hot chocolate can't be hot chocolate milk bc some ppl make it w/ water
most hot chocolate mixes and packets contain dried milk as an ingredient so personally i think that your argument is a bit on the weak side as mixes still have milk in them regardless of whether or not someone makes them with water. (so people adhering to vegan diets and with dairy allergies have to be careful!)
that being said you totally can mix cocoa powder with straight up hot water and call it hot chocolate but i cannot imagine it would taste very good without any sugar.
perhaps i should rephrase my question:
if you microwave chocolate milk do you get hot chocolate as a result?

I think hot chocolate vs hot chocolate milk depends on the materials, like chocolate milk to me is always chocolate sauce whereas hot chocolate can be a mix of cocoa powder or literal chocolate melted, you can also use water to make hot chocolate (even if I personally find that gross). That said, I realized iced hot chocolate is just chocolate milk
Despite the divide on whether or not hot chocolate is heated chocolate milk it is agreed that it would be kinda gross to just mix cocoa powder or melted chocolate into water (especially when you have a plethora of perfectly creamy and delicious non dairy milk options out there though water is defs much more accessible).
But then, you can't use chocolate syrup to make hot chocolate if you don't have cocoa powder, mix or melted chocolate on hand?

hot chocolate isnt the same as hot chocolate milk bc i would never drink hot chocolate milk but i would drink hot chocolate
so moda what would you do if your hot chocolate got cold? you got distracted or something happened and you forgot? would you dump it out and waste the drink? would you reheat it?

microwaving chocolate milk just gives you warm chocolate milk. also like the contents of chocolate milk vs hot chocolate (esp things like swiss miss) is different -iz
But would you still drink it?
Since we're talking about contents I've brought up ingredient lists:

I think the main takeaway here is the presence of hydrogenated coconut oil in hot chocolate mix (for extending the shelf life?). I looked at Nestlé, Stephen's and Nestle Abuelita hot chocolate mixes and found it there too.
