New Delhi:
The Delhi High Court on Monday extended the interim bail of 2,961 undertrial prisoners by 45 days to de-congest jails during the coronavirus pandemic.
A bench of Justices Siddharth Mridul and Talwant Singh passed the order in view of a high-power committee’s recommendation that it would be dangerous to send the prisoners back to jail as the risk still remains high.
The court said the interim bail of these undertrials is extended by 45 days from the date of expiry of the relief on the same terms and conditions and listed the matter for further hearing on August 4.
The committee, headed by Justice Hima Kohli, in its June 20 meeting said since there was no certainty when the threat of pandemic shall be over and requirement of social distancing no longer necessary, the interim bail of under-trial prisoners (UTPs) needs to be extended for a further period of 45 days from the date their respective interim bail is expiring.
During the hearing, Delhi government standing counsel Rahul Mehra and advocate Chaitanya Gosain, appearing for the prison authorities, said they have no objection to the extension of bail.
“Accordingly, it is ordered that the interim bails for a period of 45 days granted to 2,961 UTPs, in view of the recommendations of HPC…are hereby extended by another period of 45 days from the date of their respective expiry of interim bails on the same terms and conditions,” the bench said.
It also directed the Director General (Prisons) to ensure that the order was conveyed to all 2,961 under-trial prisoners (UTPs) by telephone and other available modes.
During the hearing, Delhi State Legal Services Authority (DSLSA) member secretary Kanwal Jeet Arora submitted that the situation was the same and it was not possible to take the undertrials back in jail at this time and urged the court to further extend the relief period.
Director General (Prisons) Sandeep Goel said before the process of de-congesting jails began, there were 18,000 inmates in jail against the holding capacity of 10,000.
After decongestion, though the jails population is still more than the holding capacity but it has reduced to 13,677 which is a great relief.
The committee, which was formed on the order of the Supreme Court to lay down guidelines to decongest jails and prevent spread of the coronavirus, was also of the view that moving a separate application on behalf of each of the 2,961 UTPs would be “cumbersome” and lead to wastage of judicial time.
Therefore, it had recommended that the high court be requested to pass a judicial order to extend the interim bail of the prisoners by 45 days.
The matter was placed before Chief Justice D N Patel, who on May 7 issued verbal directions to set up the bench on Saturday, May 9.

New Delhi: Jail inmates who are above 60 years of age will be granted emergency parole in view of the coronavirus pandemic, according to Delhi Prisons department.

A circular issued earlier this week stated that the convicts in this age group are more susceptible to COVID-19 and the emergency parole will be given to decongest the jails, officials said on Saturday.
If an inmate has been convicted for less than five years and has already completed three months in jail, he or she is eligible for the emergency parole, the circular stated.
For jail term of more than five and up to 10 years, only those convicts will be released who have completed a stay of six months and their appeal is not pending in the court.
For prisoners having more than 10 years sentence and life convicts, except those having specific direction not to be released before a specific period or not to consider them for remission, they should have completed six months or more as convict and overall period of custody undergone should be one year, it said.
The parole will be for eight weeks.
For the emergency parole, the convicts behaviour in the jail will also be considered. The convicts whose appeal against conviction is pending in High Court or Supreme Court will not be eligible for it, said Sandeep Goel, Director General (Prisons).

An inmate of Delhi’s Rohini Jail tested positive for Corona Virus on Thursday. The inmate was admitted to Lok Nayak Hospital. The inmate underwent intestine surgery on May 10 and was tested for the virus .

New Delhi:
Days after a 62-year-old inmate of Mandoli Jail died due to COVID-19, 17 others who shared barrack with him tested positive for the disease on Monday, prison officials said.
The first inmate, Kanwar Singh, lodged in Central Jail number 14, Mandoli, died in his sleep on June 15. His test report for COVID-19 came back positive on Saturday, following which 29 inmates who shared barrack with him were also tested, according to officials.
Mr Singh’s is the first case of a Delhi prison inmate dying due to the contagious respiratory disease, reported news agency PTI.
Director General (Prisons) Sandeep Goel said of the 29 inmates who were tested, reports of 17 came back positive on Monday. The remaining 12 inmates have tested negative for the disease.
All the 17 inmates who tested positive have been shifted to a separate barrack in Central Jail number 14 and their health is being closely monitored by the jail doctor. As of now, they are alright, he said.
The 12 inmates who tested negative have also been separately quarantined, he added.
In the wake of an increase in COVID-19 cases in prisons, the officials said, the jail staff and inmates have been briefed to remain extra careful, take all necessary precautions and follow social distancing norms.
Till now, 40 inmates of Delhi Prison have been tested positive for COVID-19, out of which 16 have recovered and one died. As many as 46 prison staff members have also tested positive for the disease. Of these, 12 have recovered so far, according to the officials.
Delhi Prison comprises Tihar, Mandoli and Rohini jails.
Singh was in jail since July 6, 2018. He was lodged in the senior citizens” barrack of Central Jail number 14. He was asymptomatic and the cause of his death was ascertained after a COVID-19 test was conducted on his body, the officials said.
He was serving life imprisonment in a 2016 murder case, they said.
