Top 10 Trademark Law Firms in India
This article has been written by Ishaan Banerjee, from Vivekananda Institute of Professional Studies, Delhi, affiliated to Guru Gobind Singh Indraprastha University. This article explores trademark law as a sought after option for lawyers and what are the top law firms practising trademark law in India. This list will be useful to know what exposure one can get and the level of skills one needs in the trademark law industry.
Introduction
Trademark law has emerged as a lucrative opportunity for practising law and it is still expanding. With the globalization and expansion of trade and business, India signed the TRIPS Agreement (The Agreement on Trade-Related Aspects for Intellectual Property Rights) for protection of trademarks and this has brought a large amount of business and litigation in trademarks being conducted in India. The government, in 2017, made some trademark rule changes which brought much-needed improvements like expedited prosecution and electronic service of documents. In this growing legal market, firms are succeeding and their specialisation in trademark matters is improving day by day.
If you want to be a successful trademark lawyer, this compiled list of the top 10 trademark law firms in India, while not definitive, would certainly give you an idea of what law firms are the top in the business and identify their key practice areas, along with gauging the level of skills needed to work in these firms.

Importance of Trademarks and Patent Protection to your Business
Trademark registration is important for a business as it holds the potential to become the most valuable asset if promoted properly. It can be any sign – a word, logo, label, shape, color or sound that helps in distinguishing the goods or services of one business from another. A trademark is a unique identity for your brand, so it can put your business at risk in case you don’t register it. However, you can file an application for registering your trademark only if an identical or a similar trademark does not already exist. There are many legal firms in India that can help you in filing of an application for trademark registration in Mumbai, Bangalore, Delhi and other cities.
What cannot be a trademark?
If the sign meets any of the following conditions, it cannot be used as a trademark:
It does not have distinguishing characteristics.
It is misleading to consumers i.e. it shows a product or service which is different from the one being sold.
It is descriptive of the characteristics of the product or service.
It is a flag, state emblem, official sign, hallmark, abbreviation, and name of a government organization.
It has already been registered by some other business.
What can be a trademark?
The following signs may constitute a trademark:
Any name
An invented/ coined word
Letters or numerals
Devices
Monograms
Combination of colors
Shape of goods
Slogans
Sound marks
Patent Registration
A patent is a right granted by the government to investors that allow them to prohibit others from making, using and selling the claimed invention without their consent. This right is, however, granted for a limited period only. A patent granted in any particular country provides legal authority in that country only; it does not extend to other countries. For a patent registration in Bangalore or any other part of India, the inventor needs to publicly disclose all the details of the invention and how it can be performed.
For an invention to be granted the patent rights, it must be new and industrially applicable. There are three broad categories of patents and all inventions fall into one of these categories:
Utility Patents: An invention is qualified for a utility patent if it is new and useful. This is the most common type of patent that is granted for a new invention or an improvement in an existing process, machine, manufacture, and composition of matter.
Design Patents: A design patent can be obtained for protecting the appearance or design of an object. It does not protect the functional or structural features of an object.
Plant Patents: This patent is granted for protection of new and asexually reproducible plants.
In order to obtain a patent protection, you need to file an application which is usually handled by a government agency. It can be difficult for you to understand the laws governing patent prosecution, so it is recommended to contact a patent attorney for filing the application.
