounding the project in 2020; between BLM Protests, the start of (and horrific mishandling of) the Panama Canal we find ourselves living in, and murder hornets a lot was going on.  
The entire goal of the 1619 project is to re-contextualize the understanding of American History, by accounting for the story of slavery.  Even if you are a casual student of American history, it won’t take long to realize that our history is often told through the lens of white men--specifically rich white men.  But, that’s not the only story of this country--America was built on the exploitation of Black men, women, non-binary and queer folks.  Black and Native American narratives are often ignored in the teaching of history and the ahistorical understanding of our country leads to an ahistorical present.  
It’s...how white people can hop on a private plane, fly to the Capitol, and attempt to overthrow our government “because they’re being oppressed”.  
Anyways, whether you like the project or not, I challenge everyone to read more about out country’s history.  If you haven’t dove into history at all outside of school, chances are that there is a lot that you need to learn--the way history is taught now does not invite American citizens to look at our country with a critical lens.  To quote James Baldwin,  “I love America more than any other country in the world and, exactly for this reason, I insist on the right to criticize her perpetually.”  Do not confuse patriotism with nationalism. 
2. Centering Black Women
Teen Vogue (yes, Teen Vogue, do not look at me like that) recently published an op-ed that discusses the need for centering Black Women economically moving forward.  
I’ll drop a link below, but one of my favorite quotes from the article really sums up the thesis quite well.
“Brittany Packnett Cunningham puts it best: “When Black people win, everybody benefits.” And she’s right. The agency of Black women, especially, is the cornerstone of American democracy, and failing to acknowledge that fact will ultimately stifle any economic growth and progress for the country, which hurts every single American, regardless of race and gender. With the recent appointments of Joelle Gamble, Cecilia Rouse, and Jones herself in key economic posts, there is reason to believe that the reality of Black Women Best is well underway with the Biden Administration.“

3. The Future
A conversation about Black history would not be complete without a conversation about our present and future.  
Recent stories continue to not just display police violence against Black people, but specifically against Black children.  Below are some stories--trigger warning being police brutality...

Last week sixteen year old Taylor Bracey was horrifically body slammed by a school resource officer; the article does have video of the officer slamming Taylor, as a warning:

According to her mother she is suffering from memory loss, headaches, blurry vision, and sleep deprivation.  
The family is being represented by civil rights attorney Ben Crump who really sums it up well:
"He's supposed to be trained," he said. "It's foreseeable that children may get in altercations at school. You're not supposed to knock them unconscious. You're supposed to be the person who knows how to de-escalate the situation. It's just mind-boggling."
"This is the adultification of Black children -- that our children are seen as adults," he added. "No, no, this was a child."

And it’s never a bad time to remember Tamir Rice (twelve) and Trayvon Martin (seventeen) and even recent incidents like Miya Ponsetto (aka “SoHo Karen”) who attacked fourteen year old black child because she accused him of stealing her iphone (and, infamously, looked like a whole mess trying to defend herself during a Gayle King interview by claiming that she was “only twenty-two”--of course Gayle snatched her up gracefully).  I say all of this as a reminder that there has always been a pernicious “imagining” of the Black body and the adultification (seeing Black kids as older than what they are) of Black Youth is but one of the many very dangerous forms this form of racism takes shape today.  Protecting Black women, protecting Black trans-women, protecting Black youth is important--and seeing these folks victimized by the law in every form needs to be fought against. 
In short; defund the police (let’s have no resource officers in schools and more social workers/counselors!), challenge whatever prejudices and assumptions you may have, center Black women and Black female voices, and read up on your history kids.

dinah was the only child of adam and davina perlman, born in rochester, new york. she grew up a happy girl, with a close bond to both of her parents, who were also happily married. as a small girl in a situation as privileged as the one she was in, she had no idea just how rare it was. she attended many classes and spent all of her free time doing activities with her parents, it was almost a childhood out of a fairytale.
DEATH TW. it was unfortunate, but very early in her life, the peaceful and loving world she’d been raised in would be ripped away from her in an instant. she was ten years old when the accident happened. it was a head-on collision, and according to many, dinah had been lucky to have survived the hit, especially with as little injuries as she did. whereas her parents hadn’t been so lucky, and had died either instantly or before reaching the hospital. 
she had only ever been close to her parents, she had never even met any extended family. so it was a surprise when her uncle, her father’s brother, stepped up and volunteered to take care of his brother’s only daughter, just as he had done with his company — as a way to honor his memory, he had said.
ABUSE TW. dinah moved into her uncle’s house in hermosa beach, california, soon after all formalities were over and done with. lifestyle wise, it wasn’t too bad of an adjustment, maybe just the warm winters were the ones that confused her the most. but everything else... it was a very chaotic change in dinah’s life. to begin, her new guardians, her uncle and aunt... they weren’t nearly as kind as her parents had been. they would put her down with every chance that appeared, only to then tell her it was for her own good. not to mention they were so dead set on keeping up this... perfect family façade with her uncle being the new ceo of the family company and whatnot, especially when she knew how they spoke of everyone involved behind their backs, how they acted with each other behind the scenes... all the yelling, the blaming. it made for a very confused young dinah, when it came to social interactions.
dinah’s only saving grace growing up in california was her cousin, natalie. the two were close in age, and she found solace in the girl. natalie reminded her a little bit of what her life had been like in upstate new york, she had this soft character that reminded her of her mother. despite going through the same stuff, natalie had always chosen to be kind and remain herself, so she wouldn’t become bitter like her parents had. so the girls were best friends, and in all formality, they were like sisters.
in high school, dinah had no problems making friends — but there was always something missing. she had learned how to treat people and have them like her from her new family, but she had never really been able to have a connection like the one she had with her parents in her early youth. until alexander came around. he was going through a whole new kind of shit that dinah couldn’t quite grasp, but she understood the motions of grieving and losing someone you love. they became close friends, and eventually, dinah’s first serious relationship.
despite her new family’s thoughts, she moved to new york city with alex with the premise of going to college. it wasn’t a complete lie, but it was also an excuse to leave that home and build something with her love, something that could become what she had had in her childhood, to her future children. it all seemed like it was falling into place: her degree in psychology and an engagement to the love of her life.
of course though, based on past experiences, dinah had some suspicion with how well her life was going. it usually ended up a preface to something terrible, something she had no control over. and well, her suspicions ended up being correct — while she attended law school, her previously perfect relationship with alex quickly deteriorated... until there was nothing else to do. and the engagement ended fairly quickly after she realized they had reached that point of no return. 
very much in her feelings about the failed engagement, dinah began refusing the love and care natalie would always offer. it came as something hypocritical to her, as she seemed to be so happy with her partner, that her parents seemed to love so very much. why couldn’t they have supported her, too? and why hadn’t natalie defended her?
DEATH TW. the woman decided to stay in new york despite the clusterfuck that it had become, dinah refused to make any appearances in california, she hadn’t even attended natalie’s baby’s birth. but she would soon regret her choices, as a year or so after the baby’s birth, dinah received the news that both the baby and nat had died in a car crash. of all things, a fucking car crash. part of her felt like she held some curse, and maybe that was why alexander had fallen out of love with her so quickly.
these kind of situations will harden up anyone. the woman placed her focus almost entirely on her work, doing some paralegal work in a number of offices, until reaching the district attorney’s office, recently getting the job as an assistant district attorney.
after natalie’s death, dinah actually came to learn that her relationship with her baby’s dad wasn’t as accepted with their family as she had first thought (which infuriated her. how could she not have known? they did the same to her!) and how little her uncle seemed to care. how he was mostly angry at the inconvenience. since then, there’s been some alarm bell ringing every time she has to be in contact with the man. she’s turning a blind eye to the suspicion, but she’s starting to think that her parents’ death was way too similar to natalie’s.

dinah has tried to channel her negative energy since losing natalie into self-defense. she’s proficient in krav maga and kickboxing!
very recently though, she realized aggression wasn’t the best way for her to go about things (although self-defense has proven to be useful in the city and in the courtrooms), dinah found a healthier way for her to let out her energy: dancing. nothing fancy, she attends some classes and loves throwing it back on the weekends lmao
her apartment complex doesn’t allow pets, but she’s befriended a feral cat that she feeds and pets every so often. still needs a name for the cat.

Ricardo Harris is an innocent African American Deaf man who has been imprisoned in Georgia since 2013 for a crime he did not commit. We are working to raise funds to try to pay to retain Attorney J.Scott Key to hopefully help free him. Ricardo was wrongfully convicted and sentenced to life in prison in July 2015. In January 2013, Ricardo was visiting his friends in Georgia on a winter break from college when he found himself in the wrong place at the wrong time at a hotel. Ricardo went to the front desk receptionist and requested they call 911 but they refused to call for him. Ricardo then drove to the closest gas station and asked the cashier to call 911. The police arrived and communication breakdowns started immediately. Ricardo’s primary language is American Sign Language (ASL). Many of the errors in this case occurred because the Cobb County Police Department and Ricardo’s own attorney failed to provide qualified ASL-English interpreters for critical communication. Instead of providing qualified interpreters, Cobb County forced Ricardo to write in English and only provided an unqualified, uncertified former employee who knew basic signs. Ricardo’s attorney--who was disciplined for behavior in other client’s cases during the time he was representing Ricardo--also failed to provide effective communication for communication during critical communication. Ricardo’s trial attorney who the family paid $50,000 even allowed officers to continue questioning Ricardo with the unqualified employee and without the benefit of a qualified attorney to verify information. As a result, there were numerous misinterpretations and miscommunications during critical first communications. Without interpreters and effective communication, he could not participate in his own defense. All of this and much more was a violation of his civil and Constitutional rights. Ricardo would learn later that misinterpreted and written statements with police officers would be used against him in court. Officers in the court said that Ricardo repeatedly lied to officers during their interviews, stating that he changed his version of events several times. But this “changing of stories” is a clear example why violations of federal disability rights laws like the Americans with Disabilities Act require police to provide effective communication when interacting with deaf and disabled people. Ricardo has faced legal challenges largely due to communication barriers that are not recognized by police, lawyers or the courts. He has been in jail and prison with limited to no communication with his attorneys, advocates, and loved ones including a young child since 2013. Since his wrongful conviction, Ricardo and his family got another lawyer to work on his appeal for a new trial. In February 2019, Ricardo’s motion for a new trial was denied. After that denial, Ricardo’s appeal went to the Supreme Court of Georgia for review. In January 2020, the Georgia Supreme Court reviewed his case and upheld his conviction.Today, Ricardo still fights for his innocence. He is on a long wait list for help from the Georgia Innocence Project. Rather than wait for what may be years before the Georgia Innocence Project can possibly take on his case, Ricardo and his family are  exploring the option of filing a writ of habeas corpus. On March 22, Prude, 41, got an Amtrak train from Chicago to Rochester to visit his brother. He was behaving unusually when he arrived and had threatened to harm himself, Joe Prude told The Appeal, so he contacted the police and had his brother taken to the hospital. But he was released within hours, Joe Prude said. Later, in the early morning hours of March 23, Daniel Prude asked his brother for a cigarette, then suddenly ran out the back door.
So Joe Prude called the police again. An officer arrived, and Joe Prude told him his brother was only a danger to himself, and told police not to kill his brother.
Body camera footage from the responding officers shared with The Appeal shows police found Prude at around 3 a.m., walking naked and bleeding down Jefferson Street. Rochester police officer Mark Vaughn pulls out his taser and tells Prude to get on the ground and put his hands behind his back. Prude immediately complies and is handcuffed without incident. After touching Prude, Vaughn returns to his squad car and uses hand sanitizer on his gloved hands.
“That was easy and fast,” Vaughn says as he walks back to Prude. At least five Rochester police officers stand over Prude, who is lying on his stomach on the cold, wet ground with his hands bound behind his back, rambling and saying the same phrases over and over. Snow is falling on him.
Prude appears to spit several times while on the ground, but not at the officers. One of the officers asks if anyone has a spit sock.
“Sir, you don’t got AIDS do you?” Vaughn asks Prude, who is writhing on the ground and repeating himself.
Another officer again asks for a spit sock, and though Prude is handcuffed on the ground and all of the officers are standing a few feet away from him, Vaughn pulls one out of his pocket and puts it over Prude’s head.
“He complied with all of their demands, and then they treated him like a piece of garbage with not even one speck of basic humanity,” Elliot Dolby-Shields, an attorney representing Prude’s family, told The Appeal. “No, ‘Hey are you alright? Hey, can we get you a blanket?’ … It’s freezing out and he’s naked. They don’t offer him anything.”
When Vaughn covers Prude’s face with the spit sock, Prude’s demeanor changes. Though he continues to ramble, his voice begins to quiver, and it sounds like he is on the verge of tears. He repeatedly asks officers to take the mask off his face, and tells officers to give him their mace, handcuffs, and guns.
After about a minute of this, while Prude is sitting upright but still handcuffed and on the ground, Vaughn and officer Troy Taladay approach Prude and push him onto the ground.
The two can be seen pinning him down, Talady kneeling on Prude’s back and Vaughn pushing Prude’s face into the ground, while Prude repeatedly asks the officers to get off him. Prude’s speech becomes garbled and difficult to understand. He cries and makes sputtering sounds, but the officers don’t relent.
“Relax dude, you’re gonna end up getting tased,” another officer tells Prude as he begs Vaughn and Talady to get off him.
Two emergency medical technicians arrive in an ambulance and approach the officers, who continue to mock Prude as he whimpers on the ground, wet snow covering his naked body. A police report says that officers believed Prude had stopped breathing by the time the EMTs arrived. In the body camera footage, one EMT can be heard asking if Prude feels hot.
“Do you want me to take his temperature?” Talady says sarcastically, pointing to Prude’s buttocks. The EMT laughs. Prude has already stopped moving and talking at this point, but Talady continues to kneel on the man.
“At first he’s talking, and then he’s whimpering, and then he goes silent,” Dolby-Shields said. “And they all laugh. They’re having a good time, and you can see at that moment that his hand stops twitching, and his chest stops going up and down, and he’s dying, and they’re just casually making jokes.”
One of the EMTs asks if he has a pulse. Another EMT says no. They start performing CPR, and Vaughn walks back to his car to grab more hand sanitizer. Officers uncuff Prude and get him onto a gurney. Medics managed to resuscitate Prude. A doctor later told Prude’s sister-in-law that he had been deprived of oxygen for a long time, and he was most likely brain dead, according to a police report.
As far as Joe Prude is concerned, his brother functionally died before making it to the hospital. “He died there. They just took him to the hospital and put a tube in him,” he said. With no sign of brain activity, the family decided to take Prude off life support the following week.

BOSTON — A federal jury on Thursday found the top executives of Insys Therapeutics, a company that sold a fentanyl-based painkiller, guilty of racketeering charges in a rare criminal prosecution that blamed corporate officials for contributing to the nation’s opioid epidemic.
The jury, after deliberating for 15 days, issued guilty verdicts against the company’s founder, the onetime billionaire John Kapoor, and four former executives, finding they had conspired to fuel sales of its highly potent drug, Subsys, by not only bribing doctors to prescribe their product but also by misleading insurers about patients’ need for the drug.
The verdict against Insys executives is a sign of the accelerating effort to hold pharmaceutical and drug distribution companies and their executives and owners accountable in ways commensurate with the devastation wrought by the prescription opioid crisis. More than 200,000 people have overdosed on such drugs in the past two decades.
Federal authorities last month for the first time filed felony drug trafficking charges against a major pharmaceutical distributor, Rochester Drug Cooperative, and two former executives, accusing them of shipping tens of millions of oxycodone pills and fentanyl products to pharmacies that were distributing drugs illegally.
And the state attorneys general of Massachusetts and New York have recently sued not just Purdue Pharma, the maker of OxyContin, but also members of the Sackler family who own the company — and who have largely escaped personal legal penalties for the company’s role in the epidemic, culpability they deny.
Also on Thursday, the state of West Virginia reached a $37 million settlement in a lawsuit against the McKesson Corporation, one of the nation’s leading drug distributors, which was accused of shipping nearly 100 million doses of opioids to residents over a six-year period.
Experts said the Insys verdict could encourage other corporate prosecutions and said it demonstrated that the public was willing to mete out penalties for high-level executives at companies profiting from the sales of highly addictive painkillers.
“Just as we would street-level drug dealers, we will hold pharmaceutical executives responsible for fueling the opioid epidemic by recklessly and illegally distributing these drugs, especially while conspiring to commit racketeering along the way,” said Andrew E. Lelling, the United States attorney in Massachusetts who pursued the case.
Abbe Gluck, a Yale law professor, said “the case paints a picture of the kind of troubling industry practices that helped fuel the opioid epidemic.” And the verdict “shows that a jury is willing to punish for them.”
The federal government had previously brought civil racketeering charges against drug companies for promoting their drugs for unapproved uses, said Richard C. Ausness, a law professor at the University of Kentucky who has been tracking opioid cases. Bringing criminal racketeering charges, he said, “raises the stakes by a lot.”
“This could be the tip of the iceberg as far as drug company misconduct is concerned,” he said.
During the 10-week trial, federal prosecutors had detailed Insys’s audacious marketing plan — which included paying doctors for sham educational talks and luring others with lap dances — to spur sales of Subsys, an under-the-tongue spray approved to treat patients with cancer.
Company executives were accused of paying doctors to write prescriptions for a much wider pool of patients than the drug was approved for, and of misleading insurance companies so they would cover the potent and pricey medication. With the drug’s sales soaring, Insys became a darling of Wall Street, generating annual sales at one point of more than $300 million.
In addition to Mr. Kapoor, the other executives found guilty were Richard M. Simon, the former national director of sales; Sunrise Lee and Joseph A. Rowan, both former regional sales directors; and Michael J. Gurry, former vice president of managed markets. Lawyers for the defendants either did not comment or said they planned to appeal.
The former chief executive, Michael L. Babich, had pleaded guilty to conspiracy and mail fraud charges.
Beth Wilkinson, a lawyer for Dr. Kapoor, said she and her client were disappointed in the verdict. “Four weeks of jury deliberations confirm that this was far from an open-and-shut case,” she said in a statement. “We will continue the fight to clear Dr. Kapoor’s name.”
Jackie Marcus, a spokeswoman for Insys, said the verdict was not representative of the company’s mission, but only reflected the “actions of a select few former employees of the company.”
One of the few other criminal cases against drug company executives involved another opioid manufacturer, Purdue Pharma, whose executives pleaded guilty in 2007 to criminal charges that they misled regulators, doctors and patients about the addiction potential of the painkiller OxyContin.
At the Insys trial, the government suggested that executives at the Arizona-based company often operated like drug dealers and that Mr. Kapoor was the ringleader.
“The decisions, the money, the strategy came from the top,” K. Nathaniel Yeager, a federal prosecutor, said during closing arguments.
Details of Insys’s strategy from 2012 to 2015 to target doctors and allegedly bribe them have been revealed in lawsuits and news reportsfor about five years. The trial of Mr. Kapoor and his four co-defendants has brought to light the extent to which the schemes permeated the entire company and its national sales team.
Former Insys sales representatives, testifying for the prosecution, said their bonuses were tied to the dosages of Subsys prescribed by the doctors they recruited. The higher the dose, the higher the bonus. Evidence presented in court showed that sales representatives had to justify low doses to their boss within 24 hours.
Not only did Subsys cost more at higher doses, but patients were also more likely to become dependent on the highly addictive medication. Subsys is up to 100 times more potent than morphine. Abuse of fentanyl, especially black-market versions imported from overseas, have increasingly contributed to the opioid epidemic.
Alec Burlakoff, the former vice president of sales at Insys, pleaded guilty to one count of racketeering conspiracy. He wrote in an email read at trial that patients on high doses would be desirable because they “will continuously refill their monthly prescriptions indefinitely.” Court filings in a separate case suggest Purdue Pharma, the maker of OxyContin, pursued a similar strategy.
Two Insys sales representatives made a rap video in 2015 about titration, the technique used to increase a patient’s dose. The main lyric: “I love titrations, and it’s not a problem. I got new patients, and I got a lot of them.” The video, in which the salesmen dance alongside a person in a Subsys dispenser costume, was shown at a national Insys sales staff meeting where Mr. Kapoor was present.
Testimony from government witnesses suggested there were few limits to what the Insys sales team was willing to do. Mr. Burlakoff, who testified for the prosecution as part of a plea deal, said the company purposefully targeted doctors with a history of liberally prescribing opioids. “Pill mills, for us, meant dollar signs,” he told the jury. “It was not run the other way. It was run to the pill mills.”
Holly Brown, a former Insys sales representative in the Chicago area, testified that she saw her boss, Ms. Lee, a former exotic dancer, give a doctor a lap dance hoping it would encourage him to prescribe Subsys.
After doctors had prescribed Subsys, the company focused on persuading insurance companies to cover the drug, which can cost thousands of dollars a month. Jurors heard recorded calls from the Insys Reimbursement Center in which employees posed as doctors’ assistants and invented diagnoses that would smooth the approval process.
“Insurers were told about medical things that never happened,” Mr. Yeager told the jury. “They told deception after deception after deception on recorded lines.”
While the legal strategy may be noteworthy, evidence has emerged that aggressive marketing of opioids is far from unique to Insys.
In a similar effort to hold individuals accountable, the attorneys general in New York and Massachusetts have recently turned their attention to the Sacklers, the family that controls Purdue, filing lawsuits that allege members of the family pushed their company to aggressively sell opioids like OxyContin, despite the high risk for addiction.
There have been nearly 218,000 overdose deaths related to prescription opioids since OxyContin was introduced in 1996, according to the Centers for Disease Control and Prevention.
Insys has struggled to move past its legal troubles. The company’s stock currently trades at around $4 per share, down from a high in 2015 of nearly $45, and it has disclosed to investors that it is at risk of going out of business. Last month, the company — which also sells a liquid form of an anti-nausea drug derived from cannabis — announced it was replacing its president and chief executive, Saeed Motahari, who had joined the company in 2017.

Amer Sinan Alhaggagi was sentenced today to 188 months for attempting to provide material support to a designated foreign terrorist organization and identity theft charges.

Schuyler County Attorneys to Present at New York State Public Welfare Conference
Schuyler County Attorney Steven Getman has announced that two assistant county attorneys will share insights on child abuse investigations and court orders at the upcoming New York Public Welfare Association (NYPWA)’s Winter Conference on Thursday (January 20).
 Assistant County Attorneys Kristin Hazlitt and Vinton Stevens will present a one-hour continuing legal education class, “Obtaining a CPS Access Order When Efforts at Persuasion Fail.”  The course, designed for new and experienced attorneys, will look at cases where Department of Social Services child protective services (CPS) and law enforcement respond to a location after receiving a report of possible imminent danger to a child’s life or health and the adult subjects refuse to allow access to the home or child.
 “Although DSS is usually able to obtain voluntary access to a home to investigate concerns about possible child maltreatment, occasionally a parent will refuse access,” Getman explained. “This presentation will discuss the law, the rights of the children and parents and administrative guidance for obtaining an access order in these situations.”
 This year’s annual NYPWA winter conference, its 153rd, will be held virtually on January 18-21 and January 24-28.
 NYPWA was founded in 1869 as the first public welfare association in the United States. It independently represents all of New York's 58 local social services districts. NYPWA is an active partner with government agencies, associations, and community organizations. It fulfills a key public role while presenting a variety of opportunities to exchange ideas, develop new initiatives, and refine existing programs and services.
 The Schuyler County Department of Social Services is the lead civil investigative agency for cases of alleged child abuse and neglect and works with the Schuyler County Sheriff and other law enforcement agencies to investigate suspected maltreatment.
 The Schuyler County Attorney is the prosecuting attorney for all county agencies involving civil cases, including family court matters involving abuse and neglect.  Assistant County Attorneys are appointed by Getman, as County Attorney, to assist with the litigation of the various types of civil cases brought by the county.
 Hazlitt is originally from Schuyler County and commenced her legal career in Washington, DC after graduating cum laude from American University, Washington College of Law in 1989. She joined the county attorney’s office in 2002. Stevens was born and raised in Elmira, graduated from the University of Rochester and Temple University School of Law and has worked for the county since February 2019.
