One thing that inspired me greatly was as a teenager, like 10-12 years ago i watched a documentary called RIP : A Remix Manifesto and like its an incredible documentary and it really made me hate the copyright systems thats been in place since the 70s because it really no longer is about protecting the creative works of people and more corporations sucking up as much control and money as they can possibly get. I really recommend that documentary it interviews a lot of artists who remix stuff in their works and is really well done.

Le droit d’auteur face à la culture du remix

Le documentaire RiP : remix manifesto, de Brett Gaylor sorti en 2008 impose une bonne réflexion éthique et morale sur la propriété intellectuelle. Dans son documentaire, il est fait état du droit d’auteur et de la propriété littéraire et artistique.

En effet, le réalisateur prend comme exemple « le roi des collages musicaux de Pittsburgh, Girl Talk. » Ce passionné de remix crée des pièces musicales originales à partir de chansons connues. Il qualifie son art de « mashup musicaux ». Bien évidemment, il ne demande pas la permission à chaque artiste s’il peut utiliser leurs chansons. Le résultat de son art : des plaintes et des poursuites.

Plusieurs questions sont soulevées dans le documentaire. Par exemple : pourquoi est-ce illégal ? L’œuvre ne représente en rien ce que l’artiste original a produit, c’est une autre œuvre en soi. Le rendu est totalement unique et les pièces d’origine utilisées ne sont presque pas reconnaissables. Alors pourquoi les poursuites ?

C’est à ce moment que les points de vue divergent et que la notion de propriété intellectuelle, surtout celle sur le droit d’auteur devient flou.

L’industrie et les gouvernements devraient revoir les barrières perméables et les cas d’exceptions de la propriété littéraire et artistique. Espérons que d’ici quelques années de nouvelles lois seront là pour restreindre et contrôler ce domaine.

30 seconds to mars: artifact (2013) covers the band’s struggle with virgin/emi, the doc with the most concise explanation of how the industry/labels work/’own’ the artists. 

metallica: some kind of monster [netflix] (2004) many insights on band dynamics. when setting out to record XX metallica hired a therapist to work through their issues. many insights on band dynamics, including dave mustaine who returns to confront them years after leaving the band.

robyn: don’t fucking tell me what to do (2011) discusses the difficulties of growing up in the spotlight; getting dropped and held back and getting back into the swing of things.

backstreet boys: show 'em what you're made of (2012) the rise and struggles of a boyband including all the dirty tricks they were subjected to, and some of the legal battles they fought to remain together as well as the band’s internal frictions are covered.

no room for rockstars (2012) warped tour 2010 behind the scenes, chronicling the rise and stalling of various artists. 

kate nash: underestimate the girl (2019) starting after kate nash was dropped from her label, nash attempted to regain ground on her own in the US. unfortunately her manager seemed more intent on stealing money from her.

vh1 behind the music: boy george/culture club  insight into the friction of having a closeted couple in the band, and the repercussions that followed from drugs and interpersonal issues.

chasing happiness (2019) documents the jonas brothers career up to their reunion. mostly about them personally but features some interesting tidbits about career dynamics, expectations and radio leveraging airplay.

the punk singer (2013) this film is about kathleen hanna, the front woman of bikini kill and le tigre but it covers the whole riot grrrl movement pretty well, with a dash of courtney love drama and all that. good for history.

take that for the record (2005) & take that look back don’t stare (2012) lots of ups and downs; interpersonal dynamics including members leaving and intense feuds that are overcome, overbearing managers, regaining controls of their careers.

dixie chicks: shut up and sing (2006) covers the fallout from the onstage comments they made about president bush. lots of industry politics.

rip!: a remix manifesto (2008) - on the history of file sharing and the laws surrounding copyright and remixes.

wilco: i am trying to break your heart (2002) profiles the recording of ‘tango foxtrot hotel’ and the band being dropped from their label after submitting their album.

the decline of western civilization part ii: the metal years (1988) an incisive look at the boom of the metal years. wannabes, fans and stars feature heavily. 

whitney (2018) closeting, pr stunts, greed and drugs. an incisive and heartbreaking look at how everyone around whitney houston let her down or wanted something from her.

SÉANCE #08 — Tous les jours j’écoute du Madlib

La réinterprétation en art est très vieille. On peut penser aux grands livres de religions abrahamiques qui sont en partie basés sur les mêmes événements et personnages. Peu importe qu’il soit perçu comme positif ou négatif, l’impact de ces œuvres littéraires sur la culture à l’internationale est indéniable. Il n’existe pas de mouvement prétendant que ces œuvres ne sont pas originales à cause de cette réutilisation et réinterprétation de certains passages, personnages et événements. De nos jours, plusieurs mouvements artistiques visuels modernes, dont l’Art pop et le graffiti, ont mené à la normalisation du remix et du collage, ce qui à ensuite mené à des mouvements musicaux comme le Hip Hop et la musique électronique au sens large. Le remix est lorsqu’un artiste réuni des sons, des images et/ou des vidéos d’origine disparate pour en faire une sorte de collage qui porte une signification autre que l’original, « le dialogue entre ces images, et par conséquent la communauté qu’il fait exister, ne sont réellement créés que par le montage » (Galibert-Laîné, 2018, p. 10) Même si certains s’y opposent, je crois fortement à la validité artistique et au droit au remix et au sampling, et ce, que j’aime l'œuvre en question ou non. Si ce n’était d’artistes comme J.Dilla et Madlib et de leur technique de « sampling », la musique moderne serait drastiquement différente (Charnas, 2022, paragr. 1). Aujourd’hui, plusieurs obstacles entravent la liberté de création de ces artistes. En effet, selon le documentariste derrière RiP : remix manifesto et plusieurs autres, les présentes lois de droit d’auteur et de brevet nuiraient à la créativité et à la liberté artistique et ne profiteraient qu’à certaines méga-compagnies comme Disney et autres, et non aux artistes qu’elles défendent supposément (Gaylor, 2008, 00:01). Plus largement, selon moi, il est nécessaire de protéger le droit au remix car la culture numérique en dépend. Il est très difficile de passer plus de quelques minutes sur un réseau social sans apercevoir la réinterprétation d’une œuvre d’art par un utilisateur, sous la forme de meme ou autre. Par contre, certains perçoivent le remix d’un bon œil comme étant une opportunité publicitaire et de marketing gratuite, et ce, même si le numérique crée des courts-circuits entre « les productions des industries culturelles et la créativité des internautes » (Cardon, 2019, p. 193), il est donc intéressant de voir quelle école de pensée va l’emporter.

L’arrivée d’Internet, dans les années 1990 a permis aux gens de partout à travers le monde de se connecter sur différents réseaux de télécommunications. Cette technologie qui ne cesse d’évoluer offre d’innombrables informations aux utilisateurs et ce par de multiples formes. De ce fait, il nous est tous arrivé de consommer, à un moment ou à un autre, du contenu culturel illégalement, soit de façon directe ou indirecte. Ainsi un questionnement s’impose, à savoir si le modèle actuel de la propriété intellectuelle s’adapte encore aux technologies numériques (Pénin, N.D).

Dans une perspective de marchandisation, il faut défendre le copyright. Le droit d’exploitation protège les personnes qui investissent dans la propriété intellectuelle soient leurs œuvres et leurs exploitations économiques. Dans notre société capitaliste actuelle où la recherche de profit est constante, le respect des œuvres est primordial pour promouvoir l’essor de la culture. D’ailleurs, Brett Gaylor le démontre dans le documentaire: “RiP : remix manifesto”, l’empire de Walt Disney repose principalement sur la reproduction d’œuvres littéraires empruntées au passé (Gaylor, 2008).

De plus, on constate que la révolution du domaine numérique engendre des conséquences importantes sur le droit d’auteur. C’est pourquoi nous devons défendre le respect des œuvres culturelles. Effectivement, le droit d’auteur vise à favoriser la création et non à la restreindre. Puisque la majorité des individus font des usages pirates, c’est-à-dire qu’il navigue sur Netflix, par exemple, sans avoir payé d’abonnement car nous n’avons pas forcément les moyens de financer ces industries culturelles. Ainsi, la défense de la propriété intellectuelle des créateurs et des créatrices doit être considérée comme un enjeu prioritaire dans le domaine culturel.

SÉANCE #09 | Girl Talk

À l’ère du numérique, la propriété intellectuelle est fragile et très encline aux débats. Cette dernière se divise en deux catégories : soit la propriété littéraire et artistique ainsi que la propriété intellectuelle. Le documentaire RiP : remix manifesto, de Brett Gaylor sorti en 2008 impose une bonne réflexion éthique et morale sur la propriété intellectuelle. Dans son documentaire, il est fait état du droit d’auteur et de la propriété littéraire et artistique.

En effet, le réalisateur prend comme exemple « le roi des collages musicaux de Pittsburgh, Girl Talk. » Ce passionné de remix crée des pièces musicales originales à partir de chansons connues. Il qualifie son art de « mashup musicaux ». Bien évidemment, il ne demande pas la permission à chaque artiste s’il peut utiliser leurs chansons. Le résultat de son art : des plaintes et des poursuites.

Plusieurs questions sont soulevées dans le documentaire. Par exemple : pourquoi est-ce illégal ? L’œuvre ne représente en rien ce que l’artiste original a produit, c’est une autre œuvre en soi. Le rendu est totalement unique et les pièces d’origine utilisées ne sont presque pas reconnaissables. Alors pourquoi les poursuites ?

C’est à ce moment que les points de vue divergent et que la notion de propriété intellectuelle, surtout celle sur le droit d’auteur devient flou. 

Selon le gouvernement du Canada, le droit d’auteur contient : « le droit exclusif de produire ou de reproduire la totalité ou une partie importante d’une œuvre sous une forme quelconque. Ce droit comporte le droit d’exécuter une œuvre ou toute partie importante de cette œuvre ou, dans le cas d’une conférence, le droit de la donner. » Girl Talk enfreint la notion en reprenant des partielles de la pièce de musique. De plus, il ne vend pas sa musique, on peut facilement la télécharger gratuitement sur son site internet.

« La plupart des noms connus se sont prononcés contre le téléchargement gratuit » puisqu’ils ne peuvent bénéficier de leur part de profit. Ce qui amène une frustration et une violation des droits d’auteurs.

En bref, les artistes ne cessent de remettre en question les notions de propriété intellectuelle. Il faut que ces notions soient revues et adaptées en fonction d’internet et de sa progression fulgurante dans nos vies. L’industrie et les gouvernements devraient revoir les barrières perméables et les cas d’exceptions de la propriété littéraire et artistique. Espérons que d’ici quelques années de nouvelles lois seront là pour restreindre et contrôler ce domaine.

RiP! A Remix Manifesto

Welcome to mashdemon, your window to the world of mashups, remixes, sampling, photoshopping and anything in-between. If you’d like to know more about mashup culture, a good starting place is the excellent documentary RiP: A Remix Manifesto by documentary maker Brett Gaylor. 

I met Brett Gaylor at a ROFLCon convention in Boston in 2010... I think. I say “I think” because that whole period is a bit of a blur for me as I zipped around the US doing seminars and conventions to promote my webcomic Garfield minus Garfield, which had gone viral-nuclear at the time. So I’m not 100% sure which convention I met Brett at. Put simply, I was caught up in the adrenaline rush of my 15 minutes of fame. 

Brett’s documentary was screened at the convention and when I saw it, it sparked something in my head. I was inspired by the phenomenon it was exploring, it was exciting, it felt like a new kind of rock n’ roll. At the time I was experiencing the wild things that can happen when you poke a stick at that scary beast called copyright, and I was exposed to a lot of imaginative people who were playing around with the concept of fair use to create new art/music/cool stuff. What is fair use? Fair use is defined as “any copying of copyrighted material done for a limited and “transformative” purpose.”

It was at that time that I first thought about creating a website to catalogue mashup culture and everything that orbits it, and it’s taken me 10 years to get there. But here it is, let’s see what we can find, and maybe tell some stories along the way.  - Dan Walsh 22/10/2020

La culture libre permet-elle aux artistes de gagner leurs vies? Il semblerait que oui.

Tout d’abord, il faut comprendre que la « Free Culture is inspired by non-profit Creative Commons institution and the Electronic Frontier Foundation […] inspired by the free-software movement promoting an alternative copyright replacing the ‘all rights reserved’ with ‘some rights reserved’. » (Coyer, Dowmunt et Fountain, 2007 : 201)

Il est donc faux de prétendre que les partisans de la culture libre font la promotion d’une anarchie sans règle concernant les droits d’auteur. En effet, un des pères du mouvement affirme « A free culture is not a culture without property; it is not a culture in which artists don’t get paid. » (Lessig, 2004 : XVI)

Il s’agit simplement d’un changement de paradigme qui crée une rupture importante quant à la distribution des produits culturels et les règles entourant la propriété intellectuelle. Ce changement ne profite malheureusement pas à tout le monde. En faisant référence au documentaire RiP : remix manifesto,  Ramon Lobato explique que « RiP is structured around the following Lessig-inspired free culture manifesto: 1. Culture always builds on the past. 2. The past always tries to control the future. 3. Our future is becoming less free. 4. To build free societies, you must limit the control of the past. » (Lobato, dans Media International Australia, 2011 : 117)

Il est donc normal que les institutions qui ont profité, et profitent toujours, le plus de cet ancien modèle se battent afin de le préserver.

Mais qu’en est-il des artistes de ce « nouveau monde »? Il semble que ceux qui comprennent bien comment utiliser ce nouveau modèle s’en sortent plutôt bien. Prenons l’exemple d’Ogden, un rappeur québécois, qui affirmait lors d’une conférence que « ça va bientôt faire trois ans que je vis de ma musique, et ça c’est spécifiquement grâce au fait qu’elle est disponible gratuitement en ligne. » (Ogden Ridjanovic, TEDxQuebec 2013), puis continue en disant, « selon moi, l’industrie du disque demeure un vestige d’un modèle économique du 20e siècle mais qui n’est plus logique aujourd’hui. »
