Jarnail Singh v. Lachhmi Narayan Gupta, 2018 SCC OnLine SC 1641
📢 Hey Tumblr fam! Let's dive into an important case in India 🇮🇳 that has a significant impact on public employment and equality of opportunity. The case is Jarnail Singh v. Lachhmi Narayan Gupta, 2018 SCC OnLine SC 1641, and it's all about the correctness of the decision in M. Nagaraj v. Union of India.
🤔 The main argument: Is the requirement of collecting quantifiable data on backwardness for Scheduled Castes (SCs) and Scheduled Tribes (STs) really necessary, considering they're already presumed to be the most backward among backward classes? And should the creamy layer concept be applied to them?
⚖️ The Supreme Court of India provided some insights:
1️⃣ Social and educational backwardness can't be applied to SCs and STs, as they are undoubtedly backward class citizens.
2️⃣ Quantifiable data on backwardness for SCs and STs is not required since this contradicts the Indra Sawhney v. Union of India case.
3️⃣ Applying the creamy layer principle to SCs and STs doesn't interfere with the Presidential List under Articles 341 and 342 of the Indian Constitution.
🔍 In short, the Court held that the Nagaraj case doesn't need to be referred to a larger bench. However, the part of the judgment requiring states to collect quantifiable data on the backwardness of SCs and STs is invalid.
👩⚖️ This case is super important as it highlights the ongoing debate about reservation policies, public employment, and equality of opportunity in India. Let's keep our eyes on future developments in this area! ✊💼🏛️

“I think it is high time we change the way we do things. What always happens when someone get a job with the government, he/she relaxes because they have already secured a job space. Public employees know that they will be in the civil servant until their retirement age at 55 years, so they don’t care whether they perform well or not. With the introduction of performance contracts, people will now start to be dedicated to their job, since they will be required to renew their contract after three to four years depending on how their have performed in that particular department. This is also going to open an opportunity for our young graduates who always have skills but they don’t have a place to exercise them.” #PerformanceContract #PublicEmployment #HumansOfKibera
