CASE DIGEST: ISABEL RUBIO ALCASID, assisted by her husband DOMINGO A. ALCASID v. CA and RUFINA L. LIM. - G.R. No. 104751 October 7, 1994

CIVIL CODE:

ARTICLE 1337 : There is undue influence when a person takes improper advantage of his power over the will of another, depriving the latter of a reasonable freedom of choice. The following circumstances shall be considered: the confidential, family, spiritual and other relations between the parties, or the fact that the person alleged to have been unduly influenced was suffering from mental weakness, or was ignorant or in financial distress

FACTS:

Petitioner is one of the co-owners of two parcels of land located in Calamba, Laguna. Private respondent offered to purchase from petitioner and her co-owners the abovementioned property. Petitioner was willing to sell her share for P4,500,000.00 and only if all her co-owners would sell their respective shares of the said land.

Petitioner engaged the services of Atty. Antonio A. Fernandez for the purpose of negotiating the sale, without knowing that he was also representing private respondent.

In March 1990, Atty. Fernandez confirmed to petitioner that all her co-owners were already amenable to sell their shares for P1,500,000.00.

On March 4, 1990, petitioner signed a Deed of Sale drafted by Atty. Fernandez. Subsequently, petitioner learned that the other co-owners did not agree to sell their shares over the subject property.

On November 4, 1990, petitioner filed a complaint in the Regional Trial Court, Branch 34, Calamba, Laguna, for annulment of the contract of sale and damages with a prayer for temporary restraining order or writ of preliminary injunction against private respondent. Private respondent filed a motion to dismiss on the grounds that the complaint stated no cause of action. The trial court denied the motion to dismiss.

On August 20, 1991, a motion to declare private respondent in default was filed by petitioner. This was granted by the trial court.

Private respondent appealed the said orders of the trial court to the Court of Appeals, which reversed the decision of the trial court and held that the complaint stated no cause of action. Hence this Petition

ISSUES:

Whether or not the contract is based upon fraud, mistake and undue influence which vitiated her consent.

RULING:

No. Undue influence, is any means employed upon a party which, under the circumstances, he could not well resist and which controlled his volition and induced him to give his consent to the contract, which otherwise he would not have entered into. It must in some measure destroy the free agency of a party and interfere with the exercise of that independent discretion which is necessary for determining the advantages or disadvantages of a proposed contract (Tolentino, supra at p. 501). If a competent person has once assented to a contract freely and fairly, he is bound thereby.

The finding of the Court of Appeals that petitioner executed the contract of her own free will and choice and not from duress is fully supported by the evidence. Such finding should not be disturbed (Martinez v. Hongkong & Shanghai Bank, 15 Phil. 252 [1910]).

Private respondent did not commit any wrongful act or omission which violated the primary right of petitioner. Hence, petitioner did not have a cause of action (State Investment House, Inc. v. Court of Appeals, 206 SCRA 348 [1992]).

WHEREFORE, the petition is DENIED. The decision of the Court of Appeals appealed from is AFFIRMED.

10 Design envisions Shanghai’s future retail destination at the city’s West Bund

Shanghai West Bund Parcels C&D Vision by 10 Design

10 Design (part of Egis Group) reveals the shortlisted design vision for Shanghai West Bund in China. The proposed scheme for parcels C&D was submitted as part of Hongkong Land’s 32-hectare site with direct subway and a planned cable car connection. 10 Design has been appointed to develop further two parcels (E&F) within the site that include a series of retail components, an office campus, cultural and sports facilities.

Our proposal for the 492,000sqm GFA scheme on parcels C&D utilises a unique human-scale retail configuration whereby 6 access points converge at a central plaza. Led by Design Partners Chin Yong Ng and Lukasz Wawrzenczyk, the design includes a 5-storey shopping mall with the green open plaza that blurs the lines between indoor and outdoor spaces. The scheme also includes 3 high-rise office towers, a luxury serviced apartment, a hotel and high-end retail streets.

The two main mall entrances incorporate simple pixelated massing topped with greenery: the river-facing entrance with constituted concrete blocks and white façade to echo the adjacent museum, and the entrance connected to the subway with glass blocks to create an inviting retail environment. The central plaza is covered with a circular translucent canopy, forming an iconic oculus that brings natural light into the depth of the mall. At night, the plaza turns into a flexible public space for performances, exhibitions and projections with dramatic lighting.

Restaurants, cafes and bars are placed along the higher floor units surrounding the oculus, encouraging people to explore the upper-level retail programmes along with a sky bar street and a kid’s playground, culminating at the floating pod housing the viewing deck, museum of Haipai and the gondola station.

The sculptural gondola station connects the scheme with the upcoming Shanghai Grand Opera House. It gives a futuristic character to the building, provides panoramic views towards the Huangpu River and the modern Bund skyline and creates a lush green roof that serves as the extension of the Bund Park.

Chin Yong Ng, Design Partner, says: “Our project design aspires to create a landmark civic statement embodying the Shanghainese Haipai spirit. Taking inspiration from the local figure Xu Guangqi, the proposal imagines the fusion of culture and space to enrich the visitors’ retail experience.”

Lukasz Wawrzenczyk, Design Partner, says: “Through our retail planning strategy, the project has been reimagined as an urban retail hub that blends the cultivated space and the natural world, acting as a source of vitality for Shanghai’s Xuhui district.”

La dérive absolutiste de Xi Jinping n'épargne pas les différentes Églises, soumises à une répression de plus en plus sévère.

Dernier exemple en date de la paranoïa du Parti communiste chinois (PCC): il devrait bientôt interdire aux croyants de diffuser des photographies ou des vidéos de baptême, de messe, ou de cérémonies bouddhistes sur les réseaux sociaux.

L'étau ne cesse en effet de se resserrer sur les cultes depuis l'arrivée au pouvoir de Xi Jinping, fin 2012. Le dirigeant chinois le plus puissant depuis Mao Tsé-toung se méfie de toutes les organisations susceptibles de contester l'autorité du régime, surtout si elles ont des liens avec l'étranger. La pression ne cesse de s'accentuer sur les Églises chrétiennes non reconnues par le Parti, dont certaines sont dissoutes ou détruites. Et, dans le Xinjiang, des musulmans sont envoyés en masse dans de terribles camps de «rééducation», dénoncent plusieurs rapports.

Le PCC a-t-il toujours réprimé les religions?

Les religions vécurent le martyre sous Mao. En particulier pendant la Révolution culturelle (1966-1976), qui a cherché à les éradiquer. Les lieux de culte furent massivement fermés ou détruits, et de nombreux responsables religieux furent emprisonnés ou envoyés en camps de travail.

À partir des années 1980, après le début des réformes économiques et de l'ouverture du pays, le régime communiste s'est montré plus tolérant. Les croyants des cinq grandes religions - bouddhisme, catholicisme, protestantisme, islam, taoïsme - ont été autorisés à construire de nouveaux lieux de culte, et à pratiquer leur foi. À condition toutefois de faire allégeance à des organisations patriotiques étatiques, supervisées par le PCC. Refusant cette tutelle, de nombreux chrétiens ont cependant préféré continuer à fréquenter les Églises «clandestines» dans lesquelles ils s'étaient réfugiés sous Mao. Les autorités ont plus ou moins laissé faire, et ces églises se sont développées, même s'il y eut des persécutions. Le gouvernement a commencé à vraiment serrer la vis sur les religions après les Jeux Olympiques de 2008, dans le cadre d'une reprise en main plus globale de la société. Ce mouvement s'est nettement accentué depuis l'arrivée au pouvoir de Xi Jinping, fin 2012. «L'empereur rouge» a prévenu: pas de pitié pour tous ceux qui menacent l'autorité du Parti. En octobre dernier, il a insisté sur la nécessité que les religions se «conforment mieux» aux «réalités chinoises» et à la «société socialiste». L'objectif de cette «sinisation» des croyances est simple: elles doivent suivent la ligne du Parti.

Qu'imposent les règles apparues récemment?

Alors que les religions étaient déjà étroitement surveillées, de nouvelles réglementations destinées à encadrer davantage les cultes sont entrées en vigueur en février. Elles sont officiellement destinées à «faire barrage à l'extrémisme», à «contrer les infiltrations» étrangères et à limiter les pratiques non reconnues par l'État. Ces directives interdisent les dons venant de l'étranger et restreignent les conditions d'ouverture des écoles confessionnelles. Depuis leur entrée en application, les mosquées sont par exemple obligées de hisser bien haut le drapeau national pour «développer l'esprit patriotique». Et leur personnel est contraint d'assister à des formations pour étudier la Constitution, dans laquelle figure depuis mars dernier la «pensée» de Xi Jinping, ainsi que les «valeurs centrales du socialisme».

Un projet de loi dévoilé dernièrement prévoit, en outre, d'interdire sur Internet tout échange - photos, vidéos ou textes - témoignant d'une cérémonie religieuse. Censé endiguer le prosélytisme, il propose aussi de bannir «la distribution de produits religieux» ou «l'incitation faite aux mineurs à participer à des activités religieuses». Le texte est ouvert aux commentaires publics, mais le Parti modifie généralement très peu ce genre de projets législatifs.

Le recadrage concerne également les membres du PCC, sommés par Xi Jinping d'être des athées «inflexibles». Selon une nouvelle circulaire destinée à renforcer la discipline, ceux qui ne parviennent pas à se débarrasser de leurs croyances religieuses grâce à «l'éducation» fournie par le PCC, «doivent être incités à quitter le Parti».

Les Chrétiens sont-ils particulièrement ciblés?

Le Parti se méfie surtout des religions qui ont des liens avec l'étranger: le christianisme, l'islam et le bouddhisme tibétain. L'essor rapide des Églises protestantes non officielles dans les villes ces quinze dernières années l'inquiète au plus haut point. Les autorités ont dissous ce mois-ci à Pékin l'une des plus importantes organisations de ce type dans le pays: l'Église de Sion. «Cela signifie que le Parti est déterminé à supprimer ces communautés indépendantes dans toute la Chine», estime Yang Fenggang, professeur à l'université de Purdue, aux États-Unis.

En 2016, plus de 1500 croix surmontant des Églises, essentiellement protestantes, ont été détruites dans la province du Zhejiang. Cette campagne s'est ensuite étendue à d'autres régions, comme le Henan, selon certains observateurs, qui dénoncent parallèlement une censure croissante des livres traitant du christianisme.

«Le nombre de chrétiens chinois pourrait être proche de 100 millions actuellement (soit plus que les effectifs actuels du PCC, 90 millions) et atteindre 224 millions en 2030», évalue Yang Fenggang. Le régime «est très nerveux à l'idée qu'une communauté si nombreuse et bien organisée puisse contester son pouvoir», et promouvoir un discours différent du sien, complète le politologue Willy Lam, basé à Hongkong. Et ce, d'autant plus que les congrégations protestantes «non officielles» attirent par ailleurs de plus en plus de cadres d'entreprises et de jeunes Chinois très diplômés. Ceux précisément sur lesquels mise le PCC pour bâtir une superpuissance moderne.

Cette année, les pressions et les intimidations des autorités se sont multipliées pour dissuader les chrétiens de se rendre dans des églises non reconnues par l'État, selon certains observateurs. Cette répression concerne aussi les catholiques «clandestins», alors même qu'un rapprochement entre Pékin et le Vatican est en discussion. Dans le Henan, des églises sont détruites, la messe est interdite aux enfants et des prêtres ont dû fournir la liste de leurs fidèles aux autorités, selon des témoins cités par l'AFP. La Chine compte 10 à 12 millions de catholiques, à peu près répartis à parts égales, entre une Église étatique, et une autre, qui ne reconnaît que l'autorité du Pape.

Quel sort est réservé aux Musulmans?

La Chine se dit particulièrement préoccupée par la situation de la province du Xinjiang, une région où vivent quelque 14 millions de musulmans et qui a connu des violences ces dernières années. Les autorités chinoises, redoutant d'éventuels liens entre des militants «séparatistes» et des groupes djihadistes internationaux, ont multiplié les initiatives pour contrôler chaque parcelle de la vie des musulmans. Le gouvernement a interdit depuis 2017 le port du voile intégral et les «barbes anormales» et traque dans les téléphones portables le moindre signe de «radicalisation».

Mais les choses sont allées beaucoup plus loin. Des rapports ont dénoncé la naissance d'un vaste réseau de camps de «rééducation» dans cette province. Entre plusieurs centaines de milliers et un million de Ouïgours et de Kazakhs de confession musulmane ont été envoyés dans ces camps depuis 2017, selon le chercheur allemand Adrian Zenz. D'après les témoignages recueillis par les ONG et par la presse, les détenus subissent un terrible lavage de cerveau. Le but est de les obliger à renoncer à leur identité religieuse, en les forçant à chanter les louanges du Parti communiste et à dénigrer leur propre culture. L'ONG américaine Human Rights Watch (HRW) a dénoncé «des violations des droits de l'homme au Xinjiang à une échelle jamais vue dans le pays depuis des décennies». L'ONU, qui est montée au créneau, a appelé Pékin à autoriser l'envoi d'observateurs. La Chine a rétorqué qu'elle ne persécutait pas les musulmans, mais mettait en place des «centres éducatifs»…

Certaines religions sont-elles davantage épargnées?

Même si tous les cultes sont surveillés, le bouddhisme chinois (première religion avec entre 185 et 250 millions de membres) ou le taoïsme, bénéficient d'un traitement de faveur. Ces religions traditionnelles sont en effet jugées compatibles avec le «grand renouveau» de la nation prôné par Xi Jinping. Le maître de Pékin, qui cherche à renforcer la cohésion sociale, juge que ces systèmes de pensée profondément enracinés dans la culture chinoise peuvent être utiles pour répondre à un besoin de sens que ne parvient pas à combler la course à l'argent ou le Parti. Ce faisant, il renforce son pouvoir, car les leaders bouddhistes acceptent plus que ceux d'autres religions de se soumettre à l'emprise du PCC et à ses règles, décryptent des experts.

Le Parti entend néanmoins lutter contre la «marchandisation» du bouddhisme. «Il a compris que trop de temples étaient devenus des affaires commerciales, ce qui les rend peu attrayants aux yeux de la classe moyenne des grandes villes chinoise, de plus en plus sophistiquée», explique Ian Johnson, auteur d'un ouvrage (The Souls of China, éd. Pantheon), sur le retour des religions en Chine après Mao. Le régime veut à tout prix éviter que cette population continue à rejoindre les rangs du christianisme, considéré comme moins corrompu.
