AG declines consent to initiate contempt against Prashant Bhushan, says he expressed regret for tweets on CJI
NEW DELHI: Attorney General KK Venugopal has declined consent for initiation of criminal contempt proceedings against Prashant Bhushan for his tweets in which he was critical of Chief Justice of India (CJI) S A Bobde being provided a special helicopter by the Madhya Pradesh government, saying the activist-lawyer later expressed regret. On October 21, Bhushan had said the CJI availed the special helicopter during his visit to Kanha national park while “an important case of disqualification of defecting MLAs of MP (Madhya Pradesh) is pending before him. Survival of MP govt depends on this case”. However, Bhushan on November 4 had regretted the error in his earlier tweet and tweeted: “Elections were held yesterday to seats of defecting Cong MLAs in MP who were made ministers in the Shivraj Govt. Survival of Shivraj govt will depend on their re-election, not on decision of case in CJIs court challenging their ministership. I regret this error in my tweet below.” The consent of the topmost law officer was sought by one advocate Sunil Singh to initiate contempt proceedings against Bhushan for his October 21 tweet saying that the activist-lawyer connected “the personal life of CJI with a pending case before him. Though Venugopal termed Bhushan’s earlier tweet about the CJI as wholly unwarranted, improper, devoid of legal basis and prima facie contumacious, he declined the consent considering the regret expressed in his later tweet. “I am of the opinion that the imputations contained in three tweets to the effect that the Chief Justice of India committed an act of impropriety in accepting facilities of the state of Madhya Pradesh during his visit to Kanha National Park while a case pertaining to the disqualification of certain members of the legislative assembly of MP was pending before him were wholly unwarranted, improper , devoid of legal basis and prima facie contumacious for following reasons, Venugopal said in his response to the lawyer. He said firstly the CJI is one of the highest constitutional functionaries in the country and is entitled to receive protocol as befits the stature of his office and the state guests are entitled to be extended appropriate security. The top law officer said he was initially of the mind to grant the consent to initiate proceedings for criminal contempt. However, I must bring to your attention subsequent developments … he has expressed regret for the error made in his earlier tweet on October 21. He has stated publicly that it was incorrect to state that the fate of the government of Madhya Pradesh depended on the case pending before the CJI. In these circumstances, I do not think that it would be in public interest to give consent for proceedings on the basis of the original tweet in view of the subsequent tweet expressing regret. I accordingly decline consent, Venugopal said. The Attorney General said the region CJI visited has been a Maoist affected region and that is why he was given the helicopter facility. It is significant to note that on November 4, a bench headed by the CJI disposed of a plea that had raised the issue of pendency of disqualification proceedings against some Congress MLAs who had joined the BJP and were appointed as ministers in the Shivraj Singh Chouhan government in Madhya Pradesh. If the Supreme Court is convinced that what Prashant Bhushan has said is false, then it is surely up to the court that it is so. If, however, what Bhushan has said is true, then the damage done to the institution by the actions of the last four CJIs is more than the two tweets that could ever happen.
Can two tweets shake the foundations of law and governance of Indian democracy?
If Supreme Court decides Re: Prashant Bhushan Considered, they can.
Containing less than 600 characters, but offering comment on the position of the Supreme Court and the conduct of the current Chief Justice of India, Bhushan's two tweets were clearly critical of a 108-page response from the apex court. It is an exaggeration and a self-defeating exercise. Social media has given every citizen, intelligent or otherwise, the power to bring their views into the public domain on matters, all and diverse subjects.
Various views about the judiciary are observed on a daily basis and excluded for all to see. Some are just and some are bizarre. Even if one accepts that Bhushan is one of the most prominent advocates in the country and is more credible than the average tweeter, such criticism is contempted with contempt of court The court has to take ill to answer. There are two specific allegations that Bhushan leveled against the Supreme Court and its judges in a tweet: first, that the last four CJIs, along with the Narendra Modi government, have damaged democracy in India since 2014 and second, the Supreme Court remains closed ( When he tweeted) Citizens have no access to their fundamental right to justice.
That the Supreme Court chose these two tweets and printed them to reply, as Hindi says, "Head of thief"However, the court does not really give Bhushan an opportunity to prove his claims, but to set them aside with his own counter-claim. If, however, what Bhushan has said is true, then the damage done to the institution by the actions of the last four CJIs is more than the two tweets that could ever happen. The discerning reader is likely to conclude that in order to find no way to effectively dismiss Bhushan's allegations, the court uses its brutal power to do justice and convicts him for contempt. This hasty and pre-judicial conviction of Bhushan raises more questions than attempts to answer.
If the court was doing such a good job (it seems to be doing it), was there really a need to take up the case when so many people are pending during the epidemic? Does it consider the public so childish and immature that it is unable to weigh the evidence of the actual functioning of the court against two tweets questioning such functioning? To go back to the question asked at the beginning of this piece - can two tweets shake the foundations of the rule of law?
Yes, they can.
When the rule of law has been rendered a drawback as the court runs away from the hearing and adjudicates matters of public importance concerning the rights of millions as it moves from adjournment to adjournment. When the rule of law has been allowed to be completely abolished by judges who are less interested in maintaining it than in acquiring futures after their tenure. When the rule of law is ignored by judges to protect one of the allegations of sexual harassment or corruption.
If these two tweets threaten to bring down the "central pillar of Indian democracy", it is only because this column is rotten, broken and collapsing.

NEW DELHI: The Supreme Court on Wednesday issued a notice to senior lawyer Prashant Bhushan asking him to file a detailed response on a suo moto criminal contempt matter against him over his alleged tweets. A three-judge bench headed by Justice Arun Mishra also asked Twitter India to file its response in the case and fixed the matter for further hearing on August 5. The apex court also asked the Attorney General to assist the court in the case. Senior lawyer Sajjan Poovayya, appearing for Twitter India, submitted that Twitter Inc is the correct party and added that it has been incorrectly impleaded in the case. “We can disable the tweet after a court order,” Poovayya said. Supreme Court had taken suo motu cognisance against lawyer Prashant Bhushan for his alleged tweets. Bhushan had on June 27 accused the Supreme Court of playing a part in the “destruction of India’s democracy” in the last six years. “When historians in the future look back at the last 6 years to see how democracy has been destroyed in India even without a formal Emergency, they will particularly mark the role of the Supreme Court in this destruction, and more particularly the role of the last four CJIs,” he had tweeted.
