With just over 18 months having passed since Nikki's abduction, bits and pieces of the translated appeal court judgement are trickling in:….the court finds that the child (Nikki) was wrongfully retained in Bulgaria within the meaning of article 3 of the Convention. As seen from the evidence on file with regard to the law applicable in the Republic of South Africa governing the exercising of the rights of custody with regard to minor children, the law has granted the exercising of the rights of custody with regard to the child (Nikki). as at the date of his removal to Bulgaria – 09.07.2017, and as the time of his retention in Bulgaria, without father’s consent, to both parents jointly….. It should be noted that the father (Paul) actually exercised the rights of custody granted thereto by the law with regard to the child (Nikki)., demonstrated parental care and willingness to contact the child. Notwithstanding the above, the court of appeal finds that in this particular case there are grounds to refuse the return of the child within the meaning of article 13, paragraph 1, letter “b” of the Convention. This article sets out that the competent authority of the requested state is not bound to order the return of the child if the body which opposes the return establishes that there is a grave risk that the return of the child would expose him to physical or psychological harm or otherwise place the child in an intolerable situation.

When judging the existence of the above negative prerequisite for the return of the child in his country of habitual residence before the wrongful retention, the court is being led by the child’s interest. The child’s interest, as a principle of paramount importance for solving the matters with regard to the rights of custody, is set out in the preamble of the Hague Convention and is a primary matter of the regulations governing the relations between parents and children in the family laws of the Republic of Bulgaria.

For the sake of completeness, it should be noted there is a grave risk that the return of the child (N). would expose him to physical or psychological harm. It was established that the father does not have a family environment suited to the child’s upbringing, and furthermore in respect of him there are actions threatening child’s health. The fact that there is no criminal conviction against the father does not mean a lack of possibility to treat the child roughly. The child himself does not want to contact him and runs away holding his mother’s hand. The court believes this is an act of seeking support and security in his mother and the court established that he feels strong attachment to her.

Upon consideration of the interest of the child (N.), the court finds that the return of the child in the Republic of South Africa would place him in an intolerable situation within the meaning of article 13, paragraph 1, letter “b” of the Convention. This is a case of a child at young age – four years, who is strongly attached to his mother taking immediate care of his upbringing, as well as to the mother’s extended family in Bulgaria, and therefore his detachment from the mother and the environment in Bulgaria would have extremely adverse effect on the child. Child’s possible return to the Republic of South Africa and the respective detachment from the mother and the established peaceful environment in which the child grows in Bulgaria, would be a shock for the child and poses a risk of adverse effect on his mental, emotional and social development. The court took into account the conclusions to this effect made by the social services at child’s domicile. It should be noted that the child has spent very short time in South Africa with his father. The mother who has brought him up has lived in a city other than the father’s city, and logically the child has built stronger connection to his mother. Currently, despite his removal to Bulgaria, the child grows in an environment that is extremely peaceful and suitable for his development, he develops properly, and therefore the radical change upon his removal to the South  Africa would be a shock with adverse consequences for him. It should be further noted that in case of possible return of the child to the country of his previous residence, he would be detached from the mother in a period where the connection between them is of greatest importance for his peace, security and proper development.

Upon realisation of the prerequisite under article 13, paragraph 1, letter “b” of the Convention, the court should refuse the return of the child (N). to the country of his habitual residence – Republic of South Africa, and the claim of the father P. M. for return of the child is subject to repeal.

Due to the discrepancy between the conclusions of this court of appeal and those of the first instance court, the appealed decision should be repealed, and another one should be enacted instead to repeal the petitioner’s claim.

With view of the provisions of article 22г, paragraph 2 of the Child Protection Act, this decision is final and is not subject to appeal.

Based on the above background, the court

DECIDED AS FOLLOWS:

REPEALS decision № 5016 of 24.07.2018 enacted under civil case № 1068/2018 as per the inventory of Sofia City Court, 4th Matrimonial Division, and ENACTS:

REPEALS the claim of P. M. [date of birth], citizen of the Republic of South Africa filed through the Ministry of Justice of the Republic of Bulgaria on the grounds of article 12, paragraph 1 of the H. Convention on the Civil Aspects of International Child Abduction of 1980, for return of the minor child (N). PIN [PIN] to the country of his habitual residence – Republic of South Africa.

This decision is final and is not subject to appeal.

The photo looks very similar to the ones I posted from my previous three trips to visit Nikki in Sofia, Bulgaria.....that's because the outcome was essentially the same.... Today I went to visit Nikki at the Social Services Directorate (SSD)….On arrival I was informed that a sick note and script had been emailed to them yesterday, implying that Nikki was sick……and he would not be attending. My reception is once again hostile but the formalities are completed and I leave without seeing Nikki…. Here’s a summary of the last 4 visits: I had sent a “visitation schedule” to my lawyers for forwarding to Nikki’ Mom. Receipt by her was never acknowledge and didn’t really matter because the outcomes were as below : 1. A sick note is received 5 minutes before my arrival stating that Nikki would not attend due to a respiratory infection. I send an email to Nikki’s Mom requesting information about his state of health, no response is received. 2. Nikki arrives and looks through the door, sees me and returns to his Mom outside. They are seen by SSD officials walking down the road, never to return. 3. Nikki and his Mom come around the corner (outside the SSD), Nikki sees me and stops point at me…..His mother leans towards him and mouths something, After looking uncertain what to do Nikki returns around the corner and is followed by his mother. After a while the SSD officials go to look for them...they cannot be found. 4. On arrival today (2 days after the final appeal hearing), I was informed that a sick note and script had been emailed to the SSD yesterday, implying that Nikki is sick with a respiratory infection……he will not be attending the visit today. Well Mr Lion, I've lost count now of the number of times you've hosted me.....The appeal hearing for my HAGUE CONVENTION ON THE CIVIL ASPECTS OF INTERNATIONAL CHILD ABDUCTION in Sofia, Bulgaria took place this morning. I am pleased to say, my conviction that: honesty, integrity and justice will prevail and that Nikki will be home soon, has been strengthened today.... A decision is not made on the day of the hearing and we still have to wait for that, but the state prosecutor recommended to the 3 judges that the first instance ruling (the Bulgarian Family Court’s final ruling and order is made, it states among other things: “…parental abduction has taken place…��� and “The court ORDERS THE RETURN OF THE CHILD,…..to the country of habitual residence – the Republic of South Africa,...”) be upheld . Fri 2019/10/18 2:59 PM – Receive notification from the Bulgarian Ministry of Justice that Nikki’s mother does not oppose mediation (she actually has no choice as a court would frown on her declining, now she just needs to ensure she controls the process).

Fri 2019/10/25 3:23 PM – Receive a list of 84 mediators to choose from, a random sample reveals that they are all Bulgarian.

Sat 2019/11/02 7:53 AM – I respond notifying the Bulgarian Ministry of Justice that I am no happy that the proposed process is “is devoid of neutrality and disadvantageous to Nicholas and I.”. I proposed using a neutral mediator based in the UK:We offer a specialist mediation service in cases of cross border family disputes involving children and mediate in cases of:

·       international parental child abduction/wrongful retention - involving both Member States of the 1980 Hague Convention and Non-Hague Convention

States;

·      prevention of abduction - where a family is separating and there are links with another country;

·      contact across international borders;

·      relocation - where one parent wishes to reside with their child in a different country.

Given Nikki’s mother’s crusade for total control, what do you think the chances are of her agreeing to this mediator (rhetorical question)?

Saturday, 9 November 2019 marks 28 months since Nikki’s abduction.

I look through my records and find a formal application (in Bulgarian) for contact with Nikki signed by me on 22 April 2019, in between the appeal judgement and lodging the application I lost 3 months scrambling around trying to find out how to kick-start this process. Today it is 9 November 2019 and this is where we are at…..

Mon 2019/08/26 12:26 PM: The Bulgarian Ministry of Justice advised me that they were planning to inform the competent social service in Bulgaria about exploring the possibility of negotiating with the Nikki’s mother about contact for me with Nikki.

Mon 2019/10/21 12:41 PM: I was advised by the Bulgarian Ministry of Justice that the Family Mediation Center in Sofia, Bulgaria can organize mediation sessions and the costs are for the parents.

Fri 2019/10/25 3:23 PM: I receive from the Bulgarian Ministry of Justice a list of 84 mediators in the Agreements Programme of Sofia Regional and Sofia City Court from whom I can choose as mediator.
